Supervisor Smith opened the meeting at 7:30 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the town Graham Foster, Highway Superintendent Absent: Vincent Bettina, Councilman Supervisor announced that Mr. Bettina is absent tonight due to a family emergency. The first item for discussion is MVK. Supervisor Smith announced that we already authorized the Attorney to the Town Al Roberts to proceed in regard to the violation if MVK did not follow the proposal that he was given. He did in the beginning, but now we received a letter from the Zoning Administrator explaining that MVK failed to submit the last payment of $1,000. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Al Roberts, Attorney to the Town to apply to State Supreme Court to close that portion of the MVK business in order to make him comply with the Zoning Laws. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Attorney to the Town to go after the money that is still due. Seconded by Mr. Valdati Motion Unanimously Carried The next item on the agenda is the Lehigh Landscaping contract for the Emergency Services Building. Graham Foster, Highway Superintendent explained that it was his understanding, when the board agreed on the hiring of two additional men for Highway, that Highway would plow and sand the Emergency Services Building. COUNCILMAN RUGGIERO moved to authorize Supervisor Smith send a letter to Lehigh Landscaping informing him that the Highway Department would take care of the sanding and plowing the Emergency Services Building. Seconded by Mr. Paoloni 1 12/13/99.WS Motion Unanimously Carried Supervisor Smith announced that Toll Brothers were scheduled to be on the tonight's agenda, but they called and asked to be removed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts to defend and ratify the actions taken in bringing the application to a preliminary injunction against PIQWON. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts to defend the Town of Wappinger in the Alpine lawsuit. Seconded by Mr. Valdati Motion Unanimously Carried Next is Jay Paggi, Engineer to the Town. At the October Workshop, Mr. Paggi was authorized to revise sections of the Map Plan and Report for the Wappinger Water Improvement 99-2. The proposed improvements called for in the October 11th proposal to the Town, which included 3 additional wells at the Atlas well field, bringing the total to 5, the construction of an appropriate size clear well and water storage facility at the Atlas site. This would allow for the efficient pumping of that water from there to a dedicated tank line to a new one main gallon storage facility at the Cider Mill Loop site. Discussion followed. Also discussed was the testing of giardia . COUNCILMAN RUGGIERO wished to know is there was any way we can mandate the testing of giardia and cryptosporidium on a regular basis to all our systems. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town Al Roberts to draft a local law for the testing of giardia and cryptosporidium once every three months for all of our municipal wells in the town. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Engineer to the Town Jay Paggi, revise the 99-2 Map, Plan and Report to include the new well at Rockingham in the 99-3 proposal. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN PAOLONI moved to investigate the cost of a new tank in Rockingham versus repairing the existing tank to include in 99-2 report. Seconded by Mr. Ruggiero 2 Motion Unanimously Carried 12/13/99.WS 3 Next is.discussion on the Meadowood Subdivision. Jay Paggi, Engineer to the Town informed the board that the developer of Meadowood, Steve Domber had two questions. The first question has to do with water, and Mr. Domber had made a presentation to the town regarding his donation on the completion of the existing water supply well, that will be tied into the existing Rockingham distribution system, and the water would in turn allow Mr. Domber to extend service out of Central Wappinger to approximately 25 to 30 lots within his subdivision, and also lots within the proposed Shamrock Subdivision. The well has capacity of in excess of 200,000 gallons per day and the remainder of the source would be used to augment the existing Rockingham usage, and somewhat replace the existing well. The second question is a request to tie into the sanitary sewer line. Mr. Paggi explained that the Meadowood Subdivision is included in the Map, Plan and Report for Phase 3A of the Wappinger Sewer Transmission Treatment Improvement. In fact it was included at the then density, of 79 lots. Mr. Domber explained he would like to hookup by midsummer of the year 2000. Discussion followed. COUNCILMAN VALDATI moved to authorize Supervisor Smith contact Tri - Municipal to get permission for temporary usage of sewer and water, and authorize the Attorney to the Town, Al Roberts to work with Mr. Domber so he can have in place, the proper deeding or a memo of understanding that this will be done, and we are in accord that Mr. Domber should proceed with .. this proposal. Seconded by Mr. Ruggiero Motion Unanimously Carried Mr. Domber wished to know if Engineer to the Town, Jay Paggi could work on the design. Supervisor Smith explained, we can not dictate to Mr. Paggi what to do, its up to him if he wishes to do it. Discussion followed. Mr. Domber explained he may look for another partner to do this with, rather than Shamrock, if his approvals are not moving along, or if Mr. Buyakowski changes his mind, and wants reassurance that there is a certain amount of gallonage that he can reserve for himself. Discussion followed COUNCILMAN VALDATI moved to rescind his motion for contacting Tri - Muni for temporary usage of sewer pending Mr. Domber's written request to the town as to what he would like reserve for himself. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is a request from Mr. Terwilliger, Comptroller, for a transfer of $75,000 from A Fund to the Central Wappinger Emergency District #1 on a temporary basis, until new District's funding is in place. This will enable the 3 12/13/99.WS town to pay bills it has incurred in the drilling of the two new wells at the Atlas Well site. COUNCILMAN RUGGIERO moved to authorize the Mr. Terwilliger to transfer $75,000 from A Fund to the Central Wappinger Emergency District #1 on a temporary basis, until new District's funding is in place. Seconded by Mr. Valdati Motion Unanimously Carried At this time 8:35 p.m., COUNCILMAN RUGGIERO moved to go into Executive Session for consultation with Attorney, to the Town, regarding the Assessor, and his court report on PIQWON. Seconded by Mr. Valdati Motion Unanimously Carried The meeting reconvened at 9:32 p.m. with all board members present, except Mr. Bettina. THERE WAS NO ACTION TAKEN AT THE EXECUTIVE SESSION.
