Public Hearings Resolution Introducing Proposed Local Law Entitled "Town Of Wappinger Cross Connection Control Law" Opened by Councilman Beale Seconded by Councilman Casella. RESULT: CLOSED [UNANIMOUS] MOVER: Al Casella, Councilman SECONDER: Christopher Phillips, Councilman AYES: Thurston, Beale, Bettina, Phillips, Casella V. Public Portion 1. Motion To: Open Public Portion Robin Licari from 15 Red Hawk Hollow Road rose to speak on a petition signed by 721 people to restore long standing code from the 1980's that was removed on March 11, 2019 that prohibited gas stations within 2500 feet of each other and within 1000 feet of residents. The petition was signed by people in opposition to a proposed gas station at the intersection of New Hamburg Road and Route 91) that was submitted to the correspondence log, the last resolution on the agenda. Supervisor Thurston with remote access via'Zoom', argued a point of order that it is not on the agenda, that it is in the correspondence log and that she is out of order. Councilman Beale said that the `Town Board Rules' do not support that this item is on the agenda, only the log. He added that the proposed gas station is a matter before the Planning Board. Ms. Licari persisted that this is where the law was changed in 2019 not the Planning Town of Wappinger Page 3 Printed 6/17/2021 Regular Meeting Minutes June 14, 2021 Board; and, this is where it can be restored. Councilman Beale accommodated Ms. Licari and the cross talk. Councilman Beale stated, "This Town can be sued if the Town Board takes a position on a project that is before the authority having jurisdiction, which is the Planning board." He also said, "When there's an application before the planning board, you can't change laws while there's an application before the planning board". Concerning the detail of the correspondence log being an agenda item, a resident stated that there is no reason why agendas cannot be amended. A resident commented that a change in the law would require the proposed gas station to acquire a variance. Councilman Beale said, "The reason why this was changed was because of litigation I had previously mentioned relative to the BJs application that came before the planning board when BJs wanted to put a gas station in at Route 9 and Old Hopewell Road." In response to a resident's question about changing the law for the whole town, Councilman Beale said, that was the recommendation of legal counsel. Another resident asked, "Did you change it because you were sued?" Councilman Beale asked the attorney, if there was a legal issue regarding BJs. The attorney responded, yes. Attorney Horan added, "with respect to the 2500 feet between gasoline filling stations, there are court cases that say, that is an anti-competitive, anti-trust provision that is unenforceable as a matter of law." He continued, "With respect to the 1000 foot, that Councilman Beale mentioned, all but one of the gas stations in the town is within 1000 feet of a residential district." He added many of them have variances that serve as a precedence for other variances. He said that variances are not for the standard case that is what the Special Permit requirement is for, that is still in play in the zoning code. Councilman Beale agreed to letting two more people speak. He added that there certain things he cannot give an opinion on. Ben Amundson from 73 Losee Road wanted clarity on why the law was changed due to litigation and asked if the way to put it back was to sue the Applicant or the Town to get it back in. Would the town rather be sued by the applicant or the residents. He stated. "We think it's a bad idea to allow gas stations to be touching people's properties." He said, "If we had it for so long, I don't see, have we lost a severe amount of lawsuits? Did we lose more lawsuits than we won? I think it was a solid zoning code that survived a long time." He asked to put it on the next agenda. Ron Evangelist from Hughsonville addressed the board. He said that he looked at other neighboring the Town of Wappinger, five towns counting Newburgh that all have some kind of restriction, including 1000ft, 1500 hundred foot separations. They all have some kind of separation restriction. He said, "Unfortunately, in 2019, the Town of Wappinger removed all of its separation restrictions in March. He added, in November they added apartments above a gas station in a Hamlet Mixed -Use zoning. By December 20th, 2019 or within 30 days, `Gasland' made a full submittal indicating that `Gasland' must have been aware. He added that when there is an existing controversy, they put in place a moratorium and make recommendations with a planner or a committee. He added that this is done all the time. Eddie Palm from 237 Beacon Lane in Wappinger, said, "The restrictions were dropped whenever, I understand from a very reliable source. You have no idea how reliable this source is that the Town Board approached the Nesheiwats to come in with this project." Councilman Beale stated, "I have no knowledge and I did not have any communication with Nesheiwat until they called me after my community gathering very upset with me about having the community gathering." Mesier Avenue asked if you can change the law back to the way it was, then the applicant can apply to the ZBA for a variance. Then it is up to the other board to make the determination. Attorney Horan stated that was recused from the `Gasland' application before the planning board. He said there are three different processes and the one before the planning board has not been determined and that many of the requirements for getting a variance are the same for granting a Special Use permit. Resolutions RESOLUTION: 2021-84 A Resolution Authorizing, Subject To Permissive Referendum, The Reconstruction Of And Construction Of Additions To Various Highway Department Buildings And Facilities, In And For The Town Of Wappinger, Dutchess County, New York, At A Maximum Estimated Cost Of $1,250,000, And Authorizing The Issuance Of $1,250,000 Bonds Of Said Town To Pay The Cost Thereof Town of Wappinger Page 7 Printed 6/17/2021 Regular Meeting Minutes June 14, 2021 WHEREAS, the capital project hereinafter described, as proposed, has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, which regulations state that Type II Actions will not have a significant adverse effect on the environment; and WHEREAS, it is now desired to authorize such capital project and its financing; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. The reconstruction of and construction of improvements and additions to various Highway Department buildings and facilities, in and for the Town of Wappinger, Dutchess County, New York, including site improvements, original furnishings, equipment, machinery, apparatus, appurtenances, as well as other incidental improvements and expenses in connection therewith, is hereby authorized, subject to permissive referendum, at a maximum estimated cost of $1,250,000. Section 2. The plan for the financing of the aforesaid maximum estimated cost is by the issuance of $1,250,000 bonds of said Town, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is twenty-five years, pursuant to subdivision 12(a)(1) of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year unless paid from other revenues. There shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor of said Town, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. All other matters except as provided herein relating to the bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or Town of Wappinger Page 8 Printed 6/17/2021 Regular Meeting Minutes June 14, 2021 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 9. Upon this resolution taking effect, the same shall be published in full or summary form in the official newspaper(s) of said Town for such purpose, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. OF THE YEAR 2021 A Local Law entitled "Town of Wappinger Cross Connection Control Law." BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section L• Title. This Local Law shall be known and cited as Town of Wappinger Local Law No. of the Year 2021 entitled "Town of Wappinger Cross Connection Control Law." Section IL• Amendment of Chapter 234, Article VIII, Section 234-47 Cross -Connection Chapter 234, Article VIII, Section 234-47 of the Town Code of the Town of Wappinger is hereby amended to read as follows: "§ 234-47. Cross -connection control. A. The purpose of this section is to safeguard the municipal water supply from potential contamination by preventing backflow from a water user into the Town of Wappinger municipal water supply system. The adoption of this section will enable the Town of Wappinger to comply with the requirements of the New York State Sanitary Code, Part 5, Section 5-1.31, and, in some cases, supersede the requirements of the state code. The safeguarding shall be accomplished by a requirement for the installation by the owner of the premises of an approved air -gap separation, reduced -pressure zone (RPZ) device or a double-check valve assembly (DCVA), as defined in this Chapter, consistent with the degree of hazard posed by a service connection from the premises to the municipal water supply system. B. Facilities requiring cross -connection control devices as designated: 1. Hazardous facilities requiring air -gap separation or reduced -pressure zone (RPZ) device. (a) Sewage and industrial wastewater treatment plants and pumping stations; sewer flushers. (b) Paper manufacturing or processing; dye plants; petroleum processing; printing plant; chemical manufacturing or processing; industrial fluid systems; steam generation; rubber processing; tanneries. (c) Canneries; breweries; food processing; milk processing; ice manufacturing; meat packers; poultry processing; rendering companies. (d) Hospitals; clinics; laboratories; medical office buildings; veterinary hospitals; mortuaries; embalmers. (e) Airports; aircraft hangers; passenger and freight terminals; trucking terminals; shipyards; marinas. (� Metal -plating; photo -processing; laundries, commercial car washes; commercial refrigeration systems; dry-cleaning establishments. (g) Commercial greenhouses; spraying and irrigation systems using weedicides or herbicides; exterminators. (h) Boiler systems; cooling towers or internal fire -fighting systems using conditioners, inhibitors or corrosion -control chemicals (typically: apartment buildings, cooling towers and warehouses). (i) Residential units with lawn and irrigation system with chemical injection. (j) Any building or premises on which there exists an auxiliary water supply which is not separated from the municipal water supply system. 2. Aesthetically objectionable facilities requiring double-check valve assembly (DCVA). (k) Customer fire -protection loops; fire storage tanks with no chemical additives. (1) High-temperature potable water. (m) Utilization of food -grade dyes. (n) Complex plumbing systems in commercial buildings (typically: barbershops, beauty salons, churches, apartment buildings, gas stations, supermarkets, nursing homes, construction sites and carnivals). (o) Residential units with lawn and irrigation systems. (p) Industrial, commercial, professional and business facilities which receive a building permit after the effective date of this chapter. (q) Existing residential and nonresidential buildings containing an auxiliary water supply in a separate piping system (i.e., a well) with no known cross -connection to the municipal water supply system. (r) Existing residential and nonresidential buildings containing an internal cross - connection of any type to the municipal water supply system. C. Nonhazardous facilities not requiring a cross -connection control device: 1. All residences, up to four units, except those containing an auxiliary water supply, an internal cross -connection to a municipal water supply system or a lawn irrigation system. 2. All business, professional and commercial establishments, whose use of the municipal water supply system is restricted to drinking and toilet purposes for employees and customers, except those containing an auxiliary water supply, an internal cross -connection to a municipal water supply system or a lawn or irrigation system service or water meters. The Water Superintendent or designee with the assistance of the engineer for the Town shall evaluate any facility which is not listed above and make a determination as to the category and requirements for installation of a cross -connection protection device. D. Approval of cross -connection control devices. The Water Superintendent or designee with the assistance of the engineer for the Town shall have the responsibility for approving each cross -connection control device, on the basis of catalog or other professional information submitted to the Code Enforcement Officer. The installation of an air -gap separation device, RPZ or DCVA requires prior plan approval from the Dutchess County Community Health Department or the New York State Health Department prior to installation, and documentation of such approval shall be provided to the Code Enforcement Officer. The design and installation of an acceptable cross - connection control device hookup must be in accordance with New York State laws and regulations. E. Testing requirement. The testing of every cross -connection control device required shall be performed on initial installation and on an annual basis by a certified inspector, and the cost shall be borne by the owner of the premises. The tests shall be performed by a New York State certified tester on file with the Dutchess County Community Health Department. 2. The owner shall send a certified copy of all test results to the Code Enforcement Officer. Residential dwellings of four units or less shall be exempt from this annual requirement, as are certain businesses under subdivision B above. Certifications of such tests, as well as records of repairs and overhaul of the devices, shall be maintained at the premises for a period of 10 years and shall be made available to the Code Enforcement Officer, as well as the Dutchess County and New York State Health Departments, upon request. In the case of nonresidential buildings which are subject to annual inspection by the Code Enforcement Officer, the Code Enforcement Officer shall check the certification of the cross -connection control device by a certified inspector. Section III. Numbering for Codification. It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of this Local Law shall be included in the Code of the Town of Wappinger; that the sections and sub- sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish such intention; that the Codifier shall make no substantive changes to this Local Law; that the word "Local Law" shall be changed to "Chapter," "Section" or other appropriate word as required for codification; and that any such rearranging of the numbering and editing shall not affect the validity of this Local Law or the provisions of the Code affected thereby. Section IV. Severability. The invalidity of any word, section, clause, paragraph, sentence, part or provision of this Local Law shall not affect the validity of any other part of this Local Law, which can be given effect without such part or parts. Section V. Effective Date. This Local Law shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
