County, New York, do hereby certify that the foregoing Ordinance
was duly adopted at the Regular Meeting held May 8, 1972 at which
time a quorum was present and participated throughout, and that
the same has not been in any manner rescinded or annuled and the
same is still in force and effect and is duly entered in the minutes
of this meeting.

ORDINANCE OF THE TOWN OF WAPPINGER
The following ordinance was introduced by Councilman

BE IT RESOLVED AND ORDAINED by the Town Board of the Town
of Wappinger, Dutchess County, New York, pursuant to laws of t:e
State of New York, that the Town of Wappinger Zoning Ordin,..ve
adopted January 29, 1963, as amended from time to time, -.areby
further amended as follows:

Section 1.
Section 412.02 is hereby zemended to read as follows:

"Section 412.02 Subject to the approval of the P:.--:.--�-.
Board in its subdivision review, develcp.ment in any RD --1,
or R-40 districts may take place at the minimum lot sizes
and dimensions permitted in the next less restrictive dis-
trict, provided that public or community water and sewer
facilities systems, meeting the requirementz of the Dutchess
County Department. of Health and the New York State Departr,,;::.t
of Health are provided by the developer at no expense .o
Town, except that in no area shall these minimum lot _-_J-_C-
and
_J -_C- r,and dimensions be less than those prescribed in the
restrictive residential district. Before taking act -c.:

Be it ordained by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
The Zoning Ordinance of the Town of Wappinger adopted
January 29, 1963, and as amended from time to time is hereby
further amended as follows:
Section 1: Section 412.02 is hereby repealed.
Section 2: This amendment shall take effect immediately
except that the same shall not be applicable to subdivision
plats which have received preliminary approval by the Town of
Wappinger Planning Board as of the date of the introduction of
this Ordinance.
