V.Public Hearings Resolution Setting A Public Hearing On Proposed Benefit Assessment Rolls For Special Improvement Districts And Special Improvement Areas For Fiscal Year 2021 And To Hear Any Objections Thereto Opened by Casella, seconded by Phillips. Single family with 2 acres or less is 1 benefit unit. For each acre over 2 is an additional .2 benefit unit per acre. Because there was one objection outstanding the accompanying resolution will be adopted at a future meeting before November 20, 2020. There were no other objections. Mike Tremper summarized by saying he submitted the budget back in August. He does all the repairs through the O&M budget versus bonding. There were no objections. Maximum capacity is between 2.2 million and 2.4 million gallons a day. Mike Tremper said, "due to the PFOA (Poly Flouro Octanoic Acid) situation, sampling and testing is done 4 times per year." Mike covered his budget presentation under the public hearing portion whose details are on the video of the minutes on the town website. Justice Court Judge Wolfson appeared before the board and discussed using the board room for court on Tuesday nights to reduce the backlog. He went over the capacity. 3. Accounting Comptroller Awino presented his budget. The board agreed to investigate a different set of auditors. 4. Code Enforcement Barbara Roberti presented her budget beginning with Fire Inspector. She went line by line all which is available on the town website video. 5. Tax Receiver Lee Freno presented her budget. She handed out a document to the board, but not to the Town Clerk for publishing in these minutes. 6. Assessor Coordinated Assessor Program (CAP) Assessor Christian Harkins presented his budget. Resolutions RESOLUTION: 2020-110 Resolution Accepting Padasana Court And Related Easements For All Angels Heights Subdivision Together With Maintenance Agreement Secured By Cash Deposit WHEREAS, westerly side of All Angels Hill Road, and WHEREAS, RJA HLD made application to the Town of Wappinger Planning Board to approve a Engineering Services, P.C. dated September 15, 2008 and last WHEREAS, the Town of Wappinger Planning Board granted Conditional Final Subdivision Plat Approval by Resolution dated November 17, 2014, subject to, and conditioned upon, fulfillment of the conditions set forth in the aforementioned Resolution, and subject to certain improvements being made and constructed as shown on the aforesaid Plat as required by the Town of Wappinger Subdivision Regulations; and WHEREAS, the Plat was filed in the office of the Dutchess County Clerk on October 21, 2016 as Filed Map 11701B; and WHEREAS, by letter dated April 30, 2020, the Engineers to the Town have advised that the construction of Padasana Court and the related improvements have been completed; and WHEREAS, pursuant to §214-43 of the Town of Wappinger Code, RJA HLD is required to post a highway construction guaranty in the form of a bond or performance guarantee in an amount equal to $104,937.08, which is 20% of the cost of construction, to be held for a period of three years to guarantee that any defects of the type described in §214-76(B) shall be cured; and WHEREAS, RJA HLD tendered to the Town of Wappinger a deed for the right of way for Padasana Court from R.J.A. HLD. INC. together with the associated transfer documents all in recordable form and approved by the Attorney to the Town, James P. Horan, Esq.; and WHEREAS, the Superintendent of Town Highways and the Engineer to the Town have recommended that the Town Board accept Padasana Court as a town; NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The Town Board hereby determines that it is in the best interest of the residents of the Town of Wappinger to accept Padasana Court as a Town Highway together with the drainage facilities and other public improvements located in the highway right of way, except those specifically excepted by the subdivision plat. 2. The Town Board hereby accepts a maintenance bond in the amount of $104,937.08 as a highway construction guaranty in accordance with §214-43 of the Town of Wappinger Code which shall be held for a period of three years to guarantee that any defects of the type described in §214-76(B) shall be cured. Town of Wappinger Page 6 Printed 11/5/2020 Regular MeetingMinutesOctober 26, 2020 3.The Maintenance Agreement executed by RJA HLD, as Obligor, in favor of the Town of Wappinger, as Obligee, is accepted as the guarantee that the quality and workmanship of the road and other public improvements will be free from defects in materials and workmanship for a period of three years from the date of acceptance by the Town as required by §214-43. 4. This acceptance is expressly conditioned upon RJA HLD delivering the right of way and the public improvements to the Town free and clear of any liens or encumbrances, and upon payment by RJA HLD of all outstanding fees and escrow reimbursements due to the Town. 5. The Town Supervisor and the Attorney to the Town are authorized to execute any and all documents necessary for the recording of the deed and easements from RJA HLD. 6. The Attorney to the Town is directed to cause the deed and easements to be filed in the property records of the Dutchess County Clerk. 7. Upon its return from the County Clerk, the Town Clerk is directed to file the deed for the town highway in his files as required by Highway Law §171(1). RESOLUTION: 2020-154 WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger introducing a proposed Repealing the Existing Provis of adoption by the Town Board; and WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and the Poughkeepsie Journal as required by law; and WHEREAS, a Public Hearing was held on September 28th, 2020 and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and WHEREAS, the Town Board determined that the proposed Local Law is a Type II action pursuant to 6 NYCRR § 617.5(c)(20) and is otherwise exempt from environmental review; and WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in the best interest of the Town to adopt said Local Law; and Town of Wappinger Page 7 Printed 11/5/2020 Regular MeetingMinutesOctober 26, 2020 WHEREAS, said Local Law has been on the desks of the members of the Town Board of the Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption of this Resolution. RESOLUTION: 2020-162 Resolution Adopting Final Benefit Assessment Rolls For Special Improvement Districts And Special Improvement Areas For Fiscal Year 2021 WHEREAS, the Town Assessor prepared proposed Benefit Assessment Rolls for all Special Improvement Districts and Special Improvement Areas in the Town of Wappinger, assessed on a benefit basis, for Fiscal Year 2021 and said proposed Benefit Assessment Rolls were filed with the Town Clerk as required by Town Law § 239; and WHEREAS, in accordance with Town Law § 239, the Town Board duly noticed and held a Public Hearing on October 26, 2020, to hear and consider any objections to said Benefit Assessment Rolls within the Town for use in Fiscal Year 2021; and WHEREAS, all interested persons were given the opportunity at the Public Hearing to challenge or contest such benefit assessment determinations; and WHEREAS, the Town Board has reviewed the proposed benefit assessment rolls within the Town for use in Fiscal Year 2021 and has determined that they were prepared in proper order. NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby adopts the Benefit Assessment Rolls as prepared by the Assessor subject to any corrections made by this Board, as the final benefit assessment rolls for the Special Improvement Districts and Special Improvement Areas in the Town of Wappinger for Fiscal Year 2021. RESOLUTION: 2020-163 Resolution Adopting Capital Budgets, O&M Charges And Water/Sewer Rates And Rents For Special Districts And Special Improvement Areas For Fiscal Year 2021 WHEREAS, on September 28, 2020, the Town Board, pursuant to and in accordance with the provisions of Sections 198 and 202-a of the Town Law and other applicable provisions of law, scheduled a Public Hearing on the Proposed Capital Budgets and Proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for Fiscal Year 2021; and WHEREAS, the Town Board conducted a Public Hearing on October 26, 2020 at 7:30 p.m. and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed Capital Budgets and proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and Special Improvement Areas for the fiscal year 2021; and WHEREAS, the Town Board has taken into consideration the comments made by the public at the Public Hearing. NOW, THEREFORE, BE IT RESOLVED, that pursuant to and in accordance with the provisions of Sections 198 and 202-a of the Town Law and other applicable provisions of law, the annexed detailed statement of the Capital Budgets and O&M Charges Water/Sewer Rates and Rents for Special Improvement Districts and Special Improvement Areas of the Town of Wappinger is hereby approved and adopted as the Capital Budgets and O&M Charges Water/Sewer Rates and Rents of the Town of Wappinger for the fiscal year beginning January 1, 2021; and BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to enter the aforementioned budgets adopted herein in the minutes of the Town Board. RESOLUTION: 2020-164 Resolution Approving Preliminary Budget For Fiscal Year 2021 And Directing A Public Hearing Thereon WHEREAS, the Town Supervisor, as Budget Officer, pursuant to §106 of the Town Law has presented the Tentative Budget to the Town Board for review, examination and possible revision; and WHEREAS, the Town Board has reviewed the Tentative Budget and has made changes thereto deemed reasonable and appropriate and intends to adopt the Preliminary Budget herewith; and WHEREAS, New York State Town Law § 108 requires that the Town Board must hold a public hearing on the Preliminary Budget on or before the Thursday immediately following the general election in November; and WHEREAS, Town Law § 109 requires the adoption of a Final Budget on or before November 20, 2020. NOW, THEREFORE, BE IT RESOLVED, that pursuant to and in accordance with the provisions of Section 106 of the Town Law, and other applicable provisions of law, the annexed detailed statement of estimated expenditures and revenues is hereby approved and adopted as the Preliminary Budget of the Town of Wappinger for the fiscal year beginning January 1, 2021; and BE IT FURTHER RESOLVED, that the Preliminary Budget adopted herein shall forthwith be filed in the Office of the Town Clerk in the Town of Wappinger where it shall be available for public inspection on weekdays between 8:30 a.m. and 4:00 p.m.; and BE IT FURTHER RESOLVED, that the Town Board of the Town of Wappinger shall meet at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 5th day of November, 2020 at 7:00 p.m. and then and there shall hold a Public Hearing upon such Preliminary Budget; and BE IT FURTHER RESOLVED, that the Town Clerk of the Town of Wappinger shall give Notice of such Public Hearing in the format attached hereto by publishing Notice thereof in the Southern Dutchess News, the official newspaper of the Town of Wappinger, and also in the Poughkeepsie Journal, at least five (5) days prior to the scheduled Public Hearing and the Town Clerk shall cause a copy of said Notice to be posted on the sign board of the Town no later than five (5) days before the scheduled Public Hearing. Resolution Approved After Executive Session RESOLUTION: 2020-167 Resolution Authorizing A Public Hearing On The Intended Use Of Dutchess County Community Development Block Grant Funds And The Submission Of The Grant Application For Fiscal Year 2021 WHEREAS, the Dutchess County Department of Planning and Development is soliciting applications for the 2021 Community Development Block Grant Program; and WHEREAS, the Town of Wappinger intends to make application for a Community Development Block Grant pursuant to the Dutchess County Department of Community Development Block Grant Program for 2021; and intended use of Community Development Block Grant Funds prior to and in furtherance of making application for said funds. NOW, THEREFORE, BE IT RESOLVED, as follows: The Town Board hereby schedules a Public Hearing to be held at Town Hall, 20 Middlebush Road, th Wappingers Falls, New York, on the 9 day of November 2020 at 7:00 P.M. at such time all parties and citizens shall have an opportunity to be heard as to the grant proposal for the Community Development Block Grant Funds being applied for by the Town of Wappinger for 2021. The Town Board has determined that pursuant to 6 NYCRR 617.5(c)(21) the proposed adoption of the aforementioned Resolution is a Type II action not requiring environmental review pursuant to the State Environmental Quality Review Act (SEQRA) and, accordingly, no environmental review has been undertaken. The Town Clerk is hereby directed to publish and post the Notice of Public Hearing in the form annexed hereto which said publications are to be made in the Poughkeepsie Journal and the Southern Dutchess News at least three (3) days prior to the scheduled Public Hearing and post same The Town Board hereby further authorizes and directs the Engineers to the Town, CPL, to assist the Town to prepare and submit the Grant Application for fiscal year 2021. Nothing in this paragraph shall be construed to prohibit persons with disabilities from bringing service animals into a park as authorized by federal, state, or city law. C. It shall be the duty of each dog owner or each person in possession, custody or control of a dog to remove any feces left by his/her dog on any public area in any Town park. D. No person shall cut, deface, injure, remove or disturb any tree, shrub, building, fence, bench or any other structure, apparatus or property; or pick, cut or remove any shrub, brush or flower; or mark or write upon any building, fence, bench, signs or other structures. E. No profane or abusive language shall be used in any Town park. F. No persons shall sell or offer for sale any goods without permission from the Recreation Director G. No persons shall erect, post, carry or distribute any signs, flyers, posters or placards without written permission of the Recreation Director. H. No alcoholic beverages shall be permitted in the park area unless permission is received from the Recreation Director, or except during activities sponsored by the Town. I. No smoking. J. Betting or gambling of any type is prohibited. K. Baseball will be permitted only on diamonds set aside for this activity. L. Hitting golf balls is prohibited, except in designated areas. M. No persons shall erect any recreation or play equipment in any park without written permission of the Recreation Director. N. Open fires (that is to say, fires not in gasoline stoves, charcoal grills, etc.) or fires not in designated places and any unattended fires are prohibited. No overnight parking of motor vehicles in any park area. V. Privately owned boats, rafts or other artificial means of support on water shall be only allowed entry upon waters in designated areas. W. No swimming without written permission of the Recreation Director. X. No persons shall enter upon any ice in any park. Y. No entertainment or exhibition of any kind shall be given without the directions, approval or supervision of the Recreation Director. Z. No person shall throw stones or other missiles. AA. No persons shall ride a horse or pony in any park. §171-4 Closing of parks. The Recreation Director, Supervisor and Town Board may close the park facilities whenever, in their judgment, such action is deemed necessary or desirable for the protection of health or safety of persons entitled to use such facilities. Request for use of Park and Recreation facilities may be made up to one year in advance of an event but no later than two (2) weeks prior to the intended date of use and is subject to approval of the Recreation Director. B. Persons wishing to reserve Town facilities for specific use shall first apply at the Recreation office or online on the approved application form with all requisite documentation. Applications shall be approved or denied by the Recreation Director. Denial of use may be appealed to the Town Board. C. The Recreation Director may set reasonable conditions upon any approval to use a Town Facility. D. The fee for use of certain Town Facilities shall be set by separate Resolution of the Town Board which may be amended from time to time. (2) Comprehensive general liability limits of at least $1,000,000 per occurrence/$2,000,000 aggregate. (3) Request shall not be processed unless all requisite documentation is provided at time of application. G. Persons applying for use of Town lands must provide a signed hold harmless agreement. H. The Recreation Director shall have the responsibility to resolve all scheduling conflicts involving the use of park facilities. §171-7 Penalties for offenses. Any person committing an offense against any provision of this chapter, or any rule or regulation made pursuant thereto, shall, upon conviction thereof, be guilty of a violation punishable by a fine in the amount set forth in Chapter 122, Article V, § 122-20U of the Code or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. § 171-8 Enforcement. This chapter may be enforced by any police agency having jurisdiction within the Town of Wappinger. §171-9 Posting. A. Signs shall be conspicuously posted at the regular entrances to Town Parks to provide notice of the park hours and other restrictions established by this Chapter. The failure to post signs, or the failure to include the prohibited conduct on the sign shall not be a defense against a violation of this Chapter and proof of posting a sign shall not be required to establish a violation of this Chapter. B. They work in concert with the following documents to insure consistency between programs: 1.Dutchess County Contracted Services Policies and Procedures 2.Procurement Policies and Procedures These documents should be reviewed when developing and implementing any activity. guidance supersedes County policies and procedures in any case where they conflict. Eligibility Determination One of the most important things to remember is that the Community Development Block Grant (CDBG) is designed to assist with the development of projects that primarily benefit low and moderate-income residents. Information on eligibility is available on Table A, page 2. Eligible Applicants Any municipality which is a member of the 2021 CDBG Urban County Consortium. Number of Applications - Only one (1) application may be submitted, except that a second application may be submitted for an eligible housing activity. Housing activities require a separate application. Funding Maximums- There is no guarantee an application will receive the maximum amount requested. APPLICATION PROCESS The County uses a two-step application process: Step 1 - Submit eligibility information via the LOI feature in the Dutchess County Grant Portal. After signing into the portal, click the blue APPLY button in the upper right to start the process. Applicants must complete this process by Friday, November 13, 2020 so the County has time to review and approve eligibility. Applicants will only be able to proceed to the application once the LOI has been approved by the County. The application and attachments must be submitted via the grant portal by Tuesday, December 1, 2020 at 4:00 p.m. Required Public Hearing Municipalities must hold a public hearing to solicit project ideas PRIOR to submitting the application. The purpose of the hearing is to provide residents, particularly low- and moderate- income residents, an opportunity to suggest projects for CDBG funds. To ensure this requirement is met, municipalities should schedule a public hearing early in the application process. After the public hearing (at the same or subsequent meeting) the municipality must consider potential projects, select a project, and pass a resolution approving the application prior to submission. Applications submitted without a public hearing are ineligible and will be rejected. For joint applications, each municipality must hold a public hearing and pass a resolution. Municipalities are required to invite representatives from any proposed projects to the hearing. A copy of the public notice and authorizing resolution must be submitted with the application. The County has provided a sample resolution. PRIORITIES AND ELIGIBILITY Proposed activities must meet: 1. Federal eligibility requirements (Table A), AND 2. A Consolidated Plan priority (Table B) A. Federal Eligibility Use the following chart to see if your project meets federal eligibility requirements: Table A - Federal Eligibility Requirements To be eligible, you must be able to check one box in each column. Eligibility must be confirmed by submitting a Letter of Intent (LOI) via the Dutchess County Grant Portal. Alternative wastewater systems. New techniques to contain drainage such as green streets, pervious parking lots and walkways, and rain gardens, with a priority for areas where runoff and infiltration of storm water into sewer systems is a problem. Housing that address needs also identified in the Dutchess County Continuum of Care Application and the 10-Year Plan to End Homelessness. Housing that sets aside units for hard-to-serve special needs populations. Housing developed by agencies that demonstrate collaboration and are active participants in the Dutchess County Housing Consortium (DCHC). Created via the Dutchess County and City of Poughkeepsie Land Bank or City of Poughkeepsie Anti-Blight Task Force The County has an obligation to address all the priorities over the Plan period. The County reserves the right to fund activities as necessary in order to meet this objective. CDBG POLICIES AND PROCEDURES The CDBG Program has detailed Policies and Procedures. Below is a summary of the several important items: Implementation and Architectural/Engineering Costs - Activity implementation and engineering costs for consultants will be limited to 20% of the activityMunicipal personnel are not eligible to be reimbursed for activity implementation. Start Date Activities may not begin or incur costs prior to March 1, 2021 (beginning of the program year). Completion/Expenditure Deadline Activities allocated funds under this application must be completed and all funds expended by October 31, 2022 (twenty (20) months from the beginning of the program year). Environmental Reviews The County must conduct an environmental review under the National Environmental Policy Act (NEPA) and the municipality must ensure compliance with the NYS Environmental Quality Review Act (SEQRA). Activities may not begin construction until the environmental review is complete. City of Beacon Annual Allocation - The City of Beacon receives 15% of the annual CDBG allocation after the activities with the exception of maximum grant award and number of applications submitted. Public Service Activities Up to 15% administrative expenses, may be set aside for public service activities. If a public service agency is applying for a construction activity, that is considered a municipal activity and must be sponsored by the municipality in which the activity is located. Parties interested in non-construction public service activities should apply directly to the CDBG Public Service or Agency Partner Program using the APG/CDBG Public Service Application. Procurement Requirements - All activities are subject to Federal and County Procurement Policies and Procedures. This generally includes public bidding and prevailing wages. APPLICATION REVIEW Applications are reviewed for completion. Applications that lack required items or contain technical errors will be notified by email and given ten (10) calendar days to correct the error. Documentation of public hearing is the one document that cannot be submitted after the application due to HUD regulations. Failure to submit the missing items by the deadline will result in ineligibility. Theapplication process is competitive and based on the below considerations. A site visit and staff evaluations are conducted. Preliminary staff recommendations are presented to the Community Development Advisory Committee (CDAC). The CDAC reviews the recommendations, and requests additional information if necessary. CDAC funding recommendations are sent to the County Executive for final approval. Review Considerations The staff will begin the evaluation of each activity by asking: 1. Is the proposed activity eligible under HUD CDBG guidelines? 2. Does the activity address a HUD National Objective (Low/Mod Benefit)? If the activity does not meet these first two criteria it is ineligible. Questions 3 through 14 aid in further evaluation and development of funding recommendations. 3. Does the proposed activity meet a priority of the Consolidated Plan? 4. Does the activity benefit a substantial number of low to moderate income persons? 5. Is the estimated completion time for the activity realistic and allow for completion by the deadline? 6. Does the proposed activity build on previous investments or is it part of a larger development plan? 7. Does the municipality have outstanding CDBG funds? 8. Does the activity represent an innovative approach to a problem? 9. Is the activity , Analysis of Impediments to Fair Housing and other County Plans such as Directions, Centers and Greenspaces Guide, and the PDCTC Metropolitan Transportation Plan Moving Dutchess? 10. Is the activity a cooperative effort from two or more municipalities? 11. Has the municipality leveraged other sources of funds? Are they secure? 12. How is the municipalit organizational capacity; was the administration of previously activities positive? 13. Is the activity cost effective? Are costs in line with comparable activities? 14. Has the municipality taken action to affirmatively further fair housing? Housing projects will have the following additional questions: 15. Are the development and construction costs in line with similar projects? 16. If the applicant has received HOME or CDBG funds in the past, were those projects completed in a timely fashion and with quality workmanship? Has the applicant maintained the projects in an appropriate manner and complied with all rental/sale price and income regulations? 17. Is the municipality where the project is located supportive of the project? Specifically, is it likely to receive the necessary planning and zoning approvals?
