COS:dly 10/12/99.WS The Workshop Meeting of the Town of Wappinger was held on October 12, 1999 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:30 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina, Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Elaine H. Snowden, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent The first order of business is to approve the acquisition of a tax delinquent parcel ( Lauffer Parcel). The following resolution was moved by COUNCILMAN RUGGIERO and seconded by Councilman Bettina. WHEREAS the County of Dutchess has acquired a number of parcels of land because the property owners have failed to pay real estate taxes thereon; and WHEREAS, the County's practice has been to sell the various parcels it has acquired through tax delinquency at a public auction; and WHEREAS, pursuant to a policy and procedure duly adopted by the County, it has offered these parcels to various municipalities who may have an interest in acquiring same; and WHEREAS, the Town Board, upon recommendation of the Engineer to the Town, has an interest in acquiring one parcel, located on Myers Corner Road, formerly owned by Elizabeth Lauffer, bearing tax grid parcel number 19- 6158-04-805120-00, hereinafter referred to as the "Parcel"; and WHEREAS, said Parcel contain several "Federal Wetlands"; and WHEREAS, acquisition of said Parcel will enable the Town to implement storm water control measures in the future and/or utilizing same as "Green Space"; and WHEREAS, the Town Board has determined that the acquisition of said parcel would be in the best interests of the public health, safety and welfare of the residents of the Town of Wappinger; and WHEREAS, Town Board has been advised that the County will sell said Parcel to the Town for the sum of $49,348.56; and WHEREAS, the Town Board has undertaken an environmental review of this action (i.e., the intended purchase of the subject Parcels), and has determined that there are no environmental impacts and intends to issue a Negative Declaration thereon. 1 i 10/12/99.WS NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Town Board hereby incorporates the recitations set forth above as if fully set forth at length herein. 2. The Town Board hereby declares that it is in the public interest to purchase the premises described as tax grid number 19-6158-04-805120- . 00. 3. The Town Board has reviewed the intended action (the purchase of the above referenced parcels) with the provisions set forth in 6 NYCRR (SEQRA) and the provisions of Town Code Chapter 117, and hereby determines that the intended action is and "Unlisted Action". 4. The Town Board hereby determines that it is the only involved agency in this action and hereby declares itself lead agency pursuant to Article 8ECL and related Title 6, Part 617-NYCRR. 5. The Town Board has caused to be prepared and completed Part 1 and Part 2 of a Short Form EAF for this project in the form annexed hereto. 6. Based on its review of the EAF and the information contained in the attachments thereto, the Town Board hereby determines that there are no environmental impacts associated with this action (i.e., the purchase of the parcel) and the Town Board hereby makes a Negative Determination of Significance for this project. 7. The Town Board hereby authorizes the purchase of the aforementioned ffi parcel in accordance with applicable County policy, at a cost not to exceed $49,348.56 plus sums necessary for all related and appurtenant costs, such as attorneys fees, title insurance premium and recording charges. 8. The Town Board hereby authorizes and directs the Town Supervisor, Constance O. Smith, to take all steps and execute all documents necessary to acquire said Parcel from the County of Dutchess. 9. The Town Board further directs Attorney to the Town of Wappinger, Albert P. Roberts, to make application for title insurance to insure the Town of Wappinger for the principal amount of $49,348.56. The question of adoption of the foregoing Resolution was duly put to a vote on roll call, which resulted as follows: Constance Smith, Supervisor Voting Aye Robert Valdati, Councilman Voting Aye Vincent Bettina, Councilman Voting Aye Joseph Ruggiero, Councilman Voting Aye Joseph Paoloni, Councilman Voting Aye The Resolution is hereby duly declared adopted 011 10/12/99.WS A Public Hearing having been held on the proposed Local Law Amending Section 230-46, 230-47, and 230-48 of the Code of the Town of Wappinger, to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection with All Angels Hill road to its intersection with Brothers Road, the matter of its adoption was now placed before the Board for their consideration. The following Resolution was offered by COUNCILMAN PAOLONI who moved its adoption and seconded by Councilman Ruggiero. LOCAL LAW #8 OF THE YEAR 1999 A Local Law entitled "Local Law Amending Section 230-46, 230-47, and 230- 48 of the Code of the Town of Wappinger, to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection with All Angles Hill Road to its intersection with Brothers Road." BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: This Local Law shall be know and cited as Town of Wappinger Local Law #8 of 1999, and entitled "Local Law Amending Sections 230-46, 230-47, and 230-48 of the Code of the Town of Wappinger, to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection with All Angels Hill Road to its intersection with Brothers Road." Section II: Legislative Intent: It is the determination of the Town Board of the Town of Wappinger that the portion of Myers Corners Road from its intersection with All Angels Hill Road to its intersection with Brothers Road has become extremely congested with traffic. This portion of Myers Corners Road contains a firehouse, a Grange Meeting Hall, a church, a gasoline service station, an office complex, used car dealership and a small strip shopping center. The Town Board further determines that given the traffic volume along this section of Myers Corners Road, parked, stopped or standing vehicles present a significant threat to the safety of motorists, the traveling public and pedestrians in this area. Accordingly it is the express determination of the Town Board that in the interest of the public health, safety and welfare of the residents of the Town of Wappinger to prohibit parking, stopping or standing on both sides of Myers Corners Road from its intersection will all Angels Hill Road to its intersection with Brothers Road. Motion Unanimously Carried 0 r 10/12/99.WS A Public Hearing having been held on a Local Law Amending Section 175-12 of the Code of the Town of Wappinger `Restrictions' Applicable to Hawkers and Peddlers in the Town of Wappinger", the matter of its adoption was now placed before the Board for their consideration. The following Resolution was offered by COUNCILMAN BETTINA and seconded by Councilman Ruggiero. LOCAL LAW #9 OF THE YEAR 1999 A Local Law entitled " Local Law Amending Section 175-12 of the Code of the Town of Wappinger, "Restrictions", applicable to Hawkers and Peddlers in the Town of Wappinger". BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: Local Law Amending Section 175-12 of the code of the Town of Wappinger, `Restrictions', applicable to Hawkers & Peddlers in the Town of Wappinger". This Local Law shall be know and cited as Local Law No. #9 of the year 1999, entitled "Local Law Amending Section 175-12 of the Code of the Town of Wappinger, `Restrictions', applicable to Hawkers and Peddlers in the Town of Wappinger" which shall amend the present Section 175-12 as set forth below. Section II: Legislative Intent: The Town Board has determined that some of the existing restrictions imposed on licensed hawkers and peddlers in the Town of Wappinger as set forth in the Code of the Town of Wappinger at Section 175-12, are no longer required in order to promote the best interests of the Town's residents. It is the determination of the Town Board that the existing restrictions, requiring that hawkers and peddlers move after one (1) hour in a given location, result in the presence of hawking and peddling activities in a greater number of locations than would otherwise be the case. To the extent that hawkers and peddlers are otherwise in compliance with the restrictions on the location of their activities, it is the determination of the Town Board that the Town's residents are best served by allowing such hawkers and peddlers to remain in a single location. Section III: Deletion Section 175-12 of the code of the Town of Wappinger is hereby amended by deleting in its entirety following text, Section 175-12 A.(4): No licensee shall, while engaged in the activity for which a license was issued pursuant to this chapter, stand or allow or permit the vehicle used in such licensed activity to stand in any one location for more than one hour. After one hour in any one location, the licensee shall move said vehicle a distance of not less that 1,000 feet from such location and shall not return to same location more than twice in one day. This restriction shall not 5 10/12/99.WS apply to licensees who are participating in one -day or two-day special event authorized by the Town Board." Section IV: Separability. The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their application to other persons or circumstances. It is hereby declared to be the legislative intent of the Board of the Town of Wappinger that his Local Law would have been adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable, had been specifically exempt therefrom. Section V: Ratification. Except as amended by this Local Law, the Code of the Town of Wappinger, as amended, is hereby ratified, confirmed and readopted. Section VI: Effective Date. Motion Unanimously Carried A Public Hearing having been held on a "Local Law Amending Section 230-43 of the Code of the Town of Wappinger to designate Iroquois Drive as a STOP intersection at its easterly intersection with Cayuga Drive." The matter of its adoption was placed before the Board for their consideration. The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption and seconded by Councilman Paoloni. LOCAL LAW #10 OF THE YEAR 1999 A Local Law entitled "Local Law Amending Section 230-43 of the Code of the Town of Wappinger to designate Iroquois Drive as a stop intersection at its easterly intersection with Cayuga Drive." BE IT ENACTED by the Town Board of the Town of Wappinger as follows: Section I: Title: This Local Law shall be known and cited as Town of Wappinger Local Law #10 of 1999, and entitled "Local Law Amending Section 230-43 of the Code of the Town of Wappinger, to designate Iroquois Drive as a stop intersection at it easterly intersection with Cayuga Drive". Section II: Legislative Intent: It is the determination of the Town Board of the Town of Wappinger that Iroquois Drive, at its easterly intersection with Cayuga Drive, shall be designated a stop intersection and that a stop D 10/12/99.WS sign shall be erected accordingly. The Town Board has received a number of requests that this intersection be made a stop intersection and Graham Foster, Superintendent of Highways, concurs. Accordingly, it is the express determination of the Town Board and in the interests of the public health, safety and welfare of the residents of the Town of Wappinger to establish Iroquois Drive at its easterly intersection with Cayuga Drive be designated a stop intersection and that a stop sigh be erected accordingly. Section III• Stop Intersections. Section 230-43 of the Code of the Town of Wappinger entitled "Schedule IX: Stop Intersection" is hereby amended by including, in alphabetical order, Iroquois Drive at its easterly intersection with Cayuga Drive to said "Schedule IX: Stop Intersection' as follows: Stop Sign on Direction of At Intersection Travel Section IV: Separability. The provisions of this Local Law are separable and if any provision, clause, sentence, subsection, work or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity or unconstitutionality, shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this Local Law or their application to other persons or circumstances. Motion Unanimously Carried SUPERVISOR SMITH announced that Attorney to the Town, Al Roberts needs authorization to release the appraisal of the Capolino property to Ken Capolino, executor of his fathers estate, in furtherance to obtaining an easement for 3A. COUNCILMAN VALDATI moved to authorize Attorney to the Town, Al Roberts to release the appraisal of the Capolino property to Ken Capolino, executor of the estate. Seconded by Mr. Bettina 7 10/12/99.WS Motion Unanimously Carried Mr. Roberts announced that he is going to be successful with two of the needed easements, the Kowalsky parcel on Old Hopewell Road and the Ditullio piece which is located in Wappinger Park. There are two other people that have not responded to Supervisor Smiths letter. If they do not cooperate, Mr. Roberts would like permission to advise the people that the Town will be forced to take it by emanate domain. There would have to be formal proceedings, a public hearing. The second stage he is proposing now is to forward them a copy of the document, a copy of the map on Supervisor Smiths letterhead advising them if they do not respond, the Town will authorize emanate domain proceedings. He did not wish to do that without the Town Boards permission. Discussion followed. COUNCILMAN VALDATI announced he would hand deliver another to letter to the residents requesting their cooperation in obtaining the easements, before authorizing Mr. Roberts to emanate domain proceedings. THE FIRST ITEM the Joint City/Town Water Connection. SUPERVISOR SMITH would like permission to send a letter to the Town of Poughkeepsie Supervisor saying we understand what the terms imply and we should set up a meeting to start negotiations as soon as possible. Discussion followed. COUNCILMAN BETTINA moved to authorize Supervisor Smith send a letter to Town of Poughkeepsie Supervisor, Thomas Murphy stating the Town of Wappinger wishes to set up a meeting to start negotiations. Seconded by Mr. Valdati Roll Call Vote vote Constance Smith, Supervisor aye Robert Valdati, Councilman aye Vincent Bettina, Councilman aye Joseph Ruggiero, Councilman nay Joseph Paoloni, Councilman nay Motion Carried Next is the Fieldstone Farms Subdivision. Al Roberts, Attorney to the Town announced that he had given his opinion in his September 24th letter and basically when this subdivision was developed, the Planning Board required certain conditions and restrictions on the uses of the property. They required the developer to incorporate those restrictions in a declaration which was filed with the County Clerks office shortly after the subdivision was approved. The way it was set up, it was not contemplated that they could make changes. The Planning Board can amend the resolution, but that is not going to solve the Title issues created by the declaration. E:3 10/12/99.WS COUNCILMAN RUGGIERO moved to accept Mr. Roberts opinion with a letter, describing it to every resident on the petition in the districts, so they are well aware of the issue. Seconded by Mr. Valdati Motion Unanimously Carried A progress report for the Atlas Well No. 99-2 was received from Jay Paggi, Engineer to the Town. They are nearing completion of the drilling of the first two wells at Atlas Wellfield. Atlas Well No. 99-1 showed preliminary pump test that the well can be safely pumped at 400 GPM. With respect to Well No. 99-2, the preliminary pump test indicates that the well can pump approximately 500 GPM while maintaining sufficient draw down. However during the development phase of the well construction, which is when you pump the well to remove the silt and sands that are introduced into the well during the drilling process, the well driller was not successful in removing all the fine materials. He had authorized additional development time for the Contractor, but this did not prove successful. The Contractor, at the direction of the hydrogeologist tried surging the well at a very high rate of flow. This posed an additional problem to us in that the only place to discharge this volume of water was directly to the Wappinger Creek, and with discharging waters of such high turbidity, it visually impacted the creek. They spoke with DEC, and they cautioned that they would not issue a permit for the discharge and the Town should not allow such a discharge that would cause a visual impact to the creek. They did pump the well for an extended length of time at a lower series of rates and discharged the water onto the ground and let it disperse over a wide area. This type of pumping showed a small improvement in the turbidity levels in the discharge. However it was not to the levels that would be deemed acceptable. At this time they cannot pursue this alternative. It is the recommendation of Mr. Paggi at this point in time that there not be any further development of Well No. 99-2 and gather all costs on this well to date, and seek a proposal to build a second well adjacent to this existing location. In all likelihood the well will be drilled to a shallower depth. Well No. 99-1 is ready for the long term pump test now. If we do the 72 hour pump test now, it will be ready in 3-4 week time frame. If we wait and drill alternative Well No. 99-2 it may be 6-8 weeks until simultaneous tests. However we could potentially save between $10K to $15K. COUNCILMAN VALDATI moved to authorize Mr. Paggi to wait and do both pump tests simultaneously. Seconded by Mr. Bettina E 10/12/99.WS Motion Unanimously Carried Next are the bids for the Regency Drive Culvert Construction. Bids were received and opened on October 181 1999. Three bids were received, the lowest being Ben Ciccone, Inc., at a bid of $76,575.00. Although Ben Ciccone, Inc., summed their Total Bid Price incorrectly, a check of their bid proposal showed that all the unit priced, both in figures and written in words, were correct, but their total bid should have been $76,750.00. Despite the error, Ben Ciccone is still low bidder. The construction cost estimate for the project prepared by this office 1996 was $70K. In order to compare this estimate to the bid of Ben Ciccone, Inc., we needed to update the 1996 estimated to 1999 dollar value. The construction cost estimate in dollars for 1999 is $75,970.00. The cost difference is $780. In light of the cost difference we feel this is a good price for this work and would recommend that the Board consider awarding the contract to Ben Ciccone, for $76,500. COUNCILMAN RUGGIERO moved to award the bid for the Regency Drive Culvert Replacement to Ben Ciconne, Inc., for $76,500, as low bidder, upon the recommendation of Jay Paggi, Engineer to the Town. Seconded by Mr. Bettina Motion Unanimously Carried Next is discussion on Dr. Velardi. Mr. Roberts, Attorney to the Town informed the board that the current issue is that all the proposed road was never dedicated to the Town. He would need that to get access for further development of his property. The Town stated that they would request deeds from the property owner. Dr. Velardi provided Mr. Roberts with a legal description and the gentleman's name and address. COUNCILMAN PAOLONI moved to inform Dr. Velardi to set up an escrow account in the amount of $500 before Mr. Roberts can proceed. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is Murray of 7 Hamlet Court. Mr. Roberts, Attorney to the Town informed the board that Mark Liebermann is sending Mr. Murray a letter detailing what we have proposed, and he be permitted to keep the new driveway there at his own risk. The Town would not be responsible if it had to go in and exercise any rights to the easement area. We also directed Mr. Murray to pick up the unused driveway, rake it and seed it, and we would have Graham Foster issue a provisional consent, consistent with the proposed settlement. COUNCILMAN VALDATI moved to accept the report and place on file. Seconded by Mr. Paoloni 10 10/12/99.WS Motion Unanimously Carried Next is Mr. Holt, Chairman of Recreation. First Mr. Holt wished to discuss the Senior Center. He informed the board that there are 450 + seniors signed up at the center at this time, and as you know we can only handle 90 on any given day with the facilities that we have. The last census that was done by the county in 1990 said there were 3,500 seniors, and that census is ten years old, so you know there are more now. Mr. Holt was asked to look into leasing or renting a piece of property, which he did, but nothing was available. He also looked into a Modular Structure, which he did. A study was performed by Mr. Paggi and Mr. Swartz, and they said that the Montfort Road property was one of the better pieces of property where the Town ought to build a new center. They decided that 9,000 sq. ft. would be acceptable. East Fishkill has just built a beautiful center, and its already too small. He feels that a 9,000 sq. ft. would also be to small. He feels we just can't build a Senior Center we have to build a Community Center. In addition we want a Teen Center, so lets build something that will satisfy all three needs. We have dealt with some professionals in regard to a Community Center. At this time Joe Ennesser was introduced, to give a report on the cost of a new building. Mr. Ennesser explained that he had contacted several companies, back in the spring to get some prices for construction. Mr. Ennesser went over all the items that would be required for the building and said the estimated cost for a 9,000 sq. ft. building would be between $530K to $600K. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi to go to the DEC and inquire into the possibility of erecting a building on Town Hall property. Seconded by Mr. Bettina Motion Unanimously Carried The last item to discuss is the lighting of a field at Robinson Lane. Mr. Holt said the if the field had lighting, it could be used in a number of other ways, not just for little league. A number of vendors were contacted as to the cost of the hardware needed to install lights. The estimated cost would be between $50k to $60K. Electrician would cost around $10K. Installing the poles, around $5K. To dig the holes for 9 poles to a depth of 8 to 10 feet would cost around $5K. If Highway were to dig the trenches connecting the poles, there would be no charge. Central Hudson's cost, which would include a new transformer and a change to the existing one plus the adding of a separate pole outfitted with a single phase primary metering package is estimated to cost $38K, for a estimated cost of $110K to $120K to install lights at 11 10/12/99.WS Memorial Field at Robinson Lane. If we do this, there is still some other lighting that would need to be done at a cost of $10K to $15K. Lights would be needed at the parking area, and restroom area. COUNCILMAN VALDATI wished to know if there were sufficient funds in Parkland Trust for this project. Supervisor Smith answered no! Discussion followed. Bill Farrell, President of the Little League was introduced, and was in favor of the lights for Memorial field, because we are branching out a big league program which we are going to re-establish next year, but we are also going to run a Connie Mack League, which is a higher level of ball. We can run later games for the older boys, and putting lights in gives us more use of the fields. There was no other business to come before the Board. COUNCILMAN BETTINA moved to close the meeting, seconded by Mr. Valdati and unanimously carried. The meeting adjourned at 8:55 p.m. C� Elaine H.
