Grant of exemption. °? ii An enrolled member of an incorporated volunteer fire company, fire department or incorporated - voluntary ambulance service, or such enrolled member and their spouse, is hereby granted a partial 3 exemption from real property taxes of the Town of Wappinger of ten percent (10%) of the assessed value, excluding special assessments, provided that the eligibility requirements are met. o J § 221-20 Eligibility requirements. m Such exemption shall be granted to an enrolled member of an incorporated volunteer fire company, U fire department, or incorporated voluntary ambulance service provided that: A. The volunteer firefighter or volunteer ambulance worker is certified by the authority having K W jurisdiction for the incorporated volunteer fire company, fire department, or voluntary ambulance X service as duly enrolled member of such incorporated volunteer fire company, fire department, or incorporated voluntary ambulance service; and E. The volunteer firefighter or volunteer ambulance worker meets the minimum service requirement ° o. established by the Town of Wappinger, which is hereby established as 2 years. 0 N § 221-21. Application. o A volunteer firefighter or volunteer ambulance worker must annually, on or before the applicable z 3 taxable status date, file an application for such property tax exemption with the assessor responsible � for preparing the assessment roll for the Town of Wappinger, on a form as prescribed by the New York o State Commissioner of Taxation and Finance. Such list must provide, as of the applicable taxable status date, the number of years of o service served by each such enrolled member and such enrolled member's address of residence. a) X § 221-23. No diminution of benefits. w L An applicant who is receiving any benefit pursuant to Article 4 of the Real Property Tax Law, other than a benefit granted pursuant to Real Property Tax Law §466-c, as of the effective date of this article shall not have any of those benefits diminished because of this article. U § 221-24. Grant of lifetime exemption. E Any eligible enrolled member who accrues more than 20 years of active volunteer service (as certified by the authority having jurisdiction) shall be granted the 10% exemption as authorized by this article for the remainder of his or her life as long as he or she owns their primary residence within the Town of U- Wappinger. § 221-25. WAPPINGER LITTLE LEAGUE shall provide programs for the following ages: U a. Challenger Leagues —Age Group —varied 4 to 20 years old; 2 b. Tee Ball—Age Group - 4 to 6 years old; 0 c. The following fields at the Robinson Lane Complex shall be reserved for M 4- 0 the programs of the WAPPINGER LITTLE LEAGUE during the agreed upon times of operation: r- .2 0 U F3, Insl, Ins2, R1, R2, SLI, Tl, T2, and Challenger (hereinafter "RESERVED FIELDS"). The K W WAPPINGER LITTLE LEAGUE shall be permitted to use other fields at the Robinson Lane M N Complex as needed with the approval of the TOWN. co W 3.4. To the extent practicable, the TOWN shall give WAPPINGER LITTLE 0 0 LEAGUE priority in scheduling the use of the fields. The Wappinger Recreation Director and/or 0 0 the Chairman of the Recreation Committee may consult with the Supervisor of Buildings and U Grounds of the Town of Wappinger in approving the use of the fields or other facilities authorized 0 U herein. The TOWN reserves the right to permit third parties to use the RESERVED FIELDS at 0 such times that do not interfere with the schedule of WAPPINGER LITTLE LEAGUE. 4 0 3.5. The Recreation Director will notify WAPPINGER LITTLE LEAGUE in o N the event there is any request to use any of the park facilities that may conflict with the approved U Q - 4 - Packet Pg.63 7.11.a schedule of uses by WAPPINGER LITTLE LEAGUE. To the extent practicable,the TOWN shall a� not grant approval to outside users so as to insure there will be no conflicts with the approved m schedule of uses for WAPPINGER LITTLE LEAGUE. The TOWN shall be responsible for the maintenance and repair of the fields a� Q and such custodial services as may be deemed necessary by the Supervisor of Buildings and M 4- 0 Grounds, except as hereinafter set forth. o 0 U 4.2 The TOWN will clean and supply the restrooms, including the Challenger K W restrooms, twice a week during normal working hours throughout the play season, on days agreed M N upon by the Supervisor of Buildings & Grounds and President of the WAPPINGER LITTLE U) W LEAGUE. The TOWN will also provide an outside contractor to clean and supply the restrooms 0 0 on weekends during the play season as needed. Such cleaning shall include sweeping the floor, 0 0 picking debris, cleaning sinks, toilets and partition walls, mopping the floor, checking and U resupplying toilet paper,paper towels and hand soap as needed, and emptying the garbage. 2 0 U 4.3 Weather and field conditions permitting, the TOWN will provide weekly 0 It- mowing of the outfields and common areas on a day to be agreed upon by the Supervisor of 0 M Buildings & Grounds and WAPPINGER LITTLE LEAGUE President. The TOWN will also 0 N provide string trimming of the fences, buildings, and bleachers on a bi-weekly basis. Q Q 4.5 The WAPPINGER LITTLE LEAGUE shall promptly notify, in writing,the 06 0 Supervisor of Buildings and Grounds of any dangerous conditions on any of the facilities licensed o a� hereunder or any needed repairs to the baseball fields or other facilities. The Supervisor of 0 a� a� Buildings and Grounds will provide an emergency phone number at which he or another a� m designated individual can be reached in the event emergency repairs are required. C E a) 4.6 The Town Board, in consultation with the Supervisor of Buildings and a� Q Grounds must approve all capital or major improvements requested to be undertaken by M 4- 0 WAPPINGER LITTLE LEAGUE on any of the sports fields; the approval shall be in the form of o 0 U a motion or resolution adopted by the Town Board at any regular or special Town Board Meeting. K W The request for improvements must identify the type of improvements, design plans, projected M N cost, and expenses. All such improvements shall be paid for by WAPPINGER LITTLE LEAGUE U) W unless the TOWN expressly agrees otherwise. W 0 0 4.7 Since Robinson Lane Recreation Facility is a locked-gate Town park, the 0 0 Town's Supervisor of Buildings and Grounds, after consultation with the Town Supervisor, shall U create a list of authorized key holders to open and close the park each day and shall so notify 1212 0 U WAPPINGER LITTLE LEAGUE and the Town's Director of Recreation. L 3.2. Thirty (30) days prior to the start of each season, WUSC shall submit a .Q Q proposed use of the soccer fields necessary to provide the soccer program for the League specified M in 2.2 above. The Recreation Director will notify WUSC in the event there 0 m m is any request to use any of the park facilities that may conflict with the approved schedule of uses m by WUSC. To the extent practicable,the TOWN shall not grant approval to outside users to insure C E m there will be no conflicts with the approved schedule of uses for WUSC. Both parties agree to a� Q cooperate to maximize use of the facilities with other users, with a preference given to WUSC Q O whenever possible or practical. o .2 3.4. The TOWN authorizes WUSC to use portable lighting on the fields until K W 8:00 p.m. The TOWN shall not be responsible for supplying or maintaining portable lighting for M N use by WUSC. N U) W 3.5. Weather and field conditions permitting, the TOWN will provide weekly .Q Q mowing of the fields and common areas on a day to be agreed upon by the Supervisor of Buildings M M & Grounds and WUSC President. During the time that WUSC is using the fields in accordance with the a� approved schedule of use, the TOWN hereby grants a revocable permit to WUSC to use existing Q buildings at the Airport Drive Soccer Fields for the purposes of storage of equipment and the 06 operation of a food and drink concession. No other use of the buildings or the grounds shall be 0 0 m permitted without the expressed consent of the Supervisor of Buildings and Grounds, after a� a� consultation with the Town Supervisor. m 4.2. The WUSC will be responsible for the maintenance and cleanliness of the E m concession stand and all equipment in connection therewith, and further affirmatively agrees to a� Q operate the concession stand and equipment in accordance with the rules of the Dutchess County Q O Health Department and any other regulatory agency having jurisdiction over the facility. o 4.3. Any violations of any rule, law, regulation, ordinance, or statute by WUSC K W in the operation of the concession stand will be the sole responsibility of WUSC and WUSC agrees M N to indemnify and hold harmless the TOWN for any such violations. WUSC will repair/correct any Q U) W violation within 30 days or by the date mandated by the Dutchess County Health Department and U any other regulatory agency having jurisdiction over the facility. 0 5. TOWN Responsibilities. U U 5.1. The TOWN shall supply general and routine maintenance to the parks' a� buildings, structures, and grounds, except for those items specifically designated as WUSC L responsibilities in paragraph 6 following. .Q Q 5.2. The TOWN shall supply porta johns and garbage removal. M M 5.3. The Supervisor of Buildings and Grounds shall be notified in the event N 0 emergency repairs are required and needed for any of the facilities licensed herein. The TOWN shall mow and maintain the length of the grass on the soccer Q fields. The TOWN shall, weather and field conditions permitting, provide weekly mowing of the 06 0 3 fields and common areas on a day to be agreed upon by the Supervisor of Buildings & Grounds 0 0 and the WUSC President. The TOWN will also provide string trimming of the fences, buildings, 0 0 0 and bleachers on a bi-weekly basis. The Town will attend to clean up of storm debris including m fallen trees or branches as soon as possible following the storm. C E 0 5.5. The TOWN shall maintain and keep in structurally and/or mechanically 2 a� Q good order the fences, signs, and electrical services to the parks. Q 0 5.6. Upon request by WUSC, the TOWN, through the Department of Buildings o and Grounds shall trim or remove any trees or ornamental shrubbery that interferes with game K W playing on any of the fields. M N 6. WAPPINGER UNITED SOCCER CLUB'S Responsibilities. N Co W 6.1. WUSC will be responsible for measuring and marking all field lines, U locating goals and any other field configurations pursuant to the guidelines and regulations for the 0 U game of soccer. U U 6.2. WUSC will pay for any improvements it deems necessary outside of the Co 0 TOWN responsibilities, subject to Town Board approval, in consultation with the Supervisor of L Buildings and Grounds. _ .Q Q 7. Equipment. The WUSC shall provide all sporting equipment necessary for the M implementation of the soccer program or shall require the participants to provide their own CD 0 equipment, including, but not limited to, balls, insurance, uniforms, league fees, players' 0 E U Q - 7 - Packet Pg.84 7.12.a equipment, goals, etc., and such other equipment to maintain the fields as required for the game of soccer. The Town shall not be responsible for providing any soccer equipment under this a� agreement. Q 8. Availability. The soccer program herein provided shall be made available to all 06 0 youth of the TOWN, inclusive of the Village of Wappingers Falls. The sports program shall be 0 m provided starting in the month of March 2023 through December 2023, as approved by the 0 m m Recreation Department. m m 9. Medical Insurance Coverage. C m E m 9.1 The WUSC shall provide medical/injury insurance equal to or greater than Q the standard insurance coverage covering the medical expenses for any of the participants Q O in the soccer program. o 9.2 The WUSC shall notify the recreation director and the Town Supervisor in 0 W writing, via email or regular mail, within 2 business days of any injury that occurs. Injury Ln M N includes injuries to players, staff, parents, spectators, visitors, invitees, and guests. The CD Co W injury shall be reported by any form approved and required by Eastern New York Youth U Soccer Association, East Hudson Youth Soccer League or other governing organization, 0 or on a form approved by the Recreation Director. The Town shall be provided with a copy U U of any forms that the WUSC is required to file related to the injury to its governing Co m organization, insurance carrier, or any other entity. L 10. Liability Insurance. 0 .Q Q 10.1. The WUSC shall indemnify and hold harmless the TOWN from all claims M on account of injury, loss or damage arising or alleged to arise out of or in connection with the Q 0 m E U Q - 8 - Packet Pg.86 occupancy or use of the Town of Wappinger Recreation Fields; including all expenses incurred by the TOWN in the defense, settlement or satisfaction thereof including expenses of legal counsel m a� 10.2. In addition, the WUSC agrees to provide to the TOWN, a certificate of Q insurance, which indicates a current Commercial General Liability policy is in force with the 06 WUSC as a named insured written with an insurance company with an A. M. Best's rating of"A" 0 m or better. The occurrence limit must indicate a limit not less than $1,000,000. The TOWN shall m m be named as an additional insured and/or certificate holder on a primary, non-contributory basis. m 10.3. No approval is granted or implied unless and until all requirements as E m outlined above have been submitted to, received, and accepted by the TOWN. a, Q 11. Indemnification. The WUSC will save, indemnify and hold harmless the Q O TOWN and its agents, servants and employees from against all claims, damages, losses and o .2 expenses including attorney's fees arising out of or resulting from any claims, damages, disease, K W death or injury to any participants in the program conducted by the WUSC, including the loss or M N destruction of tangible personal property, except, however, the WUSC shall not responsible or Q U) W assume any liability for any acts of negligence committed by or on behalf of the TOWN, its agents, U servants and employees 0 12. Worker's Compensation. The WUSC shall provide Worker's Compensation U U coverage as required by General Municipal Law §108. co m 13. Financial Disclosure. The WUSC will furnish to the Town Board a profit and L loss statement for the WUSC and show distribution of funds from any non-profit tournaments and .Q Q camps run by WUSC on TOWN property no later than January 31st of each year hereafter. The TOWN shall pay WUSC the sum of Five Thousand Dollars ($5,000.00) m a� for the administration and oversight of the soccer program to be provided pursuant to this Q Agreement. 06 0 3 14.2. WUSC shall be solely responsible for providing all additional financial 0 a� support necessary to provide the soccer programs to be provided hereunder. 0 a� a� 14.3. The TOWN will authorize the use of the Airport Drive Soccer Fields by the m WUSC for one summer camp program. All proceeds from the camp will be paid to WUSC and C E m will be used to financially subsidize the soccer program authorized by this Agreement. The TOWN a� Q shall not charge any fee for the use of the Airport Drive Soccer Fields for this camp. Q O 15. Non-Discrimination. The WUSC will not discriminate because of race, color, o national origin, ancestry, or religion. WUSC will commit to being a safe and civil environment for K W all players, coaches, staff,volunteers,referees, and patrons, free from harassment, intimidation, or Lo M N bullying. The program shall be open to all youths who have a permanent residence within the CD U) W Town of Wappinger, including the Village of Wappingers Falls, who are between the ages of 3 U and 18. 0 0 16. Independent Contractor. The parties hereby agree that WUSC is hereby deemed v a� U U an "independent contractor" and shall not be considered an employee or agent of the Town of a� Wappinger. L 17. Non-Assignment. This Agreement may not be assigned. .Q Q 18. Authorization. Each party, by execution of this Agreement, represents that it has M duly obtained the authorization of its governing body to enter into this Agreement.
