LL #07-1999LOCAL LAW # 7 OF THE YEAR 1999 A Local Law entitled "Local Law Amending Local Law #6 of the Year 1995 Enacting Regulations on Flood Damage Prevention". BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title. This Local Law should be known and cited as Town of Wappinger Local Law # 7 of the Year 1999 entitled "Local Law Amending Local Law #6 of the Year 1995, Enacting Regulations on Flood Damage Prevention", and shall reference the revised Flood Insurance Rate map completed by the Federal Emergency Management Agency. Section II: Revision of Flood Insurance Rate Map Reference. Section 3.2 of Local #6 of the Year 1995, a "Local Law Enacting Regulations on Flood Damage Prevention" is amended and shall read as follows: "3.2 BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD The areas of special flood hazard are identified and defined on the following documents prepared by the Federal Emergency Management Agency: (1) Flood Insurance Rape Map (multiple panels) Index No. 361387 0001-0007, whose effective date is September 22, 1999. (2) A scientific and engineering report entitled "Flood Insurance Study, Town of Wappinger, New York, Dutchess County" dated September 22, 1999. The above documents are hereby adopted and declared to be a part of this Local Law. The Flood Insurance Study and/or maps are on file at: Town Clerk's Office, Town Hall, 20 Middlebush Road, Wappingers Falls, New York 12590." Section III: Separability: The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom. Section IV: Effective Date. This Local Law shall become effective immediately upon filing with the Secretary of State as prescribed by law. 2 i
