Supervisor Smith opened the meeting at 7:37 p.m. Present: Constance Smith, Supervisor Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Elaine H. Snowden, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent Absent: Robert Valdati, Councilman The first item on the agenda concerns I & I. for Phases I & II. SUPERVISOR SMITH announced that we have some money left over. In the sewer lines we had $114,123.59 which they rolled over They also want to roll over the $951,261.49 for the plant. She asked them not to do that, because her intention was to ask the boards approval for I & I work with this money, which we sorely need. This would be subject to verification of Bond Council. Discussion followed. COUNCILMAN BETTINA moved to approve the I & I work and proceed with the study, based on the Attorneys recommendation and subject to verification of Bond Council. Seconded by Mr. Paoloni Motion Unanimously Carried Jim Sedore went over the report on the Tri -Municipal Sewer Commission step III Final Distribution Analysis which included the Receipts, Projected Disbursements, and Cash In Bank Ending for Phase 3A. Discussion followed. NO ACTION TAKEN Next is a Verbal report from Jay Paggi, Engineer to the Town, on the Developers Participation Improvement #2. SUPERVISOR SMITH felt this report should be discussed in Executive Session. COUNCILMAN RUGGIERO moved to discuss this report at Executive Session. Seconded by Mr. Bettina Motion Unanimously Carried 1 11/08/99.WS Next is the Klein Nicole Farms update from Al Roberts, Attorney to the Town. Mr. Roberts informed the board that the Nicole Farms Bond has been renewed for an additional year. The reason we did not go forward in calling the Bond is because we have to identify precisely what we are going to be doing. Mr. Klein cooperated to the extent that he renewed the Letter of Credit. We still have not identified the nature of the work to be done. Some form of the old work or this new scheme. All we are trying to do at this point is find out what's going to be done, who is going to do it and proceed from there. Whether or not the town should have accepted the reduced bond in the first place is water over the dam. Mr. Klein indicated that he would cooperate and we will sit down, come up with some numbers and report back to the board. NO ACTION TAKEN Next is the Interim Plot Plan. SUPERVISOR SMITH announced that we have had several meetings on this. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts, in conjunction with Dan Wery, draft a proposal, with input from Jay Paggi, Engineer to the Town on a interim Plot Plan procedure to be amended to our Town Code. Seconded by Mr. Paoloni Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Al Roberts, Attorney to the Town to draft a similar proposal to include Commercial also. Seconded by Paoloni Motion Unanimously Carried Jay Paggi, Engineer to the Town, gave his report on the Post Closure Monitoring for Castle Point. Once we have established one year of monitoring we are going to apply for a reduction in the number of years, and the number of times per year we must monitor it. We can apply for this under the mandate relief program. Discussion followed NO ACTION TAKEN Next is the request from Bill Diesing to hook up to Town water for a house he wishes to build on Myers Corners Road. Supervisor Smith explained, even though he is in the district, we can't supply him with water, but he needs a letter from the Town sent to the Health Department stating the fact. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Mr. Paggi to send a letter to Supervisor Smith first, stating we must deny Mr. Diesing's request. Seconded by Mr. Valdati Motion Unanimously Carried 11/08/99.WS COUNCILMAN RUGGIERO moved to authorize Supervisor Smith to send a letter to the Health Department once she receives a report from Jay Paggi, Engineer to the Town denying Mr. Diesing's application for water from the district. Seconded by Mr. Bettina Motion Unanimously Carried Several weeks ago we went out to bid to replace the front doors for the Town Hall to make them handicap accessible. We have to be in compliance by the end of the year, and we did not receive any bids. Supervisor Smith would like to have Mr. Paggi authorized to rebid for the doors again. COUNCILMAN BETTINA moved to authorize Mr. Paggi, Engineer to the Town to rebid for the handicap accessible front doors for Town Hall. Seconded by Mr. Paoloni Motion Unanimously Carried Next is a chargeback memorandum from the County. These charges are for services in the production of assessment rolls and bills, and refunds related to erroneous taxes and judgments. Attached was a history and explanation of charges. Discussion followed. COUNCILMAN RUGGIERO moved to authorize the Comptroller to chargeback out of the budget $42,444.94, and the funds to come out of Fund Balance to 1355.A. Seconded by Mr. Paoloni Motion Unanimously Carried Supervisor Smith announced, that she was informed that the Roberts Mobil Home Park water system contains a bacteria called Beaver Feuer. The Health Department has informed the park owners, that they want them to hook into Hilltop Water, immediately, but Mr. Rawls must come before the town first, with the request, which he has not done yet.. The residents were notified to boil their water. NO ACTION TAKEN. TOWN CLERK, Elaine Snowden informed the Board that she was served with papers from PIQWON today. It has not been turned over to the insurance company because its a town matter, and the Town Board needs to refer this to Al Roberts, Attorney to the Town, to investigate and defend. COUNCILMAN RUGGIERO moved to refer the papers from PIQWON to Attorney to the Town, Al Roberts to investigate and defend. Seconded by Mr. Paoloni Motion Unanimously Carried At this time 9:00 p.m. COUNCILMAN RUGGIERO moved to go into Executive Session. 3 Seconded by Mr. Bettina 11/08/99.WS Motion Unanimously Carried The meeting reconvened at 9:27 p.m. with all board members present, except Mr. Valdati. There was no action taken at the Executive Session. COUNCILMAN BETTINA moved to close the meeting, seconded by Mr. Ruggiero and unanimously carried.
