RESOLUTION: 2023-72 Resolution Authorizing The Settlement Of Tax Certiorari Proceedings Regarding Krivas Executive Park, LLC WHEREAS, there is now pending in the Dutchess County Supreme Court tax certiorari proceedings commenced in 2021 and 2022 by Krivas Executive Park, LLC, regarding a parcel of real property located at 1207 Route 9 in the Town of Wappinger, Tax Grid # 6157-04-582220, seeking a reduction in the 2021 and 2022 tax assessment for those respective tax rolls; and WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of these tax review proceedings; and WHEREAS, the petitioner has agreed to waive any refund of Town taxes, including Special District taxes, for the aforementioned years as part of a negotiated settlement; now, therefore be it RESOLVED, that the Town Board of the Town of Wappinger hereby approves a settlement on behalf of the Town of Wappinger of the tax review proceedings for the years 2021 and 2022, as it pertains to: 121 17 Route 9, Tax Grid # 6157-04-582220 ASSESSMENT ASSESSMENT REDUCED ASSESSMENT AMOUNT OF ROLL REDUCTION 2021 $2,782,500 $2,500,000 $282,500 2022 $2,921,600 $2,500,000 $421,600 As part of the negotiated settlement, the assessment will be valued at $2,300,000 for 2023, 2024 and 2025. RESOLUTION: 2023-73 Resolution Setting Storage Fees For Vehicles WHEREAS, from time to time the Town of Wappinger may come into possession of private vehicles during the execution of Town functions; and WHEREAS, in some instances the Town must act as a bailee of the vehicles and must store them in a secure location, such as the Town Highway Garage; and WHEREAS, when the Town acts as a bailee it incurs the cost of insurance, inspection and other security expenses which should be recovered by means of a storage charge imposed upon the owner at the time of the redemption of the vehicle; NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby determines that a reasonable storage fee for a vehicle is $50.00 per day for each day, or part of a day, that the vehicle is in possession of the Town; and BE IT FURTHER RESOLVED that the storage fee is due and payable at the time of redemption of the vehicle and such payment shall be made by bank check, money order or electronic funds transfer. RESOLUTION: 2023-74 In the Matter of The Increase and Improvement of the Facilities of the United Wappinger Sewer District in the Town of Wappinger, Dutchess County, New York Town of Wappinger Page 4 Printed 6/8/2023 Regular Meeting Minutes May 22, 2023 WHEREAS, the Town Board of the Town of Wappinger, Dutchess County, New York, directed the Engineers to the Town to prepare a a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of the United Wappinger Sewer District, in the Town of Wappinger, Dutchess County, New York (the "Sewer District"), being the upgrade of the sludge digestion facilities at the Tri Municipal Sewer Treatment Plant, including incidental improvements and expenses in connection therewith, at a maximum estimated cost of $722,279.94; and WHEREAS, the Town Board duly adopted a resolution on May 8, 2023, calling a public hearing to consider said proposed increase and improvement and estimate of expense, to be held at Town Hall, 20 Middlebush Road, in Wappingers Falls, New York, in said Town, on the 22 day of May, 2023, at 7:00 o'clock, Eastern Daylight Saving Time; and WHEREAS, notice of said public hearing was duly published and posted in the manner provided by law and proof thereof has been submitted to said Town Board; and WHEREAS, said public hearing was duly held at the time and place aforesaid, at which all persons interested were duly heard; and WHEREAS, said Town Board has duly considered all of the evidence given at such public hearing; NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: 1. Male Associates dated February 15, 2023, and the Town Board finds that it complies with the requirements of Article 12 of the Town Law; and WHEREAS, the Tri -Municipal Sewer Commission and the Town of Wappinger has applied for certain grants in aid to reduce the costs of construction; and WHEREAS, the Town Board determines that the capital project is a Type II Action pursuant to 6 NYCRR § 617.5(c)(2) as it is the replacement, rehabilitation or reconstruction of facility, in kind, on the same site and as such is not subject to review under the State Environmental Quality Review Act ("SEQRA"); and WHEREAS, it is now desired to call a public hearing on the question of the increase and improvement of the facilities of said Sewer District, in the matter described above, and to hear all persons interested in the subject thereof, concerning the same, in accordance with the provisions of Section 202-b of the Town Law; NOW, THEREFORE, IT IS HEREBY ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: 1. (SMC), for the purposes of assisting the Town in complying with its MS -4 requirements including the preparation of the annual MS4 Report; and WHEREAS, SMC has prepared the Annual Report for the period covering March 10, 2022 through March 9, 2023 and has been submitted it to the Town of Wappinger for its approval and endorsement; and WHEREAS, Walter R. MALE ASSOCIATES 1.0 INTRODUCTION 1.1 Summary The Tri -Municipal Sewer Commission (Commission) owns and operates a publicly owned Wastewater Treatment Plant (WWTP). The WWTP treats domestic and industrial wastewater from the Village of Wappingers Falls, Town of Wappinger, and Town of Poughkeepsie. For the purpose of improving the sludge digestion process at the WWTP, a Map, Plan and Report (Report) has been prepared to present the general plan, capital costs, method of financing, and first year operating costs of the proposed project. This report documents the need for the project and the costs. The following items are documented in this report: • Identifies and describes the proposed sludge digestor improvements • Documents the municipalities' percent allocation for the work. • Documents the estimated capital and operational costs 1.2 Project Need The Commission has identified the need to improve their sludge digestion. Reportedly, there has been an increase in the odors generated by the sludge produced at the WWTP. The sludge is processed on site, mixed with wood chips, and composted. Our understanding is that the compost may also be generating odors. 2.0 DESCRIPTION OF THE IMPROVEMENTS 2.1 Existing WWTP The WWTP was completed in the mid-1980s and is located in Dutchess County, New York. See Figure 1 for a Location Map. The WWTP receives and treats approximately 2.0 million gallon per day (MGD) of wastewater from the Town of Wappinger, Village of Wappingers Falls, and the Town of Poughkeepsie. The WWTP is permitted by the New York State Department of Environmental Conservation (DEC) to treat flows up to 2.775 MGD. Each of the three municipalities is allocated a portion of the 2.775 MGD. -1- C.T. MALE ASSOCIATES The Town of Wappinger is allocated 1.375 MGD. The Town has a population of 33,523 and has a land area of 28.6 square miles. Only a portion of the Town is tributary to the WWTP. The Village of Wappingers Falls is allocated 1.000 MGD. The Village has a population of 5,522 and a land area of 1.2 square miles. The entire Village is tributary to the WWTP. The Town of Poughkeepsie is allocated 0.400 MGD. The Town has a population of 44,090 and a land area of 31.2 square miles. Only a portion of the Town is tributary to the WWTP. The capital costs for the project are to be shared by all three municipalities based on their allocated flow percentages. Operation and maintenance costs are to be shared by the municipalities based on their actual metered flow. 2.2 Aerobic Sludge Digestion Process A typical sludge digestion process consists of sludge digester tanks, process air piping, diffusers, and blowers. Primary and waste activated sludge is dewatered and sent to the digester tank(s). Initially in the aerobic sludge digestion process, a maximum capacity of air is provided to the digester tanks to provide oxygen for the oxidation of cell tissue to carbon dioxide, water, and ammonia. The maximum capacity of air is supplied continuously over time to provide the oxygen requirements to oxidize ammonia to nitrate, the nitrification process. During the nitrification process, the pH of the sludge decreases due to the increase in acidity from an increase of hydrogen ions. pH must be closely monitored during aerobic digestion because biomass organisms favorable to aerobic sludge digestion process are depleted when pH drops below 6.0. When pH drops below 6.3, process air should be decreased or eliminated to allow for denitrification process, which will raise the pH level to acceptable levels. Once the pH levels rise to acceptable levels, maximum air is then re -introduced. This cycle is continuously repeated to provide reasonable sludge digestion. Malodorous conditions occur if the amount of process air is limited and does not allow the nitrification of ammonia or if too much air is introduced during the denitrification process which depletes the biomass organisms favorable to aerobic sludge digestion process. -2- C.T. MALE ASSOCIATES An aerobic sludge digestion process requires proper amounts of air as well as constant process monitoring and control. 2.3 Existing Sludge Digesters The Tri -Municipal Wastewater Treatment Plant aerobic sludge digestion system consists of four below grade concrete tanks, process air piping, diffusers, and two blowers. The process air for oxygen requirements is provided by the two blowers. Several deficiencies have been identified in the sludge digestion process at the WWTP that are the focus of the improvements described herein are: • The two existing blowers do not have sufficient air capacity to satisfy the theoretical oxygen required for oxidation or the requirements for sufficient mixing and redundancy as specified by Recommended Standards for Wastewater Facilities - 2014. • The sludge digestion process air is manually energized and de -energized and there is no ability to individually control the air flow to respective tanks. • The process cannot be monitored or manually controlled during overnight hours. The aeration piping external to the tanks has been in service for 30 to 40 years and is nearing the end of its reliable service life. The tanks' internal piping has been in service for 30 years and nearing the end of its reliable service life. Tank air diffusers have been replaced over time and as required. The two existing blowers have been in continuous service for approximately five years and are in good condition. 2.4 Proposed Upgrades to Digesters There are several improvements intended to resolve the deficiencies in the sludge digestion process at the WWTP. • Two additional blowers will be installed to provide the air supply requirements with the largest blower out of service. The two additional blowers will provide the air capacity to satisfy the oxygen demands required for oxidation and mixing. • Distribution piping will be replaced and configured to replace aging piping and to provide process air flow control to each tank, respectively. BIB C.T. MALE ASSOCIATES • Instrumentation and control devices will be provided to properly monitor and control the process. This will allow the operator to maintain acceptable levels of pH ensuring proper oxidation, nitrification, and denitrification. These improvements will bring the system into compliance with Recommended Standards for Wastewater Facilities - 2014 and provide the operator more control over the sludge digestion process. 3.0 PROJECT COST OPINIONS 3.1 Description The project cost opinions consist of two main components, capital cost and operation and maintenance cost. The capital cost is the projected cost to design and build the improvements at the existing Tri -Municipal Wastewater Treatment Plant. The operation and maintenance cost is the annual cost to keep the aerobic sludge digestion system functional and well maintained. 3.2 Capital Cost The opinion of probable cost presented in Table 1 below is based on a summation of itemized tasks of labor, equipment, and material required to provide the improvements in the Mid -Hudson Region based on prevailing wage rates. MALE ASSOCIATES The capital cost of approximately $1.31 million assumes the project will be constructed in 2023, and includes all engineering, construction administration and legal costs, plus a contingency based upon the conceptual level of the current plans. Pursuant to the existing agreements, the costs for the sludge digestion improvements at the Tri -Municipal Wastewater Treatment Plant are to be shared by the United Wappinger Sewer District (UWSD), the Village of Wappinger Falls (VWF) and the Town of Poughkeepsie (TOP). The breakdown in allocated flow for each municipality is as follows: • United Wappinger Sewer District Percent Allocation 49.55% • Village of Wappinger Falls Percent Allocation 36.04% • Town of Poughkeepsie Percent Allocation 14.41% The capital cost for each municipality, based on the above opinion of cost, is as follows: • United Wappinger Sewer District Percent Allocation $670,252 • Village of Wappinger Falls Percent Allocation $487,505 • Town of Poughkeepsie Percent Allocation $194,921 Assuming the capital cost will be fully bonded with a traditional municipal bond over a 30 -year period, at 4.25%, the result would be an annual bond payment of $79,859. (SMC), for the purposes of assisting the Town in complying with its MS -4 requirements including the preparation of the annual MS4 Report; and WHEREAS, SMC has prepared the Annual Report for the period covering March 10, 2022 through March 9, 2023 and has been submitted it to the Town of Wappinger for its approval and endorsement; and WHEREAS, Walter R. Arcus, CPESC, CMS4S of SMC, has fully explained the contents and details of the MS -4 Annual Report and answered all questions presented by the Town Board at a duly convened meeting of the Town Board; NOW, THEREFORE, BE IT RESOLVED: 1. The Town Board has reviewed the MS4 Annual Report for the period of March 10, 2022 through March 9, 2023 and after due deliberation, hereby accepts the MS4 Annual Report and authorizes and directs the Supervisor to execute the certification on behalf of the Town of Wappinger. 2. The Town Board directs the Town Supervisor and SMC to file the MS -4 Annual Report with the New York State Department of Environmental Conservation. 3. The Town Board further directs that a copy of the MS -4 Annual Report shall be filed in the Town Clerk's Office where it shall be available for public inspection and that an electronic copy of the Report shall be posted on the Town of Wappinger website.
