LL #09-1999LOCAL LAW # 9 OF THE YEAR 1999 A Local Law entitled "Local Law Amending Section 175-12 of the Code of the Town of Wappinger, `Restrictions', applicable to Hawkers and Peddlers in the Town of Wappinger". BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: "Local Law Amending Section 175-12 of the Code of the Town of Wappinger. `Restrictions', applicable to Hawkers and Peddlers in the Town of Wappinger" This Local Law shall be known and cited as Local Law No. #9 of 1999, entitled "Local Law Amending Section 175-12 of the Code of the Town of Wappinger, `Restrictions', applicable to Hawkers and Peddlers in the Town of Wappinger" which shall amend the present Section 175-12 as set forth below. Section II: Legislative Intent: The Town Board has determined that some of the existing restrictions imposed on licensed hawkers and peddlers in the Town of Wappinger as set forth in the Code of the Town of Wappinger at Section 175-12, are no longer required in order to promote the best interests of the Town's residents. It is the determination of the Town Board that the existing restrictions, requiring that hawkers and peddlers move after one (1) hour in a given location, result in the presence of hawking and peddling activities in a greater number of locations than would otherwise be the case. To the extent that hawkers and peddlers are otherwise in compliance with the restrictions on the location of their activities, -it is the determination of the Town Board that the Town's residents are best served by allowing such hawkers and peddlers to remain in a single location. Section III: Deletion Section 175-12 of the Code of the Town of Wappinger is hereby amended by deleting in its entirety following text, Section 175-12 A.(4): -1- "No licensee shall, while engaged in the activity for which a license was issued pursuant to this chapter, stand or allow or permit the vehicle used in such licensed activity to stand in any one location for more than one hour. After one hour in any one location, the licensee shall move said vehicle a distance of not less than 1,000 feet form such location and shall not return to same location more than twice in one day. This restriction shall not apply to licensees who are participating in a one -day or two-day special event authorized by the Town Board." Section IV: Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their application to other persons or circumstances. It is hereby declared to be the legislative intent of the Board of the Town of Wappinger that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable, had been specifically exempt therefrom. Section V: Ratification. Except as amended by this Local Law, the Code of the Town of Wappinger, as amended, is hereby ratified, confirmed and readopted. Section VI: Effective Date. This Local Law shall take effect immediately upon adoption and filing with the Secretary of State as provided by the Municipal Home Rule Law. -2-
