ADJOURNMENT 102797.RGM The Regular Meeting of the Town Board of the Town of Wappinger was held on October 27, 1997 at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York. Supervisor Smith called the Meeting to order at 7:30 P.M. Present: Constance Smith, Supervisor Joseph Ruggiero, Councilman Robert Valdati, Councilman Vincent Bettina, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Jay Paggi, Engineer to the Town Al Roberts, Attorney to the town Graham Foster, Highway Superintendent The Supervisor requested all to join in the Pledge of Allegiance to the Flag. REPORTS OF OFFICERS Reports for the month of September were received from the Town Justices, Supervisor/Comptroller, Building Inspector, and Dog Control Officer, for August. COUNCILWOMAN VISCONTI moved to accept the reports and place them on file. Seconded by Mr. Valdati Motion Unanimously Carried PETITIONS & COMMUNICATIONS Correspondence from William & Sharon Murphy, 26 Edgehill Drive, regarding their Escrow Account with the Planning Board. COUNCILWOMAN VISCONTI moved to place this item on a Workshop for further discussion. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence from Karen M. Evertts of 37 Dorothy Heights, regarding the drainage problem that sill exist on Dorothy Heights. Mr. Foster reminded the Board, when he looked into this several years ago, it was agreed that if the residents across the street would allow easements to dump the water the problem would be resolved. The residents will not allow easements into their property to put a drainage pipe. Its a natural low area that has always been low, and there is no way of stopping the water. In this case there is no where to drain the water to. There is nothing he can do. COUNCILWOMAN VISCONTI moved to authorize Mr. Foster send a letter to Mrs. Evertts, explaining that there is nothing he can do if the residents will not allow a drainage easement. Seconded by Mr. Ruggiero 1 102797.RGM Motion Unanimously Carried Correspondence from Eric W Gardell with suggestions for saving time and money for obtaining approvals for Zoning and Building projects. COUNCILWOMAN VISCONTI moved to place this correspondence from Mr. Gardell on a Workshop for further discussion. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Laurence Mercer of 5 Wildwood Drive complaining about the outrageous costs of Water and Sewer. He is a Senior Citizen, and a Military Veteran, and wishes to know if he would qualify for any type of relief. Mr. Mercer would appreciate a reply. COUNCILWOMAN VISCONTI moved to authorize Councilman Ruggiero to respond to Mr. Mercer, as requested. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Andrew Hartman, of 21 Kretch Circle requesting an update on the water problems in the Fleetwood District. Supervisor Smith reminded the Board that this issue will be discussed later in the evening. COUNCILMAN BETTINA moved to accept the correspondence from Mr. Hartman and place it on file. Seconded by Mrs. Visconti Motion Unanimously Carried Correspondence from Jack Peluse of Marshall & Sterling that he was pleased to inform the Town of Wappinger that he was enclosing a dividend check of $3,998.00 which represents a dividend to the Town for their Workers Compensation program for the policy period January 1996 to January 1997. While the dividend is significant, it is only a partial dividend as there will be another valuation done in September of 1998. A possible additional check will be issued at that time. COUNCILMAN VALDATI moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Robert Gray, P.E. writing on behalf of Chester A. Gardner, with an enclosed plan for development of Mr. Gardners property on Scotse Road, and requesting that this property be included in the next phase of the Tri -Municipal Sewer Improvement. Supervisor Smith advised the Board that she checked with Mr. Paggi, Engineer to the Town, and this property is included in Phase 3A. 2 102797.RGM COUNCILMAN RUGGIERO moved to accept the correspondence and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Next is an invitation from the American Legion Post -427 inviting the Town of Wappinger to participate in their Veterans Day Services on November 11, 1997 at 11:00 A.M. at the Joseph McDonald MIA Park on East Main Street. Supervisor Smith announced that the Town of Wappinger was going to have a short ceremony at 12:30 P.M. that day at the War Memorial at the corner of All Angels Hill and Myers Corners Road. COUNCILWOMAN VISCONTI moved to accept the invitation and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Next is correspondence Graham Foster, Highway Superintendent in regard to a memo from Tom Wood dated 10/28/88 which refers to adjusted hiring dates for Glen Heady and George Silvestri, Highway Employees. Both employees had a break in their continual service with the Town of Wappinger of less than one year, and the employees are seeking to have their date of hire adjusted to reflect the first date upon which they became employees of the Town of Wappinger. Comptroller, Ann Buckley researched her records and La felt the Board never acted on this letter in 1988. The Union has taken the position that the dates were adjusted and the longevity increases for these employees should be based on the original dates. COUNCILMAN RUGGIERO moved to bridge the original time, plus the current time, minus the gap. Seconded by Mr. Bettina Motion Unanimously Carried A letter from Mark Liebermann, Fire Inspector for the Town of Wappinger in regard to Compensatory time for extra hours worked, due to call outs, meeting, schools and required after hours inspections. In checking with other Townships, the Fire, Building and Zoning Inspectors all receive Comp time for extra hours worked for activities as mentioned above. Some inspections have to be made after four o'clock due to the businesses only operating during these hours. Mr. Liebermann is requesting comp time be granted for the extra hours work which total to 81 hours as of this date October 14, 1997. COUNCILMAN VALDATI moved to credit Comp time for Mr. Liebermann as vacation time this year. Use this policy for the rest of the year for any Comp time due employees. Seconded by Mrs. Visconti 3 102797.RGM Motion Unanimously Carried Correspondence from Dominique Manpel-Scianna, Attorney handling The Estate of William C. Gross. Mr. Gross owned the Property referred to as Grid Number 19-6156-02-737984, which is located on Route 9 in the Town of Wappinger. Ms. Manpel-Scianna wishes to inform the Board that this Lot was erroneously indicated on the Zoning Map. The Property is "Commercial Property" and the taxes have always been paid as Commercial Property taxes. COUNCILWOMAN VISCONTI moved to refer the correspondence from Ms. Manpel-Scianna to Assessor, Linda Tasadfoy, for further research for correction. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Mr. & Mrs. Brian Macaya of 185 Widmer Road with some concerns they felt needed to be expressed regarding a proposed subdivision that Developers wish to build across the street from them. They appeared before the Planning Board to speak in defense of their neighborhood. All their concerns were dismissed, and they would like some clarification on this proposed subdivision pending final approval. COUNCILMAN BETTINA moved to table this item to a Workshop for further discussion. Seconded by Mrs. Visconti Motion Unanimously Carried A letter from Christine Falco -Fontana, 73 Balfour Drive, advising the Town of a situation of grave concern to the residents of Rockingham Farms. Specifically, the cul-de-sac at the end of Balfour Drive. There are many small children who live and play on this street. One small boy was almost run down by a car which was exceeding the speed limit for the area. This is only the most recent occurrence in a continued string of speed violations. She would like the Town to take action in the form of a warning sign that indicates small children are playing in the are. Graham Foster, Highway Superintendent informed the Board that there are warning signs to "watch for children" at each entrance of the subdivision. He does not know what more he can do. You can not get into the subdivision without passing one of these signs. The roads are not really a good area for the children to play in. We can't put signs up at each intersection, or we would have signs all over. There is also a specified area that signs are placed for speed zones coming off of another road. He can't sign each road in the subdivision. COUNCILMAN BETTINA moved to authorize Mr. Foster to look at the area and notify residents with his recommendations. 4 Seconded by Mrs. Visconti 102797.RGM Motion Unanimously Carried Next, from Kenneth Fasone, is a revised version of the re -drafted sight easement for Lot 1, Nicole Farms (1 Robin Lane) and a metes & bounds description, as requested by Engineer to the Town, Jay Paggi. Mr. Paggi requested the revision upon reviewing the original re -draft. The revised maps and description are consistent with Mr. Pages letter and sketch of July 21, 1997 to the Town Board, and therefor acceptable according to Mr. Paggi's report of October 22, 1997. COUNCILWOMAN VISCONTI moved to accept the revision and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Jo Ann Faulds a new resident of 4 Losee Road, informing the Town that she has been experiencing a water shortage, and inquiring about the possibility of connecting to Town water. Engineer to the Town, Jay Paggi, informed the Board that this parcel is not located in Central Wappinger Water, and as there are certain vacant properties in Central Wappinger Water yet un -served, it probably would not be prudent to allow this connection until the properties in the district are served. COUNCILWOMAN VISCONTI moved to authorize Supervisor Smith answer the letter advising Ms. Faulds that she is not in the district at this time. Seconded by Mr. Bettina Motion Unanimously Carried Correspondence from Robert Saterial in regard to a piece of property that he purchased on All Angels Hill Road in the Town of Wappinger. Due to financial reasons, the previous owner had requested that the land be taken out of what was the Rockingham Sewer District. Mr. Saterial is requesting to have the property reinstated in the present sewer district at this time. Supervisor Smith said she had spoken to Mr. Paggi, Engineer to the Town and he told her it would be approximately two years for sewers, and she informed Mr. Saterial. COUNCILWOMAN VISCONTI moved to accept the correspondence and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried Communication from the Conservation Advisory Council with the following suggestions for the preservation and enhancement of our environment via strengthened Zoning Codes: The nature of our community is changing and there are major threats to the quality of our environment, both biological and 5 102797.RGM aesthetic. IT IS THEIR RECOMMENDATION THAT THE TOWN STRENGTHEN THE CONTENT, IMPLEMENTATION, ENFORCEMENT, AND PENALTIES FOR NO -COMPLIANCE WITH THE ZONING CODES AND REGULATIONS. Attorney to the Town, Al Roberts announced that this issue is being worked on by Dan Wery and Dave Stolman. COUNCILWOMAN VISCONTI moved to accept and place on file until such time as we receive more documentation. Seconded by Mr. Bettina Motion Unanimously Carried Ralph Holt, Chairman of Recreation requests permission for Joseph Ennesser to attend the National Playground Safety Institute training program on playground hazard identification and risk management methods, to be held on December 4th and 5th at Saratoga Spa State Park, Saratoga Springs, NY. Registration is $260 which includes 10 hours of class instruction by leaders in the playground safety field. Room reservation will be $53 per night. COUNCILMAN VALDATI moved to approve the request for Joseph Ennesser to attend the National Playground Safety Institute training program at Saratoga Springs, NY, on December 4th and 5th, and his legitimate expenses be a Town charge. Seconded by Mr. Ruggiero Motion Unanimously Carried Correspondence from Kathryn and Leonard Ott requesting the Town Board to look into reforming the Hawking & Peddlers License Ordinance. The Otts then went on to explain why they were not moving 1000 feet every hour, as required. Supervisor Smith felt the Town Board should really look into the Hawking and Peddlers License Ordinance, it is not enforceable unless there is someone sitting there. It takes 15 minutes to set up 15 minutes to take down, move, and do the process all over again. COUNCILMAN VALDATI moved to refer the Hawking and Peddlers License Ordinance to Attorney to the Town Al Roberts, for his opinion, before the Town Board takes any action. Seconded by Mr. Ruggiero Motion Unanimously Carried Request for the return of escrow funds in the amount of $2000 was received from Jari Tompuri of 66 Gold Road. COUNCILWOMAN VISCONTI moved to authorize the return of the above escrow funds, based on the recommendation of the Building Inspector, Charles Ricotta. Seconded by Mr. Valdati Motion Unanimously Carried 0 102797.RGM A memorandum was received from the New York State Office of Real Property Services explaining the process used to devise the aid fairly and efficiently for the STAR Local Assistance Program to determine the aid for this year. A voucher was also enclosed showing the dollar amount of aid for the Town of Wappinger and requesting item 8 be completed with the date, signature, and title of the chief financial officer. The Town to retain the fourth page of the completed State Aid Voucher and return the other pages to the NYS Office of Real Property Services. COUNCILWOMAN VISCONTI moved to accept the memorandum from the NYS Office of Real Property Services, and place it on file. Seconded by Mr. Bettina Motion Unanimously Carried Next is a report for Jay Paggi, Engineer to the Town, regarding the existing sand filters at the former Rockingham Farms Sewage Treatment facility. In preparation of the plans and specifications for the dismantling, he discovered that the removal and land filling of the sand from the former filter at the treatment facility would be very expensive. One item the Board may wish to consider, is what will be the future use of this specific area of the Rockingham Farms Treatment Facility. As it exists, it is somewhat higher than the surrounding area and is fenced in. Mr. Paggi does not feel it would be suitable for some type of active use, however, it could be considered as a fir.. parking area in the future. COUNCILWOMAN VISCONTI moved to accept the report and place it on file, and authorize Ralph Holt, Recreation Chairman to investigate for further use. Seconded by Mr. Ruggiero Motion Unanimously Carried Several reports from Michael Tremper, CAMO Pollution Control, Inc. The first is a list of all the properties within the Town's Water and Sewer Districts which border private properties. Without knowing the exact surveys, Mr. Tremper is unsure of where the property lines are, but these are areas where there are similar "tree" potential as in Wappinger Park. There are seven (7) sewer district properties and five (5) water district properties that Mr. Tremper feels should be surveyed and monumented in the field to determine ownership responsibilities. COUNCILWOMAN VISCONTI moved to table this report to a workshop. Mr. Tremper to prioritize list that are in immediate danger to district. Seconded by Mr. Ruggiero Motion Unanimously Carried VA �102797.RGM The second report concerns the trucking of water to the Fleetwood Water District. As of October 1, 1997, 396,000 gallons of water have been trucked to the Fleetwood Water District at a cost of $9,570. In the estimated budget for 1997 there was a budget line item of $10,000 for the trucking of water. At this point, the well production is at an all time low for 1997. Even with the supplement of the water trucked, which allows the pumps to shut down and recover, we are pumping less that 30 gallons per minute. Mr. Tremper does not feel that there will be a short term increase in the well's output, and therefore believes that the trucking of water will have to continue for some time. Its a very critical situation. COUNCILWOMAN VISCONTI moved to accept the report and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried The next report concerns the cost of water to the Fleetwood Water District if it were tied to the Village of Fishkill. Engineer to the Town, Jay Paggi, explained what needed to be done in order to connect. He presented some rough figures and informed the residents that he would present a final map, plan and report around the first week in November. When questioned by residents if Fishkill would raise their rates, Supervisor Smith answered, "she did not know, we are still negotiating". Supervisor Smith told the residents that we would have a public information meeting. Tonight was not a public information meeting, this presentation was supposed to bring the Board Members up to date. Tonight was only a draft report. The main concern to many of the residents was the cost to them if Fleetwood Water District tied into the Village of Fishkill. Also, a breakdown as to the cost to the residents if we continue trucking until we can connect to the Atlas fields. So we have something to compare. Mr. Tremper also gave a report on the chloride levels in the Wappinger Park wells. He also informed the Board of the steps to be taken if they go near or over the maximum limits set by Part 5 of the New York State Health Code. He will notify the residents if and when the sodium levels go up. The Town will have to look to resolve this problem. His plan is to run a water main down into where BJ's come under the road, hopefully the DEC would fund a portion of that and provide not only clear water and clean water to the residents of Wappingers Park but provide clean water to all the residents along that pipe that are now drinking the carbon treated water. COUNCILMAN VALDATI moved to authorize Engineer to the Town, Jay Paggi, Attorney to the Town, Al Roberts, and Mr. Tremper to proceed with options and costs for alternative water source for Wappinger Park. n Seconded by Mr. Bettina q it 0 102797.RGM Motion Unanimously Carried The last report from Mr. Tremper concerns the Water Main Break at the Watch Hill District. On September 7, 1997 at 1:25 A.M.. CAMO Pollution Control, Inc., receive a call from Dutchess County Fire Control that there was a severe water main break in the vicinity of 48 Park Hill Drive. CAMO Pollution Control, Inc., responded within 30 minutes and had the water main shut down, completed final repairs, and had the water back in service in the Watch Hill area at approximately 6:30 A.M. This is the fifth major water main break in the Watch Hill Water District in 1997. The breaks were located in various parts of the distribution system and all were severe. For a system of this size, this is an abnormally high number of water main breaks. The History of this system indicates that there have been slightly more water main breaks than for typical water systems. However, in the last couple of years the instances of these water main breaks have become more numerous and seem to be more severe. COUNCILMAN VALDATI moved to authorize Engineer to the Town, Jay Paggi to look into the breaks. Seconded by Mr. Ruggiero Motion Unanimously Carried Jim Jeffries report, with an update on the computerization of the Town Hall. He informed the Board that next year everything should be finalized. He went over costs, where we are, and how much more needs to be done to complete upgrading of the system. Mr. Jeffries also provided the breakdown of what was actually purchased. A request from Craig O'Donnell for the acceptance of Erin Sue Drive as a Town Road. Attorney to the Town Al Roberts acknowledged that the deeds were posted, the title just came in revised, the Performance Bond has not been satisfied. Mr. O'Donnell informed the Board that he would have it the next day. COUNCILMAN VALDATI moved to accept Erin Sue Drive as a Town Road, pending condition of Performance Bond being satisfied, based on recommendation of Attorney to the Town Al Roberts, and Highway Superintendent Graham Foster. Seconded by Mrs. Visconti Motion Unanimously Carried A request for a P. O. in the amount of $2,000, from Graham Foster, Highway Superintendent, to replace chains on the sander. COUNCILWOMAN VISCONTI moved to approve a P.O. in the amount of $2,000 to replace chains on the sander, as requested by Mr. Foster. COUNCILMAN BETTINA had no reports at this time. COUNCILWOMAN VISCONTI had no reports at this time. SUPERVISOR SMITH on the Pizzagalli Buildings. The EDC took a straw poll, and 3 people seem interested in the building, but a water analysis must be performed on the building first. COUNCILWOMAN VISCONTI moved to authorize Engineer to the Town Jay Paggi, perform a water analysis on the Pizzagalli Buildings. Seconded by Mr. Ruggiero Motion Unanimously Carried BONDS & LETTERS OF CREDIT Mr. Close submitted his amended report for the month of August on the schedule of Bonds and Letters of Credit on the various subdivisions, the amounts, expiration dates, and call up dates. COUNCILWOMAN VISCONTI moved to accept Mr. Close's report and place it on file. Seconded by Mr. Ruggiero Motion Unanimously Carried RESOLUTIONS The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that all delinquent water and sewer bills in arrears as of November 14, 1997 in Ardmore Water, Central Wappinger Water, Fleetwood Water, Myers Corners II Water, North Wappinger Water, Oakwood Water, Tall Trees Water, Wappinger Park Homes Water, Watch Hill Water, Fleetwood Sewer, Mid Point Park Sewer, Rockingham Farms Sewer, Wappinger Sewer Improvement #1, Watch Hill Sewer, and Wildwood Sewer in the Town of Wappinger be forwarded to the County of Dutchess to be placed on the Tax Rolls of 1998. A list of all delinquent charges will be forwarded to the County on November 18, 1997. Seconded by Mr. Ruggiero Motion Unanimously Carried The Recreation Committee requests approval for the transfer of funds from the recreation budget account A-7110.4 to A-7110.2 in the amount of $2,875 and a P.O. for $2,875, payable to BTM (Blacktop Maintenance) for paving work in front of the stage of Schlathaus Park. Four estimates were received, 10 102797.RGM BTM being the lowest. COUNCILWOMAN VISCONTI moved to authorize a transfer of funds from recreation budget account A-7110.4 to A-7110.2 in the amount of $2,875 and approve a P.O. payable to BTM for $2,875 for the paving work in front of the stage at Schlathaus Park, as recommended by Mr. Holt, they being the lowest estimate. Seconded by Mr. Ruggiero Motion Unanimously Carried The next item for the Boards consideration is the 1998 Youth Development/Delinquency Prevention Grant. The grant is given by the State annually for recreation, and the Town must match it. This years grant is for $7,652. It will be used for the Recreation 1998 program. Smith is hereby authorized to make an application of the New York State Division for Youth for approval of the Projects described in the Youth Development Delinquency prevention Application on file with the Division and Dutchess County Youth Bureau. In submitting the application it is agreed that: 1) The municipality will abide by OCFS as to the propriety of all expenditures upon which state aid is requested; 2) This project will be operated in compliance with the laws, rules, regulations, resolutions, and codes of the State of New York and pertinent political subdivisions; 3) No youth will be denied the services or facilities of this project because of race, creed, color, or sex; and 4) No fee will be charged for the programs supported by State funds. Seven bids were received, and the office of Paggi and Martin has reviewed all bids and find them to be mathematically correct and in the proper format, and recommends that the Contract be awarded to Nenni Equipment Corporation for $170,332.81, they being the lowest bid. Seconded by Mr. Valdati Motion Unanimously Carried Correspondence from Comptroller, Ann Buckley regarding the bonding for Castle Point Landfill Closure and the purchase of the Dean Property. Regarding Bonding for Castle Point Landfill Closure, $250K is New York State Grant money, that as of this date has not been received. This money was allocated from the B Fund (fund balance). A BAN should be issued to cover this amount. The grant money should be realized in the Spring of 1998 and will be used to pay down the BAN. In regard to bonding for the purchase of the Dean property, $155K was allocated from the A Fund (fund balance) to pay for the purchase of the Dean property until the bonding took place. Therefore, it is necessary to expedite the bond issue to pay back the A Fund balance for the purchase of the Dean Property. COUNCILMAN VALDATI moved to issue a BAN for the purchase of the Dean Property in the amount of $155K and $480K for the Castle Point Landfill Closure. Present: Constance Smith, Supervisor Joseph Ruggiero, Councilman Robert Valdati, Councilman Vincent Bettina, Councilman June Visconti, Councilwoman Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Jay Paggi, Engineer to the Town The Town Clerk offered for the record the Affidavit of Posting and Publication duly signed and notarized. (These Affidavits are attached hereto and made part thereof the Minutes of the Meeting). Correspondence has been received from David Hagstrom, Attorney for Wallace Sheft, requesting that the benefit units assigned to parcel 19-62571-03-162230-00 be reduced from 17.8 to 5.4 units. The rate for the Wappinger Sewer Transmission Treatment Improvement Area #2 in 1997 was 74.28 and in 1998 will be $44.77 COUNCILMAN RUGGIERO moved to close the Public Hearing, Seconded by Mrs. Visconti, and Unanimously Carried.
