Resolution Denying Moratorium Hardship Waiver
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on October
15, 2008.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being
called, the following were present:

Maureen McCarthy (arrived at 7:11 PM)
Joseph P. Paoloni (arrived at 7:07 PM)
The following Resolution was introduced by Councilman Paoloni and seconded by
Councilwoman McCarthy.
WHEREAS, Brooks Real Estate Development, on behalf of the Homestead Farms
Subdivision, has made application to the Town Board to be exempted from the provisions of the
Town Wide Moratorium on Residential Development; and
WHEREAS, the Town Board conducted a Public Hearing on September 22, 2008; and
WHEREAS, Brooks Real Estate Development made a presentation to the Town Board in
support of the application; and
WHEREAS, the Town Board heard the presentation and all evidence submitted on
behalf of Homestead Farms Subdivision; and
WHEREAS, the Town Board determined that the evidence presented was insufficient to
establish a hardship on the part of the applicant; and
WHEREAS, the Town Board adopted a verbal motion to deny the application; and
WHEREAS, the Town Board wishes to formalize the denial of the application by written
resolution
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby confirms that the application of Brooks Real Estate
Development on behalf of the Homestead Farms Subdivision, for exemption from the provisions
of the Town Wide Moratorium on Residential Development, was denied on the basis that the
applicant had failed to establish hardship.
The foregoing was put to a vote which resulted as follows:
