The Reorganization Meeting of the Town Board of the Town of Wappinger was held on December 20,
2004 at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York.
Supervisor Ruggiero opened the meeting at 7:40 p.m.

RECEIPT AND APPROVAL OF MINUTES
The Minutes of the Meeting of October 25, 2004, November 22, 2004 and December 6, 2004 having
previously been forwarded to the Board Members, were now placed before them for their
consideration.
Councilman Valdati moved to accept the above stated Minutes as submitted by the Town Clerk,
�conded by Councilwoman McCarthy and unanimously carried.
SUSPENSION OF RULES FOR PUBLIC COMMENT ON AGENDA
ITEMS
Councilman Bettina moved to suspend the rules for purposes of public comment on agenda items
seconded by Councilwoman McCarthy and unanimously carried.
Mary Schmalz wished to discuss Resolution 2004-373 on tonight's Agenda, the resolution to authorize
the Supervisor to sign contracts with MJW for Intermunicipal Revaluation. She felt signing this
contract was an insult to taxpayers, and an attack on Senior Citizens. Supervisor Ruggiero
explained all the Senior Citizen Exemptions that this Town Board has passed, every one that we are
allowed to under NYS Law, is still in effect. Depending on your income as a Senior, regardless of
what your assessment is, you can get up to 50% reduction on your assessment for your Town taxes.
Every year, because of the market value that is going on, if the Town of Wappinger chose not to do
this, and all the surrounding towns do, the very tax that your are afraid of will come back to hurt you
vice as hard. Each year as the assessments change, and the market value changes, the state comes
with a equalization rate, and the state is re-evaluating your property without you knowing about it
because they apply an equalization rate. All the surrounding towns are going to de a revaluation, and
their properties will go to 100% market value while ours won't. So our equalization rate becomes
punitive against the Town of Wappinger. So the state would come in and say we have a One Million
Dollar school budget and now instead of Wappinger paying say 40% of the budget, because that's what

it should be, we may have to pay 55% of the budget because when you apply the equalization rate
against it we are going to get hit with a higher percentage of the school district budget than we
should.. If we choose not to do this, it creates a risk for you as a senior citizen and to every resident in
this town. If we fail to act when our sister towns are acting, you will feel the pinch worse than if we
did not act. You do not have to let anyone in your home. That is your right. But the data collectors
have the right to take pictures and do inventory to do the proper comparisons. If we fail to act, we
would be acting more irresponsibly than what your concerns are. Further discussion followed.
Councilman Bettina moved to reinstate the rules, seconded by Councilwoman McCarthy and
unanimously carried.

PUBLIC HEARING:
• Public Hearing for Extension No. 2 of the Wappinger Park Water District.
DISCUSSIONS:
• Dutchess County Sports Museum—Joe Ennesser explained that they have been looking to
house the Museum for some twenty years. He explained they are a viable 1-C organization and
they are charted by the State Education Department of New York as a museum. At this time,
there are approximately 2,000 pieces of memorabilia that are being stored all over the county in
private homes and low income storage facilities. He feels that Carnwath Farms is a perfect
place to house the museum. Supervisor Ruggiero explained some legal papers have to be
prepared first, but the Town is looking forward to housing this museum.
RESOLUTIONS:
At this time, Supervisor Ruggiero wished to table Resolution No. 359 and Resolution No. 362.
Councilwoman McCarthy moved to table RESOLUTION NO. 2004- 359 and RESOLUTION NO.
2004- 362, seconded by Councilman Bettina and unanimously carried.

VANDALISM PATROL PERSONNEL

BE IT RESOLVED, that the pay scale for Part-time Town of Wappinger Vandalism Patrol Personnel
engaged to perform certain services for the protection of Town Parks, various other Town properties
ad performance of other such duties as may be assigned by the Town Board of the Town, be and the
same hereby is fixed and established as per contract with the Dutchess County Sheriff.
BE IT FURTHER RESOLVED, that all of such Part-time Town of Wappinger Vandalism Patrol
Personnel engaged on an hourly basis shall be paid every Friday throughout the year 2005 with the
first payday to be January 7, 2005, and

make change on a daily basis, and

miscellaneous items, for various departments of the Town of Wappinger, and
WHEREAS, a Petty Cash fund has been established for the Receiver of Taxes, pursuant to the
provision of Section 64, paragraph 1-a of Town Law, which shall be reimbursed to the Supervisor for
advances at the close of each fiscal year, and
WHEREAS, the Recreation Committee has numerous request for expenditures of small amounts of
cash for supplies and miscellaneous items and reimbursement of small expenditures to various areas
of the Recreation program and Maintenance work for the Town of Wappinger,
NOW THEREFORE BE IT RESOLVED, that the Town Justice Court, the Town Clerk, and the
Receiver of Taxes are hereby authorized and directed to establish a Petty Cash Fund, in the sum of

Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within

WHEREAS, the Town Board of the Town of Wappinger has determined that the Town Code, Section
240-20 of the Town of Wappinger Zoning Law, Common Driveways, should be amended and revised to
amend the requirement restricting each lot to take access over its own frontage to authorize the
Planning Board to allow or require common driveways and cross access easements, under certain
circumstances and subject to certain conditions, where deemed beneficial and in the Town's best
interest (the "Proposed Action"); and
WHEREAS, the Town Board determined that the Proposed Action is a Type I action pursuant to
Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as "SEQRA")
via Local Law No. 6 of 1992 (the Town's environmental quality review law which establishes locally
designated Type I actions); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there
are no other Involved Agencies and that the Town Board is therefore, by default as the only involved
;ency, the Lead Agency for this action
"OW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board of the Town of Wappinger hereby introduces for consideration of its adoption
proposed Local Law No. _ of 2005 in the form annexed hereto; except as specifically modified by
the amendments contained therein, the Zoning Law and Subdivision Regulations as originally
adopted and amended from time to time thereafter are to remain in full force and effect and is
otherwise to be ratified, readopted and confirmed.
2. The Town Board has reviewed the Proposed Action and hereby reserves the right to make its
Determination of Significance pursuant to SEQRA until the conclusion of the Public Hearing(s) on
the proposed amendments to the Town Code.
3. The Town Board hereby schedules a public hearing regarding the adoption of the annexed

WATER DISTRICT KNOW AS EXTENSION NO.2
The following Resolution was introduced by Councilwoman McCarthy and seconded by Councilman

WHEREAS, a map, plan and report, including an estimate of cost have been prepared in such manne

and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger,
Dutchess County, New York, relating to the establishment of a proposed extension to the Wappinger
Park Water District of the Town of Wappinger, Dutchess County, New York, to be known as
Extension No. 2 to the Wappinger Park Water District (hereafter "Extension No. 2"); and
WHEREAS, said map, plan and report dated October 8, 2001, as amended March 24, 2004 and July
30, 2004 and October 1, 2004 (the "Map, Plan & Report"), were prepared by Paggi, Martin & DelBene,
LLP, competent engineers duly licensed by the State of New York, and have been filed in the office of
the Town Clerk of said Town, where the same are available during regular office hours for
examination by any persons interested in the subject matter thereof; and
WHEREAS, Extension No. 2 shall include commercial properties located along the proposed new
water main (described below) and shall be bounded and described as set forth in Appendix A attached
hereto and made a part hereof; and
WHEREAS, all of the improvements proposed for Extension No. 2, consisting of the acquisition and
construction of a tie-in and an 8 inch diameter water main, together with water service connections,
hydrants, valves and related equipment are to be undertaken by and paid for by the owners of the
properties in Extension No. 2 and the cost thereof will not be charged against the properties in
Extension No. 2; and

WHEREAS, the properties in Extension No. 2 will be charged with a portion of the cost of certain
capital improvements undertaken for the benefit of the Wappinger Park Water District, including
Extension No. 1 thereto, by allocating benefit units to the properties in Extension No. 2 as Detailed in
the Map, Plan and Report, and said allocated costs shall not exceed $100,000; and
WHEREAS, the maximum amount proposed to be so allocated to the properties in Extension No. 2 is
accordingly, $100,000; and
'HEREAS, the proposed method of financing such cost of capital improvements to be allocated and
charged to extension No. 2 is by the issuance of serial bonds of said Town maturing in annual
installments over a period not exceeding forty years, which will be payable in the first instance from
the annual apportionment and assessment on the taxable real property in Extension No. 2 which the
Town board shall determine to be especially benefited by the improvements through the allocation of
benefit units to the properties in Extension No. 2, but if not paid from such source, all the taxable real
property in said Town shall be subject to he levy of ad valorem taxes therefore; and
WHEREAS, the improvements for Extension No. 2 have been determined to be a Type II Action
pursuant to the regulations promulgated pursuant to the State Environmental Quality Review Act,
and accordingly, no environmental review under said Act is required.;
WHEREAS, there will be no hook-up fees to properties in Extension No. 2; and
WHEREAS, the estimated annual capital cost for the allocated cost of improvements, based upon the
proposed twenty year debt amortization is approximately $268 per benefit unit for each property to be
cluded in Extension No. 2. The number of benefit units for each property in Extension No. 2. is
60 sown in the Map, Plan & Report. Commercial users in the extended district (service area) will pay
annual O&M costs, to be determined by the Town Board, based on actual metered flow. The annual
cost is calculated for the first year in which operation, maintenance, debt service and other charges
and expense are to be paid. There are no residential or "typical properties" in Extension No. 2; and
WHEREAS, a detailed explanation of the manner by which were computed said estimated first-year
cost has been included in the Map, Plan & Report which has been filed in the Office of the Town
Clerk, where the same are available during regular office hours for examination by any person
interested in the subject matter thereof; and
WHEREAS, an order was duly adopted by said Town Board on November 22, 2004, reciting a
description of the boundaries of said Extension No. 2, the fact that no improvements are proposed and
that no amount is proposed to be expended for said improvements, the fact that the Map. Plan &
Report were on file in the Town Clerk's office for public inspection and specifying the
20th day of December, 2004 at 7:30 o'clock P.M., Prevailing Time, at the town Hall, 20 Middlebush
)ad, in Wappingers Falls, New York, in said Town, as the time when and the place where said Town
toard would meet for the purpose of holding a public hearing to consider the establishment of said
Extension No. 2 and the Map, Plan & Report filed in relation thereto and to hear all persons
interested in the subject thereof concerning the same;

WHEREAS, notice of the aforesaid public hearing was duly published on December 8, 2004, and
posted on December 8, 2004 in the manner and within the time prescribed by Section 209-d of the
Town Law, and proof of publication and posting has been duly presented to said Town Board;
WHEREAS, said public hearing was duly held at the time and place in said order, as aforesaid, at
which all persons desiring to be heard were duly heard; and
WHEREAS, said Town Board has duly considered said map, plan and report and the evidence given

NOW, THEREFORE, BE IT RESOLVED, by the Town of Wappinger, Dutchess County, New York, as
follows:
Section 1. Upon evidence given at he aforesaid public hearing, it is hereby found and
determined as follows:
a) The notice of hearing was published and posted as required by law and is
otherwise sufficient;
b) All property and property owners within said proposed Extension No. 2 are
benefited thereby;
c) All property and property owners benefited are included within the limits of said
proposed Extension No. 2; and
d) The establishment of said proposed Extension No. 2 is in the public interest.
Section 2. The establishment of Extension No. 2 to the Wappinger Park Water District in the
Town of Wappinger, Dutchess County, New York, to be bounded an described as hereafter set forth, i
hereby approved; provided, however, that said establishment shall become effective only upon the
completion of certain improvements by the owners of property in said Extension No. 2 (the "Owner
Improvements") and acceptance of the Owner Improvements by the Town. The Owner Improvements
may include a water supply line that is shorter that the water supply line described in the Map, Plan
& Report and may otherwise differ from the Map, Plan & Report in such manner as may be agreed
upon in writing on behalf of the Town by the Town Supervisor. The Owner Improvements must be
constructed in accordance with the specifications, rules and regulation of the Dutchess County
Department of Health, the Town of Wappinger, and any other municipal body having jurisdiction over
such construction.
Section 3. Said Extension No. 2 shall be bounded and described as set forth in Exhibit A
attached hereto and hereby made a part hereof
Section 4. The Town Clerk shall, within ten (10) days after the adoption date of this
resolution, publish in the official news papers, and post on the official signboard of the Town, a notice
which shall set forth the date of adoption of the resolution and the full text hereof.
Section 5. This resolution is adopted subject to permissive referendum.

WHEREAS, Meadowood Investors, LLC has made application to the Town of Wappinger Planning
Board to approve a subdivision of lands more particularly described in Subdivision Map entitled
"Section 2, Parcel 1 Meadowood Subdivision" prepared by Lawrence J. Paggi dated August 1, 2002,
last revised October 6, 2004; and
WHEREAS, the Town of Wappinger Planning Board granted final conditional subdivision approval,
by Resolution dated February 2, 2004 subject to and conditioned upon completion of the conditions set
forth in the aforementioned Resolution, and subject to certain improvements being made and
constructed as set forth in the aforesaid Subdivision Map and related Contract drawings, all in
accordance with the Town of Wappinger Subdivision Regulations, Zoning Code, Highway
Specifications, and Rules and Regulations of the Town; and
HEREAS, Town Law §277 requires that a developer of a realty subdivision guaranty the
�Mnstruction, installation, and dedication of the improvements required by the Resolution of
Subdivision approval, prior to issuance of any building permits.
NOW, THEREFORE, BE IT RESOLVED, as follows:

2. The Performance Agreement executed on December 14, 2004 by Michael G. Meyers,

completion of the construction, installation, and dedication of the improvements required by the
Resolution of Subdivision approval pursuant to Town Law §277.
3. The Irrevocable Letter of Credit issued by Mahopac National Bank bearing number
200450 and issued in favor of the Town of Wappinger in the sum of One Million, Seven Hundred and
Seventy Five Thousand Dollars ($1,775,000.00), securing the obligations set forth in the Performance
Agreement, is hereby accepted as security for the Performance Agreement, in substantially the same
form as attached hereto. The Board hereby authorizes the delivery of the original Letter of Credit at
any time prior to the endorsement of the Subdivision Plat by the Chairman of the Planning Board.

WHEREAS, the Town Superintendent of Highways has been requested by the County of Dutchess to
participate in the regional County Highway Snow and Ice Control Program within the boundaries of
the Town, and
WHEREAS, and logically, an earlier or sooner response factor can be provided by Town units and
personnel within locale thereby benefiting the overall safety and welfare of town residents and local
community interests, and
WHEREAS, such participation by the Town in removing snow from designated County Highways,
and by sanding and salting or otherwise treating them for the purpose of maintaining highway safety
and accessibility for emergency services, is specifically authorized by Article 6, Section 135 of the New
York State Highway Law,
NOW, THEREFORE, BE IT RESOLVED, that the Town Highway Superintendent be and is hereir
authorized to perform such work as is found necessary, at hourly rates as agreed upon by the Town i

THE TOWN OF WAPPINGER AND MJW CONSULTING, INC.

WHEREAS, the Town Board of the Town of Wappinger has previously authorized in Resolution No.
2004-331, Supervisor Joseph Ruggiero to enter into the Municipal Cooperation Agreement with Towns
of Beekman, East Fishkill, Fishkill, Lagrange and Poughkeepsie and the City of Beacon, pursuant to
Article 5-G of the General Municipal Law for the purposes of establishing the entity to be known as
the "Southern Dutchess County Reassessment Consortium" for the purposes of identifying cooperative
and economically beneficial methods for producing new and equitable assessments for each of the
participating municipalities; and
WHEREAS, "Southern Dutchess County Reassessment Consortium" has selected MJW Consulting,
Inc. as a qualified provider of the assessment services needed by the constituent municipalities; and
WHEREAS, the Town of Wappinger wishes to contract for mass appraisal services related to the
completion of the Town -wide real property reevaluation to be completed by June 1, 2007; and
WHEREAS, the Town of Wappinger wishes to enter into a contract with MJW Consulting, Inc. to
-ovide real property reevaluation/assessment services for all real property within the Town including
any property within the Village of Wappingers Falls located within the jurisdictional boundaries of
the Town of Wappinger.
NOW, THEREFORE, BE IT RESOLVED, as follows:

WHEREAS, the Town of Wappinger previously established the Wappinger Ambulance District; and
WHEREAS, the Town of Wappinger, on behalf of the Wappinger Ambulance District, has previously
entered into a written Agreement with Alamo Ambulance Service, Inc. to supply ambulance services
within the Wappinger Ambulance District; and J.
WHEREAS, the aforementioned Agreement between Alamo Ambulance Service, Inc. and the Town of
Wappinger has been terminated and the Town wishes to enter into a new Agreement with TC Hudson
Valley, Inc. d/b/a TransCare to provide ambulance services to the Wappinger Ambulance District; and
WHEREAS, the Town Board finds that it is in the best interest of the Town to have TC Hudson
Valley, Inc. d/b/a TransCare supply general ambulance services as defined in Section 3001 of the
Public Health Law for the purpose of transporting all sick or injured persons found within the
boundaries of the Wappinger Ambulance District as more particularly set forth in the proposed
Agreement attached as Exhibit "A"; and
WHEREAS, the contract for supplying ambulance services is exempt from competitive bidding
pursuant to General Municipal Law Section 103 as the Ambulance Service Agreement with TC
Hudson Valley, Inc. d/b/a TransCare is a contract for professional services that require technical skill,
training and medical expertise.
NOW, THEREFORE, BE IT RESOLVED, as follows:

2. The Town Board hereby agrees to enter into a written Ambulance Service Agreement

NEW BUSINESS/COMMENTS
Councilman Valdati explained there is a house on Route 9D near Montclair that is quite close to the
road the is boarded up and in a state of disrepair. He would like the Zoning Administrator to get the
status of the house. Also, at Optima Window, there seems to be a perpetual container on site. Since
LaFonda was demolished, some one seems to be using it a perpetual parking lot, he would like this
matter investigated.
At this time, 8:45 pm., Councilman Bettina moved to go into Executive Session to confer with
Attorney on two matters of litigation, seconded by Councilwoman McCarthy and unanimously
carried

December 20, 2004 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New
York, on the Establishment of a Proposed Extension No. 2 to the Wappinger Park Water
District.
Supervisor Ruggiero opened the meeting at 7:40 p.m.
