Supervisor Smith opened the meeting at 7:00 p.m. Present: Constance Smith, Supervisor Vincent Bettina, Councilman (arrived 7:05 p.m.) Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Mike Tremper, CAMO Pollution Absent: Robert Valdati, Councilman Elaine H. Snowden, Town Clerk Graham Foster, Highway Superintendent The first item for discussion is the report prepared by Mr. Paggi on the Kent Road sidewalks. Mr. Ruggiero said since receiving the report, he is planning to go door to door because we may need some potential deeds. He wished to table until the next meeting. COUNCILMAN RUGGIERO moved to table discussion to the next meeting. Seconded by Mr. Paoloni Motion Unanimously Carried Correspondence from Assemblyman Joel Miller, on the removal of some signs that were erected on Kent Road. It has come to his attention that there was an additional STOP sign posted on Kent and Robin on the uphill side of the road. He would like it removed. COUNCILMAN RUGGIERO moved to accept the correspondence and place it on file. Seconded by Mr. Paoloni Motion Unanimously Carried At this time Mr. Ruggiero read a letter from Mr. Wisniewski of Kent Road who is clearly opposing the removal of the STOP sign on Kent Road, and does not understand why Mr. Miller is requesting a change. Discussion followed. COUNCILMAN RUGGIERO moved to recommend to forward Assemblyman Millers correspondence to the NYSDOT and see if that's an acceptable practice of instituting a three way intersection based on the Assemblyman's letter. Seconded by Mr. Paoloni Motion Unanimously Carried 1 08/09/99.WS Correspondence from Mr. Kenneth Malley wishing to know why a STOP sign not considered at the intersection of Lake Oniad Drive and Kent Road. was JAY PAGGI, Engineer to the Town informed the board that there is a site distance problem. COUNCILMAN RUGGIERO moved to authorize Engineer to the Town, Jay Paggi, to send a response to the Town Board and we will forward that response to Mr. Malley. by Mr. Bettina Seconded Motion Unanimously Carried Next is the Astor Home rezone request. The Town Board received notification on July 20th from the Planning Board opposing the project, because it is not an appropriate site for the nursery school. Supervisor Smith said she has since talked to Jon Adams, attorney for Astor Homes, and he informed her that they had two alternative sites that were in compliance, so she suggested we should just place this Astor Home rezone request on file, with NO ACTION. COUNCILMAN RUGGIERO moved to place the rezone request on file with, NO ACTION, and authorize the Supervisor to send a letter to Mr. Adams informing him that the Planning Board has determined that this is not the appropriate site for the school and therefore the Town Board will not rezone the property. Seconded by Mr. Bettina Motion Unanimously Carried Dr. Vilardi came before the board several months ago regarding efforts to acquire a 50 ft right of way. He plans to build a house beyond the Town of Fishkill line which crosses into Wappinger. All his services come from the town of Fishkill, and in order to simplify things, he is requesting a small section be annexed to the Town of Fishkill so that he does not have to deal with variances, because it is landlocked. He explained that the access to roads at the present time is all Fishkill. After going over the map with Dr. Vilardi, Mr. Roberts, Attorney to the Town advised Dr. Vilardi that he would be better off with a variance. Discussion followed. COUNCILMAN BETTINA moved to authorize the Supervisor send a letter to the Zoning Board of Appeals in support of a variance for Dr. Vilardi. Seconded by Mr. Ruggiero Motion Unanimously Carried Dr. Vilardi also explained that there is a 50 foot right-of-way that he has tried to acquire from a Mr. Gallo, but all efforts have failed, because Mr. Gallo claims he no longer owns the property. He would like the town to send 2 08/09/99.WS a letter to Mr. Gallo, requesting him to dedicate the property in question, to the Town of Wappinger. Discussion followed COUNCILMAN RUGGIERO moved to authorize the Supervisor to send a letter to Mr. Gallo asking him to dedicate the property in question, to the Town of Wappinger. Seconded by Mr. Bettina Motion Unanimously Carried COUNCILMAN RUGGIERO moved to authorize Al Roberts, Attorney to the Town to prepare the necessary deeds and papers for such a dedication. Seconded by Mr. Bettina Motion Unanimously Carried Next is the request from the Planning Board for the placement of NO PARKING signs along Myers Corners Road at the intersection of DeGarmo Hills Road. Mr. Roberts announced that although it is a county road, he has prepared a draft of the local law, but he needs to get the code adopted. At this time he has it prepared as an amendment to the code. NO ACTION TAKEN. COUNCILMAN RUGGIERO moved to place this item on the next town board meeting. Seconded by Mr. Paoloni Motion Unanimously Carried Some time ago the Town of Wappinger prepared a disaster plan and in the disaster plan we said that we were going to get a generator for the town hall building. We also discussed getting one or two generators for the water and sewer plants. Mike Tremper of CAMO Pollution was asked to get some prices and he explained that for the moderate pump stations the cost would be $25K to $35K apiece, and for the Hilltop station, between $60K to $80K. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Mr. Tremper to get the sizes of generators that are needed and the costs of each, including the town hall and discuss further at the next workshop. Seconded by Mr. Bettina Motion Unanimously Carried Next is the Zoning Administrators Vehicle. Mr. Foody, Building Inspector was requested to look into state bids, but there were none, so he went out and got some prices for vehicles. The cheapest being $13,800, for a four door used wagon. He also priced a Ford Escort Sedan, which was $14,000. Mr. Foody explained that he went out to different dealers, and they all ran in the $15,000 range. The wagons were in the same price range. Mr. Foody felt 3 08/09/99.WS that a wagon for the Building Inspector was not a necessity. He also explained that the state bids won't come out until October or November. Discussion followed. COUNCILMAN RUGGIERO moved to table until budget time. Seconded by Mr. Paoloni Motion Unanimously Carried The next item is Schlathaus Park. A Bid was accepted for the installation of the Handicap doors at the park, but an additional $6,850 is needed for the completion of the job. Mr. Holt would like to take the funds out of the Parkland Trust. COUNCILMAN RUGGIERO moved to take $6,850 from Parkland Trust in order to complete the work at Schlathaus Park. Seconded by Mr. Paoloni Motion Unanimously Carried Next is the Fieldstone Boulevard request. Supervisor Smith announced that the reason she had this item on the agenda was to remind her to ask the Attorney to the Town, where we stand on Fieldstone. Mr. Roberts explained that he had the necessary information. When the Planning Board approved the subdivision, they put certain conditions on the use of the individual parcels. They were incorporated in the Planning Boards resolution for approval. In addition there were certain notes placed on the filed map and those notes were propounded by the original property owner. There is no procedure laid out. If there is a violation of a recorded restriction of covenant, the adjacent property owners have two years to bring a lawsuit to enforce that. Anyone in the development can bring such a lawsuit within two years of the violation. These residents have several major problems to contend with. 1) Neighbor vs. Neighbor, 2) Planning Board Issues, 3) Town of Wappinger Zoning Laws. Discussion followed. COUNCILMAN RUGGIERO moved to authorize Attorney to the Town, Al Roberts write a report summarizing tonight's discussion with the board, so we may disburse the information. Seconded by Mr. Bettina Motion Unanimously Carried Next is Spook Hill Recreation. Discussion followed. NO ACTION TAKEN. SUPERVISOR SMITH announced that this year marks the 25th anniversary of Community Day for the Town of Wappinger. She would like to plan something extra special for the residents. She and her secretary drove up to Wyndham, New York, to look at an educational circus called Circus with a Purpose. He teaches the children about pioneer days, etc. He also has two 4 08/09/99.WS tractor trailers that he has set up as walk through museums. There are also mountain lions and black bears, demonstrations, a petting zoo. He is fully insured. The cost to hire Circus with a Purpose is $7,000. The money would come out of A Fund Balance. Discussion followed. COUNCILMAN RUGGIERO moved to authorize the expenditure of $7,000 to hire Circus with a Purpose for the 25th Anniversary Celebration of Community Day, for the Town of Wappinger, and the funds to come out of A Fund Balance. Seconded by Mr. Paoloni Motion Unanimously Carried Supervisor Smith announced that a week and a half ago, Mike Tremper and Jay Paggi informed her that Rockingham developed a leak, and we lost 300,000 gallons of water because the tank had to be drained in order to repair it. She issued an emergency order so she could get it repaired. The next hour she was informed that Hilltop also had a leak. They also had to get that repaired. With Rockingham we had the ability to hook into CWW. We do not have the same ability with Hilltop, because of its height. A diver came in to repair the hole. Jay Paggi, and Mike Tremper came to a workshop, and at the workshop we moved to allow two wells to be drilled at Atlas, we also moved to authorize Mr. Paggi to perform a Map, Plan and Report for the water in order to keep this thing moving, because we have to get Hilltop repaired. We have to build a redundant tank. We are drilling on an emergency basis, however we will need to go out to bid for the pipes and tank. She was informed that the water in the wells are going down a foot every 24 hours. Mrs. Smith showed pictures of Sprout Creek which was dry in many areas. Mrs. Smith issued a Town Wide State of Emergency on the Use of Water. NO WATER USE OUTSIDE AT ALL, INCLUDING WELL WATER. There will be no warning, an appearance ticket will be issued immediately. She issued the "FULL STATE OF EMERGENCY' to all the radio stations etc., and will continue to announce the "FULL STATE OF EMERGENCY" every day. She also has purchased 1,000 gallon jugs of drinking water in case of an emergency. If any one hears of a residents well running dry, inform them that we have emergency water here at the town hall. Discussion followed. At the June 28th meeting, RALPH HOLT, Recreation Chairman was authorized to investigate the use of a safe insecticide to control tics for the ball fields and playgrounds in the Town of Wappinger. He informed the board he called a well know firm from Norwalk that uses a nontoxic spray and he took them to Airport Park, Robinson Lane, Rockingham, and 5 08/09/99.WS Schlathaus Park. He was informed that the spray would be at least 97% effective. The Norwalk firm is recommending the parks be sprayed at least 3 times during the year, at a cost of $2,800 per spray. At least once now, and the second spray is suggested some time in October. The cost would be around $5,600. If Castlepoint were included for one spray, it would cost an additional $1,000. For now Mr. Holt is recommending we spray the parks that are heavily used. Another firm was contacted also, but no bid has been received as of this date. COUNCILMAN RUGGIERO, moved to expend $6,600 to spray Rockingham Park, Airport Park, Robinson Lane, Schlathaus Park, and Castlepoint Recreation for tics as recommended by Mr. Holt. Seconded by Mr. Bettina Motion Unanimously Carried Supervisor Smith informed the board that Mr. Foster, Highway Superintendent, has requested a P.O. in the amount of $1,600 for parts and repair of their 20 Ton Jack. COUNCILMAN RUGGIERO moved to authorize a P.O. in the amount of $1,600 for parts and repair of equipment as requested by Mr. Foster. Seconded by Mr. Bettina Motion Unanimously Carried Supervisor Smith also announced that the salary study is underway, but an additional $2,000 is needed to complete the study. COUNCILMAN RUGGIERO moved to authorize $2,000 for the completion of the salary study, and the funds to come out of Fund Balance. Seconded by Mr. Bettina Motion Unanimously Carried There was no other business to come before the board.
