The Reorganization Meeting of the Town Board of the Town of Wappinger was held on January 3, 2001 at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. Supervisor Smith opened the Meeting at 7:00 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Paoloni, Councilman Others Present: Albert Roberts, Attorney to the Town Graham Foster, Highway Superintendent Absent: Joseph Ruggiero, Councilman The SUPERVISOR asked all to join in the Pledge of Allegiance to the Flag. The Supervisor confirmed the appointment of Deborah Viggiano as Deputy Supervisor/ Confidential Secretary and Angie Paustian as Bookkeeper. The confirmation to appoint deputies to the Town Clerks office is tabled until such time as a Town Clerk is appointed to fill the position The HIGHWAY SUPERINTENDENT confirmed the appointment of Glenn Thomas Heady as Deputy Highway Superintendent. TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES & POSITIONS The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the Town Board for the year 2001. TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the pay scale for the employees hired by the Town of Wappinger Highway Department will be in accordance with the C.S.E.A. contract, and BE IT FURTHER RESOLVED, that all such Highway Department employees engaged on an hourly basis shall be paid every Friday throughout the year 2001 with 52 pay periods during such year consistent with the pay schedule in accordance with a signed C.S.E.A. contract, with the first payday to be January 5, 2001. The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption: RESOLVED, that the weekly salaries for certain personnel retained to give weekly exercise classes to the Senior Citizens be and the same hereby is established as follows. Susan Borchardt Exercise Lessons $20.00 per session BE IT FURTHER RESOLVED, that all such personnel engaged on a weekly basis shall be paid every Friday throughout the year 2001 with the first payday to be January 5, 2001. Seconded by: Mr. Bettina Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER DESIGNATING COURT OFFICER FOR THE TOWN OF WAPPINGER JUSTICE COURT The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice Court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the Town Justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $ 10.06 for time actually served, and BE IT FURTHER RESOLVED, that Armed Court Officers shall be compensated at the hourly rate of $14.10 for time actually served at sessions of Court where their services are required and, BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis, the names and hours served, and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing, from funds appropriated for Justice Court, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the Year 2001. TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING PAY SCALE FOR PART-TIME CLERICAL, LABORERS & MAINTENANCE MEN OTHER THAN HIGHWAY PERSONNEL The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: RESOLVED, that the pay scale for all presently employed part-time clerical employees engaged to perform services for the Town Board and/or its Officials & Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $8.81, to a maximum hourly rate of $12.34 per hour, and BE IT FURTHER RESOLVED, that the part-time hourly rate for any subsequent part-time clerical employee engaged by any Official or Agency Department Head shall be established at the minimum hourly rate, or if otherwise fixed and established, shall be subject to the approval of the Town Board, and BE IT FURTHER RESOLVED, that the pay scale for all presently employed part-time laborers and Maintenance men, other than Highway Personnel, engaged to perform services for the Town Board and/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $ 10.13, to a maximum hourly rate of $ 14.19 per hour, and BE IT FURTHER RESOLVED, that all such extra Part-time Clerical Employees and Laborers, and Maintenance men, other than Highway personnel, engaged on an hourly basis shall be paid every Friday throughout the year 2001, with the first payday to be on Friday, January 5, 2001. Seconded by: Mr. Paoloni Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING THE PAY SCALE FOR PART TIME VANDALISM PATROL PERSONNEL The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: RESOLVED, that the pay scale for Part-time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services for the protection of Town Parks, various other Town properties and performance of other such duties as may be assigned by the Town Board of the Town, be and the same hereby is fixed and established as per contract with the Dutchess County Sheriff. Seconded by: Mr. Paoloni Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER DUTCHESS COUNTY, NEW YORK AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 2001 The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every Friday throughout the year, 2001 with 52 pay periods during such year, with the first payday to be January 5, 2001, and be it further RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holders of these designated positions on such designated paydays of the year 2001. Seconded by: Mr. Bettina Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE COMPTROLLER The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor of each Town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution, that the Supervisor shall submit to the Town Clerk within 60 days after the 01/03/2001.REO.MTG. close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. NOW, THEREFOR IT IS HEREBY RESOLVED, that in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of General Municipal Law and that the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. Seconded by: Mr. Bettina Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER DESIGNATING DEPOSITORIES FOR THE TOWN OF WAPPINGER MONIES The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the HSBC Bank USA, the Chase Manhattan Bank, Fleet Bank, (Premier National Bank) to be called, M &T Bank in February, Bank of New York, and Charter One Bank, each being a banking institution maintaining banking rooms and offices in Dutchess County, New York, be and they each hereby are severally designated as depositories of the monies of this Town, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking institutions. Seconded by: Mr. Paolom Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER RESOLUTION RELATIVE TO PURCHASING PROCEDURES The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption: WHEREAS, pursuant to Town Law, a Budget is prepared each year by the Supervisor detailing expenses and revenues for the ensuing year, and WHEREAS, the Town Board shall review said tentative budget and reject or modify any budgetary item as they deem appropriate, and 9 01/03/2001.REO.MTG. WHEREAS, that after due process of Public Hearing and provision for additional amendments, the annual Budget shall be adopted, NOW THEREFORE BE IT RESOLVED, that within the confines of section 117 of the Town Law where provisions have been made in the annual budget for specific, large expenditures, further approval by the Town Board to consider the purchase of those expenditure need not be sought, provided that no other part of the Town's procurement Policy is circumvented, and BE IT FURTHER RESOLVED, that Town Board permission to seek bids on various large purchases may not be required if any item is available through either State or County Bids. Seconded by: Mr. Bettina Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER AUTHORIZING TEMPORARY DEPOSITS AND INVESTMENTS OF TOWN FUNDS The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: WHEREAS, it has come to the attention of this Town Board of the Town of Wappinger that there are now or may be in the future, funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, or in certificates of deposit issued by banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America and/or the State of New York, and WHEREAS, it appears that the Temporary Deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the Town of Wappinger, NOW THEREFORE, IT IS HEREBY RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger by and she hereby is authorized, empowered and directed to deposit and /or invest such surplus and excess funds of the Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that such Temporary Deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that the Supervisor of the Town of Wappinger be and she hereby authorized and empowered to invest and participate in a Flexi-Cash program, sponsored by Merrill, Lynch, Pierce, Fenner and Smith, Inc., and administered by the Bank of New York, in the manner prescribed by Section 11 of the General Municipal Law, and 10 01/03/2001.REO.MTG. IT IS FURTHER RESOLVED, that the aforesaid Supervisor of this Town be and she hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this Resolution. Seconded by: Mr. Paoloni Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER APPOINTING REGISTRAR OF VITAL STATISTICS FOR THE TOWN OF WAPPINGER The following Resolution was offered by SUPERVISOR SMITH who moved its adoption. RESOLVED, that Gloria J. Morse be and she is hereby appointed to serve as Registrar of Vital Statistics to the Town of Wappinger, Dutchess County, New York, for a term of four years commencing January 1St, 2001, and ending December 31St, 2004, pursuant to Section 4123, Public Health Law, and BE IT FURTHER RESOLVED, that said Registrar of Vital Statistics to the Town of Wappinger shall receive no salary or compensation, however, she shall be entitled to receive for the performance of the duties of this respective office the fees fixed by applicable statute. Seconded by: Mr. Bettina Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER ESTABLISHING PETTY CASH FUNDS FOR VARIOUS TOWN OFFICES The following Resolution was offered by COUNCILMAN BETTINA who moved its adoption: WHEREAS, the Justice Court has had an increase in its work load and has the need of having to make change on a daily basis, and WHEREAS, the Town Clerk of the Town of Wappinger has numerous requests for expenditures of small amounts of cash for postage, supplies, making change on a daily basis, and various miscellaneous items, for various departments of the Town of Wappinger, and WHEREAS a Petty Cash fund has been established for the Receiver of Taxes, pursuant to the provision of Section 64, paragraph 1-a of Town Law, which shall be reimbursed to the Supervisor for advances at the close of each fiscal year, and WHEREAS, the Recreation Committee has numerous request for expenditures of small amounts of cash for supplies and miscellaneous items 11 01/03/2001.REO.MTG. and reimbursement of small expenditures to various areas of the Recreation program and Maintenance work for the Town of Wappinger, NOW THEREFORE BE IT RESOLVED, that the Town Justice Court, the Town Clerk, and the Receiver of Taxes are hereby authorized and directed to establish a Petty Cash Fund, in the sum of $200 each, for the use of said Justice Court, Town Clerk, and Receiver of Taxes, and the sum of $100 for the use of the Recreation Committee, as provided by Paragraph 1-a of Section 64 of Town Law. Seconded by: Mr. Paoloni Motion Unanimously Carried TOWN BOARD, TOWN OF WAPPINGER APPOINTING A DOG CONTROL OFFICER OF THE TOWN OF WAPPINGER The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that Ann Marie Buck be and she hereby is appointed to serve as Dog Control Officer of the Town of Wappinger, Dutchess County, New York, and BE IT FURTHER RESOLVED, that the annual salary for the Dog Control Officer of the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $18,873.00, to be paid every Friday throughout the year 2001, with the first payday to be January 5, 2001. RESOLVED, that the Regular Monthly meeting of the Town Board of the Town of Wappinger shall be held at 7:30 p.m. at the Town Hall, 20 Middlebush Road, in the Town of Wappinger, Dutchess County, New York, in the evening of the 4th Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. AND BE IT FURTHER RESOLVED, that the Regular Workshop monthly meeting of the Town Board of the Town of Wappinger shall be held at 7:30 p.m. at the Town Hall, 20 Middlebush Road, in the Town of 12 01/03/2001.REO.MTG. 13 Wappinger, Dutchess County, New York, in the evening of the 2nd Monday of each month, or at such other place or places within the Town of Wappinger as the Town Board shall from time to time designate. Seconded by Mr. Bettina Motion Unanimously Carried TOWN BOARD TOWN OF WAPPINGER RELATIVE TO THE APPOINTMENT OF ACTING TOWN CLERK The following Resolution was offered by COUNCILMAN VALDATI, who moved its adoption: RESOLVED, that Gloria J. Morse be and she hereby is appointed to fill the vacancy of the Office of Town Clerk of the town of Wappinger which has occurred by reason of the resignation of Elaine H. Snowden, the duly elected Town Clerk, and IT IS FURTHER RESOLVED, that the said Gloria J. Morse is hereby appointed to be the Acting Town Clerk for the year 2001, and 13 01/03/2001.REO.MTG. IT IS FURTHER RESOLVED THAT Gloria J. Morse shall receive the salary of $42,657.00 for the year 2001, with the first payday to be January 5, 2001. MEMO TO: Supervisor Constance O. Smith Town Board Members FROM.• Deborah L. Viggiano RE: Town Clerk Appointment Since I sent you the letter on December 14, 2000 asking for your consideration in the appointment of Town Clerk, many things have been happening. I received a phone call from the Chairman of the Republican Committee in which I was told in no uncertain terms that I would never be supported by them in an election. They know exactly who they want to fill the Town Clerk position, and that is that. I was also told that if I decided to take a leave of absence from my position as Confidential Secretary to the Supervisor, and then decided to return to that position they would make sure that the pay would be cut drastically. Not only did I receive that phone call, but the Supervisor received a visit in which she was told that if I did not back out of this, they would not support her for election this coming November. That sounded like a threat to me. These are just a couple of the things going on since my original letter to you. Please understand, what has been said to me and to the Supervisor, and what continues to be said, does not scare me in any way, however, it has made me realize from first hand experience how these individuals conduct themselves. I ask that you no longer consider me for the position of Town Clerk. The next item for the Boards consideration is to establish the schedule for the Legal paid Holidays for 2001, including the Floating Holiday. In conformance with the adopted Holiday Policy, a polling of the Town Hall, and Highway employees, has indicated that the majority would appreciate receiving the 24th of December (Monday) 2001 as the substitution for the "Floating Holiday" that replaces Lincoln's Birthday.
