A Public Hearing was held by the Town Board of the Town of Wappinger
on October 5, 2004, at the Town Hall, 20 Middlebush Road, Wappingers
Falls, on a proposed Local Law Creating Article VIA. to Chapter 230
Entitled "Surcharge for VTL Convictions. The meeting opened at 7:35
p.m.

The Town Clerk offered for the record, the Affidavits of Posting and
Publication duly signed and notarized. (These Affidavits are attached
hereto and made part thereof the Minutes of this Hearing).
Supervisor Ruggiero explained that the State Legislature has enabled
local Towns to add a surcharge of $10 for traffic tickets as part of their
budget that they adopted in August. The Town currently receives a local
portion of the fines collected, and the legislature has removed that local
option and has given us this instead. He understands the Assembly has
moved on the section to appeal the law regarding local share of fines.
The Senate has not met and may not meet until after November.
Supervisor Ruggiero wished to know if there were any comments or
questions from the audience. Hank Weeks of Brothers Road was
recognized by the Board. Supervisor Ruggiero explained that the Town
budgets around $130,000 for which $5,000 of that is derived from the
local share of tickets. That money is now gone, leaving a hole in the
Town Budget. The Legislature is offering local governments to make up
that gap. We pay $100% of the cost to administer our local court and
they are taking all the revenue from that. At $10 a ticket we hope to
receive around $58,000 . There were no further comments.
Councilwoman McCarthy moved to close the Public Hearing, seconded by
Councilman Paoloni and unanimously carried.

RESOLUTIONS:
RESOLUTION NO. 284 2004
RESOLUTION ADOPTING LOCAL LAW NO. #12 OF THE YEAR 2004,
CREATING ARTICLE VIA TO CHAPTER 230 ENTITLED "SURCHARGE
FOR VTL CONVICTIONS"
The following Resolution was introduced by Councilwoman McCarthy and seconded
by Councilman Paoloni
WHEREAS, a resolution was duly adopted by the Town Board of the Town of
Wappinger adopting "Local Law No. 12 of the Year 2004, Creating Article VIA to
Chapter 230 Entitled "Surcharge for VTL Convictions"; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News,
the official newspaper of the Town, and the Poughkeepsie Journal; and
WHEREAS, a Public Hearing was held on October 5, 2004 and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to
said proposed Local Law or any part thereof; and
WHEREAS, the Town Board determined that the proposed Local Law was not
subject to environmental review; and
WHEREAS, said Local Law has been on the desks of the members of the
Town Board of the Town of Wappinger for at least seven (7) days, exclusive of
Sunday, prior to the adoption of this Resolution.
NOW, THEREFORE, BE IT RESOLVED:

1. The recitations above set forth are incorporated in this
Resolution as if fully set forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby adopts
the Local Law entitled "Local Law No. 12 of the Year 2004,
Amending the Code of the Town of Wappinger by Creating
Article VIA to Chapter 230 entitled `Surcharge for VTL
Convictions"', a copy of which is attached hereto and made
a part of this Resolution.
3. The Town Clerk is directed to enter said Local Law in the
minutes of this meeting into the Local Law book for the
Town of Wappinger and shall file the Local Law with the
Secretary of State of New York as provided by law.

The Resolution is hereby duly declared adopted
At this time Supervisor Ruggiero Presented the 2005 Tentative Budget for
the Town of Wappinger to the Board Members Supervisor Ruggiero
informed the Board that department head requests totaled $8,900,669 and
the budget he has proposed totals $7,026, 808. This represents a 2.6%
increase in spending over last year. There are items that impact the budget
that are outside the spending process of the budget. There is a shift in the
base rate proportion budget for the homestead portion and there is portion
that is non -homestead. There has been a shift of over 2 1/2% from commercial
to residential. We have had a six million dollar increase in the residential
assessment, town wide. The town wide commercial actually decreased 1/2%
because of tax certioraris that were settled. The town outside the village
saw an increase of residential and we saw a slight increase of $1.2 million for
commercial. Compiling the budget, the largest increase in the tax levy
occurred in the Highway Department. This is due to several factors, one
being increase in the pension fund by the state. Last year we budgeted 4 1/2%
for the pension fund and now the state mandates 11%. There has been a
substantial increase in salt from $27 per ton to $48 per ton. Liability
insurance is projected to go up over 8-11%. We have seen very large
increases in medical insurance. What we normally do to offset tax increases
is to prorate from fund balance. Over the years we have had more of a fund
balance appropriated because we never used it. We had a fund balance of

$102,939 in Highway and we appropriated $50,000 from last years budget to
go to this years budget. However this year we have seen a large increase to
the highway department and we don't know what November and December
are going to bring, because the snow budgets are thin at this point. If we are
hit hard we would wind up with a $12,000-$14,000 fund balance at the end of
this year. What he is proposing in the budget is to do interfund transfers
out of B Fund Highway for $300,000. The Village homestead rate will be
$1.27 per $1,000. There is a 7.6% increase over last year. The commercial
rate for the Village saw a decrease. The Village rate is now $2.08 per $1,000
for commercial property. The residential rate outside the Village is $3.05 per
$1,000. This is up 8 1/ % over last year. The residents in the Town of
Wappinger with a $100,000 assessment will pay $305 in Town taxes which is
a $22 increase over the previous year. The 2005 Commercial rate is $5.15 per
$1,000 which represents 2.72% increase over the 2004 non -homestead rate.
Town commercial property with a $100,000 assessment will pay $515 in
Town taxes. This is an $11 increase. The levy in the B fund is zero. The
County put a surcharge of $5 an hour for the Sheriffs Department for
administrative fees, which is costing the Town $30,000 extra in
administrative fees. This is the first year, 2004 we will have the opportunity
to see what the new sales tax rate will generate in terms of revenue. The
Mortgage tax generated $1.2 million last year and he is still budgeting
around $900,000. Within the budget of the B fund of $1.6 million, $300,000 is
going toward Highway. Pension costs will be increasing from $130,000 to
$280,000, town wide. He also wishes to propose a reserve fund for the
pension so at the end of 2004, when we see what the real sales and mortgage
taxes are, we can make appropriations from the reserve fund and hold it
exclusively to help offset the pension fund. As you know we have the step
program for the employees salaries. When we created the step program the
idea was to raise salaries step program 3%, then give steps. When he first
prepared the budget, it was with the intention of the KOLA step program,
but that would have caused taxes to increase 16%. He had to back off on that
and just give steps, depending on what tier the employee was at according to
the salary schedule. Pay raises will go anywhere from 3% to 6%. The
ambulance is a separate budget. It is proposed to increase an additional
$179,000 for the anticipated contract with Transcare. This would result in a
$15 increase per house. The good news about the budget is that most of the
Town's indebtedness is starting to fall off. Next year it will drop off even
more. The budget has been pared down and some departments cut spending,
but we do not have much to cut. Councilwoman McCarthy wished to know if

money was saved on Bulk Pick-up this year. Supervisor Ruggiero answered,
"yes" but the recycle center itself has increased cost in hauling fees because of
its popularity. He did propose in the budget to increase the summer
recreation program fee to bring in extra revenue. Next year should see some
extra revenue created from the signs placed for advertising at Robinson
Lane.
Hank Weeks of Booth Boulevard was recognized from the audience, and he
suggested allowing an amnesty for homeowners to legalize accessory
apartments in their homes in order to increase the taxes somewhat because
of extra income. Supervisor Ruggiero explained we have a law on the books
on how to go about legally obtaining an accessory apartment. We also
passed legislation increasing fines and fees for people who violate the zoning
ordinance. He does not want to make a carte blanche amnesty to legalize
illegal apartments. It does have to be a relative in order to have an accessory
apartment. Mr. Weeks felt there was a need for families who cannot afford
other apartments.
There was no other business to come before the Board
Councilwoman McCarthy moved to close the Special Meeting, seconded by
Councilman Paoloni and unanimously carried.

A Local Law entitled "Local Law No. # 12 of the Year 2004, Creating a New Article VIA to
Chapter 230 entitled `Surcharge for VTL Convictions"'.
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger "Local Law No. LZ of
the Year 2004, Creating a New Article VIA to Chapter 230 entitled `Surcharge for VTL
Convictions"'.
Section II: Legislative Intent:
The New York State Legislature recently amended §1809-1) of the New York State
Vehicle and Traffic Law ("VTL"), as added by Chapter 56 of the Laws of 2004 (5.6056-B and
A.9556 -B), which provides authority to the Town of Wappinger Town Justices to impose a $10
surcharge on VTL convictions rendered in the Town of Wappinger Justice Court.
The Town Board has determined that it is in the best interest of the Town and its
residents to permit the imposition of a $10 surcharge on convictions rendered in the Town
Justice Court pursuant to §1809-1) of the New York State VTL. The Town Board has further
determined that the surcharge that may be imposed by the Town will assist in deterring
violations of the VTL, and to help protect the health, safety and welfare of Town residents.
Accordingly, it is the determination of the Town Board that Chapter 230 of the Town of
Wappinger Code shall be amended to create a new Article VIA which shall be entitled
"Surcharge for VTL Convictions", which shall permit a $10 surcharge on convictions for
violations of various sections of the VTL.

Section III:
The Town of Wappinger Code, Chapter 230, Article VIA ("Surcharge for VTL
Convictions") is hereby created, which shall appear in Chapter 230, Article VIA of the Town of
Wappinger Code as follows:
"Chapter 230
Article VIA
Surcharge for VTL Convictions
§230-34.1. Purpose. The purpose of this Local Law is to impose a local surcharge on convictions
rendered in the Town Justice Court pursuant to the enabling authority of § 1809-D of the Vehicle
and Traffic Law, as added by Chapter 56 of the Laws of 2004.
§230-34.2. Local Surcharge for Traffic Violations. There shall be an additional surcharge of Ten
Dollars ($10.00) per violation for convictions rendered in the Town of Wappinger Justice Court for
violations committed between the effective date of this Local Law and September 1, 2005, which
convictions are subject to a mandatory surcharge imposed pursuant to §1809 of the Vehicle and
Traffic Law.
§230-34.3. Payment to Clerk of Court; Disposition of Surcharge. The surcharge authorized by
subdivision one of this section shall be paid to the Clerk of the Court that rendered the conviction.
Within the first ten days of the month next succeeding the collection of such surcharge, the Court
shall pay the surcharge to the Chief Fiscal Officer of the Town.
§230-34.4. Refunds. Any person who has paid a surcharge authorized by this Chapter which is
ultimately determined not to be required by this Chapter shall be entitled to a refund of such

surcharge upon application to the Town Chief Fiscal Officer. Such Chief Fiscal Officer shall
require such proof as is necessary in order to determine whether a refund is required by law.
§230-34.5. Effective Date. This Local Law shall take effect immediately."
Section V: Separability.
The provisions of this Local Law are separable and if any provision, clause, sentence,
subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall

not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this local law or their application to other persons or circumstances. It is hereby declared
to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law
would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence,
subsection, word or part had not been included therein, and if such person or circumstance to
which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom.
Section VI: Effective Date:
This Local Law shall become effective immediately upon filing with the Secretary of
State as provided by law.
