BOX 324 WAPPINGERS FALLS, NY 12590-0324 O1/08/2001.WS The Workshop Meeting of the Town of Wappinger was held on January 8, 2001, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:30 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Others Present: Al Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent COUNCILMAN PAOLONI moved to appoint Anthony Mussara to fill the position of Custodian for Building and Grounds. Seconded by Mr. Ruggiero Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize the expenditure for the roof repair and the funds to come out of the Fund Balance. Seconded by Mr. Bettina Motion Unanimously Carried Jay Paggi, Engineer to the Town gave an update on the Domber Wells. It was found that there was a potential for these wells to be under the influence of the Sprout Creek. If its under the influence we have to provide for filtration. Mr. Paggi informed the Board that the proposal that was in front of them now did not include filtration. The additional cost of the filters would cost between $400K and $1.1 million. The two issues that Mr. Paggi felt the board should explore. First, if there could be any more of a contribution from the developer, Mr. Domber, and second, when does the benefit of these wells diminish to the cost of providing the filtration. Discussion followed. COUNCILMAN VALDATI moved to authorize Attorney to the Town, Al Roberts, to draft a proper contract with Mr. Domber. Seconded by Mr. Ruggiero Motion Unanimously Carried. Mr. Paggi gave a report on the status of the application of 99-2R. Mr. Paggi would recommend that there are components in the application that we need to get going on. The Cider Mill Loop Tank, and the four wells at Atlas. Discussion followed. COUNCILMAN VALDATI moved to authorize Attorney to the Town, Al Roberts follow up on the application to keep it going. 1 O1/08/2001.WS Seconded by Mr. Ruggiero Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Attorney to the Town Al Roberts, and Engineer to the Town Jay Paggi to prepare the amendment of our application in order to do the filtration system as outlined by the Engineer to the Town. Seconded by Mr. Paoloni Motion Unanimously Carried Next is the interim inspection of the Cider Mill Loop Water Tank. Mr. Paggi informed the board that a year and a half ago we encountered problems with the Cider Mill Loop Water Tank and we did some rehabilitative work on it. As you know under 99-2R, once we construct the adjacent tank to Cider Mill Loop, we will be able to take it out of service and rehab it completely, internally and externally, and having the two tanks will allow us to do that on a regular basis. At this point in time, it might be appropriate to perform another internal inspection to see if there any further failure since the summer of 1999, knowing that this has to last 3 more years. The cost for the inspection is $2,900. COUNCILMAN VALDATI moved to authorize $2,900 for the inspection of the Cider Mill Loop Water Tank. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Paggi also gave a short report on the Poughkeepsie Water Connection. NO ACTION TAKEN. Supervisor Smith gave a report on the Chelsea Water. She informed the Board that Dan Stone met with the new owners of Chelsea Ridge. They are still interested in the project, but they did not have authorization to allow Dan to come to the meeting tonight. Everything is on hold for now. Discussion followed. COUNCILMAN BETTINA moved to authorize Engineer to the Town, Jay Paggi prepare a cost analysis of the feasibility of bringing in water from either Baxtertown Road or Briarwood connection. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is discussion on the New York City Delaware Shaft Water Connection. COUNCILMAN VALDATI moved to authorize Supervisor Smith send a letter to Senator Saland and Assemblyman Miller requesting their assistance in setting up a meeting for a water connect. Seconded by Mr. Bettina 2 O1/08/2001.WS Motion Unanimously Carried SUPERVISOR SMITH announced that she needed authorization to sign the contracts with Architect, Don Swartz for the Community Center and the Roof Canopy for the Town Hall. The contracts are needed for Bonding and Grant money. COUNCILMAN VALDATI moved to authorize the Supervisor to sign the contracts with Mr. Swartz. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN PAOLONI moved to authorize Supervisor Smith sign a contract in the amount of $8,050 for computer software for the tax office. Seconded by Mr. Valdati Motion Unanimously Carried At this time COUNCILMAN VALDATI moved to recognize Richard Cantor, Attorney. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Cantor explained that there is pending before the Planning Board an application for site plan approval for property off of All Angels Hill Road owned by Susan Fischera & Grace Elder, also known as GALS. They are seeking site plan approval to park and store heavy construction equipment. Mr. Cantor's interest is on behalf of the neighbors who live in houses behind this property. They abut the piece of property that is zoned residential. They are concerned to the portion of property proposing the placement and storage of approximately 30 vehicles. The matter went from the Planning Board to the Zoning Board. The GALS property is partly in a residential zone and partly commercial zone. The applicant went before the Zoning Board requesting interpretation where the line was located, and in the alternative for a variance to allow a 90 foot frontage in the commercial zone rather than the required 100 foot frontage. The neighbors have also gone to the Zoning Board to ask them to determine that this use is not allowed, even in the commercial portion of the property. Also that there are other zoning violations in the application, including the location of a commercial driveway in a residential zone. He is here tonight to request the Town Board to consider the possibility of moving the zoning line so all of this property is residential. Discussion followed. Supervisor Smith informed Mr. Cantor, that she would like to consider this request with the Attorney to the Town in attendance at a workshop. Mr. Kl O1/08/2001.WS Ruggiero asked Mr. Cantor to also submit a narrative to the Town Board. We will then get the opinion of our professionals. NO ACTION TAKEN. At this time 9:05 p.m. COUNCILMAN RUGGIERO moved to go into Executive Session to confer with Council on the above matter, seconded by Mr. Ruggiero and unanimously carried. The meeting reconvened at 9:10 p.m. with all board members present. There was no action taken at Executive Session.
