The Regular Meeting of the Town Board of the Town of Wappinger
was held on January 22, 1996 at the Town Hall, 20 Middlebush
Road, Wappingers Falls, New York.
Supervisor Smith called the Meeting to order at 7:30 P.M.

MINUTES
The Minutes of the Regular Meeting of December 28, 1995 having
previously been forwarded to the Board Members, were placed
before them for their consideration.

PETITIONS & COMMUNICATIONS
The first item for the Boards consideration is correspondence
from Gail Beverly, Diddell Road, with a petition for public
safety hazard removal.
COUNCILWOMAN VISCONTI moved to accept the correspondence and
place it on file.

Mr. Ruggiero questioned Supervisor Smith, why was this issue
still unresolved. Mrs. Smith answered that is was a
neighborhood problem and had been advised by the attorney to
accept the correspondence; take no action.
An application for a Salvage Dealers License was received from
Robert Ronconi.
COUNCILMAN VALDATI moved to table this application until some
corrections are made and we hear from the Zoning Administrator.

Request for the return of escrow was received from (1) Theresa
Garofalo in the amount of $2,607.50 (2) The Poughkeepsie
Savings Bank, Debra Friedrich in the amount of $829.75.

Funds to Theresa Garofalo for $2,607.50 and The Poughkeepsie
Savings Bank, Debra Friedrich for $829.75, based on the
recommendation of Zoning Administrator, Don Close.

Several Reports were submitted by Engineer to the Town Jay
Paggi. The first Report concerns Mr. Bozentko, 5 Edgehill
Drive. Mr. Bozentko is presently a tenant to the Rockingham
Farms Sewer District, and as such pays double rates. He wishes
to become a member once the connection to Tri -Muni is made.
COUNCILMAN RUGGIERO moved to allow Mr. Bozentko, 5 Edgehill
Drive to become a member of the District once the connection to
the Tri -Muni is made, and authorize a departmental memo be sent
to Mrs. Buckley and Mr. Logan, informing them that Mr. Bozentko
be taken off as a Tenant and be included in the next Benefit
Assessment Roll, Phase 1 and Phase 2.

The next report concerns the issuance of a C/O for a new home
for Mr. & Mrs. Denardo 190 Smithtown Road. This was discussed
at a workshop, and the Building Inspector refused to issue a C/O
until all requirements were satisfied.
COUNCILWOMAN VISCONTI moved to authorize Attorney to the Town Al
Roberts to send a letter to Mr. & Mrs. Denardo and a copy to
Presidential Homes stating what was discussed at the Workshop.

Mr. Roberts informed the Board that he did send a letter to Mr.
& Mrs. DeNardo at 190 Smithtown Road, and a carbon copy to Mr.
Gus Angelo going over what was discussed on January 9, 1996 in

the Supervisors office. If the solution was acceptable, Mr.
Denardo was to have his attorney contact him so details on the
necessary documentation could be discussed and submitted to the
Town Board. The letter was returned unopened.
SUPERVISOR SMITH said that she did receive an affidavit from the
Assessor that the house is being occupied because breakfast
dishes were left out. The School was also contacted, and the
children are being picked up and left off at the house.
The third report relates to the Widmer Road Project including
issues that were discussed with John D'Albro and Al Berberich
and concerns they were having on the proposed project.
They are willing to allow for the necessary easements.
Mr. Paggi would also recommend discussing Wheeler Hill, Spook
and Old Troy Roads at the February Workshop.
COUNCILWOMAN VISCONTI moved to authorize Attorney to the Town
prepare for the necessary land acquisitions for the Widmer Road
Project .

Next is a request from Mr. Paggi to add a requirement to the
Building Permit process that would insure to the Town that the
house is being constructed to the proper elevations and yard
setbacks. This additional requirement would have the builder
submit a certified intermediate plot plan at the completion of
the foundation, prior to any framing being allowed, showing the
following:

REAR YARD SETBACK
ELEVATION OF THE TOP COURSE OF BLOCK FOR MAIN HOUSE.
ELEVATION OF THE TOP OF BLOCK AT THE GARAGE DOOR.
This plan should be reviewed by the Building Inspector and our

office if necessary. This will assist the Town in determining
whether or not the house is being constructed to the elevations
and locations as shown on the original approved preliminary plot
plan.

The last report is in reference to the Wappinger Sewer
Improvement Area No. 1 Additional Collection Lines. Mr. Paggi
recommends a workshop on this as soon as possible so that some
agreement can be reached.

The next item for the Boards Consideration
is a Change Order for
the Wappinger Sewer Transmission/Treatment
Improvement Area
Phase II, Contract 2E. Change Order No. 1.
consists of
additional payment for labor and materials
for the generator to
pump station connection. The additional labor
and materials
resulted from field changes required on the
generator set, The
switch which controls the electrical supply
to the pump station
was mounted on the opposite side of the generator
due to
structural restraints of the fiberglass enclosures.
Also, this
change allowed the communications and alarm
wiring to be
installed in a more accessible location. The
additional cost of

labor and materials was due to the extra 4
inch galvanized steel
conduit and electrical wire required to connect
the above
mentioned switch. The cost breakdown is a

Next are two accident reports involving Town vehicles. The
first involves a Town vehicle driven by Michael Hirsch.
and a vehicle driven by Irene M. Paino. The second involved the
Town Fire Inspector's vehicle, it was struck when it was parked.

place it on file.

Correspondence was received from the Offices of Sedore,
O'Sullivan, Letterio and Barschi, Certified Public Accounts for
the Town of Wappinger. Their office examined certain purchase
orders, vouchers and related invoices pertaining to the Highway
Department for the purpose of compliance with the Town's
purchasing policy, with their recommendation to improve
policies and/or procedures.

COMMITTEE REPORTS
COUNCILMAN RUGGIERO had no reports at this time.
COUNCILMAN VALDATI on Highway. Because of the inclement weather
conditions, he noticed many deep gullies along the shoulders of
the Town Roads which are dangerous and should be repaired as
soon as possible. He also requested Mr. Foster to contact the
the County and inform them of the erosion along Old Hopewell and
All Angels Hill Roads. COUNCILMAN VALDATI also wished to know
if Mr. Foster was keeping an accounting on the amount of salt
and sand the Village of Wappinger was using, because he received
a letter from the Village and to date they have had no
accounting as to how much has been used. MR. FOSTER was never
informed he was to give the Village an accounting or monthly
report. The Village purchases their own salt and sand that is
stored at the Highway Department and he signs the receiving
slip, which goes directly to the Village for payment. Highway
keeps track on much how goes out. Mr. Valdati replied, it's in
the contract. Mr. Foster explained that he had never seen or
received a copy of an agreement. Mrs. Smith said she would see
to it that Mr. Foster did receive a copy the agreement. Mr.
Valdati also requested Mr. Foster to add another column to his
monthly report to reflect the amount of salt and sand that is

used by the Village. Mr. Valdati also instructed, any
correspondence that directly relates to Highway Business go
directly to the Highway Superintendent, so he can respond to the
Board.
COUNCILWOMAN VISCONTI had no reports at this time.
COUNCILMAN BETTINA commended Mr. Foster on the fine job the he
and the Highway men did during the recent storm. He did have
some concerns regarding site distance at Chelsea and Thornacres
Drive, Ketchamtown Road, and Osborne Hill. Mr. Foster informed
him that the most of the sites had been cleared up.
SUPERVISOR SMITH also commended Mr. Foster and his men on the
fine job during the recent rain storm which flooded the
basements of many families. Many of whom were present in the
audience. At this time SUPERVISOR SMITH addressed the
residents of the Rockingham that were present and informed them
that she looked into FEMA. Low interest loans may also be
available to repair damage that was caused by the recent
floods. COUNCILMAN RUGGIERO related that the residents has some
concerns on the removal of the damaged items caused by the
storm. Could the Town arrange for a special pick-up?
SUPERVISOR SMITH said she would contact Royal Carting and have
them come through the Rockingham area (Drew Court, Carrol,
Balfour, Doyle, Scott Drive, and Craig Place) in about two weeks
for a special pick up of all the damaged items in a one day
sweep.
COUNCILMAN RUGGIERO moved to authorize Supervisor Smith to make
arrangements with Royal Carting for a special pick-up in the
Rockingham Area to remove the damaged items caused by the storm.

Supervisor Smith noted when she read the police report she
noticed that 20 parking tickets had been issued on the night of
the storm. She spoke to Carl Amburgy and he will speak to the

officer who gave the tickets out and try to get them dismissed
by the Judge.
George Campbell, a Resident of Rockingham praised Mr. Foster and
his men for the fine job they did during the flooding following
the storm but was concerned about returning the sandbags in case
more flooding occurred. Mr. Foster explained to Mr. Campbell
them that once the bags are frozen, they would be useless. He
would pick up the used sand bags and replace them with fresh dry
ones. Rain is predicted again, but not a flooding rain. This
was an unusual storm, because there was approximately 2 feet of
snow that melted very quickly due to the rain.
SUPERVISOR SMITH informed the Residents that there are funds
available in a Special Drainage Fund. Everyone on the Board
feels very strongly about using them for this purpose. We know
it will alleviate the problem on Carrol Drive and Drew Court.
We don't know about the other Roads, but one step at a time.
One of the items on the tonight's Agenda is to authorize the

Engineer to the Town to go out to Bid for the drainage work in
Rockingham. A workshop is scheduled for March and residents
will be notified. SUPERVISOR SMITH announced that she would
move the item up from the bottom of the Agenda and present it to
the Board at this.
COUNCILMAN VALDATI made a motion to move the Rockingham Drainage
item up on the Agenda at this time for the purpose of
authorizing Engineer to the Town to go out to Bid.

the Town go out to Bid for the proposed Rockingham Drainage

Mr. Close submitted his monthly report on the schedule of Bond
and Letters of Credit for the various subdivisions, the amounts,
expirations dates and call up dates.

RESOLUTIONS
The introduction of the proposed Local Laws for the increase of
Rates for (1) Rockingham Farms Sewer (2) Wappinger Sewer
Improvement Area #1 (3) North Wappinger Water and to set a
Public Hearing was placed before the Board.
Supervisor Smith informed the Board that she would like to set
the Public Hearings for the Local Laws for the increase of rates
for Rockingham Farms Sewer, Wappinger Sewer Improvement Area #1,
and North Wappinger Water for February 26, 1996, to begin at
7:20 P.M. set one minute apart.
COUNCILMAN RUGGIERO moved to Introduce the following Local Laws
for the increase of rates for, Rockingham Farms Sewer, Wappinger
Sewer Improvement Area #1 and North Wappinger Water and set
the Public Hearings for February 26, 1996; Rockingham Sewer
District at 7:20 P.M., Wappinger Sewer Improvement Area #1 at
7:21 P.M. and North Wappinger Water District at 7:22 P.M.

BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
SECTION 1. Any and all prior laws establishing sewer rates
for the Rockingham sewer District with respect to residential
uses is hereby repealed, only with respect to sewer rates and
the prior laws otherwise confirmed.
SECTION 2. The following sewer rates are hereby established
for the Rockingham Sewer District:
A. Residential
1. Each residential unit connected to the system:
$340.00 annually and payable on a quarterly basis.
SECTION 3. This Local law shall take effect upon adoption
and as provided by Municipal Home Rule Law.

BE IT ENACTED, by the Town Board of the Town of Wappinger,
Dutchess County, New York, as follows:
SECTION 1. Section 2 of Local Law #13 of 1992 is hereby
amended to read as follows:
SECTION 2. The following Sewer Rates are hereby amended
to read as follows:
A. Residential
1. Each residential unit connected to the System:
$480.00 annually and payable on a quarterly basis.
SECTION 3. This Local Law shall take effect upon
adoption an filing as provided by Municipal Home Rule Law.

IMPOSITION, CHARGE AND COLLECTION OF WATER RATES
FOR THE CONSUMPTION AND USE OF WATER FOR THE
NORTH WAPPINGER WATER DISTRICT OF THE TOWN OF WAPPINGER

BE IT ENACTED BY THE Town Board of the Town of Wappinger,
Dutchess County, New York as follows:
SECTION 1. Section 2 of Local Law #1 of 1992 is hereby

amended in regards to the water rates for North Wappinger Water
District and all other laws otherwise confirmed.
SECTION 2. The following water rates for the
Consumption/Usage of Water by the North Wappinger Water District
are hereby established as follows:
A. Residential: Each residential dwelling unit connected
to the water system, excluding such units and users otherwise
expressly provided for herein, shall pay the minimum charge of
$25.00 (twenty-five dollars) for the first fifteen thousand
(15,000) gallons of water consumed/used, and $1.50 for each one
thousand (1,000) gallons consumed and used thereafter. Each
unit of a multiple dwelling shall be individually and separately
charged in accordance with this schedule.
B. Wildwood Manor Condominiums: Each Wildwood Manor
Condominium unit connected to the water system shall pay $25.00
(twenty-five) dollars per quarter.
C. Greentree Apartments: The Greentree Apartments shall
be billed $25.00 (Twenty-five dollars) per quarter for each
unit, or an aggregate minimum of $450.00 (four hundred and fifty
dollars) per quarter, whichever is greater. In the event that
the aggregate water consumption/usage of Greentree Apartments
exceeds two hundred seventy thousand (270,000) gallons, such
excess will be billed at a rate of $1.50 for each one thousand
(1,000) gallons per quarter.
D. Commercial and Industrial: Commercial and Industrial
users shall be billed at a rate a minimum of $1,000.00 per
quarter for the first 50,000 cubic feet of water consumed and
.935 per 100 cubic feet consumed and used thereafter.
SECTION 3. This Local Law shall take effect upon adoption
and filing as provided by Municipal Home Rule Law.
Next is the Review of the purchasing Policy for the Town of
Wappingers. Mr. Foster, Highway Superintendent wished to table
this review and his memo to the Town Board, to a Workshop.

policy to a Workshop.

COUNCILWOMAN VISCONTI moved to adopt the following amended
Alcohol and Drug abuse Policy.
In order to ensure a safe working environment for all employees
and provide the most effective delivery of services to residents
of the Town of Wappinger, it is the policy of the Town of
Wappinger that no employee may manufacture, distribute,
dispense, use, sell, purchase, possess or be under the influence

of alcohol or other illegal/controlled chemical substance,
except prescription medication, during scheduled business hours
or while on or using Town owned property. The Town recognizes
that alcohol and chemical substance abuse are progressive,
potentially fatal diseases which may affect employees/ lives and
relationships with families and/or co-workers, p / e s, quality of life
and job performance. The Town encourages and supports employees
who seek voluntary treatment. Employees must abide by the terms
of this policy statement as a condition of employment and
failure to do so may result in disciplinary proceedings.
However, nothing herein is intended to diminish the rights of an
employee under the collective bargaining agreement or the law.
Effective January 1, 1996, the Town of Wappinger will institute
a drug free policy in compliance with 49 CFR Part 382.605.CDL &
safety sensitive personnel, in accordance with 49 CFR, will be
randomly tested. It will include testing for Cocaine,
Amphetamines, PCP, Marijuana, and Opiates. In addition to the
I
above drugs, we will also test for alcohol. The Test schedule
Low will include pre-employment, random, post -accident, for cause,
and bi-annual testing.
Definition: Safety sensitive --Anyone having use of a Town
vehicle and mechanic.
Guidelines
1. Using, selling, manufacturing, distributing, dispensing,
being under the influence of or impaired by or possessing
alcohol (unless in a sealed container) or any illegal/controlled
chemical substance on town of Wappinger premises is prohibited.
2. When there is probable cause to believe that an employee has
violated this policy, the infraction shall be reported to the
department head or his designee or where that is not
appropriate, to the Supervisor or Highway Superintendent
(hereafter, any of these individuals will be referred to as the
investigating official), who will be responsible for

investigating the incident in an appropriate manner.

The following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption.
RESOLVED, that Douglas Warren be and he hereby is
appointed to fill the vacancy of the Zoning Board of Appeals of ,
the Town of Wappinger which has occurred by reason of expiration
of his term of office, and
IT IS FURTHER RESOLVED, that the said Douglas Warren is
hereby appointed to the said Zoning Board of Appeals for a term
which shall expire on the 1st day of February, 2001.

At the Reorganization Meeting, all the Board members were
requested to present a person of their choice as their
appointment to the Board of Ethics. COUNCILMAN BETTINA
was not sure of his choice at that time.
At this time COUNCILMAN BETTINA offered the name of Anna Mae
DeMilio as his choice to be appointed as a member of the Board
of Ethics.

UNFINISHED BUSINESS
At this time the Town Board members were requested to
sign the agreement for the expenditure of Town Highway Funds
that is filed with the County Superintendent.
The next item for the Boards consideration is to authorize
Engineer to the Town, Jay Paggi to assess the drainage at Dana
Place.
COUNCILMAN RUGGIERO moved to authorize Engineer to the Town Jay
Paggi, assess the drainage at Dana Place with the Highway

Superintendent, as to what point the Towns responsibilities
begin and report back to the Town Board with his report.

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM APPLICATION
PROJECT: RECREATION AT CASTLE POINT PHASE II HANDICAP
WHEREAS, the Town of Wappinger is participating in the
Dutchess County Community Development Consortium for Fiscal Year
1996, and
WHEREAS, input from citizens and groups has been received
and considered, and
WHEREAS, an application has been prepared which addresses
our community concerns.
NOW THEREFORE BE IT RESOLVED, that the Dutchess County
Community Development Consortium Fiscal Year 1996 application
for the Town of Wappinger including the certifications included
therein by and hereby is approved.
BE IT FURTHER RESOLVED, that the submission of said
application to the Dutchess County Department of Planning and
Development be and hereby is authorized.

WHEREAS, the Town of Wappinger is participating in the

WHEREAS, input from citizens and groups has been received
and considered, and
WHEREAS, an application has been prepared which addresses
our community concerns.
NOW THEREFORE BE IT RESOLVED, that the Dutchess County

for the Town of Wappinger including the certifications included

COUNCILMAN RUGGIERO reminded Mr. Roberts, Attorney to the Town
that at the November 27, 1995 Town Board Meeting he was
authorized to render an opinion on the legality of curfews in
the Town of Wappinger. Is it legal? Mr. Roberts looked into
briefly, it appears it can be done, but suggests this topic be
discussed up at a Workshop.
At this time Gail Beverly, 80 Diddell Road was recognized from
the audience. Mrs. Smith informed her that her petition was
addressed at the beginning of the meeting. On the Advice of the
Attorney it was placeAon file, because it appears to be a
neighborhood problem.
Mrs. Beverly explained that the barriers Mr. Houghtaling placed
prevented her from getting her driveway plowed out and she had
to hand shovel. When asked to describe the barriers that
Mr. Houghtaling had placed, she said they were boulders and
metal stakes. SUPERVISOR SMITH asked Mr. Foster if there was a
reason why the barriers were not removed. Mr. Foster explained,
when he and Mr. Roberts went to check it out, it was deemed

a neighborhood problem. They did speak to Mr. Houghtaling,
however, and he said he would remove them. Mrs. Visconti asked
Mrs. Beverly if she had a real true survey that she paid for to
prove that the barriers are on Town Property. She explained she
only had a copy. Supervisor Smith said Mr. Houghtaling was
rr asked to remove the barriers and this time a letter should be
directed to him on this matter.
COUNCILWOMAN VISCONTI moved to authorize Attorney to the Town Al
Roberts send a letter to Mr. Houghtaling requesting him to
remove the boulders and metal rods.
Seconded by Mr. Bettina
Motion Unanimously Carried
There was no other Business to come before the Board.
COUNCILMAN BETTINA moved to adjourn the Town Board Meeting,
Seconded by Mrs. Visconti and Unanimously Carried.
