1. Motion To: Report on proposed Indian PowWow Event Jessica and Connie Smith
Former Supervisor Connie Smith appeared before the board to explain the planned carnival Pow-
Wow event for May 16th and May 17th from 11:00 AM to 5:00 PM at Shlathaus Park with a $75
vendor fee. A document was handed out; but, nothing was filed with the town clerk. The board
moved to authorize the proceedings

2. Clear Gov service as a discussion item Joey C. and Clear Gov Rep.
Historian Joe Cavaccini and Tom Bahr explained 'Clear Gov'; a tool used for providing
information for total transparency to residents and for aiding in board decision making. Rob
Pataglia made the presentation from 'Clear-Gov'. The estimated cost would be $5,500 per year.
No action was taken.
3. Anti-Bullying Program - Jessica
Director Fulton and Daw Nasi explained a planned anti-bullying event at Slaughthaus Park.
They asked for the use of the kitchen. Nothing was filed with the clerks office. She discussed
the calendar of events.
4. Community Day Report - Jessica
Director Fulton spoke of community day. She spoke with the rides provider last year with whom
was well received, but was told they hadn't set their calendar yet and would not sign a contract
until they had their 2020 schedule laid out. She repeatedly reached out to them and kept trying
and received the same response. - wanted 2020 scheduling The board suggested a committee
be put together.
5. Municity Software Discussion - Barbara Roberti
Barbara Roberti explained the need for an update to the antiquated Municity program which has
difficulties under Window 10. Municity is pushing the Cloud based version which are $2,000
more per year. Councilman Casella asked why would we pay a maintenance fee in the first year.
An estimate was given to the board, but nothing was given to the town clerk for filing in these
minutes.
VII. Resolutions
RESOLUTION: 2020-40
Resolution Appointing Deputy Zoning Administrator
WHEREAS, the Zoning Administrator of the Town of Wappinger is responsible for
administering land use activities in the Town of Wappinger including reviewing building
permits, land use applications, floodplain permits and Stormwater management compliance; and
WHEREAS, the Zoning Administrator needs assistance in carrying out these duties on a
day to day basis and also needs a person to act in her absence to insure continuity of the
operation of the Zoning Department; and
WHEREAS, the Town Board of the Town of Wappinger wishes to create the position of
Deputy Zoning Administrator with the job duties set forth in the Class Specification established
by the Dutchess County Department of Human Resources; and
WHEREAS, the Dutchess County Department of Human Resources has given a

competitive examination and created and certified to the Town of Wappinger a current list of
eligibles for the Title of Deputy Building Inspector, and
WHEREAS, the Town has canvassed the certified eligible list for Deputy Zoning
Administrator and has determined that the persons on the list are not available or suitable for
employment with the Town; and
WHEREAS, the Town Board, with the recommendation of Barbara Roberti, Zoning
Administrator, has determined that Judith Subrize meets the qualifications to fill the position of
Deputy Zoning Administrator; and
WHEREAS, the budget transfer is required to fund the salary for the Deputy Zoning
Administrator; and
WHEREAS, the position of Deputy Zoning Administrator is not addressed in the
Collective Bargaining Agreement between the Town of Wappinger and Teamsters Local 445
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. Judith Subrize is hereby provisionally appointed to the full-time civil
service job title Deputy Zoning Administrator Inspector for the Town of Wappinger,
effective February 25, 2020 and shall end within the time period prescribed by Civil
Service Law §65(3) and the rules of DCHR.
2. Judith Subrize shall be compensated at the hourly rate of $23.10, which
shall be paid in weekly installments.
3. The following budget transfer is authorized to fund the salary for the
position:

4. The appointment is subject to the approval of the Dutchess County

Department of Human Resources.

Resolution Urging The State Legislature And Governor Of New York To Amend Or
Repeal The New Bail Reform
BE IT RESOLVED, The Town Board of The Town of Wappinger strongly urge the State of
New York to amend or repeal the newly implemented criminal justice reforms including changes
to bail and d
law enforcement and victims made good faith attempts to aid with their expertise and
perspective. However, Albany took no notice to their advice and concerns which has led us to the
present and dangerous situation which is still unfolding. We urge you to go back to the drawing
board with those previously excluded and correct this situation.

Aggravated assault upon a person less than 11 years old
Stalking (while committing a sex offense)
Arson (as a hate crime)
Grand larceny
Bail jumping
Disseminating indecent material to minors
Promoting an obscene sexual performance by a child
Criminal possession of a weapon on school grounds
In an article outlining the domestic violence-related deficiencies, Leah Feldman of Family
Services
acts of violence and places the burden on the victim to find safety.
Releasing these people will validate their mindset that society should not fear the repercussions
of their crimes. These people are released back into our neighborhoods as if nothing even
happened. Some arrested persons will never be charged due to the insurmountable evidentiary
and paperwork burdens placed on police departments and prosecutors.
According to the Dutchess County District Attorney, our County can expect hundreds of
thousands of dollars in new annual spending solely attributed to the new bail and discovery
requirements. The shortened fifteen-day window has put an enormous strain on the New York
The untold effects of justice avoided, and lack of victim closure, will ripple through our society
for years to come. It is our hope that these misguided reforms do not reverse decades of effective
bi-partisan crime reduction and the scales of justice will structured evenly.

Resolution Appointing a Water Meter Reader for the Town of Wappinger
WHEREAS, the Town of Wappinger employs Water Meter Readers for the purpose of
residential collection of water meter usage data; and
WHEREAS,
of Wappinger in accordance with the compensation enumerated within the Town of Wappinger
Budget for Fiscal Year 2020.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby confirms the
appointment of Joseph Dauzat as Water Meter Reader for the Town of Wappinger; and
BE IT FURTHER RESOLVED, that for calendar year 2020, the remuneration for
Town of Wappinger Water Meter Readers is hereby established at the rate of $1.30 per manual
meter read and $0.65 per radio meter read, until further action of the Town Board; and
BE IT FURTHER RESOLVED, that for the calendar year 2020, the remuneration for
Town of Wappinger Water Meter Readers for Repair and Maintenance of meters is hereby
established at the rate of $13.00 per hour, until further action of the Town Board; and
BE IT FURTHER RESOLVED, that payment to the Water Meter Reader shall be in
accordance with the number of water meters read and repaired and the Town Supervisor is
authorized and empowered to pay the Water Meter Reader upon proof of the number of water
meters read and repaired as confirmed by the Town of Accountant.

In the Matter of The Increase and Improvement of Facilities of the Wildwood Sewer
District in the Town of Wappinger, Dutchess County, New York PUBLIC INTEREST
ORDER
WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York,
has duly caused to be prepared a map, plan and report including an estimate of cost, pursuant to
Section 202-b of the Town Law, relating to the proposed increase and improvement of the
facilities of the Wildwood Sewer District, in the Town of Wappinger, Dutchess County, New
York, consisting of the construction of a pump station, force sewer main and sanitary sewer main
from the existing Sewer Plant to the Village of Wappingers Falls, including incidental
improvements and expenses in connection therewith, at a maximum estimated cost of
$5,566,000; and
WHEREAS, at a meeting of said Town Board duly called and held on January 27, 2020,
an Order was duly adopted by it and entered in the minutes specifying the said Town Board

would meet to consider the increase and improvement of facilities of the Wildwood Sewer
District in said Town at a maximum estimated cost of $5,566,000, and to hear all persons
interested in the subject thereof concerning the same at the Town Hall, in Wappinger, New York,
WHEREAS, said Order duly certified by the Town Clerk was duly published and posted
as required by law; and
WHEREAS, a public hearing was duly held at the time and place set forth in said notice,
at which all persons desiring to be heard were duly heard; NOW, THEREFORE, BE IT
ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New
York, as follows:
Section 1. Upon the evidence given at the aforesaid public hearing, it is hereby found
and determined that it is in the public interest to make the increase and improvement of the
facilities of the Wildwood Sewer District, in the Town of Wappinger, Dutchess County, New
York, consisting of the construction of a pump station, force sewer main and sanitary sewer main
from the existing Sewer Plant to the Village of Wappingers Falls, including incidental
improvements and expenses in connection therewith, at a maximum estimated cost of
$5,566,000.
Section 2. This Order shall take effect immediately.

A Resolution Authorizing The Issuance Of Up To $5,566,000 Bonds Of The Town Of
Wappinger, Dutchess County, New York, To Pay The Cost Of The Increase And
Improvement Of The Facilities Of The Wildwood Sewer District, In The Town Of
Wappinger, Dutchess County, New York
WHEREAS, the capital project hereinafter described has been determined to be an
Environmental Conservation promulgated pursuant to the State Environmental Quality Review
Act, the implementation of which as proposed, it has been determined will not result in any

significant adverse environmental impacts; and
WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with
the provisions of Section 202-b of the Town Law, and more particularly an Order of even date
herewith, said Town Board has determined it to be in the public interest to improve the facilities
of the Wildwood Sewer District, in the Town of Wappinger, Dutchess County, New York, at a
maximum estimated cost of $5,566,000; NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New
York, as follows:
Section 1. For the specific object or purpose of paying the cost of the increase and
improvement of the Wildwood Sewer District, in the Town of Wappinger, Dutchess County,
New York, consisting of the construction of a pump station, force sewer main and sanitary sewer
main from the existing Sewer Plant to the Village of Wappingers Falls, including incidental
improvements and expenses in connection therewith (which include original furnishings,
equipment, machinery, apparatus, appurtenances as proposed therefor), there are hereby
authorized to be issued up to $5,566,000 bonds of said Town pursuant to the provisions of the
Local Finance Law.
Section 2. It is hereby determined that the maximum estimated cost of the aforesaid
specific object or purpose is $5,566,000 and that the plan for the financing thereof is by the
issuance of the $5,566,000 serial bonds of said Town authorized to be issued pursuant to this
bond resolution; PROVIDED, HOWEVER, that to the extent that any grants-in-aid are
received for such specific object or purpose, the amount of bonds to be issued pursuant to this
resolution shall be reduced dollar for dollar Section 3. It is hereby determined that the
period of probable usefulness of the aforesaid specific object or purpose is forty years pursuant
to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further
determined that the maximum maturity of the serial bonds herein authorized will exceed five
years.
Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New
York, are hereby irrevocably pledged for the payment of the principal of and interest on such
bonds as the same respectively become due and payable. An annual appropriation shall be made
in each year sufficient to pay the principal of and interest on such bonds becoming due and
payable in such year. To the extent not paid from monies raised from said Wildwood Sewer
District as applicable in the manner provided by law, there shall annually be levied on all the
taxable real property of said Town, a tax sufficient to pay the principal of and interest on such
bonds as the same become due and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
serial bonds herein authorized, including renewals of such notes, is hereby delegated to the
Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.
Section 6. The powers and duties of advertising such bonds for sale, conducting the
sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such
bonds for sale, conduct the sale, and award the bonds in such manner as she shall deem best for
the interests of said Town, including, but not limited to, the power to sell said bonds to the New
York State Environmental Facilities Corporation; provided, however, that in the exercise of these
delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance
Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds.
The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall
not be obliged to see to the application of the purchase money.

Section 7. All other matters except as provided herein relating to the serial bonds
herein authorized including the date, denominations, maturities and interest payment dates,
within the limitations prescribed herein and the manner of execution of the same, including the
consolidation with other issues, and also the ability to issue serial bonds with substantially level
or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of
such Town. Such bonds shall contain substantially the recital of validity clause provided for in
Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such
recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the
Supervisor shall determine consistent with the provisions of the Local Finance Law.
Section 8. The Supervisor is hereby further authorized, at his sole discretion, to
execute a project finance and/or loan agreement, and any other agreements with the New York
State Department of Environmental Conservation and/or the New York State Environmental
Facilities Corporation, including amendments thereto, and including any instruments (or
amendments thereto) in the effectuation thereof, in order to effect the financing or refinancing of
the specific object or purpose described in Section 1 hereof, or a portion thereof, by a bond,
and/or note issue of said Town in the event of the sale of same to the New York State
Environmental Facilities Corporation.
Section 9. The power to issue and sell notes to the New York State Environmental
Facilities Corporation pursuant to Section 169.00 of the Local Finance Law is hereby delegated
to the Supervisor. Such notes shall be of such terms, form and contents as may be prescribed by
said Supervisor consistent with the provisions of the Local Finance Law.
Section 10. The validity of such bonds and bond anticipation notes may be contested
only if:
1) Such obligations are authorized for an object or purpose for which said Town is
not authorized to expend money, or
2) The provisions of law which should be complied with at the date of publication of
this resolution are not substantially complied with, and an action, suit or
proceeding contesting such validity is commenced within twenty days after the
date of such publication, or
3) Such obligations are authorized in violation of the provisions of the Constitution.
Section 11. This resolution shall constitute a statement of official intent for purposes
of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies
are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set
aside with respect to the permanent funding of the object or purpose described herein.
Section 12. This resolution, which takes effect immediately, shall be published in
summary form in the official newspaper, together with a notice of the Town Clerk in
substantially the form provided in Section 81.00 of the Local Finance Law.

Resolution Authorizing Printing Of Town Of Wappinger Guides
WHEREAS, the Town of Wappinger prepared a guide to the government services which
are available to residents of the Town of Wappinger; and
WHEREAS, the Dutchess County Central Services offers printing services to
municipalities as a shared service; and
WHEREAS, bulk printing of the Town Guides by County Central Services would result
in a savings to the Town of Wappinger;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes the
printing of 3,000 copies of the Town of Wappinger Guide; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes and directs the
Town Supervisor to sign the attached printing proposal from Dutchess County Central Services
for printing said guide; and
BE IT FURTHER RESOLVED, that the Town Board hereby authorizes the following

WHEREAS, the Town Board is desirous of interviewing interested persons to fill the
several vacant Board positions.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby agrees to hold
interviews for the several open Board positions at the March 9, 2020 Town Board meeting.
