UntitledAT A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF WAPPINGER ON JUNE 15, 1978 WHEREAS, a motion was made at a prior meeting of the Town Board of the Town of Wappinger that the attached amendment to the zoning map be introduced and that a public hearing be held thereon, and WHEREAS pursuant to Section 239-m of the General Municipal Law, the proposed amendment to the map was referred to the Dutchess County Planning Department, and WHEREAS by letter dated the 13th day of June, 1978 the Dutchess County Planning Department has recommended disapproval of the amendment, and WHEREAS a motion has been made that the zoning map be amended as provided in the attached resolution, NOW, THEREFORE, BE IT RESOLVED that the zoning map amendment as attached hereto be and is hereby adopted, and BE IT FURTHER RESOLVED that pursuant to the provision of General Municipal Law Section 239-m approval to the said amendment is granted for the following reasons: ONE: That the land proposed to be rezoned is contiguous to lands presently zoned for shopping center use but which have not yet been developed for such use. TWO: That the land rezoned is presently zoned for commercial uses, and the rezoning will be consistent with the said use and permit multiple commercial use on one parcel. THREE: That the land rezoned is situated on heavily travelled traffic arteries and is well located for such use. FOUR: That the land rezoned has remained undeveloped for many years and there are indications that the rezoning will lead to immediate development thereby improving the economic and tax base of the town. FIVE: That the land rezoned will facilitate development of shopping centers, none of which are located within the town presently. SIX: That notwithstanding the large suburban population of the town, inadequate provision has been made on the town zoning map for multi -unit commercial development on a single 4wof land. SEVEN: That the land rezoned is within a heavily developed commercial zone and rezoning will not have an adverse effect on surrounding lands. EIGHT: That the rezoning will concentrate shopping center use in existing high intensity commercial areas. Section Two: This ordinance shall take effect upon adoption, posting and publication. To: Town Board Referral: 78-106 Town of Wappinger Re: Minimum Lot Area - Shopping Center District RECEIVED JUN 1 4 1978 ELAINE H. SNOWDEN In accordance with the provisions of General Municipal Law (Article 12B, Sections 239-1 and 239-m), the Dutchess County Department of Planning has reviewed subject referral with regard to pertinent inter -community and county wide considerations. Upon analysis, this Department makes the following findings: General Information and Analysis Subject proposal is a zoning amendment of the minimum lot area for the Shopping Center Business Zone from the existing thirty (30) acre minimum to a proposed minimum lot area requirement of ten (10) acres. This proposal would affect all land in the Shopping Center Zone. This in- cludes land on the eat side of Route 9, south of Myers Corners Road, as well as any land rezoned to Shopping Center Business. This amendment of the minimum lot area represents a fundamental change in the type of shopping center that would be permitted. According to the Communit, Builders Handbook, published by the Urban Land Institute, the thirty (30) acre requirement would allow regional shopping centers. Re- gional shopping centers generally include at least one major department store as well as a variety of smaller retail outlets. A ten (10) acre re- quirement would allow community type shopping centers, which generally have a variety or junior department store as the main tenant. The subject proposal of a ten (10) acre minimum lot area thus would allow more smaller shopping centers in the Shopping Center District. Recommendation In view of the aboe findings, this Department recommends that this amend- ment of the minimum lot area for the Shopping Center District be disapproved. Additional shopping centers of the community type would be competing with existing centers north of the Town's Shopping Center District. The existing economic base of the community could be eroded by additional shopping centers of this type. -1- L Town Board -2- June 13, 1978 The Dutchess County Department of Planning does not presume to base its decision on the legalities or illegalities of the facts or procedures enumerated in subject zoning action.
