2003-217RESOLUTION NO. 2003-217 RESOLUTION AUTHORIZING THE EXECUTION OF THE AGREEMENT BETWEEN THE TOWN OF WAPPINGER AND THE WAPPINGER DISTRICT POP WARNER FOOTBALL ASSOCIATION At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the St" day of September, 2003, at 7:30 P.M. The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmen - ABSENT: Joseph Ruggiero Robert L. Valdati Vincent F. Bettina Joseph P. Paoloni Christopher J. Colsey The following Resolution was introduced by Mr. Bettina and seconded by Mr. Colsey WHEREAS, the Town Board finds that it is in the best interest of the Town to have the Wappinger Pop Warner Football Association provide football and cheerleading activities for the boys and girls of the community in accordance with the proposed Agreement dated September 9., 2003 between the Town of Wappinger and the Wappinger District Pop Warner Football Association. NOW, THEREFORE, BE IT RESOLVED, that the Town Board hereby agrees to enter into the written Agreement dated between the Town of Wappinger and the Wappinger District Pop Warner Football Association; and F:\Gina\My Documents\Resolutions 2003\RESOLUTION NO 2003-217.doc BE IT FURTHER RESOLVED, that Supervisor Joseph Ruggiero is hereby authorized and directed to sign on behalf of the Town said Agreement dated 4/q/6 between the Town of Wappinger and the Wappinger District Pop Warner Football Association. I will keep it short. Pep Rally: We will kicking off our 2003 season with a pep rally at the Wappingers Junior High football field, on Friday, August 29, 7:30 pm. We'd be honored if you could stop by and perhaps open the ceremonies with a few words. Subsidy: Enclosed is the contract for 2003. If you need anything else, please let me know. The number above is my cell. Sloper-Willen: I am going to contact the people at S -W with our practice and, ultimately, game schedule. OK? Fields: After we last spoke, I contacted the soccer league -- no luck there. Their schedule overlaps directly with ours, and their concern for excessive field wear, I think, is a legitimate one. Would like to explore a couple of possibilities: 0 The baseball and other fields behind the Castle Hill Veterans Hospital, I am told, are never used. The last time I held a Little League practice there was in the early 1990s. Might we consider putting in a "short-term" football field there? 0 The town recently acquired some acreage (near Channingville Road?). Could we talk about getting some field space in there? AGREEMENT made this day of , 2003, between the Town of Wappinger (hereinafter ❑town❑) a municipal subdivision, having its offices at Middlebush Road, Wappingers Falls, New York 12590 and the WPWLS, Inc. (dba Wappingers Pop Warner, hereinafter referred to as ❑Pop Warner[]), a not-for-profit corporation with its principal offices at VC R-15 510 Maloney Road, Poughkeepsie, NY 12603. WHEREAS the town wishes to contract with Pop Warner for the providing of services hereinafter defined, and WHEREAS Pop Warner is willing to provide said services in exchange for consideration hereinafter defined, NOW, THEREFORE, it is agreed between the parties as follows: 1. Pop Warner shall provide for all youth within the Town of Wappinger, excluding those not within the Wappinger Central School District , between the ages of 5 and 15, who fit the Pop Warner age and weight requirements, the opportunity to participate in either football or cheerleading activities in one of the following divisions: FLAG --Cub, TACKLE—Mitey-Mite, Junior Pee Wee, Pee Wee, Junior Midget and Midget. Assignment of such teams shall be made by Pop Warner which shall take into consideration the age and weight of the applicant and the applicant❑s experience level (if applicable). 2. Pop Warner shall provide all coaches, instructors and officiating personnel necessary to provide both instruction and team experience to each youth. Pop Warner shall also undertake all administrative acts as necessary for the operation of such divisions. 3. The town shall provide ambulance coverage in support of the sports program herein set forth during those times described in the Pop Warner schedule established and distributed for the 2000 season. 4. Pop Warner shall provide all sporting equipment necessary for the implementation of the sports program, with the exception of personal items (cleats, socks, mouthpieces and undergarments). 5. The sports program shall be provided to the youth of the town, excluding those not within the Wappinger Central School District, beginning in the month of August through the completion of Bowl Game participation or post season play in December. 6. Pop Warner shall maintain the standard Pop Warner insurance coverage to provide for medical expenses of participants. 7. The terms of this agreement shall be from the date of execution of this agreement through the completion of the 2003 Pop Warner season. 8. The town shall pay to Pop Warner the sum of $1,700.00 in exchange for the programs provided. 9. Pop Warner shall be solely responsible for any liabilities arising from its acts in the operation of the programs pursuant to this agreement and shall indemnify and hold harmless the town for any claims arising from the same. 10. This agreement may not be assigned. 11. Pop Warner will not discriminate because of race, color, creed, national origin, ancestry or religion; the program shall be open to all youths who have permanent residence within the town, excluding those not within the Wappingers Central School District, who are between the ages of 6 and 15 and fit the Pop Warner age and weight requirements. 12. Pop Warner shall be solely responsible for the obtaining of financial support necessary to fulfill its obligations for the sports program under this agreement. 13. Each party, by executing this agreement, represents that the authorization of the governing body has been obtained to permit such. 14. Pop Warner represents that it is authorized by its governing instruments to enter into this agreement. IN WITNESS WHEREOF, the parties have set their hands and seals this day of 2003.
