2022-104 2022-104 Resolution Approving Payment Of Accumulated Sick Time At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on May 9, 2022. Beale Mover     Defeated  Angela Bettina Voter     Tabled  Christopher Phillips Voter      Withdrawn Al Casella Seconder     The following Resolution was introduced by Councilman Beale and seconded by Casella. WHEREAS, the Collective Bargaining Agreement between the Town of Wappinger and CSEA Local 1000 AFSCME, Town of Wappinger Highway Department provides that an employee may only accumulate 200 sick days; and WHEREAS, due to a change in time tracking systems the accrued sick time of Craig Bova was not properly credited and he accrued 238.09 days of vacation which exceeded the limit set in the CBA; and WHEREAS, the Town has investigated the sick time tracking systems and confirmed that Craig Bova is the only employee who has exceeded limit through no fault of his own and the employees are aware of the contractual limit; and WHEREAS, the Highway Superintendent, the Town Comptroller and the Attorney to the Town recommend that Mr. Bova be paid for the sick days accumulated above the 200 day limit to avoid the filing of a formal labor grievance as well as a disruption in the staffing of the highway department; WHEREAS, the Town Board has determined that the payment for the excess sick days is appropriate under the circumstances, notwithstanding the limit set in the CBA; NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby authorizes a payment of $10,814.51 to Craig Bova in compensation for 38.09 accumulated sick days which reduces his sick day balance to 200 days as of the date of this resolution. The payment shall be made from DB.5110.100. The foregoing was put to a vote which resulted as follows: RESULT: ADOPTED \[UNANIMOUS\] MOVER: William H.
