SUPERVISOR RUGGIERO opened the meeting at 7:35 p.m. Joseph Ruggiero, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Christopher Colsey, Councilman Joseph Paoloni, Councilman Others Present: Jay Paggi, Engineer to the Town Al Roberts Attorney to the Town Graham Foster, Highway Superintendent Absent: Gloria J. Morse, Town Clerk SUSPENSION OF RULES FOR PUBLIC COMMENT Councilman Bettina moved to suspend the rules for purposes of public comment on agenda items. Seconded by Councilman Colsey Motion Unanimously Carried Supervisor Ruggiero wished to know if anyone in the audience wished to discuss any items listed on the Town Board Agenda. Dave Campagni of Cortland New York, owner of Grant Street Construction was recognized. Mr. Campagni wished to discuss Resolution #186, the awarding of the Contract for Wappinger Water Improvement Area 1999-2(R) Contract No. 6. Supervisor Ruggiero announced that the bid had not been awarded yet. Mr. Campagni explained that his company has completed four contracts for the Town of Wappinger last year and two projects for the Tri -municipal Sewer Commission. His office was the second place bidder at $1,966,666. The low bidder was Clayton Industries at $1,593,250. Mr. Compagni wished to point out several reasons why the Town should not accept the bid.. On May 29th of this year Clayton Industries was the low bidder on a project for New York State Office of General Services in Red Hook, New York. Clayton Industries submitted a Bid Bond for that project that was unauthorized by the Bonding Company. The bid was disqualified by the New York State Office of General Services for that reason. He is urging the Town Board to see if Clayton has done this again. That would k make his bid invalid. Another reason why Mr. Compagni feels that Clayton Industries should not be awarded the project is that Clayton Industries is presently in default on a project in the Town of Walkill. On June 28, 2002 5 bidders, including Grant Street Construction were asked by Claytons Bonding Company to submit bids for the completion of that project. The project is in such disarray, that not a single contractor submitted a bid. Discussion followed. 07/01/2002.RGM A Public Hearing was held on the proposed Law Revising the Salary of the Superintendent of Highways. PRESENTATIONS • Pat Carendia/Executive Session At this time 7:45 p.m. COUNCILMAN BETTINA moved to go into Executive Session to meet with residents in regard to pending litigation, seconded by Councilman Colsey and unanimously carried. The meeting reconvened at 8:30 p.m. with all board members present. There was no action taken at the Executive Session • Kevin Jeffries of Northeast Computer Services gave a presentations on Developing a long term master technology in terms of Web site for the Town of Wappinger. Don Crane of Software Consultants gave a presentation on implementing data sharing. Ken Scherrieble of Valley River Inc., gave a presentation on Geographic Information System. Alpine/Whitegate Sewer, Jay Paggi. COUNCILMAN VALDATI moved to authorize up to $10,000 for the Alpine/Whitegate sewer interconnection on the Alpine property. Seconded by Councilman Paoloni Motion Unanimously Carried • Chelsea Area Water. Councilman Bettina wishes to get a plan in place to provide water in the Chelsea Area. and wishes to put this on the agenda again. Discussion followed. Jay Paggi, Engineer to the Town announced that he would draft a letter to Dan Stone regarding status. • Cranberry Hill Project. Al Roberts Attorney to the Town was authorized to draft a Local Law and proceeded to go over the conditions of the Local Law. Peter Cherneff, Attorney for Cranberry was concerned that the way this law is laid out would create an architectural review board and Cranberry would not want to be in a situation where many years down the road a new board would want to review the lay out of the homes. The issues that this board has raised may not be resolved in the near future. He wants this board to set the standards. Discussion followed COUNCILMAN BETTINA moved to table, seconded by Councilman Valdati and unanimously carried. :xamples Architectural Review/Dan Wery. Mr. Wery explained we need some how the other towns do their review and recommends we go with a separate architectural review board. Discussion followed. • Town Board Office and Councilpeople. Don Swartz and Mr. Ruggiero will get together and get something for the towns review. RESOLUTION NO. 186-2002 0 07/01/2002.RGM AWARD 99-2R CONTRACT NO. 6 COUNCILMAN COLSEY moved to table Resolution No. 186-2002, Awarding 992R Contract No. 6 until all references are contacted and the Town Attorney completes his research. Seconded by Councilman Valdati Motion Unanimously Carried RESOLUTION NO. 189 - 2002 RESOLUTION TO AUTHORIZE THE ADOPTION OF A LOCAL LAW ENTITLED "LOCAL LAW #9 OF THE YEAR 2002 REVISING THE SALARY OF THE SUPERINTENDENT OF HIGHWAYS FOR CALENDAR YEAR 2002" The following Resolution was introduced by Councilman Paoloni and seconded by Councilman Bettina WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger introducing a proposed Local Law entitled "Local Law #9 of The Year 2002 Revising the Salary of the Superintendent of Highways for Calendar Year 2002" for consideration of adoption by the Town Board; and WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News, the official newspaper of the Town; and WHEREAS, a Public Hearing was held on July 1, 2002 and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any part thereof; and WHEREAS, the Town Board determined that the proposed Local Law was not subject to environmental review; and WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in the best interest of the Town to adopt said Local Law. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger hereby adopts the Local Law entitled "Local Law #9 of The Year 2002 Revising the Salary of the Superintendent of Highways for Calendar Year 2002", a copy of which is attached hereto and made a part of this Resolution; and BE IT FURTHER RESOLVED that the Town Clerk is directed to post and publish a Notice of Adoption of Local Law subject to Permission Referendum in the form annexed hereto. COLSEY, Councilman Voting This Resolution is hereby duly declared adopted. 3 Aye Aye Aye Aye Aye 3 07/01/2002.RGM RESOLUTION NO. 212-2002 RESOLUTION TO AUTHORIZE THE REPAIR OF DUGOUT ROOFS AT THE ROBINSON LANE RECREATION AREA The following Resolution was introduced by Councilman Bettina and seconded by Councilman Colsey. WHEREAS, the Recreation Committee has recommended the removal and replacement of the decaying plywood and installation of rubber roofing for four (4) dugout roofs at the Robinson Lane Recreation Area; and WHEREAS, the Town Board wishes to authorize the removal and replacement of the decaying plywood and installation of rubber roofing of said dugout roofs and award the repairs to be completed to Bracaden Construction with an office at 304 Cary Road, Fishkill, New York 12524. NOW, THEREFORE, BE IT RESOLVED, as follows: The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. Bracaden Construction with an office at 304 Cary Road, Fishkill, New York 12524 is hereby authorized to remove and replace the decaying plywood and install rubber roofing to four (4) dugout roofs at the Robinson Lane Recreation Area at a cost of Three Thousand Five Hundred and Ten Dollars ($3,510.00) from Recreation Account No. A-7110.4, in accordance with the letter dated June 14, 2002 from Ralph Holt, Recreation Chairman, to the Town Board Members. Seconded by Councilman Valdati Motion Unanimously Carried RESOLUTION NO. 215 —2002 RESOLUTION AUTHORIZING RESIDENT BARBARA CONLEY CONNECTION TO CENTRAL WAPPINGER WATER DISTRICT 4 07/01/2002.RGM The following Resolution was introduced by Councilman Valdati and seconded by Councilman Colsey. WHEREAS, Barbara Conley resides and owns property at 13 Bel Air Lane in the Town of Wappinger; WHEREAS, Ms. Conley's property is situated outside the Central Wappinger Water District; and WHEREAS, Ms. Conley has requested in writing authorization to have her property connected to the Central Wappinger Water District as a Tenant; and WHEREAS, Ms. Conley has demonstrated hardship in her letter dated June 27, 2002 to Supervisor Joseph Ruggiero. NOW THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth an adopted herein. 2. Barbara Conley, residing and owning property at 13 Bel Air Lane, Town of Wappinger, New York, is hereby authorized to connect to the Central Wappinger Water District as a Tenant, Effective upon the Towns receipt of an executed Central Wappinger Water District Tenant Agreement and payment or required fees. 3. Barbara Conley will pay the same water/sewer service charge that is paid by District residents.
