COS:dIv 09/11/2000.WS The Workshop Meeting of the Town of Wappinger was held on September 11, 2000 at the town hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:50 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman (arrived at 8:10 p.m. Joseph Paoloni, Councilman Elaine H. Snowden Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent SUPERVISOR SMITH announced that Debbie Brown, the Data Entry Operator for the Water & Sewer Department has been with the town for 25 years, and at this time she wished to present her with a plaque for her many dedicated years of service. The first item on the agenda is a request from the Justice Department for authorization to send to two Court Personnel to obtain their Notary License. COUNCILMAN PAOLONI moved to authorize the Justice Department to send two of their personnel to obtain their Notary License. Seconded by Mr. Bettina Motion Unanimously Carried The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption, seconded by Mr. Bettina and unanimously carried. RESOLUTION RESOLVED, that Constance O. Smith, Supervisor of the Town of Wappinger, Wappingers Falls, New York, is hereby authorized and directed to file an application for funds from the New York State Department of Transportation (NYSDOT) in the amount of $5,000 and upon approval of said request, to enter into, and execute a project agreement with the New York State Department of Transportation for such financial assistance to this municipality for concrete work required in mounting new pedestrian trail foot bridge and adjacent bridge interface improvements for Reese Park. Town of Wappinger $5,000 Environmental Consultant, Matt Rudikoff gave a short presentation on the water improvement for 99-2R for SEQRA. He reported that there were no significant environmental impact. Around 75% of water lines are in existing roads. Also established, based on the Engineers report, the plan that has 1 09/11/2000.WS been chosen will address the water needs of the district. There are no surface waters effected. One of the other aspects of a water improvement such as this is that with these new water lines, what new developments will be allowed. COUNCILMAN VALDATI moved to authorize Engineer to the Town, Jay Paggi, and Environmental Consultant, Matt Rudikoff to amend the Map Plan and Report and the SEQRA, to include the wells, the drilling of the Rockingham well and the completion of the Domber well. Seconded by Mr. Paoloni. Motion Unanimously Carried COUNCILMAN VALDATI moved to authorize Attorney to the Town, Al Roberts to contact the Bond Counsel to draft a resolution for same. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Jay Paggi, Engineer to the Town in reference to the Rowell Lane Drainage/Curbing Improvements Bid review. As a follow up to his August 14, 2000 letter to the Town Board, Mr. Paggi has reviewed the bids and would advise that the price submitted by the apparent low bidder, S.J. Lore Contractors for $49,900, appears to be consistent with current construction trends. Mr. Paggi recommends that the Board review this amount, and decide whether or not they wish to make the improvement. Again, the cost is representative of current construction trends. Bids for the last 3-4 months are appreciably higher than earlier in the year, and in most recent years, due to the amount of work and workload of the individual contractors. This bid is approximately $20K over the budget. Mr. Terwilliger informed the board that we have some funds left in the drainage reserve for this project. Discussion followed. COUNCILMAN PAOLONI moved to award the bid for the Rowell Lane Drainage/Curbing Improvements to S.J. Lore Contractors for $49,900 as recommended by Mr. Paggi, they being the lowest bid. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is the bid for the proposed Wappinger Water Improvements Atlas Wellfield Contracts 99-1 and 99-1(E). As you know the bids came in last month for this project approximately 15% over the estimated amount. Mr. Paggi's office estimated this job about $200,000 for the general construction, and the low bid came in at $238,000. The electrical work came in about 30% over the electrical engineers estimate of $70,000. With this in mind to award these two bids, and maintain the total authorization Mr. Paggi would need 2 09/11/2000.WS to ask for an increase in the amount of approximately $160,000. He cannot advise the Board that the work that was put out to bid for this improvement will be 100% able to be molded into improvement 99-2R. If a certain amount of work is done now, it will not need to be duplicated and or relocated when we do 99-2R. Mr. Paggi recommends that the bids be awarded to Sun Up Enterprises for $238,000.00 and Hudson Valley Electrical Construction & Maintenance for $106,444.00 as low bidders, and the work be done as soon as possible. We would have to ask for an increase in the authorized amount of from $500,000 to $660,000. That would need to amend the Map Plan and Report. For the Boards information the additional $160,000 authorization will increase the per year benefit cost from the original $9 per year per benefit unit to approximately $12. If we decide to go forward with this, Mr. Paggi would also need to be authorized to contact the contractor and request an extension, because there is a 45 day bid limit. Discussion followed. COUNCILMAN RUGGIERO moved to go forward on this project, and authorize Jay Mr. Paggi to contact contractors for an extension. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN VALDATI moved to authorize Attorney to the Town Al Roberts, to contact Matt Rudikoff to amend the Map Plan and Report and contact Bond Council to authorize amendment to increase amount to $160,000. Seconded by Mr. Bettina Motion Unanimously Carried COUNCILMAN VALDATI moved to authorize Attorney to the Town, Al Roberts, and Engineer to the Town Jay Paggi to do the necessary contacts and paper work. Seconded by Mr. Paoloni Motion Unanimously Carried SUPERVISOR SMITH announced that a Public Hearing would be held on October 10th for 99-1 and 99-2R and for the increase in expenditures. Next is Mr. Paggi's report on Highway Specifications with a response from Highway Superintendent, Graham Foster. In his correspondence of August 22, 2000, Mr. Paggi informed the Town Board, that the Planning Board was currently reviewing a small commercial subdivision on St. Nicholas Road just south of New Hackensack Road known as Hilltop Business Park. The proposal calls for seven (7) small lots and the construction of approximately 700' of road. The theory behind the subdivision is to allow small business owners/contractors, etc. to put up a 3 09/11/2000.WS small building to allow them to efficiently run their business. It was the Applicants request to reduce the width of the roadway from the present commercial specification of 36' to 30'. This appeared, on the surface to be an acceptable proposal by the Applicant as reviewed by the Planning Board. This proposal was also supported by the Highway Superintendent and this office. The reason for the reduction was to reduce construction cost, reduce blacktop and future maintenance cost for the Town, reduce impervious area, and overall aesthetics. As the Town Highway Specs do not currently have a standard for a light commercial roadway, the Applicant will be forced to build the road to 36'. Mr. Paggi would recommend that the Town adopt a local law to amend the Highway Specs to include a section that takes into account this light commercial type road. The only changes proposed would be a reduction in width from 36' to 30'. In his response memo of August 28th, Mr. Fosters realizes we are in need of a light Commercial category which should apply to an Office Park type subdivision. We should consider adding a section 214-45 "D" in our Code Book, which Mr. Paggi has outlined in his 8/22 memo. Discussion followed. COUNCILMAN PAOLONI moved to authorize the Supervisor to send a letter to the Planning Board requesting they not change the road Specifications to create a light commercial road category at this time. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence from Andrew Fetherston of 16 Eck Road, in regard to the dead bluejay found on his property. It was found to contain the Virus, and steps were taken to install bug traps around his property by Hudsonia Environmental Research. After a storm, large puddles form on the east side of the cul de sac. Mr. Foster informed the board that these pot holes were filled in by the highway department. COUNCILMAN BETTINA moved to accept the correspondence and place it on file. Seconded by Mr. Valdati Motion Unanimously Carried Next are several reports from Highway Superintendent Graham Foster. The first report concerns the stonewall on Wheeler Hill Road. There is a constant problem of loose stones falling into the road from Dr. Garrell's property on Wheeler Hill Road, creating a dangerous situation which often occurs during the worst weather. Mr. Foster spoke to Dr. Garrell, and he has agreed to let highway move the wall approximately 8 ft. on to his property. This is well within the three rods which normally is the width of our right of way. Cd 09/11/2000.WS However, because Wheeler Hill Road is a road by use, Mr. Foster believes the property in question is owned by Dr. Garrell which will enable Highway to move the wall during the upcoming winter season. COUNCILMAN VALDATI moved to authorize Al Roberts, Attorney to the Town to prepare a grading easement to re -erect the stonewall further back on the adjoining property. Seconded by Mr. Ruggiero Motion Unanimously Carried The next report concerns the drainage at 12 Ronsue Drive. Mr. Foster received a complaint from George Coffey of the above address. The drain pipe was installed years ago to drain Ronsue Drive. The pipe ends approximately 75' from the rear of the property. Any sign of a ditch to drain the water has disappeared over the last 30 years. The current condition is a blocked pipe which eventually seeks the surface and spills out onto the rear yard. Mr. Foster feels the best solution for this problem would be to extend the pipe to the property line. Discussion followed COUNCILMAN VALDATI moved to authorize Mr. Foster to extend the pipe 50' to 75' of the ditch. Seconded by Mr. Paoloni Motion Unanimously Carried Correspondence from Frederick Clark Associates with a draft SEQRA Notice of Intent to be Lead Agency for PIQWON. In order for the Town to process the application it must conduct and conclude the SEQRA process. Pursuant to the Town of Wappinger Environmental Quality Review Law (WEQR), the proposed action is a Type I Action which requires the submittal of a Full Environmental Assessment Form and a coordinated review. A review of the application materials indicates that a short EAF dated March 26, 1999 was prepared. The Applicant has been directed to prepare and submit a full EAF for this project. Upon receipt, the Town Board will then be able to circulate the Full EAF to all other involved agencies with its intent to be the Lead Agency, along with a copy of the Applicants latest plans. Once the Lead Agency has been established, it will then be able to schedule a public hearing and make a determination of significance before it takes action on the application. However, the legal status of the application with respect to Zoning appears to be in question. As noted in the draft Lead Agency Notice and in the September 1999 resolution of denial (since vacated by the Supreme Court on procedural grounds), it does not appear that the Town can approve the application. The Zoning Law, namely Section 240-16.F, V 09/11/2000.WS Improvement of Non -Conforming Uses, does not appear to permit the proposed use because it is not a modification to an existing non -conforming use. Therefore, despite the application for special permit and site plan approval, it appears that the proposed use can only be permitted by obtaining a use variance or an amendment to the Zoning Law. Discussion followed. COUNCILMAN BETTINA made a motion that the Town Board be considered Lead Agency and circulate the EAF to all other involved agencies. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence from Emanuel F. Saris, Attorney to the Town appointed to handle Tax Reviews, with a recommendation that the Town of Wappinger settle the matter in regard to Advanced Advisory v. Town of Wappinger. COUNCILMAN VALDATI moved to confirm Mr. Saris to finalize the settlement with Advanced Advisory v. Town of Wappinger. Seconded by Mr. Paoloni Motion Unanimously Carried At the June 26th meeting a request was received from Denise Bertolino for the refund of her $200 due to the denial of a variance from the Zoning Board of Appeals. At that time, the request was referred to the Zoning Board of Appeals for comments. A letter has been received from ZBA recommending the refund be authorized. COUNCILMAN PAOLONI moved to approve the $200 refund to Denise Bertolino, due to denial of a variance, upon the recommendation of the Zoning Board of Appeals. Seconded by Mr. Ruggiero Motion Unanimously Carried Next for the Boards consideration is to direct the Assessor, Linda Tasadfoy to prepare the Benefit Assessment Rolls for all the Water and Sewer Improvement Areas and Districts. The following Resolution was offered by COUNCILMAN RUGGIERO who moved its adoption, and seconded by Mr. Paoloni A RESOLUTION AUTHORIZING THE SUBMISSION OF THE FISCAL YEAR 2001 DUTCHESS COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM APPLICATION PROJECT: HANDICAP IMPROVEMENTS FOR THE REST ROOMS AT MARTZ FIELD WHEREAS, the Town of Wappinger is participating in the Dutchess County Community Development Consortium for Fiscal year 2001, and WHEREAS, input from citizens and groups has been received and considered, and WHEREAS, an application has been prepared which addresses our community concerns. NOW THEREFOR BE IT RESOLVED, that the Dutchess County Community Development Consortium Fiscal Year 2001 application for the Town of Wappinger, including the certifications included therein be and hereby is approved. BE IT FURTHER RESOLVED, that the submission of said application to the Dutchess County Department of Planning and Development be and hereby is authorized. Motion Unanimously Carried SUPERVISOR SMITH also announced that she went to the Soccer opening Friday night, and was informed that more dirt is needed (4-5 loads) for their fields. She told them they could take the compost that is up at the Highway Department. Authorization would be required for the Highway Department to deliver the compost. Mr. Foster explained that a representative from the Soccer program should come to look at the compost first, and if they can use it, Highway will deliver it. 17 09/11/2000.WS COUNCILMAN RUGGIERO moved to authorize the Highway Superintendent to deliver the compost to the Soccer field if they want it. Seconded by Mr. Bettina Motion Unanimously Carried COUNCILMAN RUGGIERO informed that board that he was called out by a constituent to look at the drainage in her back yard. There seems to be an ongoing oily substance coming out of the ground. He wishes to authorize the Engineer to pursue this and call the DEC if necessary. COUNCILMAN RUGGIERO moved to authorize Jay Paggi, Engineer to the Town to pursue this drainage problem. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN VALDATI in regard to the used car facility on the west side between Nissan & Greer Toyota. They are parking the cars very close to the road. Mr. Paggi explained they have an approved site plan. Discussion followed. COUNCILMAN VALDATI wished to know the status on the lighting at Greer Toyota. They had no amended site plan. Mr. Paggi explained that it is being reviewed by Dan Wery's office. Discussion followed. COUNCILMAN VALDATI moved to authorize a letter be sent to the Planning Board that the Town Board does not approve the lighting situation at the Toyota dealership and we wish this matter addressed at their next meeting.
