LL #08-1999LOCAL LAW # 8 OF THE YEAR 1999 A Local Law entitled "Local Law Amending Sections 230-46, 230-47, and 230-48 of the Code of the Town of Wappinger, to prohibit parking, stopping or standing on both sides of Myers Comers Road from its intersection with All Angles Hill Road to its intersection with Brothers Road." BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: This Local Law shall be known and cited as Town of Wappinger Local Law #__ of 1999, an&entitled "Local Law Amending Sections 230-46, 230-47, and 230-48 of the Code of the Town of Wappinger, to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection with All Angles Hill Road to its intersection with Brothers Road." Section II: Legislative Intent: It is the determination of the Town Board of the Town of Wappinger that the portion of Myers Comers Road from its intersection with All Angels Hill Road to its intersection with Brothers Road has become extremely congested with traffic. This portion of Myers Corners Road contains a firehouse, a Grange Meeting Hall, a church, a gasoline service station, an office complex, used car dealership and a small strip shopping center. The Town Board further determines that given the traffic volume along this section of Myers Comers Road, parked, stopped or standing vehicles present a significant threat to the safety of motorists, the traveling public and pedestrians in this area. Accordingly, it is the express determination of the Town Board that in the interest of the public health, safety and welfare of the residents of the Town of Wappinger to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection with All Angels Hill Road to its intersection with Brothers Road. -1- I Section III: Parking Prohibited: Section 230-46 entitled "Schedule XII: Parking Prohibited at All Times" is hereby amended by including, in alphabetical order, the following portion of Myers Corners Road to said "Schedule XII: Parking Prohibited at All Times" as follows: Name of Street Side Location Myers Comers Road Both From its intersection with All Angels Hill Road to its intersection with Brothers Road Section IV: No Stopping: Section 230-47 entitled "Schedule XIII: No Stopping" is hereby amended by including, in alphabetical order, the following portion of Myers Corners Road to said "Schedule XIII: No Stopping", as follows: Name of Street Side Location Myers Comers Road Both From its intersection with All Angels Hill Road to its intersection with Brothers Road Section V: No Standing: Section 230-48 entitled "Schedule XIV: No Standing" is hereby amended by including, in alphabetical order, the following portion of Myers Comers Road to said "Schedule XIV: No Standing", as follows: Name of Street Side Location Myers Comers Road Both From its intersection with All Angels Hill Road to its intersection with Brothers Road -2- I � I Section VI: Separability. The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable, had been specifically exempt therefrom. Section VII: Ratification: Except as amended by these additions to Sections 230-46, 230-47 and 230-48, the Code of the Town of Wappinger is hereby ratified, confirmed and readopted. ' Section Vlll: Effective Date. This Local Law shall take effect immediately upon adoption and filing with the Secretary of State as provided by the Municipal Home Rule Law. -3-
