The purpose of the meeting was to authorize the application for Community Development Block Grant for Chelsea Water, to Introduce a Local Law for a Surcharge for Tickets, and to authorize Testing at Carnwath. Supervisor Ruggiero opened the meeting at 6:10 p.m. Present: Joseph Ruggiero, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman (arrived at 6:20 pm) Maureen McCarthy, Councilwoman Gloria J. Morse, Town Clerk Others Present: Al Roberts, Attorney to the Town Absent: Joseph Paoloni, Councilman RESOLUTION NO. 2004-275 RESOLUTION AUTHORIZING THE SUBMISSION OF THE FISCAL YEAR 2005 DUTCHESS COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM APPLICATION PROJECT: PROPOSED CHELSEA WATER DISTRICT The following Resolution was introduced by Councilwoman McCarthy and seconded by Councilman Valdati. WHEREAS, the Town of Wappinger is participating in the Dutchess County Community Development Consortium for Fiscal Year 2005; and WHEREAS, input from citizens and groups has been received and considered by virtue of a Public Hearing which was conducted at a regular Town Board meeting on Monday, September 13, 2004 at 7:30 p.m. at Town Hall; and WHEREAS, an application has been prepared which addresses our community concerns. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Dutchess County Community Development Consortium Fiscal Year 2005 application for the Town of Wappinger including the certification included therein be and hereby is approved. 1 09/23/2004.SPM 3. The submission of said application to the Dutchess County Department of Planning and Development be and hereby is authorized, in the form attached hereto. RESOLUTION NO. 2004-276 RESOLUTION INTRODUCING LOCAL LAW NO. _ OF THE YEAR 2004, AMENDING THE CODE OF THE TOWN OF WAPPINGER BY CREATING A NEW ARTICLE VIA TO CHAPTER 230 ENTITLED "SURCHARGE FOR VTL CONVICTIONS" The following resolution was introduced by Councilwoman McCarthy and seconded by Councilman Valdati. WHEREAS, the Town Board wishes to amend the Code of the Town of Wappinger by creating a new Article VIA to Chapter 230 which will authorize a $10 surcharge for convictions of violations of the New York State Vehicle and Traffic Law (hereinafter referred to "VTL"); and WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and is otherwise exempt from environmental review pursuant to the New York State Environmental Quality Review Act (SEQRA). NOW, THEREFORE, BE IT RESOLVED: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby introduces for adoption Local Law No._ of the Year 2004, in the form annexed hereto, Amending the Code of the Town of Wappinger by creating a new Article VIA to Chapter 230 entitled "Surcharge for VTL Convictions". 3. The Town Board hereby determines that the enactment of the aforementioned Local Law is a Type II action as defined in 6 NYCRR 617.5 (c) (20) and, accordingly, the Town Board hereby expressly determines that this action is not an action that requires review pursuant to the provisions of New York State Environmental Quality Review Act (SEQRA) or pursuant to Local Law No. 6 of 1992 or pursuant to 6 NYCRR Part 617. 4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of Local Law No. of the Year 2004 to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New 09/23/2004.SPM York on the 5th day of October, 2004, at 7:30 p.m., and the Town Clerk is directed to post the Notice of the Public Hearing in the form annexed hereto and to publish same in the Southern Dutchess News and Poughkeepsie Journal as required by law. The question of the foregoing Resolution was put to a vote which resulted as follows: Joseph Ruggiero, Supervisor Voting Aye Robert Valdati, Councilman Voting Aye Vincent Bettina Councilman Voting Absent Maureen McCarthy, Councilwoman Voting Aye Joseph Paoloni, Councilman Voting Absent The Resolution is hereby duly declared adopted. RESOLUTION NO. 2004-277 RESOLUTION AWARDING BID FOR ENVIRONMENTAL TESTING AT CARNWATH FARMS The following Resolution was introduced by Councilwoman McCarthy and seconded by Councilman Valdati. WHEREAS, bids were received by Don Swartz, Architect to the Town of Wappinger for environmental testing at Carnwath Farms, and WHEREAS, bids were received as follows: Air Care Environmental Service $4,068 Quality Environmental Solutions & Technologies $4,407 WHEREAS, Don Swartz of Cerniglia and Swartz, has provided an award recommendation to the Town Board. NOW, THEREFORE, BE IT RESOLVED, 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The bid for the environmental testing at Carnwath Farms is hereby awarded to Quality Environmental Solutions and Technologies for an amount not to exceed Four Thousand, Four Hundred and Seven Dollars ($4,407) in accordance with the award recommendation letter dated September 17, 2004 from Don Swartz of Cerniglia and Swartz, to the Town Board. 3. Supervisor Joseph Ruggiero is hereby authorized and directed to execute said Contract on behalf of the Town of Wappinger. The question of the foregoing Resolution was put to a vote which resulted as follows: Joseph Ruggiero, Supervisor Voting Aye Robert Valdati, Councilman Voting Aye Vincent Bettina Councilman Voting Absent Maureen McCarthy, Councilwoman Voting Aye Joseph Paoloni, Councilman Voting Absent 3 09/23/2004.SPM The Resolution is hereby duly declared adopted.
