SUPERVISOR RUGGIERO opened the meeting at 7:35 p.m. Joseph Ruggiero, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Christopher Colsey, Councilman Joseph Paoloni, Councilman Gloria J. Morse, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts Attorney to the Town Graham Foster, Highway Superintendent The Supervisor asked all to join in the Pledge of Allegiance to the Flag. RECEIPT & APPROVAL OF MINUTES The Minutes of the Workshop Meeting of May 13, 2002, Special Meeting of May 15, 2002 and Town Board Meeting of May 28, 2002 having previously been forwarded to the Board Members, were now placed before them for their consideration. COUNCILMAN BETTINA moved to accept the above stated Minutes as submitted by the Town Clerk be and they are hereby approved. Seconded by COUNCILMAN VALDATI Motion Unanimously Carried SUSPENSION OF RULES FOR PUBLIC COMMENT ON AGENDA ITEMS COUNCILMAN BETTINA moved to suspend the rules for purposes of public comment on agenda items. Seconded by COUNCILMAN COLSEY Motion Unanimously Carried PRESENTATIONS: MEADOWOOD SUBDIVISION. Jay Paggi Engineer to the Town explained that the Meadowood subdivision evolved into three phases. The first phase was five lots, just adjacent to the farm house on Old Hopewell and All Angels Hill Road and fourteen lots across from the Jehovahs Witness Church on All Angels Hill Road and a yet to be determined phase off Old Hopewell across from Balfour Road. It was found that the soil that existed in the five lots on All Angels Hill Road and fourteen lots in phase I across from the Church was underlying with sand and gravel and therefore very conducive to individual tile field systems, rather than a central collection system. The question that the board needs to face is what to do with the five lots on All Angels Hill Road and the fourteen I 06/24/2002 lots in phase I further down All Angels Hill Road. They were in the sewer district, and it was determined through the process that these lots would be better served by individual septics because of the soil underneath. The first alternative would be to seek special legislation to remove these parcels from the district. The second alternative would be to charge a yearly benefit assessment and keep them in the district. The third alternative would be to construct a sanitary facility for these five plus fourteen parcels. It is not the intention of Mr. Domber to pursue it. Mr. Paggi recommends seeking special legislation to remove the lots from the district. Discussion followed. COUNCILMAN VALDATI moved to authorize Al Roberts Attorney to the Town to prepare Special Legislation to remove these parcels from the district. Seconded by Councilman Bettina Motion Unanimously Carried. COMMUNITY NETWORK.NET Marc Molinaro gave a presentation on Community Network.Net. The company expanded five years ago to include not for profit and municipal work. Specifically, Grant Writing, Web Site Design, production and promotion for municipalities and not for profits. They have been working with several municipalities assisting them in preparing grant proposals for funding opportunities. Mr. Molinaro had prepared three proposals that were before the board this evening. Working with the Town of Fishkill alone, his company has secured over $400,000 in Grant Funding. TECHNOLOGY MASTERPLAN This presentation was postponed due to a death in the family. BEAUTIFICATION Supervisor Ruggiero introduced Dave Kvinge of Frederick Clark Associates and Stacey Bohannon of J& S Signs who designed a prototype of what a Town of Wappinger sign may look like. We have $5,000 in our budget for beautification. Dave Kvinge informed the Board that he and the Supervisor drove around town and looked at eighteen sites that may be a central location for signage of this type. It would add identity to the town and spruce up some intersections. He presented slides of the proposed signs and plantings envisioned for many of the town sites. MASTER PLAN Town Planner, Dan Wery went over the proposal that was submitted on June 7th of this year. This proposal lays out a scope of services that are proposed that are broken down into three primary steps. Basic studies, which takes information from past plans and studies, and update them. The next major N 06/24/2002 step is the community outreach which helps guide the discussion that we have. We recommend that a committee be established to guide the process and the committee would be represented by 15 to 30 representatives from the community, including the Town Board, Zoning Board, Business Community, Developer, and various agencies that will have impact upon the town. The last major step is preparation and planning. There would be public input in each of these stages. This process will take approximately two years to complete. Saris of Gellert & Quartararo P.C. doing business at 3010 Westchester Avenue, Suite 302, Purchase, New York 10577, for the out standing balance of Seven Hundred and Forty Dollars ($740) for legal service rendered in 2001 relating to tax certiorari matters. NOW, THEREFORE, BE IT RESOLVED, 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. RESOLUTION NO. 191-2002 INTRODUCING LOCAL LAW NO. OF 2002 AS AMENDED REGULATING GARAGE AND YARD SALES IN THE TOWN OF WAPPINGER The following Resolution was moved by COUNCILMAN COLSEY and seconded by Councilman Bettina. WHEREAS, the Town Board of the Town of Wappinger recognizes that repeated and frequent garage and yard sales threaten the peace and quiet of I 06/24/2002 residential neighborhoods and pose a threat to the health, safety, convenience and general welfare of the residents of the Town of Wappinger; and WHEREAS, the Town Board of the Town of Wappinger has determined that the Code of the Town of Wappinger does not contain adequate provisions relating to the frequency, number and extent of garage and yard sales in residential neighborhoods within the Town of Wappinger; and WHEREAS, the Town Board of the Town of Wappinger has currently before it a proposed local law which will regulate the frequency, number and extent of garage and yard sales in residential neighborhoods in the Town of Wappinger; and WHEREAS, the Town Board has determined that the proposed Local Law, which adopts a Local Law regulating the frequency, number and extent of garage and yard sales, is a Type II Action as defined in 6 NYCRR 617.5 and Section 117 of the Code of the Town of Wappinger, not requiring environmental review pursuant to provisions of the New York State Environmental Quality Review Act (SEQRA). NOW, THEREFORE, BE IT RESOLVED: The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted at length herein. 2. WHEREAS, the Zoning Administrator of the Town of Wappinger has advised that the Town's Zoning Code Definition of Building Height does not concur with the New York State Building Code; and WHEREAS, the Fire Prevention Bureau has made recommendations for updating driveway requirements; and WHEREAS, the Town Board has determined that it is in the best interest of the citizens of the Town of Wappinger to amend the Town's Zoning Code Definition of Building Height and to update the driveway requirements; and WHEREAS, the Town Board has determined that the proposed action is an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law, 6 NYCRR 617 (commonly known as SEQRA) and pursuant to Chapter 117 of the Code of the Town of Wappinger (the Town's Environmental Quality Review Law); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, and Lead Agency for this action; and WHEREAS, the Town Board has not made a Determination of Significance pursuant to SEQRA and reserves the right to make such Determination until after the conclusion of the Public Hearing. NOW, THEREFORE, BE IT RESOLVED: 1. The Town Board hereby introduces for adoption Local Law No. of 2002 in the form annexed hereto. 2. RESOLUTION NO. 193-2002 RESOLUTION INTRODUCING LOCAL LAW NO. _ OF THE YEAR 2002 AMENDMENTS TO THE TOWN OF WAPPINGER CODE REGULATINGPEDDLING AND SOLICITING The following resolution was moved by COUNCILMAN COLSEY and seconded by Councilman Bettina. WHEREAS, the Town Board of the Town of Wappinger recognizes the increase of transient solicitors and peddlers and those who establish themselves at fixed locations potentially impact the health, safety, and general welfare of the residents of the Town of Wappinger; and WHEREAS, the Town Board of the Town of Wappinger has determined that the Code of the Town of Wappinger does not contain adequate provisions regulating peddling and soliciting within the Town of Wappinger; and WHEREAS, the Town Board has determined that it is in the best interest of the citizens of the Town of Wappinger to amend the Town's Code regulating peddling and soliciting; and K 06/24/2002 WHEREAS, the Town Board has determined that the proposed Local Law, which amends the Town Code regulating peddling and soliciting is a Type II Action pursuant to Article 8 of the Environmental Conservation Law, 6 NYCRR 617 and Local Law 6 of 1992 not requiring environmental review. NOW, THEREFORE, BE IT RESOLVED: The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted at length herein. 2. RESOLUTION NO. 194-2002 RESOLUTION INTRODUCING LOCAL LAW NO. _ OF THE YEAR 2002, AMENDING THE ZONING LAW OF THE TOWN OF WAPPINGER REGARDING DENSITY UNITS AND NET LOT AREA FOR MULTI -FAMILY DISTRICTS The following resolution was introduced by COUNCILMAN VALDATI and seconded by Councilman Paoloni. WHEREAS, it has come to the attention of the Town Board of the Town of Wappinger that the Town of Wappinger Zoning Code's multi -family density unit formula does not take into consideration environmental constraints of the subject land; and WHEREAS, the Town Board has determined that it is in the best interest of the citizens of the Town of Wappinger to delete the definition of the term `Density Unit" and replace its use with "Dwelling Unit" and to define the term "Net Lot Area" and require calculation of the number of permitted 06/24/2002 dwelling units, floor area and lot coverage based upon the "Net Lot Area," that portion of the subject property that is without severe environmental constraints of wetlands, floodplain and steep slopes in excess of 25%; and WHEREAS, the Town Board has determined that the proposed action is an Unlisted Action pursuant to Article 8 of the Environmental Conservation Law, 6 NYCRR 617 (commonly known as SEQRA) and pursuant to Chapter 117 of the Town of Wappinger Code (the Town's Environmental Quality Review Law); and WHEREAS, the Town Board has determined that the proposed Local Law is an action for which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead Agency for this action; and WHEREAS, the Town Board has not made a Determination of Significance pursuant to SEQRA and reserves the right to make such Determination until after the conclusion of the Public Hearing. RESOLUTION NO. 196-2002 RESOLUTION CREATING THE POSITION OF DEPUTY ZONING ADMINISTRATOR The following Resolution was introduced by COUNCILMAN BETTINA and seconded by Councilman Paoloni. WHEREAS, the Town Board wishes to create the new position of Deputy Zoning Administrator to the Town Board and the Town Supervisor; and WHEREAS, the position will pay a salary of Grade 7, Step 1 with pay at $30,796 per year; and WHEREAS, the duties of the Deputy Zoning Administrator will include: To administer, enforce, and make interpretations of the Town of Wappinger Zoning Code; To generally work under the guidance and direction of the Town of Wappinger Zoning Administrator; To have all of the power and duties of the Zoning Administrator and act as the assistant to the Zoning Administrator; To assume the powers, duties and obligations of the Town of Wappinger Zoning Administrator whenever the Zoning Administrator is out of Town, sick, disabled or otherwise unable to perform the duties of Zoning Administrator. The duties generally include the enforcement of the Town of Wappinger Zoning Code, review and approve applications to the Planning Board, issue written interpretations of the Town of Wappinger Zoning Code, prepare and complete Orders to Remedy (OTR) as well as appearance tickets, affidavits, supporting depositions and other legal instruments for the enforcement of the Town of Wappinger Zoning Code, prepare and issue Violation Orders, review and permit various permit applications, review and approve applications to the Zoning Board of Appeals, and attend and la 06/24/2002 participate, as needed, at Town Board, Planning Board and Zoning Board of Appeals meetings. The duties generally include the enforcement of the applicable Town of Wappinger Zoning Code, review and approve applications to the Planning Board, issue written interpretations of the Town of Wappinger Zoning Code, prepare and complete Orders to Remedy (OTR) as well as appearance tickets, affidavits, supporting depositions and other legal instruments for the enforcement of the Town of Wappinger Zoning Code, prepare and issue Violation Orders, review and permit various permit applications, review and approve applications to the Zoning Board of Appeals, and attend and participate, as needed, at Town Board, Planning Board and Zoning Board of Appeals meetings. The sum of $16,000 shall be transferred from the "B" Fund Balance to Line Item 8015.100 B to fund this position for the remainder of calendar year 2002. The Town Board is hereby authorized and directed to interview and hire a qualified person for this position consistent with Dutchess County Civil Service Guidelines. RESOLUTION NO. 211-2002 AUTHORIZING THE TOWN BOARD OF THE TOWN OF WAPPINGER TO SUBMIT AN APPLICATION FOR GRANT FUNDS TO THE HUDSON RIVER VALLEY GREENWAY FOR THE DEVELOPMENT OF GROUNDS IN RELATION TO THE HUDSON RIVER SHORELINE BORDERING GREYSTONE ESTATE The following Resolution was introduced by COUNCILMAN PAOLONI and seconded by Councilman Colsey. WHEREAS, the Town Board of Wappinger, a designated Compact Community member of the Hudson River Valley Greenway will submit to the Greenway an application for $25,000 in grant funds to assist in the rehabilitation and re -development of the property known as Greystone Estate; and WHEREAS, the Town Board of Wappinger will provide a required 50% match to funds requested from the Hudson River Valley Greenway from sources such as cash donations, Town force account, donated labor, materials, and volunteerism; and WHEREAS, the Supervisor of the Town of Wappinger has requested authorization from the Town Board of Wappinger to file a grant application to the Hudson River Valley Greenway for said purposes. NOW, THEREFORE, BE IT RESOLVED, that Joseph Ruggiero, Supervisor of the Town of Wappinger is hereby authorized and directed to file an application for funds from the Hudson River Valley Greenway in an amount not to exceed $25,000 and upon approval of said request, to enter into and /I 06/24/2002 execute a project agreement with the Hudson River Valley Greenway under the auspices of the State of New York for such financial assistance to the Town of Wappinger. NEW BUSINESS SUPERVISOR RUGGIERO announced that he and Graham Foster were called out to Spook Hill Road during the last rain storm to look at the bad curve in front of the home of Angelo Antenucci of 74 Spook Hill Road. GRAHAM FOSTER informed the board that he had installed guide rails in that area, but cars coming from Old Hopewell Road to Spookhill Road at excessive speed, especially in wet weather, spin out and go out of control and end up on the lawn of 74 Spookhill Road. There has been some property donated to the town as part of home being built on the corner, and in order for Mr. Foster to do anything with the property, the town would need the firm of Jay Paggi to see if its possible to lay a curve at the suggested speed for that road. Mr. Antenucci claims the cars spin out of control and land in his yard. He is asking for the boards help. Discussion followed. COUNCILMAN VALDATI moved to repetition the D.O.T. siting St. Nicholas, Losee, and Spookhill Roads as dangerous roads. Seconded by Mr. Colsey. Motion Unanimously Carried COUNCILMAN VALDATI wished to know the status of all the cars, junk, etc. at the intersection of Old Hopewell Road and Route 9. The Zoning Administrator answered that an Order to Remedy was issued on March 26, 2002, and a new one was sent on June 30 with new charges. ,-20 06/24/2002 COUNCILMAN BETTINA wishes to address the problem of unlicensed vehicles in driveways. It is an eyesore. He was told that one car is allowed. COUNCILMAN BETTINA moved to authorize the Town Planner, Attorney to the Town and Engineer to the Town to come up with architectural reviews for cluster housing, multi -family and special use permits.
