The Regular Meeting of the Town Board of the Town of Wappinger
was held on November 25, 1996 at the Town Hall, 20 Middlebush
Road, Wappingers Falls, New York. Supervisor Smith Called the
meeting to order at 7:30 P.M.

The Supervisor asked all to join in the Pledge of allegiance to

MINUTES
The Minutes of the Regular Meeting of October 28, 1996 and
Special Meeting of November 12, 1996 having previously been
forwarded to the Board Members, were now place before them for
their consideration.

submitted by the Town Clerk be approved.

REPORTS OF OFFICERS
Reports for the month of October were received from the
Supervisor/Comptroller, Town Justices, Building Inspector,
Zoning Administrator, Highway Department, and Dog Control
Officer.

place the consideration of adoption of the Local Law on Zoning
Amendments as the first order of business because Mr. Wery and
Mr. Stolman had a long trip ahead of them.
A Public Hearing having been held on November 25, 1996, on a
Local Law Amending the Zoning Law and map of the Town of
Wappinger, the matter was now placed before the Board for their
consideration.
FIRST is the adoption of a Negative Declaration in Connection
with Amendments to the Zoning Law.
The following Resolution was moved by Councilperson Valdati and
seconded by Councilperson Visconti.
WHEREAS, the Town Board of the Town of Wappinger has
determined that he Town of Wappinger Zoning Law requires
updating and correction; and
WHEREAS, the Town Board has authorized the preparation of
recommended revisions and other amendments as part of an
updating of the Town's Zoning Law; and -
WHEREAS, the Town Board currently has before it for
consideration proposed revisions to the Town's Zoning Law; and
WHEREAS, the Town Board determined that the proposed Action
(i.e., the adoption of revisions to the Town's Zoning Law) is a
Type I action pursuant to Article 8 of the Environmental
Conservation Law, Part 617 NYCRR (commonly Known as "SEQRA") and
pursuant to Local Law No. 6 of 1992 (the Town's environmental
quality review law): and
WHEREAS the Town Board has determined that the proposed
Local Law is an action for which there are no other Involved
Agencies and that the Town Board is therefore the Lead Agency
for this action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the
recitations and statements set forth above as is fully set forth
and resolved herein.

2. The Town Board hereby adopts the attached Negative
Declaration based upon the reasons enumerated therein, and
thereby makes the determination that the Proposed Action will
not have a significant effect upon the environment, and thereby
finds that the preparations of a Draft Environmental Impact
Statement will not be required for the Proposed Action.
3. The Town Board hereby directs the Town Clerk to file the
attached Negative Declaration with the Commissioner and with the
Region 3 Office of the Department of Environmental Conservation
as shown on the attached Negative Declaration.
The question of adoption of the foregoing resolution was duly
put to a roll call vote.

The Resolution is hereby duly declared adopted.
Also received was the recommendation from the D.C.D.P which
recommends that the Town Board rely upon its own study of the
facts in this case with due consideration of their comments to
reduce unnecessary asphalt by lowering the stall size, aisle
widths and number of required parking spaces to more current
standards. Also comments from the Town of Wappinger Planning
Board.

D.C.D.P. and the Town of Wappinger Planning Board and comments
from Engineer to the Town as part of the record.

The next item for the Boards Consideration is to Adopt the Local

PETITIONS & COMMUNICATIONS
Correspondence from Stephen Tucci of 17 Bell Air Lane and a copy
of a letter sent the Town Board on December 18, 1994, requesting
the placement of Stop Signs in his neighborhood. Since his
initial request, the speeding situation has worsened. Highway
Superintendent, Graham Foster, reminded the Board that we have
taken the position in the past that we do not want to control
speed with STOP SIGNS. We want to use more conventional methods.
COUNCILWOMAN VISCONTI moved to table this until Mr. Foster
presents his comments to the Town Board and they will respond to
Mr. Tucci on this matter.

Notification from Senator Stephen Saland advising the Town that
we have received preliminary eligibility approval from the NYS
Department of Transportation for the DeGarmo Hills Road project
submitted under the Multi -Modal Transportation Program. The
amount allocated for construction of a box culvert project is
$67,500. It is important to note that these funds will be
disbursed on a reimbursement basis, and only those costs
incurred as stated in the parameters of the MOU will be
reimbursed.

which to pay the Water & Sewer Bill.

A request from Frank Carione, Principal of the Myers Corners
School for the use of two Voting Machines for a special school
project on the night of December 4, 1996. On the same matter,
Mrs. Snowden reminded the Board that the Town has several old
Voting Machines that are no longer used, they may wish to donate
them to the school.
COUNCILMAN VALDATI moved to authorize the use of two Voting
Machines for the Myers Corners School pro bono. The Highway to
transport them and a Custodian accompany the machines. In the
mean time check the spare Voting Machines that are no longer
used and offer them to the school.

The Hughsonville Fire District has requested permission for the
use of one Voting Machine for the Annual Fire District Election
to be held on Tuesday, December 10, 1996.
COUNCILWOMAN VISCONTI moved to approve the use of one voting
machine for the Hughsonville Fire District Annual District
Election to be held on December 10, 1996, and approve the use of
Voting Machines for the other districts if requests are made.

After serving 10 years as Town of Wappinger Director of
Recreation, Bernie Reimer has submitted his resignation
effective January 1, 1997. He wished to thank Mr. Holt for all
his assistance and encouragement through the years, and
especially to Peggy floe for the countless hours of work and
dedication to promote and maintain a quality Recreation Program.
COUNCILWOMAN VISCONTI moved to accept the resignation of Bernie
Reimer as Recreation Director and authorize the Town Clerk to
send him a letter of thanks for his years of dedication to the
Towns Recreation Program.

Recreation to advertise for the position being vacated by Mr.

Correspondence from Comptroller Ann Buckley requesting the
confirmation of John Vorndran years of service with the New York
State Retirement System. John worked for the Highway Department
from 10/12/73 to 3/31/81 (7 years, 5 1/2 months) and the
Recreation Department from 4/14/86 to present. Length of
service is needed to calculate for his portion of his Health
Insurance Premium.
COUNCILWOMAN VISCONTI moved to authorize the Comptroller to
calculate 4/14/86 to present or 10 years 6 months, as length of
service for Mr. Vorndran.

The next item is Graham Foster's Report on the Diddell/Maloney
Tunnels. Supervisor Smith informed the Board that the Bond for
the project has been tabled on the County level for now.

letter to Paul Cassillo, with Mr. Fosters report and copies with
a cover letter to all our legislators in Wappingers asking for
support of this project.

Correspondence was received from James Klein in regard to
acceptance of the road at Nicole Farms ( Robin Lane) as a Town
Road. The roads were inspected by Engineer to the Town, Jay
Paggi, and Highway Superintendent, Graham Foster, and they have
recommended acceptance of the roads. Attorney to the Town Al
Roberts informed the Board that Mr. Klein had agreed to do
additional work and he submitted a letter of credit to secure
that work. He incorporated that in the Maintenance Bond that
was delivered, he must sign a Companion Performance Bond, we can
accept it on condition that he sign the Performance Bond, copies
of which are at Town Hall.
COUNCILMAN VALDATI moved to accept Robin Lane as a Town Road
based on the recommendations of the Highway Superintendent and
our professionals, on condition that Mr. Klein sign a second
Performance Bond with the Town.

Correspondence from Graham Foster, Highway Superintendent
requesting permission to advertise for Bids to sell the
following equipment.
One 1983 2WD Chevy Pickup, Poor Condition.
One 1971 Bread Van (Weenie Wagon), Poor Condition.
One 1966 Gallion Roller, Bad Transmission, Poor Condition.
One 1973 Reo Dump Truck (Truck 11), partially stripped,
not operational.

Correspondence from the Village of Wappingers Falls Planning
Board for a request to become Lead Agency to conduct SEAR for
DiMarco Place Phase II Project. The Planning Board has made a
preliminary determination that it is the most appropriate agency
to conduct the SEQR of this project, since the anticipated
impacts are of primarily local significance.
COUNCILMAN VALDATI moved to consent for the Village of
Wappingers Falls Planning Board to become Lead Agency to conduct
the SEQR for DiMarco Place Phase II project.

Law representing the Town of Wappinger v Glassberg.

Next is a report from Jay Paggi, Engineer to the Town on the
Fleetwood Water District Water Supply Alternative. Mr. Paggi
presented the six alternatives with the project costs to the
r Board at the workshop and the outcome was to pursue looking into
constructing a line the entire length of the commercial district
along Route 9 and with some spurs off some of the more sensitive
residential areas and looking at whether or not it could or
would be levied as a Town wide charge.
COUNCILWOMAN VISCONTI moved to authorize Mr. Paggi to develop
these costs, and Attorney to Town Al Roberts to get opinion from
Mr. Rothman, whether it can or can not be a Town wide district
charge, and take to a workshop to discuss at a later date.

A second report from Mr. Paggi, Engineer to the Town concerns
the Atlas Well Field Phase 1 Test Well Drilling Program. Mr.
Paggi presented the Leggette, Brashears & Graham proposal for
the Phase I Test Well Drilling Program for the Atlas Well Field
at the October 15, 1996 Workshop. At the workshop, the Board
requested Mr. Paggi seek other proposals to try to better
quantify a cost for this work. Proposals were sent to four
additional firms. Although the difference in the amount between
Conrad Geoscience Corp. and LBG is approximately $1,600, it is
Mr. Paggi's recommendation that the proposal from LGB be given
consideration due to the fact that they are proposing to sample
soils continuously for the surface for the full depth of the
proposed well.
COUNCILWOMAN VISCONTI moved to authorize Leggette, Brashears &
Graham, Inc. to perform the Phase I Test Well Drilling upon the
recommendation of Engineer to the Town, Jay Paggi.

Next is an agreement of preparation of the expanded Full EAF
Phase 3A Sewer Improvement from Matthew D. Rudikoff. Presented
to the Board were additional tasks necessary to complete the EAF
and SEQR process with their recommendations. Mrs. Visconti
asked Mr. Paggi in view of what has happened in the last few
days, do we have to notify Mr. Rudikoff about scaling down
the amount of the archaeological and the EAF. Mr. Paggi,
responded that 5 areas were referred to identified as needing
additional archaeological survey, and because the matters that
have transpired over the last few days, those areas are in the
core area and would still need to be scaled.
COUNCILWOMAN VISCONTI moved to accept the recommendation of
MDR, approve the expenditure not to exceed $14,100, and
authorize the Supervisor to sign the agreement.

Correspondence from Mr. Frank Morgan of Losee Road, on the
feasibility, when digging is being done for the Tri -Muni Sewer
Project, of running a drain line for residential sump pump
effluent south to an existing storm sewer which empties into a
small stream on the east side of Losee Road. Would it be
practical to install piping connecting the homes north of the
existing storm sewer to that storm sewer. Mr. Paggi, Engineer
to the Town explained it could be done and it would be less
expensive to do it when the digging is being done for Tri -Muni.
but it would be up to the wishes of the Town.
COUNCILWOMAN VISCONTI moved to refer this letter to Mr. Foster,
Highway Superintendent for his input, and get back to the Town
Board.

Correspondence from Donald Swartz, of Archetypes Architecture &

Planning with four quotes for Drainage Work at the Town of
Wappinger Emergency Services Facility. After reviewing the
plans and quotes that were presented at the workshop of
11/12/96, which were in the $7,000 plus range, Mr. Foster,
Highway Superintendent was requested to presented a proposal
if the Highway Department did the work. The proposal
Mr. Foster presented to the Board, if the Highway Department
were to perform the Drainage Project at the Emergency Services
Building came to a total of $1,575.
COUNCILWOMAN VISCONTI moved to authorize the Town of Wappinger
Highways proposal for $1,575, as presented by Mr. Foster to
perform the Drainage Project at the Emergency Services Building.

Correspondence from Michael E. Gillespie of Barger, Day &
Oswald, Consulting Engineers & Land Surveyors with notification
the Owner of Parcel #19-6259-04-762010 Degarmo Hill Road, Town
of Wappinger is contemplating a subdivision of his parcel. The
question arises if central water services are available. The
tax map shows the parcel being incorporated within the bounds
of a water district and in speaking with the owner, his tax
bills have reflected being within the district. He wishes to be
informed as to whether water is available to serve the proposed
subdivision. It is anticipated that here would be a total of 5
to 8 single family residential lots to be served.
COUNCILMAN RUGGIERO moved to refer this to Engineer to the
Town, Jay Paggi, who will report back to the Board with his
findings.

At this time J. Yanettelli, of CLY Realty wishing to address
the Board regarding some problems she was having with the

Planning Board concerning her escrow account. She feels that she
has put out a considerable amount of money for a simple
subdivision. Among her concerns was, to whom is the Planning
Board accountable to.
COUNCILMAN BETTINA moved to table this to a workshop for further
discussion with the Chairman of the Planning Board, Mrs.
Yanettelli, and her attorney in attendance.

At this time Mr. Paggi, Engineer to the Town notified the Board
that he wished to submit a summary of his involvement in this
project with vouchers.
The Town of Wappinger was served with a Notice of Tax Assessment
Review from Route 376 Associates, L.P.
COUNCILWOMAN VISCONTI moved to refer this Notice of Tax
Assessment Review to Emanuel Saris, Attorney to the Town,
appointed to handle Tax Reviews, to defend on behalf of the
Town.

MRS. VISCONTI moved, to authorize Mr. Dunigan to address each
item as per Mr. Paggi's letter of November 21st and the Town
will expend up to $6,500 toward the services of the
professionals as outlined by the Tri -Muni Commissions Special
Meeting of November 25, 1996. Also to include Mr. Roberts
letter on the same subject.

Mr. Close submitted his report for the month of October on the
Subdivisions, the amounts, expiration dates and call up dates.

The Town of Wappinger Justice Court has the opportunity to
upgrade the Court Docket program software necessary to operate
the court, with a grant from the NYS Division of Criminal
Justice Services to cover the software cost. In order to take
advantage of this opportunity, the Town must commit itself to
fund $1,667 as a matching grant. The Division of Criminal
Justice services would then contribute the sum of $5,000 towards
the computer. In order to take advantage of this program, the
court must respond on or before December 1, 1996.
COUNCILMAN VALDATI moved to authorize the Town to commit itself
$1,667 as a matching grant to cover the software towards the
computer for the Justice Court.

The next item for the Boards consideration is the 1997 Youth
Development/Delinquency Prevention Grant. The grant is given by
the State annually for recreation, and the Town must match it.
This years grant is for $7,652. It will be used for, Recreation
1997 Program.
The following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption and authorize the Supervisor to sign.
BE IT RESOLVED, that Constance 0. Smith is hereby authorized
to make an application of the New York State Division for Youth
for approval of the Projects Described in the Youth Development
Delinquency Prevention Application on file with the Division and
Dutchess County Youth Bureau. In submitting the application it
is agreed that:
1) The municipality will abide by the Division as to the
Propriety of all expenditures upon which State aid is requested.
2) This project will operate in compliance with the laws,
rules, regulations, resolutions and codes of the State of New
York and pertinent Political subdivisions.

this project because of race, creed, color, or sex; and
4) No fee will be charged for the programs supported by

Additional correspondence from Arlene Cole satisfying her 30 day
obligation to notify the Town regarding the rats living in the
easement trench that border her property. Once again reminding
the Town if Town workers do anything to disturb the nests
causing them to migrate to her property, she is putting the Town
on Notice.

place it on file.

Mr. Foster, the Highway Superintendent questioned the Board
regarding this correspondence from Mrs. Cole. It has been on the
agenda for several months. Where does he stand if he approaches
the easement.

the Towns position on this matter and authorize a Deputy to
accompany Mr. Foster if he must go on the easement.

placement of a streetlight at the entrance of Edgehill Manor.
Mrs. Snowden informed Mrs. Visconti that she spoke to Mr.
DiCocco to inform him of the formation of a lighting district.
He wants another street light at the entrance. The Town Board
would authorize it and we would send a resolution to Central
Hudson to install another light at the entrance, and it would go
in as another Town wide charge.
COUNCILWOMAN VISCONTI moved to authorize an additional street
light for the entrance way of Edgehill Manor.

Mrs. Visconti questioned Mr. Paggi on 404 Rockingham, and Mr.
Paggi replied he has heard nothing yet from the Federal
Government. Also Mr. Logans letter on Hark Plaza. Mrs. Smith
explained it appears to be a problem between the landlord and
the lessee. He raised their rent.
There was no other Business to come before the Board.

A Public Hearing was held by the Town Board of the Town of
Wappinger on November 25, 1996 at the Town Hall, 20 Middlebush
Road, Wappingers Falls New York on the porposed Local Law
Amending the Zoning Law and Map of the Town of Wappinger.
Supervisor Smith opened the Meeting at 7:00 P.M.

The Town Clerk offered for the record the affidavit of Posting
and Publication duly signed and notarized. (These affidavits
are attached hereto and made part thereof the Minutes of the
Meeting).
SUPERVISOR SMITH informed the Board that we have received
letters from the Town of Wappinger Planning Board for
recommendations to approve the changes. Also received from
Engineer to the Town Jay Paggi, recommendations to approve the
changes. We also received a fax from the Dutchess County
Department of Planning recommending that the Board rely on its
own study of the facts in this case. Mr. Stolman, of Frederick
P. Clark Associates also went over the comments made by the
Dutchess County Department of Planning, and said it was quite
interesting that we have basically a book full of zoning
amendments, and the only thing thay are talking about is
parking. They would like to see less asphalt and some of the
the standards changed. We are already heading in that
direction. The interesting point is that 99.9% of what we
are doing received not comments.
