2009-3562009-356 Resolution Ratifying a Memorandum of Agreement for a Successor Collective Bargaining Agreement Between the Town of Wappinger and CSEA Local 1000 on Behalf of the Town Highway Employees At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on November 9, 2009. The meeting was called to order by Christopher Colsey, Supervisor, and upon roll being called, the following were present: PRESENT: Supervisor Councilmembers ABSENT: Christopher J. Colsey William H. Beale Vincent F. Bettina Maureen McCarthy Joseph P. Paoloni The following Resolution was introduced by Councilman Beale and seconded by Councilman Bettina. WHEREAS, the Town of Wappinger ("the Town") is party to a Collective Bargaining Agreement with CSEA Local 1000 AFSCME, AFL-CIO ("CSEA") on behalf of the Town of Wappinger Highway Employees Unit; and WHEREAS, the Collective Bargaining Agreement will expire on December 31, 2009; and WHEREAS, following negotiations between the Town and CSEA for a successor Collective Bargaining Agreement, the respective negotiating teams have agreed upon a Memorandum of Agreement, in the form attached to this Resolution, extending the recently expired Collective Bargaining Agreement. NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger ratifies the Memorandum of Agreement that is attached to this Resolution and authorizes Town Supervisor Christopher Colsey to execute the Memorandum of Agreement on behalf of the Town of Wappinger. MA TERSON, TOWN CLERK MEMORANDUM OF AGREEMENT This Memorandum of Agreement ("Agreement") in entered into by and between the negotiating teams for the Town of Wappinger ("the Town") and the CSEA, Local 1000 AFSCME ("CSEA") for the Town of Wappinger Highway Employees Unit, Dutchess County Local 814, referred to collectively as "the parties." WHEREAS, the Town and CSEA are parties to a Collective Bargaining Agreement ("CBA") that expires on December 31, 2009; and WHEREAS, the parties have now reached an agreement as of the date of execution of this Agreement on the terms and conditions for a successor CBA and wish to memorialize their understanding in writing; and WHEREAS, the negotiating committees of the parties have agreed that the CBA shall be amended as follows: ARTICLE III, SECTION 1 (Wages) — Replace current language with the following: Effective January 1, 2010 — All salaries shall be increased by three percent (3%). Effective January 1, 2011 — All salaries shall be increased by three and one quarter percent (3.25%). Effective January 1, 2012 — All salaries shall be increased by three and one quarter percent (3.25%). 2. ARTICLE III, SECTION 2, paragraph H (Town Equipment) — Add "lawn mower(s)" to the list of excepted equipment. 3. ARTICLE V, SECTION 2 (Sick Leave) paragraph A (Accumulation Cap) — In the last sentence, change "166" to "200." paragraph E (Pay Upon Separation) — In the first sentence, change "75%" to "85%." 4. ARTICLE V, SECTION 4, paragraph D (Bereavement Leave) — Change this paragraph to the following: "Each employee shall be entitled to five (5) consecutive work days leave with pay, upon the death of the employee's spouse, father, mother, child and non - step sibling. Three (3) consecutive work days leave with pay shall be granted upon the death of the employee's step-parent, brother-in-law, sister-in-law, father-in-law, mother-in-law, grandfather and grandmother." 5. ARTICLE VIII, new paragraph E (Medical Insurance Buyout) — The following new paragraph shall be added: "E. Any employee declining health coverage shall be eligible to receive an annual reimbursement from the Town in the amount of twenty-five percent 2 (25%) of the Town's portion of the premium for the employee and any eligible dependents under the MVP plan, or its successor. The reimbursement shall be prorated for the first year of employment. All reimbursements shall be made in December of each year. This provision shall not apply to dental and optical coverages." 6. ARTICLE XIII (Duration) — Change the first sentence as follows: "This Agreement shall be in full force and effect from January 1, 2010 to December 31, 2012." 7. APPENDIX A (Longevity) — Increase each step $0.05 for each year of the contract.
