COS:dly i 12/10/2001.WS The Workshop Meeting of the Town of Wappinger was held on December 10, 2001, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:32 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman (arrived at 7:45 p.m.) Joseph Ruggiero, Councilman Joseph Paoloni, Councilman (arrived 7:35 p.m.) Gloria J. Morse, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent Jay Paggi, Engineer to the Town was authorized to look at the wells that supply the existing Alpine Shopping Center to see if it would be plausible to tie into the Town system. Mr. Paggi reviewed the Preliminary and Final Water Supply Reports done for Alpine Commons, prepared by Ground Water Associates in October 1989. The three well yields are as follows: • BR1: 11 gpm • BR2: 12 gpm • BR3: 8 gpm Ground Water Associates recommended that the combined pumping rates for BR1 and BR2 when pumped simultaneously is 23 gpm. They go on further to recommend that those two (2) wells should not be pumped more than 18 hours a day with 6 hour recovery. BR3 should only be used as a backup. Pumping at rates greater than 23 gpm could impact the yield of the surrounding private wells. It was determined that the theoretical yield would be limited to 23 gpm for 18 hours per day or 24,840 gallons per day. The initial water quality results indicated that no Part V maximum contaminant level was exceeded. However, he has filed a F.O.I.L request with the Dutchess County Health Department to get more recent quality data. Assuming that this water quality data,comes back good, it would appear that the work required to convert the existing Alpine private supply system into a Town owned system would not be worth the yield of 24,840 gpd. One item that might be considered is keeping this source for the Alpine Shopping Center only under municipal control. This may allow Alpine to be part of the proposed Wappinger Park Water District extension, but not utilize any excess capacity. If this is the case, it may be prudent to have the attorney research whether or not they could be charged the same capital expense. Discussion followed. COUNCILMAN RUGGIERO moved to accept the report and place it on file. 1 Seconded by Mr. Valdati 12/10/2001.WS Motion Unanimously Carried Correspondence from Zvi Segal, President of Z & M Development Corp., in reference to the dedication of Phase II Sherwood Heights. Mr. Paggi, and Mr. Foster requested Mr. Segal to prepare the last portion of Sherwood Heights so it could be dedicated to the Town of Wappinger. Mr. Segal stated that the top coat was installed about a month ago and all other work necessary for the dedication is about to be completed. All the legal documents for the section requested by the Town Attorney were submitted to the Town of Wappinger on September of 1997, prior to the issuance of any building permits. He is aware that the residents on this road are anxiously awaiting for the road dedication in order for the school buses to pick up their children before winter arrives. Discussion followed. COUNCILMAN PAOLONI moved to accept the dedication of the road with the condition that $15,000 be provided in escrow for seeding and removal of the temporary cul de sac. Also 20% of the original Performance Bond be set aside to become the Maintenance Bond for 1 year and the temporary cul de sac be removed by June 1St, 2002. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Ralph Holt, Recreation Chairman in regard to the Town Personnel Policy that was adopted by the Town Board on May 29,2001. He is questioning Section 6, in reference to "Holidays" on page 12. Based on the text of the policy, "The Town designates certain holidays during which the Town offices will be closed for business. Full and part time employees scheduled to work on a holiday will be paid at a regular rate". Mr. Holt feels that part time employees should be paid for Election Day and other upcoming holidays if they are normally scheduled to work those days. Discussion followed. COUNCILMAN PAOLONI moved to clarify policy to reflect part time employees whose regular work day falls on a Town holiday be paid straight time for that day. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence from Sal Morello in regard to a salary reimbursement. On October 22, 2001, the Town Board authorized Mr. Morello be compensated in the amount of $2,696.33 for duties he performed as Acting Building Inspector when in fact he was the Deputy Building Inspector. According to Mr. Morello's calculations he is owed $3,096. Discussion followed. 2 12/10/2001.WS COUNCILMAN RUGGIERO moved to authorize back pay of $3,096 owed to Mr. Morello for duties he performed as acting Building Inspector. Seconded by Mr. Paoloni Motion Unanimously Carried SUPERVISOR SMITH also announced that Mr. Morello has now moved to 24 Lyons Road, Cold Spring, New York, but he still needs a waiver of residency for the County. A Local Law must be introduced for the waiver of residency COUNCILMAN RUGGIERO moved to introduce the Local Law for waiver of residence for Deputy Building Inspector and set the Public Hearing for December 27, 2001 at 7:25 p.m. Seconded by Mr. Paoloni Motion Unanimously Carried A memorandum was received from Highway Superintendent Graham Foster in regard to Jay Paggi's correspondence dated June 6 1989, the Nicodemus drainage, Route 376 and Diddell Road. Mr. Foster explained that the problem still exists and was not addressed at the time. He feels we should once again pursue the problem. Since we will be involved in State permits, we should make sure we are ready to do the project next Spring. COUNCILMAN RUGGIERO moved to table this project to the new year. Seconded by Mr. Valdati Motion Unanimously Carried Next is a report from Jay Paggi, Engineer to the Town on the Rockingham Curbs. COUNCILMAN RUGGIERO moved to table to the new year. Seconded by Mr. Bettina Motion Unanimously Carried A memorandum was received from Tatiana Lukianoff, Zoning Administrator informing the Board that she would be out of town for today's meeting and wished to table the Hawking & Peddling Law to the January workshop. COUNCILMAN RUGGIERO moved to refer to Town Planner, Dan Wery and David Stolman for their review and recommendations to clarify and improve this law. Seconded by Mr. Paoloni Motion Unanimously Carried Notification from Jack Peluse, Vice President of Marshall & Sterling Insurance, informing the Board that the existing Group Life Insurance program provides for a reduction in benefits at an employee's age of 65 and 70. The following are steps needed to eliminate these reduction in benefits. • The current rate is $0.63 per $1,000 3 12/10/2001.WS • The new rate to eliminate this reduction in benefits would be $0.64 per $1,000. • We would need a signed endorsement requesting the carrier to eliminate these reductions. Mr. Peluse stated that, assuming the adjustment is only a penny, you would want to correct the situation to prevent problems with any future death claims. COUNCILMAN RUGGIERO moved to authorize Marshall & Sterling to increase the insurance by $.01 per $1,000. Supervisor Smith explained that Danielle was provisional until she took the test, which she passed. COUNCILMAN RUGGIERO moved to appoint Danielle Lent to the permanent position of Court Clerk to the Justice Court. Seconded by Mr. Paoloni Motion Unanimously Carried Correspondence from the Dutchess County Department of Health in regard to Sunset Farms Mobile Home Park (Rawls). They have been experiencing problems with water. A proposal to drill a new well has been put on hold pending an evaluation of a connection to the Town of Wappinger Fleetwood water system. The nearest connection appears to be at the intersection of Ketchamtown Road and Ronsue Drive, approximately 250' from the park entrance on Ketchamtown Road. If available, it would appear that a connection to the Town system would provide the best long-term solution for a quality water supply. Mr. Rawls, owner of the park was recognized, and explained that he has four wells in the park and two of them have gone dry. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi, to amend the Map, Plan and Report proposal to include Sunset Farms Mobile Home Park. Seconded by Mr. Paoloni Motion Unanimously Carried 19 12/10/2001.WS Notification from Richard G. Barger, Licensed Engineer that a proposed 3 lot subdivision called Savanah Court Subdivision, Myers Corners & Spook Hill Road has recently received approval from the Town Planning Board. At this time the applicant requires a letter stating that the Town will supply sewerage for the 3 lots. One is for the existing dwelling and two services for the proposed two lots being created. The land is in the Wappingers Sewer Improvement Area #land the Wappinger Water Improvement Area, but at this time water is not available, therefore the applicants propose to use an existing well for the existing dwelling and drill two additional wells for the newly created lots. Please supply a letter to the applicant, "PRECIOUS PROPERTIES" c/o Richard G. Barger, stating that sewer service is available but water service is not. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi to respond to the applicant on behalf of the Town Board explaining the sewer and water situation on Savanah Court. Seconded by Mr. Valdati Motion Unanimously Carried At this time, 7:58 p.m., COUNCILMAN RUGGIERO moved to go into Executive Session to discuss the Benjamin Construction disputes, seconded by Mr. Bettina and unanimously carried.. The meeting reconvened at 8:07 p.m. with all Board Members present. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi to try to solve the dispute. If no solution, take the matter to court to settle. Seconded by Mr. Paoloni Motion Unanimously Carried. COUNCILMAN VALDATI moved to authorize Supervisor elect Joseph Ruggiero, to meet with professionals, staff, etc. Seconded by Mr. Paoloni Motion Unanimously Carried There was no other business to come before the Board.
