Resolution Introducing Local Law “A Local Law Adopted Pursuant to Cannabis Law §131
Opting Out of Licensing and Establishing On-Site Cannabis Consumption Premises within
the Town of Wappinger outside of any Village.”
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
November 15, 2021.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll
being called, the following was recorded:

The following Resolution was introduced by Councilman Phillips and seconded by
Casella.
WHEREAS, pursuant to Cannabis Law § 131, the Town of Wappinger desires to opt-out of
hosting on-site cannabis consumption establishments within the boundaries of the Town outside
of the Village; and
WHEREAS, the Town Board has determined that the proposed adoption of the aforementioned
Local Law is a Type I action pursuant to 6 NYCRR § 617.4(b)(2) and it is the only agency
having approval jurisdiction over the action therefore it is established as the lead agency;
BE IT RESOLVED, that the Town Board hereby introduces for consideration of its adoption
proposed Local Law No. ___ of the Year 2021 entitled “A Local Law Adopted Pursuant to
Cannabis Law §131 Opting Out of Licensing and Establishing On-Site Cannabis Consumption
Premises within the Town of Wappinger outside of any Village”, in the form annexed hereto;
and
BE IT FURTHER RESOLVED, that the Town Board hereby schedules a Public Hearing
regarding the proposed adoption of the annexed Local Law for 7:00 P.M., on the 13th day of
December, 2021, to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York,
and the Town Clerk is directed to post the Notice of Public Hearing in the form annexed hereto
and to publish same in the newspaper not less than ten (10) days nor more than twenty (20) days
prior to the Public Hearing as required by law; and
BE IT FURTHER RESOLVED, that pursuant to Cannabis Law §131 this Local Law is subject to
a permissive referendum.
The foregoing was put to a vote which resulted as follows:
