SNOWDEN In accordance with the provisions of General Municipal Law (Article 12B, Sections 239-1 and 239-m), the Dutchess County Department of Planning has reviewed subject referral with regard to pertinent inter -community and county -wide considerations. Upon field investi- gation and analysis, this Department makes the following findings: There are a series of proposed amendments to the Town Zoning Ordinance. These amendments propose the following changes: I. A zoning change from R-20 to Neighborhood Business is proposed for a nine -acre parcel of land near the intersection of Route 82 and All Angels Road. Part of this land is within the 100 year flood boundary, according to the Flood Insurance Rate map. 2. A change of zoning is proposed from R-40 to General Business for a parcel of 'land located at the intersection of Route 376 and Hackensack Heights Road. This lot is adjacent to an existing General Business zone. 3. An amendment to the schedule of regulations would provide for a uniform front yard setback along County and state roads. 4. Principal permitted uses in Shopping Center districts would be allowed multiple attached or detached uses, according to another proposed element. 5. Off-street parking regulations would be amended to include specific regulations for residential off-street parking. 81-28, Town of Wappinger Page 2 Recommendation The Dutchess County Department of Planning recommends that the decisions on these proposed amendments be based upon local study of the facts. Consideration, however, should be given to limiting the intensity or extent of development for the parcel near the Route 82/All Angels Road intersection. The 100 year flood boundary provides natural constraints on the use of this property. The Dutchess County Department of Planning does not presume to base its decision on the legalities or illegalities of the facts or procedures enumerated in subject zoning action. Bazley Located - Route #376 @ New Hackensack Heights Road #19-6259-04-536229-00 I recently learned my above -captioned property has been re -zoned from commercial to R-40. This re -zoning is causing me considerable hardship. Up until two years ago I ran a business from this address. At the time of purchase, and up until recently, this property was zoned commercial. At the present time, I am a widow, have two teen-age boys, and a 74 year old father, and we all use this property as our residence. However, I wish to sell the property because I can no longer afford to live there, but find it unlikely to be salable as I am surrounded by commercial property. I cannot offer it for sale as commercial since it has been re -zoned. I not only cannot afford to live there, but it is not a desirable location for a "home". I purchased this as a business venture.
