The Reorganization Meeting of the Town Board of the Town of Wappinger was held on January 2, 2002 at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. SUPERVISOR RUGGIERO Opened the Meeting at 7:30 p.m. Present: Joseph Ruggiero, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Christopher Colsey, Councilman Joseph Paoloni, Councilman Others Present: Albert Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent Absent: Gloria J. Morse, Town Clerk The SUPERVISOR asked all to join in the Pledge of Allegiance to the Flag. The SUPERVISOR confirmed the appointment of Gina Basile, Confidential Secretary to the Supervisor, Andrea Paustian as Bookkeeper and hereby appoints Joseph Paoloni as Deputy Supervisor. COUNCILMAN COLSEY moved to accept the above confirmations and appointments as presented by the Supervisor and place on file. Seconded by Mr. Valdati Motion Unanimously Carried The TOWN CLERK confirmed the appointment of Sandra Kosakowski as First Deputy Clerk, Florence Hannon as Second Deputy Clerk & Dorothy Groark as Third Deputy. COUNCILMAN BETTINA moved to accept the above confirmation as presented by the Town Clerk and place them on file. Seconded by Mr. Paoloni Motion Unanimously Carried The HIGHWAY SUPERINTENDENT confirmed the appointment of George Silvestri, as Deputy Highway Superintendent. RESOLUTION NO. 03 2002 TOWN BOARD, TOWN OF WAPPINGER APPOINTING THE COMPTROLLER IN THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption: RESOLVED, that Gerald Terwilliger be and he hereby is appointed to the office of Comptroller in the Town of Wappinger, to serve in such capacity for a term ending on the 31st of day of December, 2002, and BE IT FURTHER RESOLVED, that the Comptroller be paid an annual salary of $47,313.00 payable every Friday throughout the year 2002, with the first payday to be January 4, 2002. RESOLVED, that the salary for Andrea Paustian, Bookkeeper for the Supervisor of the Town of Wappinger be and the same hereby is fixed at an annual rate of $28,059.00 to be paid every Friday throughout the year 2002, with the first payday to be January 4, 2002. Seconded by Mr. Valdati Motion Unanimously Carried RESOLUTION NO. 07 2002 TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: 4 01/02/2002.REO.MTG. RESOLVED, that the pay scale for the employees hired by the Town of Wappinger Highway Department will be in accordance with the C.S.E.A. contract, and BE IT FURTHER RESOLVED, that all such Highway Department employees engaged on an hourly basis shall be paid every Friday throughout the year 2002 with 52 pay periods during such year consistent with the pay schedule in accordance with a signed C.S.E.A. contract, with the first payday to be January 4, 2002. RESOLVED, that Gloria J. Morse be and she is hereby appointed to serve as Registrar of Vital Statistics to the town of Wappinger, Dutchess County, New York, for a term of two years commencing January 1St, 2002 and ending December 31St, 2003, pursuant to Section 4123, Public Health Law, and BE IT FURTHER RESOLVED, that said Registrar of Vital Statistics to the Town of Wappinger shall receive no salary or compensation, however, she shall be entitled to receive for the performance of the duties of this respective office the fees fixed by applicable statute. Seconded by Mr. Paoloni Motion Unanimously Carried RESOLUTION NO. 17 2002 TOWN BOARD, TOWN OF WAPPINGER APPOINTING A CONSULTANT TO THE RECREATION COMMITTEE OF THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: RESOLVED, that Ralph Holt, Chairman of the Recreation Committee, be and he hereby is appointed to serve as the Consultant to the Town of Wappinger Recreation Committee, and BE IT FURTHER RESOLVED, that the annual salary for the Consultant to the Recreation Committee of the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $ 10,924.00 to be paid every Friday throughout the year with the first payday to be January 4, 2002. Motion Unanimously Carried RESOLUTION NO. 18 2002 TOWN BOARD, TOWN OF WAPPINGER DESIGNATING COURT OFFICER FOR THE TOWN OF WAPPINGER JUSTICE COURT The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the Town Justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $ 10.26 for time actually served, and BE IT FURTHER RESOLVED, that Armed Court Officers shall be compensated at the hourly rate of $14.38 for time actually served at sessions of Court where their services are required and, BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis, the names and hours served, and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing, from funds appropriated for Justice Court, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the Year 2002. Seconded by Mr. Bettina Motion Unanimously Carried RESOLUTION 2002-19 TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE SALARIES OF CERTAIN PART-TIME AND FULL TIME POSITIONS IN THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: 10 01/02/2002.REO.MTG. RESOLVED, that the designated salaries for the following persons holding full time or part-time positions, as otherwise fixed, be and the same hereby are fixed and established as follows: Gary Corbett Vandalism Patrol Coordinator $ 19.97 per hour. Gretchan Leak Recycling Assistant (weekly) $ 40.00 BE IT FURTHER RESOLVED, that all such persons so designated shall be paid every Friday throughout the year 2002, with 52 pay periods during such year, with the first payday to be January 4, 2002. Seconded by Mr. Paoloni Supervisor Ruggiero informed the Board that Sargent Corbett is currently on military duty at the World Trade site, and in his absence Sargent Waterson is acting on his behalf. Supervisor Ruggiero will be meeting with Sargent Waterson in the next few days. Motion Unanimously Carried RESOLUTION 2002-20 TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE WEEKLY PAY SCALE FOR CERTAIN RECREATION EMPLOYEES The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the weekly salaries for certain personnel retained to give weekly exercise classes to the Senior Citizens be and the same hereby is established as follows. Susan Borchardt Exercise Lessons $ 20.00 per session BE IT FURTHER RESOLVED, that all such personnel engaged on a weekly basis shall be paid every Friday throughout the year 2002 with the first payday to be January 4, 2002. Seconded by Mr. Paoloni Motion Unanimously Carried RESOLUTION 2002 —21 TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING REMUNERATION FOR METER READERS 11 01/02/2002.REO.MTG. The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption: RESOLVED, that the remuneration for, Barry Kaufman, and Doreen Kaufman, Town of Wappinger Meter Readers, be established at the rate of $1.00 per meter, and BE IT FURTHER RESOLVED, that the remuneration shall be consistent with number of meters read, and the Comptroller is empowered to issue remuneration upon approval by the Supervisor. RESOLVED, that Marshall & Sterling, a general insurance agent doing business in the Town of Wappinger, Dutchess County, New York be and it hereby is designated as the Insurance Agent for this Town. Seconded by Mr. Colsey Supervisor Ruggiero informed that Board that he was notified during the last week prior to taking office, that the Town's insurance was about to expire. Jack Peluse of Marshal & Sterling contacted the insurance company to make sure we were covered. After speaking to other Supervisors, Mr. Ruggiero was informed that there were ways to go out to bid for insurance to save the Town money, which he wishes to pursue, but he did not want our insurance to lapse. Mr. Peluse assured him that he has renewed the insurance and within the next few months we can discuss going out to bid. A RESOLUTION AUTHORIZING THE ISSUANCE OF $250,000 BONDS OF THE TOWN OF WAPINGER, DUTCHESS COUNTY, NEW YORK, FOR THE ACQISITION OF VARIOUS MACHINERY AND APPARATUS FOR CONSTRUCTION AND MAINTENANCE PURPOSES FOR USE BY THE HIGHWAY DEPARTMENT IN AND FOR SAID TOWN WHEREAS, the applicable provisions of the State "Environmental Quality Review Act have been complied with to the extent required with respect to the above -titled purpose; BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows" Section 1. The financing of the acquisition of various machinery and apparatus for construction and maintenance purposes for use by the Town Highway Department in and for said Town, a class of objects or purposes, is hereby authorized. Section 2. The maximum estimated costs of such class of object or purposes is $250,000, and the plan for the financing thereof is by the issuance of $250,000 bonds of said Town hereby authorized to be issued therefor pursuant to the Local Finance Law. Section 3. It is hereby further determined that the period of probable usefulness of the aforesaid class of objects or purposes is five (5) years, pursuant to subdivision 28 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity 24 01/02/2002.REO.MTG. Of the bonds herein authorized will not exceed five years, and that the foregoing is not an assessable improvement. Section 4. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Town Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such obligations as the same respectively become due and payable in such year. Section 6., Subject to the provisions of this Resolution and of the Local Finance Law, and pursuant to the provisions of 30.00 relative to the authorization of the issuance of bond anticipation notes or the renewals thereof, and of 50.00 and 56.00 to 60.00 of the Local Finance law, the powers and duties of the Town Board relative to authorizing the issuance of any notes in anticipation of the sale of the bonds herein authorized, or the renewals thereof, and relative to prescribing the terms, form and contents and as to the sale and issuance of the bonds herein authorized, and of any notes issued in anticipation of the sale of said bonds or the renewals of said notes, are hereby delegated to the Town Supervisor, as the chief fiscal officer of the Town. The Town Supervisor may sell such bonds at public or private sale, at a discount or premium, at fixed or variable rates of interest or at no interest whatsoever, or as capital appreciation bonds, and with such amortization of principal as the Town Supervisor shall determine is most favorable to said Town, and in compliance with any rules of the State Comptroller applicable thereto. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. The Town Supervisor, in the event it is determined to issue variable rate bonds, is hereby authorized to enter into such agreements as said officer finds reasonable to facilitate the issuance, sale, resale and repurchase of such bonds, as authorized under Section 54.90 of the Local Finance Law. The Town Supervisor is also authorized to enter into such agreements and take such other action as my be necessary or appropriate and lawful to assure that interest on the bonds and notes authorized hereby will not be includable in the gross income, for federal income tax purposes, of the recipients thereof. 25 01/02/2002.REO.MTG. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution Section 8. This resolution, which is effective immediately, shall be published in summary in the Southern Dutchess News, the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. SUPERVISOR RUGGIERO announced that Kevin Jeffreys came in today to help set up the e-mail account for the Supervisors office. The Councilman will get official e-mail accounts that can be logged in from their homes to get e-mail and correspondence. Once it is all set up, you will be given the passwords in order to log in from home. The locks have been changed and new keys will be issued. There were also problems with the phones and the heat. COUNCILMAN BETTINA wished to look into going out to state bid for purchase of a four wheel drive car for the Supervisor, at a future workshop.
