1999-07-12 RGM07/12/99.WS The Workshop Meeting of the Town of Wappinger was held on July 12, 1999, at the town hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith opened the meeting at 7:30 p.m. Present: Constance Smith, Supervisor Robert Valdati, Councilman Vincent Bettina Councilman Joseph Ruggiero, Councilman Joseph Paoloni, Councilman Elaine H. Snowden, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the Town Graham Foster, Highway Superintendent Dan Wery, Town Planner The Supervisor asked all to join in the Pledge of Allegiance to the Flag. At this time, Supervisor Smith asked the board for permission to move the Rawls Mobile Home Assessment first on tonight's agenda, because of the amount of residents here tonight. COUNCILMAN VALDATI made a motion that the Rawls Mobile Home Assessment be moved to the top of the agenda, because of so many concerned residents attending tonight. Seconded by Mr. Paoloni Motion Unanimously Carried Linda Tasadfoy, Assessor announced that if people were here from Birchwood or another mobile home park, she was not aware that they were sent letters as well, and were coming, so she did not prepare anything for them. If you pick up one of the tax rates breakdown sheets in the back it will give you an idea as to what she will be doing in their parks. Back in February Mr. Rawls requested the average assessment per mobile home in his parks. Linda went over the assessed value, the breakdown of values and the average value per home based on the number of homes in the Wappinger Falls MHP, the Roberts Running Creek MHP, and the Rawls Leisure Living MHP. On page two was the name of the owner, size of mobile home, year it was built, the assessed value that we now have on it, eligibility for exemptions, such as enhanced star, basic, what the school taxes would be and what the town and county taxes would be, based on last years budget. The budgets are not in place for this year as of yet. Supervisor Smith asked if anyone had an questions up to this point. Mr. Rawls, owner of the parks in question stated that the amount of homes in each of the parks is incorrect. He can back it up with the revised 1 07/12/99.WS assessment that was completed in 1987 or 1988. No more sites have been added, only replacements. Discussion followed. Supervisor Smith said that we would meet again, with the old assessor new assessor and attorney in attendance, to iron this out. Supervisor Smith said they would all meet again on July 26th at 7:30 p.m. Because there may be so many people in attendance, we may have to have the meeting across the street at the school. She will send out notices. No action taken. Next is Jon Adams who wished to discuss the drainage situation at the proposed Astor Home Nursery School. He announced that he had met with the residents and they expressed their concerns, one of which was drainage. He said they have revised the drainage plans. He felt that Mr. Paggi, Engineer to the Town could better express the revisions and solutions for the drainage. Mr. Paggi informed Mr. Adams that he had not been presented with any of the revisions. Mr. Paggi had called Chazen Engineers, and told them the method they had proposed was not acceptable, and they had to come up with an alternative. Every counter proposal they came up with had problems. After speaking to Mr. Adams, Mr. Paggi went out to the field himself and looked at a solution that would remove this issue from the table, but it would be a more costly solution. He called the engineers office, and also spoke to Mr. Adams and threw out a proposal that would be acceptable. That's the last he has heard. Mr. Adams said it is his understanding that the drainage system has been revised to collect all the drainage coming east or west. Discussion followed with input from several residents. Supervisor Smith said at this time she is requesting Attorney to the Town Al Roberts, and Jon Adams, Attorney for Astor Homes, to get together, look at the contracts and then come back with answer on the water and also answers on the zoning issues. No action taken at this time. Next on the agenda is the Deluccia/Domber/Buyakowski water issue. Larry Paggi announced that Meadowwood Subdivision is currently a 40 lot proposal before the Planning Board. Section 1 is a 12 lot proposal on All Angels Hill Road, which has received a conditional final approval for individual septic systems and wells. The other portion of the property that's on Old Hopewell Road across from Balfour Drive is Section 2 which is currently a 28 lot proposal which they a planning to connect to the existing sewer. Also proposed at this time, is to drill individual wells for all those lots. Formerly, there was a 76 lot subdivision proposed, and the intention was both sewer and water for the entire parcel. When that parcel was being developed, Mr. Domber drilled a well catty corner across the intersection on where Mrs. Whites house currently is, and that well currently yields approximately 400 0) 07/12/99.WS gallons per minute. The feasibility of bringing municipal water into this project was discussed, but it never made sense economically. That would involve connecting the existing well to the existing system and he has been told that the cost would be in excess of $200K. Subsequently, his client, Mr. Domber, has spoken to Mr. Buyakowski, who is currently developing around 47 acres down Old Hopewell from Meadowwood. Mr. Domber and Mr. Buyakowski wish to ask the board if they would be in favor of allowing them to build the connection of that well to the existing town system for the privilege of being served first by that municipal water system. Splitting the cost of that connection starts to bring the economics into more feasible magnitude to supply section 2 of this project. Section 2 of Meadowwood is a cluster subdivision and municipal water technically does not make sense. Wells are cheaper. If the board is in favor of this, can Mr. Domber and Mr. Buyakowski be put in front line by connecting the well to receive the water when their project receives final approval. These gentlemen want to build this connection, and then give it to the town. Discussion followed. COUNCILMAN RUGGIERO moved to authorize the Engineer to the Town and the Attorney to the Town to work with the developers to come up with a plan to present to the board. Seconded by Mr. Valdati Motion Unanimously Carried Last month the board moved to authorize $1,000 compensation to Mark Liebermann for the many extra hours he has filled in for Zoning. Mark's original request was for $5,000 compensation, but the board did not receive his request in time for the last meeting. COUNCILMAN VALDATI moved to amend the resolution since the town has had two years of coverage by Mr. Liebermann to perform the Zoning enforcement work, and move to give him $4,000 more in compensation. Seconded by Mr. Bettina Motion Unanimously Carried A letter from Herb Redl for a rezone request. Mr. Roberts, Attorney to the Town announced that there is a new procedure if you are going to amend the master plan. COUNCILMAN RUGGIERO moved to take to a workshop for further discussion. Seconded by Mr. Bettina Motion Unanimously Carried Next is a correspondence from Mrs. Martucci and Mr. Malley requesting additional STOP signs be placed on Kent Road. Seconded by Mr. Valdati Motion Unanimously Carried COUNCILMAN RUGGIERO Moved to authorize the Attorney to the Town, Al Roberts to prepare to go to Supreme Court on the La Fonda Del Sol matter. Seconded by Mr. Valdati F, Motion Unanimously Carried There was no other business to come before the board.
