2022-88 2022-88 Resolution Making SEQRA Determination For Mid-Point Park Engineering Planning Study At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 11, 2022. WHEREAS,the Environmental Facilities Corporation (EFC) awarded a $100,000 Engineering Planning Grant(EPG)to the Town of Wappinger for an engineering report to identify sources of inflow and infiltration in the Mid-Point Park Sewer District, evaluate alternatives, and recommend improvements to the Town of Wappinger's wastewater collection system; and WHEREAS, Title 6 of the New York Code of Rules and Regulations (6 NYCRR) Section 617.5 under the State Environmental Quality Review Act(SEQRA)provides that certain actions identified in subdivision (c) of that section are not subject to environmental review under the Environmental Conservation Law; now, therefore BE IT RESOLVED,that the Town Board of the Town of Wappinger hereby determines that the proposed engineering study to identify sources of inflow and infiltration in the Mid-Point Park Sewer District, evaluate alternatives, and recommend improvements to the Town of Wappinger's wastewater collection system is a Type II action in accordance with 6 NYCRR Section 617.5(c) (27) which provides that"conducting concurrent environmental, engineering, economic, feasibility and other studies and preliminary planning and budgetary processes necessary to the formulation of a proposal for action, provided those activities do not commit the agency to commence, engage in or approve such action;" is a Type II action and is therefore not subject to further review under 6 NYCRR Part 617; and BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to provide a certified copy of this Resolution to the Environmental Facilities Corporation (EFC) as required by the EPG program.
