Supervisor Ruggiero opened the meeting at 7:30 p.m. Present: Joseph Ruggiero, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Christopher Colsey, Councilman Joseph Paoloni, Councilman Gloria J. Morse, Town Clerk The Supervisor asked all to join in the Pledge of Allegiance to the Flag. • Public Hearing on Preliminary Budget for 2004 RESOLUTIONS: RESOLUTION NO. 2003-259 RESOLUTION AUTHORIZING PUBLIC HEARING TO HEAR OBJECTIONS TO THE ASSESSMENT ROLLS AND PROPOSED BUDGETS FOR SPECIAL IMPROVEMENT DISTRICTS OR SPECIAL IMPROVEMENT AREAS FOR CALENDAR YEAR 2004 The following Resolution was introduced by Councilman Bettina and seconded by Councilman Valdati. WHEREAS, the Town Board has completed the assessment rolls and has prepared proposed budgets for all Special Improvement Districts and Special Improvement Areas in the Town of Wappinger; and WHEREAS, the Town Board hereby schedules and orders Public Hearings for the purposes of hearing and considering any objections which may be made to the assessment rolls for all Special Improvement Districts and/or Special Improvement Areas within the town, any objections to the proposed benefit assessments to be levied in calendar year 2004 against the properties within said Special Improvement Districts or Special Improvement Areas as well as any objections to the proposed budgets for the calendar year 2004 and the Quarterly Operation and Maintenance Charges to be billed to those properties connected to said Special Improvement Districts or Special Improvement Areas; and WHEREAS, the Town Board inadvertently neglected to schedule the aforementioned Public Hearings for the Special Improvement Districts and Special Improvement Areas at their last Town Board meeting; and WHEREAS, the Town Clerk posted the Notice of Public Hearing and published the Notice of Public Hearing in the form annexed hereto in the Southern Dutchess News and the Poughkeepsie Journal commencing November 6, 2003 so as to comply with applicable statutory requirements. NOW, THEREFORE, BE IT RESOLVED, as follows: 1 11/06/2003.TBM 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby confirms that it has completed the assessment rolls for the Special Improvement Districts and Special Improvement Areas and the proposed budgets for all Special Improvement Districts and Special Improvement Areas in the Town of Wappinger. 3. The Town Board hereby schedules Public Hearings for the purpose of hearing and considering any objections which may be made to said assessment rolls or to hear any objections to the proposed Benefit Assessments to be levied in calendar year 2004 as well as to hear any objections to the Quarterly Operation and Maintenance Charges to be charged to those properties connected to the following Special Improvement Districts, said Public Hearings to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 19th of November, 2003 starting at 7:30 p.m.: Special Improvement District/Special Improvement Areas Wappinger Sewer Improvement Area No. 1 Rockingham Farms Sewer District Wappinger Sewer Transmission/Treat Improvement Area -Phase 1 Wappinger Sewer Transmission/Treat Improvement Area -Phase 2 Wappinger Sewer Transmission/Treat Improvement Area -Phase 3A Central Wappinger Water Improvement Area Wappinger — Cranberry Water Improvement Area Wappinger Park Water District Ardmore Hills Water Improvement Area Central Wappinger Emergency Improvement Area Wappinger Water Improvement Area 1999-2(R) Mid -Point Park Sewer District Wildwood Sewer District Watchhill Sewer District Watchhill Water District North Wappinger Water District Myers Corners II Water District Oakwood Knolls Water District Tall Trees Water Improvement Area Fleetwood Water District Fleetwood Sewer District Town Wide Ambulance 4. The Town Clerk is hereby direct to post and publish the Notices of Public Hearing in the form annexed hereto as Exhibit "A". Said posting and publications are to be made to the Southern Dutchess News and the Poughkeepsie Journal at least 10 days prior to the scheduled Public Hearing. 5. The Town Clerk is further ordered to send a copy of the notification of Public Hearing, in form annexed hereto as Exhibit `B", to all property owners within the above mentioned Special Improvement Districts and/or Special Improvement Areas. 0 11/06/2003.TBM 6. The Town Board hereby ratifies and confirms the actions taken by the Town Clerk of the Town of Wappinger, who published the annexed Notice of Public Hearing (Exhibit "A" in the Southern Dutchess News and Poughkeepsie Journal on November 5, 2003 so as to comply with the statutory requirement that such Notice of Public Hearing be published at least ten (10) days prior to the date scheduled for the Public Hearing. The foregoing was put to a vote which resulted as follows: Joseph Ruggiero, Supervisor Voting Aye Robert Valdati, Councilman Voting Aye Vincent Bettina, Councilman Voting Aye Christopher Colsey, Councilman Voting Aye Joseph Paoloni, Councilman Voting Aye The Resolution is hereby duly declared adopted. DISCUSSION: • Water and Sewer Budget. Mike Tremper of CAMO gave a report on the water/sewer facilities and explained that the budget that was presented to the board also contained other valuable information as far as flows, number of hookups and whether the plants were meeting permits as outlined by the DEC. They try to keep the costs down, but some are very difficult. The discharge levels at sewage treatment facilities at Fleetwood, Wildwood and Mid -Point Park are still far below the permits issued by the DEC. This year we have had an I&I problem at some of these facilities due to the amount of rain. We have put together something for these three facilities that can help us run the plants again next year and dispose of all the sludge and keep the facilities within acceptable levels. The water districts are a bit more complicated. Central Wappinger, Ardmore, Oakwood, North Wappinger Park, and Wappinger Park Water Districts are all going to become one big district soon. When you review the budget you will notice that the Wappingers Park budget was formatted because when the budget was prepared in September, we did not know what was going to happen to Wappinger Park. When the connection to Central Wappinger Water is complete their O&M rates will reduce back to the $27.50 minimum. At this time approximately 30% of our water comes from the Atlas Well Fields that are located in the North Wappinger Water District Budget. The rest of the water comes from the Central Wappinger Water Budget. They all use the Cider Mill Loop tank which is part of the Central Wappinger Water Budget. At some point in time we should combine all the districts and go with one rate. Last year we started placing generators at several of the pump stations. 3 11/06/2003.TBM At this time 7:59 p.m. Councilman Bettina moved to go into Executive Session to discuss litigation, seconded by Councilman Colsey and unanimously carried. The meeting reconvened at 8:25 p.m. with all board members in attendance. There was no action taken at Executive Session. Councilman Paoloni moved to close the meeting, seconded by Councilman Colsey and unanimously carried. The meeting adjourned at 8:26 p.m. Gloria or e Town erk 4 FJ 11/06/2003.PH A Public Hearing was held by the Town Board of the Town .of Wappinger on November 6, 2003 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the Preliminary Budget for 2004. Supervisor Ruggiero opened the Meeting at 7:35 p.m. Present: Joseph Ruggiero, Supervisor Robert Valdati, Councilman w Vincent Bettina, Councilman Christopher Colsey, Councilman Joseph Paoloni, Councilman Gloria J. Morse Town Clerk The Town Clerk offered for the record the Affidavit of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof the Minutes of the Meeting). Supervisor Ruggiero wished to know if anyone in the audience wished to speak in regard to the Preliminary Budget. There were no questions or comments. Supervisor Ruggiero wished to read into the record the Budget that was adopted by the Town Board to be the Preliminary Budget. The Town Board has until November 20th to adopt the final Budget. If no modifications are made and the board chooses not to make any changes on the Final Budget, this Budget will become law automatically on November 20th. The rates for the 2004 Village Homestead rates will be $1.18 per $1,000. This represents a 0% change over 2003 Homestead rate of $1.18 per $1,000. The Village Residential property of $100,000 assessment would pay $118 in town taxes, which is also a 0% increase over 2003. The 2004 Village Non -Homestead rate will be $2.10 per $1,000 of assessed value which represents a 3.2% decrease from the 2003 Village Non -Homestead rate of $2.17 per $1,000. A village commercial property of $100,000 assessment will pay $2.10 in town taxes, which is a $7.00 decrease from 2003. The tentative 2004 Town Homestead rate will be $2.82 per $1,000 value. This represent a 2.53% increase from the 2003 Homestead rate of $2.76 per $1000. A town residential property with $100,000 assessment will pay approximately $283 in town taxes in 2004. This is a $7.00 increase over what was paid in 2003. The tentative 2004 Non -Homestead rate will be $5.04 per $1,000 assessed value which represents a .24% decrease from the 2003 rates of $5.05 per $1,000. A town commercial property of $100,000 assessment will pay $504 in town taxes in 2004. This represent a $1.00 decrease over 2003. Part of the 2.53% increase in the town outside the Village Homestead rate was due to several factors. One being the reduction in the assessment roll of nearly $12 million dollars in taxable assessed value. This was caused by the adoption of 1 11/06/2003.PH Local Law #3 of 2003 in which the Town Board appropriately maximized the Veterans Exemption currently allowed under New York State Law. This caused an influx of new applications for the Veterans Exemption. In 2002 the Veterans Exemption totaled nearly $12,000,900,306 and after Local Law passage Number #3 the Veterans Exemption fell $23,219,345. The Town of Wappinger has a nearly a billion dollar assessment. The other factor that caused the increase was in the Highway Department. The Highway Department is one source of funding which is the real property tax. Due to the increase in the NYS Pension contribution the Town of Wappinger and other municipalities have seen an increase in appropriation to the Pension fund. The Town of Wappinger Preliminary Budget will see an increase of nearly 600% over what we appropriated for 2003. With all these factors this would only amount to a modest increase of 2.53%. We saw two decreases in commercial for two years in a row. We held the line in the village for two years in a row, and our budget this year is still smaller than the budget that was adopted for 2001 even though spending is up 3.4% over last year. He thinks the Town Board had done a decent job with the budget thus far and there is more work to be done. Supervisor Ruggiero again wished to know if there were any comments or questions.
