2003-183RESOLUTION NO. 2003-1 0 RESOLUTION AUTHORIZING A PUBLIC HEARING ON APPLICATION FOR SPECIAL USE PERMIT FOR NORTH CHELSEA SUBSTATION EXPANSION BY CENTRAL HUDSON GAS & ELECTRIC CORPORATION At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 23rd day of June, 2003, at 7:30 P.M. The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being called, the following were present: PRESENT: ABSENT: Supervisor - Joseph Ruggiero Councilmen - Robert L. Valdati Vincent F. Bettina Joseph P. Paoloni Christopher J. Colsey The following Resolution was introduced by Mr. Colsey and seconded by WHEREAS, Central Hudson Gas & Electric Corporation is the owner of a certain parcel of property known as the North Chelsea Substation identified as Tax Grid Number 13-5689- 6056-02-760980-00, with a common street address of 2070 Route 9D, Wappingers Falls, New York; and WHEREAS, by written Application received June 19, 2003 by the Town of Wappinger Zoning Administrator, Tatiana Lukianoff, Central Hudson Gas & Electric Corporation has applied to the Town Board pursuant to §240-16(F) of the Zoning Code of the Town of O:\WAPPINGE\Town Board\RESOLUTION\North Chelsea-PH.doc Wappinger to authorize an expansion of the existing 39,650+ square feet of the North Chelsea Substation site by 10,050 square feet for a total area of 52,700+ square feet; and WHEREAS, according to Richard Rennia, Jr. of Central Hudson Gas & Electric Corporation, by letter dated May 2, 2003 and attached hereto, the existing use will remain substantially the same; and WHEREAS, the Town of Wappinger Zoning Code §240-16(F) permits the Town Board, on written Application, to issue a Special Use Permit. NOW, THEREFORE, BE IT RESOLVED, as follows: The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby schedules a Public Hearing on the Application of Central Hudson Gas & Electric Corporation for a Special Use Permit pursuant to §240-16(F) to authorize an expansion of the North Chelsea Substation to be held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York on the 7th day of July, 2003, at 7:30 p.m. 3. Gloria J. Morse, Town Clerk to the Town of Wappinger, is hereby directed to post and publish a Notice of the Public Hearing in the form annexed hereto. Said publications are to be made in the Southern Dutchess News and the Poughkeepsie Journal at least ten (10) days prior to the scheduled Public Hearing. 4. Gloria J. Morse, Town Clerk to the Town of Wappinger, is directed to send copy of the Notice of Public Hearing to adjoining property owners within Two Hundred and Fifty (250) feet of the property. North Chelsea Substation Expansion Rte. 9D, Town of Wappinger MA #2003031.01 Dear Supervisor Ruggiero and Town Board Members: RECEIVED MAY 0 5 2003 SUPERVISOR'S OFFICE TOWN OF WAPPINGER At the request of the Town's Zoning Administrator, this office is contacting the Board to review the above referenced project to see_if .a Special Use Permit is necessary for the above referenced project. In accordance with Town of Wappinger Code Chapter 240, Section 37, Town Board approval of a Special Use Permit is required for new "Public Utilities" within all nonresidential districts. The current project proposes to expand the existing ±39,650 ft2 North Chelsea Substation site by 13,050 ft2 for a total area of ±52,700 ft2' The project will include 2 — New Transformers, 2 - New Circuit Breakers, 3 — Steel Transmission Line Dead End Structures, and a New Power Control Center (1,100 ft). Attached for your reference are 6 copies of a Sketch Plan that shows the general layout of the proposed expansion within Central H udson's a xisting f ee o wined p arcel. A Iso, a s p art o f t his p roject, t he existing Chelsea North and South Substations, which. are located in a residential area at the intersection of Rte. 9D and Chelsea Road, will be removed. It is requested that the Board review this issue and provide direction with regard to the need for a Special Use Permit on this site, as the existing use will remain the same. Both this office and Central Hudson Representatives are available to discuss this project as necessary.
