L The Workshop Meeting of the Town of Wappinger was held on January 10, 2000, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:45 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina Councilman Joseph Ruggiero, Councilman Elaine H. Snowden, Town Clerk Others Present: AI Roberts, Attorney to the Town Jay Paggi, Engineer to the Town Graham Foster, Highway Superintendent A Public Hearing having been held entitled, " Local Law Amending Section 230-43 of the Code of the Town of Wappinger to designate additional Full Stop intersections in the Town of Wappinger", the matter if its adoption was now placed before the Town Board for their consideration. COUNCILMAN BETTINA moved to adopt Local Law # _ of the year 2000, as follows: I L. A Local Law entitled "LOCAL LAW AMENDING SECTION 230-43 OF THE CODE OF THE TOWN OF WAPPINGER TO DESIGNATE ADDITIONAL FULL STOP INTERSECTION IN THE TOWN OF WAPPINGER." BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: This Local Law shall be known and cited as Town of Wappinger Local Law # _of 2000, and entitled "LOCAL LAW AMENDING SECTION 230-43 OF THE CODE OF THE TOWN OF WAPPINGER TO DESIGNATE ADDITIONAL FULL STOP INTERSECTION IN THE TOWN OF WAPPINGER." L Section II: Leflislative Intent: It is the determination of the Town Board of the Town of Wappinger that additional street intersections be designated full stop intersections. The Town Board has received a number of requests that the intersections of Thornacres Drive with Caroline Drive East and West, Caroline Drive West with Thornacres Drive, Caroline Drive East with Thornacres Drive, Farms End Road with Ardmore Drive, Orchard Drive with Farms End Road, and Parkhill Drive with Moccasin View Road, be made full stop intersections and the Superintendent of Highways and the Engineer to the Town both concur. Accordingly, it is the express determination of the Town Board and in the interests of the public health, safety and welfare of the residents of the Town of Wappinger to establish full stop intersections at the following locations: 1 01l10/2000.WS Thornacres Drive with Caroline Drive East and West Caroline Drive East with Thornacres Drive Farms End Road with Ardmore Drive Orchard Drive with Farms End Road Parkhill Drive with Moccasin View Road and that stop signs be erected accordingly Section III: Stop Intersections. Section 230-43 of the Code of the town of Wappinger entitled "Schedule IX: Stop Intersection" is hereby amended by including, in alphabetical order: Thornacres Drive with Caroline Drive East and West Caroline Drive West with Thornacres Drive Caroline Drive East with Thornacres Drive Farms End Road with Ardmore Drive Orchard Drive with Farms End Road Parkhill Drive with Moccasin View Road to said "Schedule IX: Stop Intersections" as follows: J Stop Sign on Direction of Travel At Intersection Thornacres Drive (at its most southerly location) South Caroline Drive E & W Caroline Drive West Caroline Drive East East West South Thornacres Drive j Thornacres Drive Farms End Road Orchard Drive Parkhill Drive West West Ardmore Drive Farms End Road Moccasin View Road Section IV: Separability. The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, work or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, works or parts of this Local Law or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, work or par had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable, had been specifically exempt therefrom. Section V: Ratification J 2 01l10/2000.WS This Local Law shall take effect immediately upon adoption and filing with the Secretary of State as provided by the Municipal Home Rule Law. Seconded by Mr. Ruggiero L Motion Unanimously Carried The first item for discussion is the Deputy Building Inspector position. The Board had discussed creating the position some time ago. Supervisor Smith informed the board, that the Building Inspector at that time, Paul Foody, felt we did not need one. Then he changed his mind, and decided we did need one. The position was created in the 1998 budget, then was removed from the budget. The salary agreed upon at that time was $28K. Supervisor Smith just needs to get the list of candidates. Discussion followed. COUNCILMAN V ALDATI moved to create the position of Deputy Building Inspector at a salary of $28,000. Seconded by Mr. Ruggiero Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize the Supervisor to post the position of a Deputy Building Inspector with Civil Service. Seconded by Mr. Valdati L Motion Unanimously Carried Next is a report from Jay Paggi, Engineer to the Town on the Rockingham Drainage at 88 Scott Drive. At the December 27th Town Board Meeting Mr. Paggi was authorized to prepare a more detailed analysis into the redefinition and/or piping of an open stream/utility easement in the Scott Drive Carroll Drive area of the Rockingham of the Rockingham Farms Subdivision. Also enclosed was a sketch showing the location of the existing easements in the area. The first portion of the project that needs to be done is the replacement of the existing 42" corrugated metal pipe. As you can see from this Filed Map, there is no recorded easement. This does not mean that there was no an easement filed subsequent to the drafting of the map. As we previously recommended, the Town Attorney should look into this. In any event, the existing pipe will need to be replaces as it has deteriorated to a near fail condition. The next portion of the project would have two (2) alternatives. The first would be to pipe the remaining utilities/open stream easement in the area as shown in the rear of Lots No. 121, 122 and 124. This would pick up the runoff from Carroll Drive and pipe it to the existing (and/or replaced) 42" pipe. This would significantly improve the areas of the rear yards of these parcels as requested by the residents, and pick up the runoff from the Carroll Drive cul-de-sac. The second alternative would be to construct a ditch along the utility/open stream easement along the rear yards '-- 3 01l10/2000.WS of Lots No. 121, 122 and 124. This would also effectively pick up the runoff from Carroll Drive cul-de-sac and transfer this runoff through the existing easement to the existing and/or replaced pipe. It is proposed to construct an open stream of sufficient cross section to carry the design runoff and line the ditch with medium stone fill to prevent erosion. The cost to replace the 42'" inch pipe is a constant for both alternatives and the costs for the pipe alternative is approximately $18,700 higher that the ditch alternative. Total project costs range from $71,900 to $90,600. COUNCILMAN RUGGIERO moved to approve the project as outlined by Mr. Paggi, and the funds to come out of the B fund of surplus. Seconded by Mr. Valdati J Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Attorney to the Town Al Roberts, to obtain the easements as necessary. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi to prepare the Contract documents. Seconded by Mr. Valdati Motion Unanimously Carried Notification from William DeVita, Executive Director for the Rehabilitation Support Services, Inc., notifying the Supervisor Smith of their interest and intent to establish a supervised community residence at 131 Osborne Hill Road, in the Township of Wappingers. They are proposing to build a residence at this location to serve twelve seniors with mental disabilities who are currently living in other supervised settings in Dutchess County. Discussion followed. It is his intention to meet with community leaders to answer any questions that may arise. Supervisor Smith informed the Board that the law states that we may hold a Public Hearing, and if we opt to hold a Public Hearing, it must be held by February 4th. Discussion followed. COUNCILMAN RUGGIERO moved to hold an informational hearing on January 24,2000 at 7:00 p.m. on the proposed building of a supervised Community Residence for Seniors with mental disabilities on 131 Osborne Hill Road. Seconded by Mr. Bettina J Motion Unanimously Carried COUNCILMAN VALDATI moved to authorize Supervisor Smith to send out letters to all the abutting property owners, informing them of this date and the nature of the hearing. J...;./ .; 4 01l10/2000.WS Seconded by Mr. Ruggiero L Motion Unanimously Carried Nest is Mr. Paggi's report on realigning the intersection of All Angels Hill and Kent Road. After some preliminary investigation, Mr. Paggi did not think the town had enough right-of-way on the north side of Kent road to accomplish that, which would be going down the hill on the right and coming up the hill on the left. Mr. Paggi wishes some direction to proceed further to identify the necessary properties. COUNCILMAN RUGGIERO moved to authorize Jay Paggi, Engineer to the Town to investigate the properties along Kent Road on the north side. Seconded by Mr. Paoloni Motion Unanimously Carried Supervisor Smith was contacted by the owner of Wrage Real Estate informing the board that there is a piece of vacant property that adjoins our sewer plant in Fleetwood. Ms. Wrage wished to know if the town would be interested in purchasing the property. It is approximately seven acres, and the asking price is $140,000. Discussion followed. COUNCILMAN RUGGIERO moved to accept the correspondence and place it on file. Seconded by Mr. Bettina I ... Motion Unanimously Carried COUNCILMAN VALDATI informed the board, that after looking over the new salary study, for the Deputy Building Inspector he sees the salary would be between grades 6 and 7. Perhaps the board would like to make this more in line and make it an actual grade 7, which would be $29,600. COUNCILMAN VALDATI moved to amend his earlier motion, and upgrade the Deputy Building Inspector position to a grade 7 at a starting salary of $29,600. Seconded by Mr. Ruggiero L Motion Unanimously Carried COUNCILMAN PAOLONI wished to have an update on the Montfort Woods. Jay Paggi, Engineer to the Town explained, that the area has been identified as a Federal Wetlands. He is going to get a formal proposal as to what we wish to do and send it to the Army Corp. of Engineers. At this time, 9:25 p.m., COUNCILMAN BETTINA moved to go into Executive Session to discuss personnel, seconded by Mr. Valdati, and unanimously carried. The Meeting reconvened at 10:44 p.m. with all board members present.
