Resolution Introducing Proposed Local Law 1 Entitled “Authorizing Best Value Procurement For Town
Of Wappinger”
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February 22, 2021.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll being called, the
following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by Casella.
WHEREAS, General Municipal Law § 103 authorizes the Town Board to adopt a Local Law to authorize the
award of certain purchase and service contracts subject to competitive bidding on the basis of “best value” as
defined in § 163 of New York State Finance Law; and
WHEREAS, the “best value” option may be used if it is more cost efficient over time to award the good or
service to other than the lowest responsible bidder for factors such as lower cost of maintenance, durability,
higher quality and longer product life; and
WHEREAS, after review and due consideration, the Town Board has determined that it would be in the nest
interests of the residents to adopt said Local Law; and
WHEREAS, the Town Board has determined that the proposed adoption of the aforementioned Local Law is a
Type II action pursuant to 6 NYCRR § 617.5 (c) (20) and is otherwise exempt from environmental review
pursuant to the New York State Environmental Quality Review Act (“SEQRA”).
NOW, THEREFORE, be it resolved, that the Town Board hereby introduces for adoption proposed Local Law
1 of the Year 2021 entitled “Authorizing Best Value Procurement for Town of Wappinger” in the form annexed
hereto; and
BE IT FURTHER RESOLVED, that the Town Board determines that the enactment of the aforementioned
Local Law is a Type II action as defined in 6 NYCRR 617.5 and, accordingly, the Town Board hereby
expressly determines that this action is not an action that requires review pursuant to the provisions of the New
York State Environmental Quality Review Act (SEQRA) or pursuant to 6 NYCRR Part 617; and
BE IT FURTHER RESOLVED, that the Town Board hereby schedules a Public Hearing on the proposed
adoption of Local Law 1 of the Year 2021 entitled “Authorizing Best Value Procurement for Town of
Wappinger” to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 8th day of
March, 2021, at 7:00 p.m., and the Town Clerk is directed to post the Notice of the Public Hearing in the form
annexed hereto and to publish same in the Southern Dutchess News and Poughkeepsie Journal as required by
law.
The foregoing was put to a vote which resulted as follows:
