The Regular Town Board Meeting of the Town of Wappinger was held on
January 24, 2000 at the town hall, 20 Middlebush Road, Wappingers Falls,
New York. Supervisor Smith opened the meeting at 8:50 p.m.

MINUTES
The Minutes of the Workshop Meeting of December 13, 1999 and
Reorganizational Meeting of January 3, 2000, having previously been
forwarded to the Board Members, was now placed before them for their
consideration.

presented by the Town Clerk be and they are hereby approved.

REPORTS OF OFFICERS
Reports for the month of Dec. were received from the Supervisor/Comptroller,
Town Justices, Receiver of Taxes, Building Inspector, Zoning Administrator,
Assessor, Dog Control Officer, Recreation Attendance for 1999, and Annual
Reports from Judge Wolfson & Judge Morse.
COUNCILMAN BETTINA moved to accept the reports and place them on
file.

The Assessor also requested permission for herself and members of her staff
for Comp time from now on until May 19t. in order to complete all the
applications for exemptions on the STAR Program, etc. It is very difficult to
get all the information and changes into the computers during the day.

and members of her staff from now until May 18t, as requested.

Notification from Ann Saylor, Housing Coordinator with the Dutchess
County Department of Planning, that her office has received an application
to the Dutchess County Senior Citizen Owner -Occupied Property
Rehabilitation Program from a property located at 83 Osborne Hill Road.
The application has been reviewed and it has been determined that the
occupant is income eligible for the program. They will be conducting a site
inspection shortly to determine the scope of the work. This project will be
brought before the Dutchess County Community Development Council for
final review and approval.

Correspondence from Debbie Brown, Water/Sewer Clerk, effective
immediately, our longtime meter reader Michael Petrus has resigned his
position due to illness. Elaine Snowden, Town Clerk informed the board
that sadly, Mr. Petrus had a terminal illness, and passed away earlier in the
week. Supervisor Smith wished to have a moment of silence for Mr. Petrus.

Correspondence from Michael Horan, regarding the drainage problem at 4
and 6 Rich Drive. In the fall of 1998, prior to the sale of the lot and
construction of the home on All Angels Hill Road, Mr. Horan, residing at 6
Rich Drive, Mr. D'Aquino, residing at 4 Rich Drive, and Mr. Saroka residing
at 4 Tor Road, attended a zoning board meeting. At this meeting they
specifically identified the wet -land problems with the lot on All Angels Hill
Road and the impact it could have after excavation and construction
applicable to water drainage to Rich Drive. They were assured that their
concerns, with respect to water drainage would be addressed and documented
in the construction plans and that at a minimum, a "drainage swale" in some
"unconcentrated form" would be installed. Since the Town Building Inspector
approved and inspected the All Angels Hill Road Site to allow the issuance of
the "Certificate of Occupancy", please advise what actions the Town Board
are taking to correct the drainage problems defined and recommended by Mr.
Paggi in his letter of September 15th . Discussion followed. Mr. Paggi
explained that there is a possible solution to the problem that can be solved

jointly by the county with some participation by the town, that would
effectively remove this runoff.
COUNCILMAN RUGGIERO moved to authorize Supervisor Smith, Engineer
to the Town, Jay Paggi, and Attorney to the Town, Al Roberts meet with
Paul Cassillo, of the Dutchess County Department of Public Works regarding
this issue.

on file with no comment.

Fredericks in the amount of $1,000, William Manfredi Construction in the
amount of $25 and Cody Custom Homes in the amount of $500 upon the
recommendations of Graham Foster and Mark Liebermann.

Several requests for P. O's from Recreation Chairman, Ralph Holt.
The first request is a P.O. in the amount of $1,421.28, payable to the
Wappinger Central School District for custodial services for the Saturday
morning boys and girls gymnastics program.
COUNCILMAN RUGGIERO moved to authorize a P.O. in the amount of
$1,421.28, payable to the WCSD for custodial services for the Saturday
morning boys and girls gymnastics as requested by Mr. Holt.

7140.4. Three quotes were received, the lowest being Goldlief.

Next are several reports from Jay Paggi, Engineer to the Town. The first
report concerns the Schnabl Court Holding Pond/Drainage Easement. As a
follow-up of the December 27th 1999 Town Board Meeting, a field inspection
of the above easement was made by Mr. Paggi, and Mr. Foster, Highway
Superintendent, on December 29, 1999. Using the available plot plans from
his files from 1986 and the Filed Map, Mr. Paggi laid out the drainage
easement in the field. The time that this took, between office research and
field inspection, was between 1 and 1.5 hours.
COUNCILMAN RUGGIERO moved to accept the report and place it on file.

The second report concerns Farms End Road. At the December 27, 1999
Town Board Meeting, Farms End Road was accepted as a town road based on
the recommendations of Graham Foster, pending easement descriptions from
Mrs. Devine, and `As Built" Acceptance by Mr. Paggi. Mr. Paggi's office has
received an "As Built" Map and a "Right of Way" description Town of
Wappinger to Devine, prepared by Gary R. LaTour, L.S. dated December 30,
1999. Upon reviewing the "As Built" and "Right of Way" Description his
office finds the following:
• The drainage structures do no appear to fall within the boundaries of
Drainage Easements Nos. 1, 2 or 3. If the structures cannot be
physically moved into the easements areas, then the Applicant should
revise the easements to encompass all improvements.
• The water service shutoff valves for all three lots appear to be on
private property. The ownership of the triangle piece of property on

the west side should be identified. Again, if the structures cannot be
physically moved into the Town owned road right-of-way, then the
Applicant should offer appropriate access easements.
• It should be noted that this "right of way" is over lands of the town of
Wappinger that are designated as "Conservation District". Mr. Roberts
Office should be consulted to determine if there are any additional legal
issues or requirements.
All other items appear to be in proper order. Discussion followed

The next report concerns the Diesing Parcel. Mr. Paggi is in receipt of a
letter from Michael Gillespie, P.E. dated January 6, 2000, regarding sewer
and water service to the above referenced parcel. Mr. Paggi had previously
reported that it would not be appropriate for the parcel to tie into the
existing Oakwood Knolls Water System at the present time. However, he
had responded that the parcel is located within Phase 1 of the Wappinger
Sewer Transmission/Treatment Improvement, and therefore, eligible for
sewer service.

The next report concerns the Meadowood Wells, and a copy of a memo from
Steve Domber with Lab Results, indicating that his well that was drilled a
few years ago in anticipation of the Meadowood Subdivision, has tested
negative for Giardia and Cryptosporidium. This is favorable news for the
Town's use of the well. In his memo, Mr. Domber is requesting to be
scheduled for an upcoming Town Board Workshop to discuss a revised
proposal regarding his participation in the planned water improvements for
the Town of Wappinger. Discussion followed

table Mr. Domber's request for a Workshop at this time.

The next report concerns the Roberts Mobile Home Park Connection to
Central Wappinger Water Improvement Area. Mr. Paggi is in receipt of the
above referenced Engineers Report and Plan dated January 7th 2000. Mr.
Paggi reviewed them and reported back to Mr. Rawls Engineer with his
comments. Discussion followed.

COUNCILMAN BETTINA moved to authorize Engineer to the Town, Jay
Paggi, and Attorney to the Town to proceed with a formula for water charges
for the Roberts Mobile Home Park, once connected to CWWIA, and come back
with their recommendations.

The final report from Mr. Paggi is the Karabinos Subdivision. Mr. Paggi is in
receipt of a letter from Wayne A Karabinos regarding the water connection
for his subdivision on Pye Lane. In his letter Mr. Karabinos is requesting
permission to connect to the water line that is being constructed along Pye
Lane to service the Roberts Mobile Home Park. He states that he does not
plan to build his house until the Spring 2001. It is Mr. Paggi's
recommendation, at the time of the Building Permit, the Town Board assess
the current situation regarding water supply and make a decision at that
point in time. Mr. Paggi explained, that they are in the district, but because
they are proposing a subdivision they cannot hook up at this time. As in any
subdivision in town in that district, they are drilling a well because of the
current water shortage.
COUNCILMAN RUGGIERO moved to authorize Supervisor Smith to
respond to Mr. Karabinos request to hook into water at this time.

SUPERVISOR SMITH regarding her letter of January 12th sent to Dr.
Wayne Gersen, Superintendent of Schools, with concerns on the planned
expansion of the transportation facility at the Wappinger Junior High. It
was so noted, that in January 1990 Wappingers Falls Junior High was used
as a site for a school bus transportation facility. The impact on local
residents was substantial, primarily a major decrease in air quality and an
increase in noise and traffic. After several meetings with the then
Superintendent Gabe Ponte, and representatives of the Town of Wappinger
and Village of Wappingers Falls, the school bus facility was relocated.
Because the Town Hall and Emergency Services Building are directly across
Middlebush Road from the Junior High School, the potential impacts to the
governmental facilities are potentially substantial and it is requested that
the Town be named as an "interested agency" pursuant to SEQRA
regulations. While it is not clear if this proposed action is a Type I Action
under state regulations, this action would be deemed Type I under Town of
Wappinger Code. Mrs. Smith has also requested that Mr. Gersen provide her
office with copies of the proposal, particularly any narrative detailing the
nature and extent of the proposal, the number of vehicles to be housed, the
location of the facility, the land area to be disturbed, and the hours of
operation. Supervisor Smith also received a draft of the environmental
impact study today, if any one wishes read it.

The next item for the Boards consideration is to go over the Resolutions that
will be up for adoption at the Association of Towns Meeting to be held on
February of 2000. COUNCILMAN BETTINA has been designated as the
representative to the Annual Association of Towns Meeting and in
accordance with the Association's Constitution and By-laws, Article VII
Section 2(b) only the resolutions favorable reported by the Resolution
Committee shall be presented for a vote. Any resolution favorably reported
by the Resolution Committee shall be presented to the Delegates who shall
either adopt or defeat same.

received from Sergeant Gary Corbett of the DC Sheriffs Office which
involved several members of the Town of Wappinger Patrol.
BONDS & LETTERS OF CREDIT
Mark Liebermann, Zoning Administrator, submitted a report for the month
of December on the schedule of Bonds and Letter of Credit on the various
subdivisions, the amounts, expiration dates and call up dates.

The next item for the Boards consideration is to fill the vacancy on the
Planning Board. SUPERVISOR SMITH offered the name of Vic Fanuele to

the next meeting.

Next item for the Boards consideration is to introduce several Local Laws
and set Public Hearings.
The following resolution was moved by SUPERVISOR SMITH and seconded
by Councilman Paoloni.
WHEREAS, the Town Board has received numerous request to prohibit
right hand turns on Blackthorn Loop at it most westerly intersection with
Myers Corners Road from 6 AM to 8 AM, Monday through Friday from
January 1st to June 30th and September 1st to December 31st to deter
motorists traveling on Myers Corners Road from using Blackthorn Loop as a
way of advancing the traffic buildup which occurs in the morning hours at
the traffic light at the entrance to Roy C. Ketcham High School; and

WHEREAS, Graham Foster, Town of Wappinger Highway Superintendent
and Joseph E. Paggi, Jr., Engineer to the Town both concur that right hand
turns from Myers Corners Road at the westerly intersection with Blackthorn
Loop be prohibited as stated above.
NOW, THEREFOR, BE IT RESOLVED AS FOLLOWS:
1. The recitations above set forth are hereby incorporated as if fully set
forth herein.
2. The Town Board hereby introduces for adoption Local Law #_ of the
Year 2000 in the form annexed hereto.
3. The Town Board determines that the enactment of the aforementioned
Local Law is a Type II action as defined in 6 NYCRR 617.5 and Section
117 of the Code of the Town of Wappinger and, accordingly, the Town
Board hereby expressly determines that this action is not an action
that requires review pursuant to the provisions of the New York State
Environmental Quality Review Act (SEQRA) or pursuant to Chapter
117 of the Code of the town of Wappinger or pursuant to 6 NYCRR Part
617.
BE IT FURTHER RESOLVED that the Town Board hereby schedules a
Public Hearing on the proposed adoption of Local Law #_ of 2000 to be held
at the Town Hall, 20 Middlebush Road, Wappingers Falls New York on the
14th day of February 2000 at 7:20 p.m., and that the Town Clerk is directed to
post and publish notice of the Public Hearing in the form annexed hereto.
The question of the adoption of the foregoing Resolution was duly put to a

The Resolution is hereby duly declared adopted.
The following Resolution was moved by COUNCILMAN RUGGIERO and
seconded by Councilman Paoloni.
WHEREAS, in the past several months there have been outbreaks of
Giardia contamination in wells providing public supplies of water; one such
outbreak was located in the water supply system serving the Roberts
Running Creek Trailer Park, located off Pye Lane in the Town of Wappinger,
and another such outbreak was located in the so-called Rockingham Wells
owned by the Town of Wappinger; and

WHEREAS, in the interest of the public health, safety and welfare the
Town of Wappinger has determined that it be required that all public water
supply systems owned, operated and maintained by the Town of Wappinger
be tested every six months for contamination by Giardia and
Cryptosporidium.
NOW THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The recitations above set forth are hereby incorporated as if fully set
forth herein.
2. The Town Board hereby introduces for adoption Local Law #_ of the
Year 2000 in the form annexed hereto.
3. The Town Board determines that the enactment of the aforementioned
Local Law is a Type II action as defined in 6 NYCRR 617.5 and Section
117 of the Code of the Town of Wappinger and, accordingly, the Town
Board hereby expressly determines that this action is not an action that
requires review pursuant to the provisions of the New York State
Environmental Quality Review Act (SEQRA) or pursuant to Chapter 117
of the Code of the town of Wappinger or pursuant to 6 NYCRR Part 617.
BE IT FURTHER RESOLVED that the Town Board hereby schedules a
Public Hearing on the proposed adoption of Local Law #_ of 2000 to be held
at the Town Hall, 20 Middlebush Road, Wappingers Falls New York on the
14th day of February 2000 at 7:25 p.m., and that the Town Clerk is directed to
post and publish notice of the Public Hearing in the form annexed hereto.
The question of the adoption of the foregoing Resolution was duly put to a
vote on roll call which resulted as follows:

A Memo was received from Graham Foster Highway Superintendent with the
following list of roads scheduled to be dug up for Tri -Muni 3A, and must be
paved.

Alladin Court
Cayuga Drive
Mohawk Drive

Unfortunately, due to budget cuts, these are the only roads currently
scheduled, which puts us another year behind in resurfacing our road system.
COUNCILMAN PAOLONI wished to know if the above roads listed were
due to be paved anyway. Mr. Foster replied, not necessarily, some of them,
especially the roads in Indian Village have been held off paving, waiting for
the Tri -Municipal project to go through. The others were not scheduled for
paving, but we are going to run pipes right down the middle of the road.
Discussion followed.
COUNCILMAN VALDATI moved to authorize Mr. Foster prepare a list of
priority roads in need of paving and costs.

NEW BUSINESS
Prior to the Town Board meeting, a Public Informational Hearing was held
on the proposal to establish a supervised community residence on 131
Osborne Hill Road. Several of the directors were in attendance to answer
questions and provide the local residents that were at the hearing tonight
with a fact sheet on the proposed facility. Residents were allowed to voice
their approval or disapproval of the proposed residence.
COUNCILMAN BETTINA moved to authorize Engineer to the Town, Jay
Paggi, Attorney to the Town Al Roberts, Town Planner and Supervisor Smith

review the proposed Osborne Hill Community Residence for impact on water,
sewer, Greenfly Swamp, septic and other environmental impacts, as well as
traffic.
Seconded by Mr. Ruggiero

COUNCILMAN VALDATI asked Mr. Paggi, who could make the
determination if the property is unsuitable and incapable of absorbing
water necessary for sewage? Mr. Paggi replied, the Health Department
would make the determinations, not the Town of Wappinger. Discussion
followed. COUNCILMAN BETTINA stated, he does not wish to have facility
in his area, and wants to have it in the record, he wants it reviewed for an
alternative site if we have an opportunity for an alternative site.
COUNCILMAN VALDATI wished to go on record that he will not disallow a
site anywhere in this town simply because people do not want it above what
the law states. AL ROBERTS, Attorney to the Town explained that we have
to respond on this application within forty (40) days we receive the notice
that this is their intended site. SUPERVISOR SMITH asked Mr. Roberts, is
it fair to say, if the State deems this property an appropriate site to build this
residence, there is not much we can do, the Town must comply? Mr. Roberts
explained that our options are; we can agree with it; suggest alternative
sites; or oppose it on the ground that there is a higher concentration in the
area. We do not have the option to say we do not want it in any ward.
COUNCILMAN VALDATI moved to request an additional 30 day extension
in which to respond to the applicants proposal to build a community
residence on Osborne Hill Road.
Seconded by Mr. Paoloni
Motion Unanimously Carried
Town Clerk, Elaine Snowden wished to be authorized, if the opportunity
arose, to hire a full time person as opposed to two part time people at the
same salary which is in her budget.
COUNCILMAN RUGGIERO moved to authorize the Town Clerk to hire one
full time person at the same salary as two part time people.
Seconded by Mr. Paoloni
Motion Unanimously Carried
There was no other Business to come before the board.
COUNCILMAN PAOLONI moved to close the meeting, seconded by Mr.
Ruggiero and unanimously carried.
