1999-08-18 SPM08/18/99 -SPM A Special Meeting of the Town Board of the Town of Wappinger, was held on on August 18, 1999, at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the meeting to order at 7:00 p.m. The purpose of the meeting is to discuss options and solutions to the town water problems. Present: Constance Smith, Supervisor Robert Valdati, Councilman Joseph Ruggiero, Councilman Absent: Vincent Bettina, Councilman Joseph Paoloni, Councilman Elaine H. Snowden, Town Clerk At this time, Mike Tremper of CAMO is requesting authorization to bill beyond the normal contract for the excessive amount of extra time and expenses incurred due to the water emergency. The cost should be between $3,500 and $4,000. Discussion followed. NO ACTION TAKEN. COUNCILMAN RUGGIERO moved to accept the Engineers Map, Plan and - Report for proposed Wappinger Water Improvement 1999 No. 1. (Central Wappinger Emergency Water Improvement Area). Seconded by Mr. Valdati Motion Unanimously Carried The following Resolution was offered by COUNCILMAN RUGGIERO who moved its adoption and seconded by Mr. Valdati. In the matter of a Proposed Water Improvement in the Town of Wappinger, Dutchess County, New York, pursuant to Article 12-C of the Town Law, to be known as Central Wappinger Emergency Water Improvement Area WHEREAS, the wells located in and benefiting the Central Wappinger Water Improvement Area are going dry and have created a public health, safety and welfare emergency for the approximately 5000 residential properties located therein, for whom it is estimated no water supply will be available within three weeks of the date hereof, and WHEREAS, it has been necessary to institute immediate preparatory actions in the planning and location of appropriate sites for a new water supply source; and WHEREAS, a map, report and plan, including an estimate of cost, have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger, Dutchess County, New York, relating to the construction of new water wells together 1 08/18/99.SPM with interconnecting facilities, water mains and original furnishings equipment machinery apparatus, appurtenances, and incidental improvements and expenses in connection therewith, to serve a benefited area in said Town to be known as Central Wappinger Emergency Water Ixnppvement Area whose boundaries shall consist of the area specified in Appendix A as attached hereto and hereby made a part hereof, as more fully shown upon a map on file in the office of the Town Clerk, which map is available for inspection by any person or person interested in same during regular office hours at said office; and WHEREAS, said map, plan and report, including estimate of cost, were prepared by Paggi, Martin & DelBene, LLP, competent engineers, duly licensed by the State of New York and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any person or persons interested in the subject matter thereof, and WHEREAS, the capital improvements proposed in connection with the establishment of the Central Wappinger Emergency Water Improvement Area of the Town of Wappinger as herein above described, are at maximum estimated cost of $500,000; and WHEREAS, said maximum estimated cost shall be authorized to be financed by the issuance by the town of Wappinger of its serial bonds with a maximum maturity not in excess of the forty year period prescribed by the Local Finance Law; WHEREAS, said maximum estimated cost is not greater than one- tenth of one per centum of the full valuation of taxable real property in the area of the Town of Wappinger outside of any villages and therefor an application to the office of the State Comptroller for approval of establishment of said Central Wappinger Emergency Water Improvement Area will not be required; and WHEREAS, it is proposed that the cost of the aforesaid improvements shall be borne by the real property in said Central Wappinger Emergency Water Improvement Area by assessing, levying upon and collecting from the several lots and parcels of land within such Central Wappinger Emergency Water Improvement Area, outside of any village, which the Town Board shall determine and specify to be especially benefited by the improvements, an amount sufficient to pay the principal and interest on serial bonds and bond anticipation notes issued in anticipation of the issuance of serial bonds, as the same become due and payable; and N 08/18/99.SPM WHEREAS, the aforesaid improvements have been determined to be a Type II Action pursuant to Section 617.5(c)(33) of the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, said regulations provide will not result in any significant environmental effects; and WHEREAS, it is now desired to call a public hearing for the purpose of considering said map, plan and report, including estimate of cost, and to hear all persons interested in the subject thereof concerning the same, all in accordance with the provisions of Section 209-q of the Town Law; NOW THEREFOR BE IT ORDERED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. A public meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, shall be held at the Town Hall, 20 Middlebush Road, in Wappingers Falls, New York, in said Town on the 13th of September, 1999 at 7:15 o'clock p.m., Prevailing Time, to consider the aforesaid map, plan and report, including estimate of cost, and to hear all persons interest in the subject thereof concerning the same and to take such action thereon as is required by law. Section 2. The Town Clerk is hereby authorized and directed to cause a copy of this Order to be published once in Southern Dutchess News & Poughkeepsie Journal, and also to post a copy thereof on the town signboard maintained by the Town Clerk, not less than ten days (10) nor more than twenty (20) days before the day designated for the hearing as aforesaid, all in accordance with the provisions of Section 209-q of the Town Law. Section 3. This Order shall take effect immediately. Seconded by Mr. Valdati 3 Motion Unanimously Carried 08/18/99.SPM COUNCILMAN RUGGIERO moved to authorize Supervisor Smith, Attorney to the Town, Al Roberts, and Engineer to the Town Jay Paggi to reach out to future developers to see what assistance they could offer the town with the water project. Seconded by Mr. Valdati Motion Unanimously Carried Supervisor Smith informed the board members that Linda Nguyen, secretary to the Planning Board and ZBA, has handed in her resignation. Supervisor Smith is requesting permission to appoint a replacement immediately so she can be trained, at a salary of $16,500 prorated, until the salary study is completed. COUNCILMAN RUGGIERO moved to authorize Supervisor Smith appoint a replacement, immediately to replace Ms. Nguyen at a salary of $16,500 prorated and inform the replacement that the salary of $16,500 is in effect until the salary study is completed. Seconded by Mr.Valdati Motion Unanimously Carried There was no other business to come before the board.
