Re; Proposed new go-kart ordinance
As attorney for Kart -O -Rama, Inc., we should first like to
state that we appreciate the courtesy of an opportunity to
express our views at the public meeting held on the evening
of October 2.4, 1961.

Although there were not a great number in attendance, it was
apparent that both sides weir -vociferous and strangely enough
in agreement in essence with most of the propositions of the
proposed ordinance.
In all fairness, however, it would seem reasonable and fair
that the members of the council take advantage of the offer
made in good faith by our client, that is, to be present
physically at a demonstration of the operation Go -Kart,
properly muffled, the time to be fixed at the convenience of
the Board. We feel that having observed yourselves, you
would be in a better position to act accordingly.
We feel also, that our final request to allow the operation
of the corporation during summer vacations and other school
holidays five nights only a week (instead of the two nights
permitted in the present ordinance) is a most reasonable re-
quest.
The fact that our client is in agreement that there should be
a town -wide regulation against the wrongful use of the Go -Kart
and the abuse of the use should be given weighty consideration.
If they violate the ordinances passed, they would be subject
to the penalties imposed,so certainly this should be a stuong

regulatory control. On the other hand, to restrict them with-
out regard to daylight saving or standard time, and with the
hours as proposed, is not fair or reasonable and would make
any operation an economic burden, which we do not believe it
is the intention of the Board to cause our clients or other
Go -Kart enthusiasts, of which there are many hundreds as
indicated by the sale of Go -Karts and the use of the facilities
which were available throughout the town.
We urge, therefore, that in the event the Board does not wish
to take advantage of the offer to observe themselves, and does
plan to act on this measure, that they do consider amending
the proposed ordinance so as to allow the use as set forth
in the present ordinance for five nights a week (not including
Sunday night) during summer vacations or other school vacations
and holidays and in that respect, there is no objection to
the ordinance.

We the undersigned hereby depose that on October 15, 1961,
between the hours of 3:00 to 5:00 p. m. , we took sound. recordings of the
"Go -Karts" being operated on a "Go -Kart" track on the property of
Mr. A. Centorani. Such property is located on Route 376, Town of
Wappingers, approximately 1 1/4 miles east of the entrance to the
Dutchess County Airport.
These readings were taken on the west line of the property of
Mr. Henry S. Hansen, Jr. approximately 150 feet east of the "Go -Kart"
track. At the time the readings were taken, two vehicles were in inter-
mittent operation around the track. This number of vehicles is less
than the number normally operating on the track.
The sound readings were recorded with a Sound Level Meter
manufactured by Weston Instrument Company. The peak sound level
ranged between 70 and 80 decibels.
