Resolution Authorizing Solicitation of Bids for the Repaving of Roads and Repair of Curbs
in the Rockingham Farms Subdivision Section 1 & 2
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on May 4,
2009.
The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Paoloni.
WHEREAS, by Resolution adopted on May 27, 2003, subject to Permissive
Referendum, the Town Board authorized the issuance of serial bonds in an amount not to exceed
$3,300,000.00 to pay the costs of paving, repaving or resurfacing of various Town roads
including repair to related curbing where appropriate; and
WHEREAS, the time in which a Petition for Permissive Referendum to be filed has
expired, and the Notice of Estoppel has been published; and
WHEREAS, Morris Associates Engineering Consultants, PLLC, Engineer to the Town,
has prepared a written report dated April 29, 2009, addressed to the Town Board, identifying the
scope of work for the repaving of roads and the repair of curbs in the Rockingham Farms
Subdivision Sections 1 and 2; and
WHEREAS, a copy of the April 29, 2009 report is affixed to this Resolution and made a
part hereof, marked and designated as Exhibit "1"; and
WHEREAS, the Town Board seeks to undertake the repaving of roads and the repair of
curbs as identified in the aforementioned report and hereby authorizes, Morris Associates
Engineering Consultants, PLLC, to prepare contract documents and bid specifications for the
purpose of soliciting competitive bids for the work identified in the report dated April 29, 2009;
and
WHEREAS, the Town Board determines that the repair of curbs in Rockingham Farms
is a Type II action pursuant to 6 NYCRR 617.5(c)(20) and is otherwise exempt from
environmental review pursuant to the New York State Environmental Quality Review Act
(SEQRA) and pursuant to Local Law No. 6 of 1992, and, accordingly, no environmental review
is required.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby accepts, confirms and adopts the scope of work to repave
portions of the roads and to repair portions of the curbs in the Rockingham Farms
Subdivision Sections 1 and 2, as described in the report prepared by Morris
Associates Engineering Consultants, PLLC, dated April 29, 2009, a copy of
which is attached hereto as Exhibit "1".
3. The Town Supervisor is authorized to issue serial bonds, pursuant to Bond
Resolution 2003-145, in an amount not to exceed $210,000.00 for the curb repairs
as outlined in the amended report from Bob Gray.
4. Morris Associates is directed to promptly prepare bid specifications, contract
documents, and advertise the same for competitive bidding pursuant to General
Municipal Law § 103, and the codes, rules and regulations of the Town of
Wappinger, and to report to the Town Board the results of such bidding.
5. The Town Board will award the bid to the lowest responsible bidder, subject to a
reservation of rights by the Town Board to reject any and all bids.
6. Douglas Goodfriend, Bond. Counsel to the Town of Wappinger, and Albert P.
Roberts, Attorney to the Town of Wappinger, are authorized to undertake any
legal work necessary to implement the provisions of this Resolution, including
such work as necessary to issue the serial bonds necessary to pay for all costs
associated with the work to be done pursuant to this Resolution.
The foregoing was put to a vote which resulted as follows:

RE: Rockingham Farms — Section I & II
Dear Supervisor Colsey and Town Board Members:
The existing concrete curb in the Rockingham Farms Subdivision was installed
by the original developer approximately 30 years ago. In many areas, the curb has
deteriorated and in some areas has been worn down or broken off to be flush with the
pavement. It is these areas where the curb has deteriorated to be even with the
pavement that have been determined to be the most in need of replacement.
This report is to present our recommendation for a scope of work as to curb
replacement in the Rockingham Farms Subdivision. The chart in this report provides a
street by street inventory of curbing noted to be most in need of replacement and the
amount of curb recommended for replacement. Maps are also provided to show the
areas of replacement. Mr. Graham Foster, Superintendent of Highways, has been
consulted in preparing this recommendation and agrees with the proposal.
This proposal is to replace the existing concrete curb with new cast -in-place or
"slip formed" concrete curb. In most areas, the curb will be installed with a 4" curb
reveal rather than a conventional 6" reveal to keep disturbance to yards at a minimum
and to more closely match the existing curb reveal. In discussions with the Highway
Superintendent, it was decided that future paving on these roads would involve milling
of 4" of pavement prior to a 2" layer of new pavement resulting in a 6" curb reveal.
The replacement of the curb will be accomplished by the following steps:
• Saw cutting the existing pavement approximately 24" out from the face of
the existing curb.
• Removal of the existing pavement material to a depth sufficient
(Approximately 12" —18") to remove the existing concrete curb.

• Disposal of all existing excavated material, pavement, subbase and
concrete curb to a location to be determined by the contractor.
• Installation of new poured -in-place or slipped formed concrete curbs
meeting New York State Department of Transportation specifications. The
poured -in-place concrete curb installation would be used in areas where
short sections of curb replacement are proposed.
• Restoration of the road subbase and pavement meeting Town of
Wappinger Highway Specifications in the areas of the newly installed curb.
• Restoration of the backside of the curbs with topsoil, seed and mulch and
driveways as necessary.
Four contractors in the area were solicited for an estimate for this type of curb
replacement to verify current bid prices for this work. Prices received ranged from $46
to $65 per lineal foot. This range of pricing verifies that $59.65 per lineal foot estimated
by Morris Associates on March 9, 2009 is a suitable cost for budgeting purposes.
Actual costs will be determined when the project is let out for bid. Bid prices will
fluctuate due to market conditions. It has not been determined how much work in the
market place will be generated by the government's economic stimulus package.
The total length of curb recommended for replacement is 2,605 feet at a cost
estimated to be $155,388.25. As has been customary in town projects in the past, a
25% factor for contingencies, legal, engineering and inspection/contract administration
results in a project cost of $194,235.25. It should be noted that legal, engineering and
inspection/contract administration would be billed hourly.
The water service connections in Rockingham are deteriorating and are replaced
by CAMO Pollution Control, Town Water and Sewer Operator, when leaks develop.
We recommend that the service connections, not already replaced, be replaced
in the areas where curbs are re -built.

As mentioned, the above Table A shows the areas of curb replacement. You will
note in the chart, that length of curb to be replaced is in most cases larger than the
length of curb missing. In general, where a short area of curb is missing, it was
determined to replace all curbing between adjoining driveways on both sides of the
deteriorated curb. In two other areas, the cul-de-sac end of Carroll Drive and James
Place, longer runs of curb replacement are recommended to avoid smaller repairs in
several places.
