An adjourned Public Hearing was held by the Town Board of the Town of
Wappinger on November 13, 2000 at the Town Hall, 20 Middlebush Road,
Wappingers Falls, New York on the Benefit Assessment for the Wappinger
Emergency Water Improvement Area 99-1.
SUPERVISOR SMITH opened the meeting at 7:31 p.m.

The board members wished to have Jay Paggi, Engineer to the Town explain
how he determined the formula for the Benefit Units for Wappinger
Emergency Water Improvement Area 99-1. Mr. Paggi explained that 99-2R
has the exact same benefit units as 99-1. It is comprised of Central
Wappinger, North Wappinger, Myers Corners II, Ardmore and Cranberry.
Mr. Paggi, explained that each improvement or district as it stands on its
own may have a number of benefit units. When they combine these areas all
together to form one district or one improvement, the numbers of Benefit
Units from each individual district or area won't necessary change because it
is no longer the sum of the part, its one big unit. The number of residential
Benefit Units whether in a single district or combined district remains the
same, when we sum them up. We also sum up the residential assessment,
commercial assessment and the total assessment. You take a percentage of
the residential assessment and divide that into the number of residential
Benefit Units and we come up the total number of Benefit Units.
SUPERVISOR SMITH announced that the rate for the Wappinger
Emergency Water Improvement Area 99-1 for 2001 will be $9.43.
COUNCILMAN RUGGIERO moved to close the Public Hearing, seconded by
Mr. Paoloni and unanimously carried.
The Public Hearing closed at 7:34 p.m.

The Workshop Meeting of the Town of Wappinger was held on November 13,
2000 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith opened
the meeting at 7:34 p.m.

Supervisor Smith wished to have it so noted that Mr. Bettina was absent
tonight due to a family emergency.
A request from Debra Brown, W/S billing clerk for re -levy of unpaid Water
and Sewer accounts.
The following Resolution was offered by COUNCILMAN RUGGIERO who
moved its adoption.
RESOLVED, that all delinquent water and sewer bills in arrears as of
November 20, 2000 in Ardmore Water, Central Wappinger Water, Fleetwood
Water, Myers Corners II Water, North Wappinger Water, Oakwood Water,
Tall Trees Water, Wappinger Park Homes Water, Watch Hill Water,
Fleetwood Sewer, Mid Point Sewer, Rockingham Farms Sewer, Wappinger
Sewer Improvement #1, Watch Hill Sewer, and Wildwood Sewer in the Town
of Wappinger be forwarded to the County of Dutchess to be placed on the Tax
Rolls of 2001. A list of all delinquent charges will be forwarded to the County
on November 22, 2000.

Correspondence from Jay Paggi, Engineer to the Town. The first is a report
regarding the excess capacity in Proposed Water Improvement 99-2R after all
the wells are complete. The original Map, Plan and Report showed the pump
times for existing demands and projected demands. These were calculated
without benefit of the "Domber" Wells. The tables have since been
recalculated. The two areas that have the most pressing needs while
working within the confines of an existing water district, would be the
Oakwood Knolls Water District and the Wappinger Park Water District.

Therefore, it can be seen that if the projected flows that are expected out of
Atlas, Hilltop and the Domber Wellfield at safe yield are realized, we will be
able to meet peak day demands for full build -out within Water Improvement
99-2R and at a minimum the Oakwood Knolls Subdivision and Wappinger
Park Subdivision. It should be noted however, that these projected flows are
based on theoretical calculated capacity. Mr. Paggi would strongly
recommend and advise the board that once the wells are up and operating,
hard flow data can be obtained including their ability to produce waters at
times of severe draught. Then and only then, will we know the true
capacities and how the dynamics of the system will be affected.
Mr. Paggi recommends that the inclusion of Oakwood and Wappinger Park
would not be done until the wells are up and running and we have some good
field data to work with.
Mr. Paggi's office also received a memo from the Chazen Companies who are
doing the hydrogeological work on the "Domber" Wells alerting them that
these wells might be determined to be under the influence of the surface
water known as Sprout Creek. If that is the case, then these wells can not be
placed in service without the water being treated for giardia and
cryptosporidium removal. Mr. Paggi will keep the board posted on the
progress.
Next is to discuss the O'Donnell complaint.
At this time 7:45 p.m., COUNCILMAN RUGGIERO moved to go into
Executive Session due to possible litigation.

Also attendance at the Executive Session were Todd Stahl, Attorney
representing Mr. O'Donnell, Bill Parsons, Planning Board Member, Mark
Liebermann, Fire Inspector, and Developer, Andy Metzger.
The meeting reconvened at 8:30 p.m. with all board members present with
the exception of Mr. Valdati and Mr. Bettina. There was no action taken at
the Executive Session.
Next is Dan Wery of Frederick Clark Associates to go over a draft of proposed
amendments to the Wappinger Code. Some of the draft amendments involve
clarifications, correction of typos, omissions and other errors found in the
Wappinger Zoning Code. Most of these proposed amendments have been
discussed by the Board and do not involve significant policy decisions. Hence
the use of the term "quick fixes" as these should be able to be addressed
without much deliberation or further delay. There were several that were
more in depth, generating discussion on their merits, those being, temporary

signs and limited duration, and small motor vehicle sales establishments
that service and repair small motor vehicles (under 1500 lbs.) such as jet skis
and motor cycles. Upon completion of this review, Mr. Wery recommends
scheduling a public hearing on the amendments as soon as possible. Several
amendments which require further discussion should be deleted from the
current list of amendments so that they do not delay the adoption of those
that are not in dispute. There are twelve different proposals: Definitions;

Frontage; Temporary Signs; Temporary Uses; Small Motor Vehicle
Sales Establishments; Parking; Special Use Permit Variances; Use
Schedules; Recreation Fees; & Interim Plot Plan. Discussion followed.
The Town Board generally favored most of the proposed amendments to the
Wappinger Code.
COUNCILMAN RUGGIERO moved to authorize Attorney to Town, Al
Roberts, Engineer to Town Jay Paggi, and Town Planner, Dan Wery to
prepare a draft version of the Town Code Amendments as outlined this
evening.
Seconded by Mr. Paoloni
Motion Unanimously Carried
There was no other business to come before the Board.
COUNCILMAN RUGGIERO moved to adjourn the Workshop Meeting,
seconded by Mr. Paoloni and unanimously carried.
The meeting adjourned at 9:40 p.m.
