Resolution Authorizing Release Of Security Posted In Connection With Nerp Holdings
And Acquisitions Company, LLC (Tractor Supply Site Plan)
At a Reorganization Meeting of the Town Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
January 11, 2021.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll
being called, the following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by
Councilwoman Bettina.
WHEREAS, by Resolution 2020-62 the Town Board previously accepted an Undertaking
Secured by Cash Deposit for Restoration dated February 6, 2020, executed by NERP Holdings
and Acquisitions Company, LLC, in the sum of Twenty Thousand Three Hundred Fifty Dollars
($20,350.00), to secure the developer’s obligations to guarantee the restoration of the property if
trees were cut, and site plan approval was not granted; and
WHEREAS, NERP Holdings and Acquisitions Company, LLC has complied with the
terms of the Undertaking; now, therefore
BE IT RESOLVED, that the Town Board hereby acknowledges that NERP Holdings
and Acquisitions Company, LLC has complied with the terms of the Undertaking and the Cash
Deposit in the sum of Twenty Thousand Three Hundred Fifty Dollars ($20,350.00) shall be
released.
The foregoing was put to a vote which resulted as follows:
