UntitledPLEASE TAKE NOTICE that the following Ordinance for Administering and Enforcing the State Building Construction Code was adoptrel by the Town Board of the Town of Wappinger at the Regular Meeting held March 13, 1978. The following Ordinance was introduced by Councilman Jensen who moved its adoption: WHEREAS on May 12, 1960 the Town Board of the Town of Wappinger duly enacted the Town of Wappinger Ordinance for Administering and Enforcing the State Building Construction Code, and - WHEREAS the Town Board of the Town of Wappinger does hereby enact and ordain as follows: SECTION 1. Section 10 of the Town Building Code is modified by adding thereto subparagraph (c) as follows: No construction of any portion of a building other than the construction of a foundation shall continence until the owner has first submitted to the building inspector an "as built" certified plot plan showing the "as built" foundation location on the plot of land for which the building permit has been issued. Such plan shall show that such foundation is situated and located within the minimum sideyard setback requirements and shall indicate that location of the foundation conforms to the "proposed construction" plot plan previously submitted or conforms to variations therefrom previously approved by the building inspector as the result of field inspection. The provisions of this subparagraph shall only apply to those foundations which are situated within three (3) feet of the minimum sideyard setback requirements as pre- scribed under the zoning ordinance or to any permit issued pursuant to a variance granted thereunder. SECTION 2. Section 15 of the Town Building Code is me lified b— the addlti.on i..hereco of subparagraph (a) which provides as follows: No certificate of occupancy shall be issued mo ? --d by the addition i.:hereco of subparagraph (d) w-1 icn provides as follows: No certificate of occupancy shall be issued for any residential building unless prior installation of footing drains has been completed and said drains have been previously approved in writing by the building inspector. The building inspector is authorized to waive the installation of footing drains in those circumstances where, in his sole discretion, he determines the same not to be necessary. I, GLADYS RUIT, Deputy Town Clerk of the Town of Wappinger, Dutchess County, New York do hereby certify that the foregoing Ordinance was duly adopted at the Regular Meeting held March 13, 1978, at which time a 4uorum was present and participated throughout and that the same has not been in any manner rescinded or annuled and that the same is still in force and effect and is duly entered in the minutes of said meeting.
