COS:dly 03/12/2001.WS The Workshop Meeting of the Town of Wappinger was held on March 12, 2001 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the meeting to order at 7:30 P.M. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Gloria J. Morse, Town Clerk Others Present: 1 Al Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent A Public Hearing having been held on the proposed Local Law amending the code of the Town of Wappinger to add the "Gold Star Parent" real property tax exemption, the matter of its adoption was placed before the board for their consideration. The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption and seconded by Mr. Ruggiero. LOCAL LAW NO. #1 OF TH YEAR 2001 A Local Law entitled "Local Law Amending the Code of the Town of Wappinger To Add the "Gold Star Parent Real Property Tax Exemption". BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section 1: Title: This Local Law shall be known and cited as Town of Wappinger Local Law No. #1 of 2001, entitled "Local Law Amending the Code of the Town of Wappinger To Add the `Gold Star Parent' Real Property Tax Exemption". This local law shall authorize a real property tax exemption for the parent(s) of a child who died in the line of duty while serving in the United States Armed Forces during a period of war. Section II: Legislative Intent: The Town Board acknowledges that it is in the best interests of the Town and its residents to provide veterans and their families with the maximum relief allowed by law from the burden of real property taxes. The Town Board further acknowledges that veterans have made a significant contribution to their country and therefore to the Town of Wappinger, and that it is appropriate to recognize the contribution in the form of tax relief to veterans and their families. The owners of "qualifying residential real property," as defined in Real Property Tax Law 458-a, Subdivision 1(d), are currently provided with the maximum tax exemptions allowable to veterans. 1 03/12/2001.WS The Town Board has determined that, to the extent that the additional tax relief is authorized by the New York State Legislature for the parent(s) of a veteran, the Town of Wappinger is best served by providing that additional { relief. Section III• This Local Law No. #1 of 2001 amends the provisions of Chapter 221, Article III of the Code of the Town of Wappinger by adding the "Gold Star Parent" exemption, thereby implementing the provisions of Chapter 326 of the Laws of 2000. Section IV• Sections 221-5, 221-6, and 221-7 of Chapter 221, Article III of the Code of the Town of Wappinger are hereby amended to read as follows: Section 221-5: TITLE. This article shall be known and cited as Town of Wappinger Local Law No. 4 of 1997 increasing the maximum tax exemptions allowable to veterans by New York State Real Property Tax Law 458-a, Subdivision 2(a), (b) and (c) as amended by Local Law No. #1 of 2001 and by further permitting the `Gold Star Parent' exemption as authorized by the most recent amendments to 458- a, Subdivision 7 of the New York State Real Property Tax Law. Section 221-6: LEGISLATIVE INTENT. This article provides that the maximum tax exemptions allowed to veterans by the New York State Real Property Tax Law 458-a Subdivision 2 (a), (b) and (c) shall be increased, and the Gold Star Parent exemption allowable by New York State Real Property Tax Law 458-a Subdivision 7 is hereby adopted and authorized. The Town Board has determined that it is in the best interests of the Town and its residents to provide the exemptions As authorized by the most recent amendments to 458-a, Subdivision 7 of the New York State Real Property Tax Law. Section 221-7: DEFINITIONS. The Town hereby adopted and authorized the definitions set forth in the New York State Real Property Tax Law 458-a, Subdivision 1, and, in addition, pursuant to the authority granted by the New York State Real Property Tax Law 458-a, Subdivision 7 hereby includes the `Gold Star Parent exemption in the following definitions: Qualified owner shall include the parent(s) of a child who died in the line of duty while serving in the United States Armed Forces during period of war (hereinafter referred to as a `Gold Star Parent'). Qualifying residential real property shall include property owned by a `Gold Star Parent' provided that such property shall be the primary residence of the `Gold Star Parent'. 03/12/2001.WS K3 Section V: Confirmation. Except as modified and amended by this provisions of the Local Law, Section 221 of the code of the Town of Wappinger is otherwise ratified and confirmed. Section VI Separability. The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this local law or their application to other persons or circumstances. It is hereby declared to be the legislative intent of the Town Board of the Town of Wappinger that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, work or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable had been specifically exempt therefrom. Section VII: Effective Date. This Local Law shall take effect immediately upon adoption and filing with the Secretary of State as provided by the Municipal Home Rule Law. BE IT ENACTED by the Town Board of the Town of Wappinger as follows: K3 03/12/2001.WS Section I: Title: This Local Law shall be known and cited as Town of Wappinger Local Law No. #2 of 2001, entitled "Local Law No. #2 of the Year 2001, Amending the Code of the town of Wappinger to Increase the Income Eligibility for Partial Real Property Tax Exemptions for Persons sixty-five (65) years of age or Older", which shall amend the present Town Code fixing the income limitations for eligibility for real property tax exemptions for senior citizens, as set forth below. Section II: Legislative Intent: Section 467 of the Real Property Tax Law has been amended to increase the maximum income eligibility for partial real property tax exemptions for persons sixty-five (65) years of age or older, specifically, from nineteen thousand, five hundred dollars ($19,500.00) to twenty -thousand, five hundred dollars ($20,500.00) and for additional partial exemptions depending on income, provided the combined income is not greater than twenty-eight thousand, eight hundred, and ninety-nine dollars and ninety- nine cents ($28,899.99). The Town Board determines that it is in the best interest of the citizens of the Town of Wappinger to increase the income eligibility for this real property exemption as authorized by the most recent amendments to Section 467 of the Real Property Tax Law. Section III: Increase in Income Eligibility: The Town of Wappinger code 221-2.B is hereby amended to read as follows: Section 221-2.B: In order to be eligible for a 50% tax exemption, the income of the owner of the combined income of the owners of the property shall not and my not exceed the sum of $20,500 for the income tax year immediately preceding the date of making the application for exemption. The "income tax year" shall mean the twelve-month period for which the owner or owners filed a federal personal income tax return, or if no such return is filed, the preceding calendar year. Where Title is vested in either the husband or the wife, their combined income may not exceed such income. Such income shall include social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset which may be off -set by a loss from the sale or exchange of a capital asset in the same income tax year, net rental income, salary or earnings, and the net income from self- employment, but shall not include a return of capital, gifts or inheritances, payments made to individuals because of their status as victims of Nazi persecution, as defined in P.L. 103-286 or monies earned through employment and federal foster grandparent program, and such income shall be off -set by all medical and prescription drug expenses actually paid which 03/12/2001.WS were not reimbursed or paid for by insurance. In computing net rental income and net income from self-employment no depreciation deduction shall be allowed for the exhaustion, wear and tear of real or personal property held ,for the production of income. Section 221-2.0 of the Code of the Town of Wappinger is hereby amended to real as follows: Section 221-2.C: If the income of an eligible property owner or the combined income of the owners of the property exceeds the sum of twenty thousand, five hundred ($20,500.00) dollars, in the income tax year immediately preceding the date of making the application for tax exemption, and is not greater than twenty-eight thousand eight hundred ninety-nine and 99 cents ($28,899.99) dollars, said owner shall be entitled to a partial exemption as follows: ANNUAL INCOME PERCENTAGE OF ASSESSED VALUATION EXEMPT FROM TAXATION Less than $20,500 50% $20,500.01 TO $21,499 45% $21,500.01 TO $22,499.99 40% $22,500.01 TO $23,499.99 35% $23,500.01 TO $23,399.99 30% $24,400.00 TO $25,299.00 25% $25,300.00 TO $26,199.00 20% $26,200.00 TO $27,099.00 15% $27,100.00 TO $27,999.99 10% $28,000.00 TO $28,899.99 5% Section IV: A new Section 221-2.H is hereby adopted to read as follows: Section 221-2.H: All persons who meet the eligibility requirements as set forth in 467 of the Real Property Tax Law, as amended from time to time hereafter, shall be eligible for such exemptions; the Town Assessors shall utilize the criteria set forth in 467 of the Real Property Tax to establish the maximum income limits permitted by said law. Section V: Separability The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, work or part thereof is held illegal or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this local law or their application to other persons or circumstances. Roll Call Vote Vote Constance Smith, Supervisor Aye Robert Valdati, Councilman Aye Vincent Bettina, Councilman Aye Joseph Ruggiero, Councilman Aye Joseph Paoloni, Councilman Aye Motion Unanimously Carried Jay Paggi, Engineer to the Town explained to the board that the Mr. Sammartino owns a small piece of property that goes out to Old Hopewell Road. We need now, to serve Pleasant Lane, an 80' easement to connect into the existing easement. Mr. Sammartino has no problems with granting the easement. He said he will give the town the easement, and also wishes to deed the town the 4.3 acres of his land, which will leave him 13.6 acres. He has no need for the small piece. If the town took this deed, it would give access from Middlebush Road for the town all the way through to Old Hopewell Road. Not so much for vehicles, but for a walking path. Discussion followed. COUNCILMAN BETTINA moved to go into an agreement for the easement we are now pursuing. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN BETTINA moved to authorize Attorney to the Town, Al Roberts to draft an agreement for the property authorizing Mr. Paggi to do the metes and bounds for the subdivision. Seconded by Mr. Paoloni Motion Unanimously Carried Next is to award the bid for the Cider Mill Loop Water Storage Facilities Site Preparation/Piping Contract. On March 9th, 2001 bids were received and opened at 11:00 a.m. for the above referenced contract. The bid results are as follows: 1. Sun Up Enterprises, Inc. $ 65,000.00 2. B & D Excavating, Corp. $121,788.00 3. RGH Construction, Inc. $149,663.75 03/12/2001.WS Jay Paggi, Engineer to the Town has examined all the bids and found them to be in order. As there is a large discrepancy between the low and the second bidder, he contacted the low bidder to make sure that they had considered all items that were to be considered in the bid. He responded that he had. Therefore, Mr. Paggi would recommend that the bid be awarded to Sun Up Enterprises, Inc., in the amount of $65,000 as low bidder. COUNCILMAN PAOLONI moved to award the bid for the Cider Mill loop Water Storage Facility, to Sun Up Enterprises for $65,000 as recommended by Jay Paggi, Engineer to the Town. Seconded by Mr. Bettina Motion Unanimously Carried DiDonato residence, 14 Carroll Drive. Jay Paggi, Engineer to the Town, explained what further efforts would be taken. As for improvements, installation of an additional catch basin on the west side of Carroll Drive and increasing the crown of the road on the western portion of Carroll Drive was a feasible option. This additional catch basin would remove more water from the gutter line and the increased crown would force the road runoff to the gutter line instead of sheeting across the road. Further discussion followed by questions from Mr. DiDonato. He was also concerned with the restoration of his property. He was informed that the contractor will return in the spring to add additional fill to the settled areas regrade the swale, and seed and mulch the entire area. He is also responsible to establish grass in all disturbed areas. NO ACTION TAKEN. Next is Chelsea Water discussion. Lance Graver, and Harry Jones were representing Chelsea. SUPERVISOR SMITH explained that it had been a while since the Town spoke to the previous owners. At that time the Town itself was not ready. As directed by the Town Board, Jay Paggi, Engineer to the Town has examined the feasibility of providing public water supply to the Chelsea area of the Town of Wappinger. It is anticipated that any such public water supply system would be installed in conjunction with the Chelsea Ridge Apartment Complex who are currently evaluating their options for acquiring a central water source. The new owners felt the best way to proceed, is if the Town Board would authorize Mr. Paggi to meet with them and look at various alternatives. Discussion followed. COUNCILMAN BETTINA moved to authorize Jay Paggi, Engineer to the Town to share the proposed feasibility study of providing public water supply to the Chelsea area of the Town of Wappinger, with the new owners. Seconded by Mr. Ruggiero Motion Unanimously Carried 7 03/12/2001.WS COUNCILMAN BETTINA moved to authorize Mr. Paggi to perform a desk top study to include Montclair. Seconded by Mr. Ruggiero Motion Unanimously Carried CAMO Pollution Water System Reports for All Water Districts. Mr. Tremper informed the board that the level of pesticides at well 5, Hilltop are extremely low. These results go to the NYS Health Department and he will include this in the verbiage when he does the consumer confidence report. NO ACTION TAKEN. Next is the status of the water plants. Mr. Tremper informed the Board that last year they did a report on the deficiency in all the water plants in preparation of improvements. Although plans are being made for Atlas and the Hilltop people in North Wappingers Water, and the Central Wappingers Water, there are still issues that are not being addressed. The storage tank at the Oakwood Knolls Water district is in bad condition and needs to be replaced to a 20K tank. There are two wells there, and the outputs in them are dropping off. The output is one well is so low it can't be used. Not only is the quantity of water poor, but the level of iron in that well is very high and when we have to use it in heavy periods, the water quality for the development goes down, and we receive many complaints. There is no generator at the site and no water meters. At some point we will have to do something. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Jay Paggi, Engineer to the Town to perform a feasibility study of building an emergency backup system for Oakwood and authorize the Attorney to the Town to look into the legality. Seconded by Mr. Paoloni Motion Unanimously Carried Mr. Tremper also informed the board that we lack generators at many of our pump and water stations. At times of power outages, it makes for a lot of problems. In our water and sewer facilities, we only have two generators, and one of them is stationery at Oakwood Sewer. We also have two portable ones that must be dragged from area to area. When there is a town wide outage, its very hectic. He has tried to prioritize the areas that are in the greatest need, buts its difficult due to volume and close proximity to homes. The approximate cost for the generators would be $270K. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Jay Paggi, Engineer to the Town to prepare a breakdown of Benefit Units. Seconded by Mr. Bettina Motion Unanimously Carried 03/12/2001.WS Community Center Construction. COUNCILMAN BETTINA moved to authorize Town Planner, Frederick P. Clark Associates to complete the SEQR necessary for the Community Center. Seconded by Mr. Valdati Motion Unanimously Carried Architect, Don Swartz announced that bids for the Roof Canopy for the Town hall will be opened on April 2, 2001. He will get the notice to the Town Clerk to submit to the newspaper. Mr. Swartz also presented a rendering of the proposed Justice Court that had been prepared in 1997. At that time he did a ten year projection. The building itself is about 9,600 square feet and would be constructed with similar materials as the Emergency Services Building. It will seat around 260 people in the courtroom itself, and would provide segregation of prisoner holding and handling chambers across the rear. He will provide the Supervisor with an updated study cost for the next meeting. Discussion followed. NO ACTION TAKEN Correspondence from Ralph Holt, Recreation Chairman, regarding recreation personnel. The town had a study performed on salaries for our full time employees which provided a reasonable salary step plan. An issue that was not addressed was for the employees who work part time. Nothing was done to address maintenance people. These employees are hard to come by and a reasonable progressive salary plan is needed for them. We face a problem with the Recreation Director and a full time addition to our maintenance crew. A higher starting salary was sought for a full time person. This individual desires to work full time and we were hoping his could be paid $22,500 as a beginning salary. His work scope was sent to the County for evaluation. With the future needs at Greystone and the addition of a Community Center, we will need good people. In regard to the Recreation Director we are seeking a raise that would bring his salary to $11,000 a year. His is the lowest paid salary of all the surrounding towns. SUPERVISOR SMITH explained that according to Dutchess County Personnel both positions are classified properly and if the positions were to become full time they become competitive and they need to take a Civil Service test. These two positions were not addressed in the salary study. r. Discussion followed. SUPERVISOR SMITH said she would get a full time salary study of the surrounding towns and have it ready for the next meeting. NO ACTION TAKEN. Supervisor Smith was asked to research the Court concerning the title for Danielle Lent. She is going to take the Civil Service Test. What we are trying to do is upgrade the position of Clerk to Senior Clerk which would fall X 03/12/2001.WS in the correct position and pay the correct salary, if the board so desires. Do you want to upgrade the position? Danielle was employed at a justice court in Croton for several years doing the same job she is doing here. It was Councilman Ruggieros understanding that we were going to give Danielle credit for the time she was employed in Croton and move her to step three in the same grade she is in now. Supervisor Smith was under the impression the board wanted to make her a grade three. Supervisor Smith explained that we could leave her at a grade two, and move her to step three. What we want to do now is bring Danielle up to speed in grade two. We can do that with no problem. We just need a vote. Discussion followed. COUNCILMAN RUGGIERO understands there is some confusion in the administration of the salary study in terms anniversary dates that employees are supposed to get. Some employees are under the impression they have to wait a whole year after their anniversary to get a longevity. COUNCILMAN VALDATI requested SUPERVISOR SMITH to bring, to the next meeting the amount of time Danielle has accrued so we may formalize this. NO ACTION TAKEN. SUPERVISOR SMITH announced that Assessor, Linda Tasadfoy is requesting to make three part time positions to one full time position. The salary would stay the same. Discussion followed. COUNCILMAN VALDATI moved to authorize the Assessor to hire one (1) full time position in place of three (3) part time positions for her office. Seconded by Mr. Bettina Motion Unanimously Carried Another matter Ms. Tasadfoy wished to bring before the board is a request she had made for a part time person to help with 911. Jay Paggi has recommended that she go to all the special district rolls. She just needs someone temporary part time. COUNCILMAN RUGGIERO suggested we get a student from one of the local colleges and they would receive special credits for field study. SUPERVISOR SMITH said she would contact the colleges. The last item Ms. Tasadfoy wished to discuss was a member of her staff, Loretta Brunello. Loretta will be here two years on the 8th. Will she go to the next step on her anniversary? The board agreed, that yes, she would, on her anniversary. The reason for asking, is because she lost Katherine Garrison, because she was in the wrong step. Last September she was supposed to get a raise and she never got it. SUPERVISOR SMITH was under the impression that they were to get it at the beginning of the year. COUNCILMAN RUGGIERO informed her they are supposed to get it on their anniversary, otherwise they get cheated out of it. Ms. Tasadfoy 10 03/12/2001.WS explained that Katherine Garrison got cheated out of her raise, and she lost her. COUNCILMAN RUGGIERO said, then this must be corrected. Mr. Terwilliger explained that the study was done in 1999 and they made adjustments on salaries. Going forward we have been stepping those up according to the first of the year. COUNCILMAN RUGGIERO responded, that is wrong. COUNCILMAN RUGGIERO explained that it has to be retroactive, because they are entitled to that. SUPERVISOR SMITH said we can take it from now forward, because it would be too complicated going back. Mr. Terwilliger explained that we gave everyone that was due an increase or upgrade based on what their jobs were. In 2000 everyone that was here a year had that raise included. There will be one or two people who will need that retroactive. COUNCILMAN RUGGIERO requested Mr. Terwilliger, to get a report of who these employees are, the salaries, the dates and who we have to adjust. There was no other business to come before the Board. COUNCILMAN BETTINA moved to close the workshop meeting, seconded by Mr. Ruggiero and unanimously carried.
