ADJOURNMENT t. 1 's, 95.REORG.MTG The Reorganizational Meeting of the Town Board of the Town of Wappinger was held on January 4, 1995, at the Town Hall, 20 Middlebush Road, Wappingers Falls, Dutchess County, New York. Supervisor Smith opened the Meeting at 6:00 P.M. Present: Joseph Ruggiero, Councilman Robert Valdati, Councilman Joseph Incoronato, Councilman June Visconti, Councilwomen Constance Smith, Supervisor Elaine H. Snowden, Town Clerk Others Present: Albert Roberts, Attorney to the Town Graham Foster, Highway Superintendent Herb Levenson, Zoning Administrator The Supervisor asked all to join in the Pledge of Allegiance to the Flag. The SUPERVISOR confirmed the appointment of June Visconti as Deputy Supervisor and Deborah Hongach as Confidential Secretary. The TOWN CLERK confirmed the appointment of Sandra Kosakowski as First Deputy, and Florence Hannon as Second Deputy. The HIGHWAY SUPERINTENDENT confirmed the appointment of Glenn Thomas Heady as Deputy Highway Superintendent. RESOLUTIONS 1. APPOINTING PERSONNEL TO VARIOUS TOWN OFFICES AND POSITIONS OF EMPLOYMENT ------------------------------------------ The Following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that the following persons be and they hereby are appointed to the following offices and positions of employment with the Town of Wappinger to serve in such capacity at the pleasure of the Town Board for the year 1995 NAME Bernard Reimer Brenda Von Berg Ll Glen T. APPOINTING A CONSULTANT TO THE RECREATION COMMITTEE OF THE TOWN OF WAPPINGER ---------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, Ralph Holt, Chairman of the Recreation Committee, be and he hereby is appointed to serve as the Consultant to the Town of Wappinger Recreation Committee, and BE IT FURTHER -' RESOLVED, that the annual salary for the Consultant to the Recreation Committee of the Town of Wappinger be and the same I hereby is fixed and established at the annual rate of $7,488.00, to be paid every Friday throughout the year 1995, with the first payday to be January 6, 1995. Although the youths responsible were not caught, Mr. Weber of recreation did manage to get photographs. 17. APPOINTING THE SENIOR CITIZEN DIRECTOR FOR THE TOWN OF WAPPINGER ------------------------------------- The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED that Kathleen DeLisa be and she hereby is appointed to serve as Senior Citizen Center Director for the Town of Wappinger, Dutchess County, New York, and BE IT FURTHER RESOLVED, that the annual salary for the Senior Citizen Center Director of the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $16,203.00 to be paid every Friday throughout the year 1995 with the first payday to be January 6, 1995. APPOINTING A DOG CONTROL OFFICER OF THE TOWN OF WAPPINGER ------------------------------------ The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that Anne Marie Buck be and hereby is appointed to serve as Dog Control Officer of the Town of Wappinger, Dutchess County, New York, and BE IT FURTHER RESOLVED, that the annual salary for the Dog Control Officer of the Town of Wappinger be and the same hereby is fixed and established at the annual rate of $10,920.00 to be paid every Friday throughout the year 1995 with the first payday to be January 6, 1995. APPOINTING THE COORDINATOR j FOR THE VANDALISM PATROL ------------------------------------------ The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that Thurman (Carl) Amburgy be and he hereby is appointed to serve as the Coordinator for the Town of Wappinger Vandalism Patrol in the Town of Wappinger, and BE IT FURTHER RESOLVED, that the annual salary for the Coordinator of the Town of Wappinger Vandalism Patrol be and the same hereby is fixed and established at the annual rate of $4,259.00, to be paid every Friday throughout the year 1995, with the first payday to be January 6, 1995 Seconded by Mrs. Visconti Motion Unanimously Carried 24. ESTABLISHING THE PAY SCALE FOR PART TIME VANDALISM PATROL PERSONNEL ------------------------------------- I The following Resolution was offered by COUNCILMAN VISCONTI who moved its adoption: RESOLVED, that the pay scale for Part -Time Town of Wappinger Vandalism Patrol Personnel engaged to perform certain services Page 10 95.REORG.MTG for the protection of Town Parks, various other Town properties and performance of other such duties as may be assigned by the Town Board of the Town, be and the same hereby is fixed and established as per Contract with the Dutchess County Sheriff, and IT IS FURTHER RESOLVED, that all of such Part -Time Town of Wappinger Vandalism Patrol Personnel engaged on an hourly basis i shall be paid every Friday throughout the year with the first payday to be January 6, 1995. APPOINTING CERTIFIED PUBLIC ACCOUNTANTS TO AUDIT THE ACCOUNTS AND REPORTS FOR THE SUPERVISOR, TOWN CLERK AND JUSTICES FOR THE YEAR 1995 -------------------------------------------- The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that Sedor, O'Sullivan, Certified Public Accounts, be and they hereby are retained to audit the accounts and reports of the Town Supervisor, Town Clerk, and Town Justices for the year 1995, and BE IT FURTHER RESOLVED, that the said Accountants are hereby further retained for the purpose of furnishing to the Supervisor, Comptroller and Bookkeeper to the Supervisor, such additional accounting assistance as may be requested from time to time, in accordance with a proposal submitted to this Town Board, not to exceed the sum of $19,500.00, and BE IT FURTHER RESOLVED, that the said Accountants receive said compensation for all inclusive productive services which they shall render to the Town in this connection. ESTABLISHING THE PAY SCALE FOR CERTAIN EMPLOYEES OF THE TOWN OF WAPPINGER HIGHWAY DEPARTMENT The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that the Pay Scale for the employees hired by the Town of Wappinger Highway Department will be in accordance with the C.S.E.A. Contract, and BE IT FURTHER RESOLVED, that all of such Highway Department employees engaged on an hourly basis shall be paid every Friday throughout the year 1995 consistent with the pay schedule in accordance with a signed C.S.E.A. RESOLVED, that the pay scale for all presently employed part-time clerical employees engaged to perform services for the Town Board and/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $4.25 to a maximum hourly rate of $9.00 per hour, and BE IT FURTHER RESOLVED, that the part-time hourly rate for any subsequent Part -Time Clerical employee engaged by any official or Agency Department Head shall be established at the minimum hourly rate, or if otherwise fixed and established, shall be subject to the approval of the Town Board, and BE IT FURTHER RESOLVED, that the pay scale for all presently employed part-time Laborers and Maintenance men, other than Highway Personnel, engaged to perform services for the Town Board an/or its Officers, Officials and Agencies, be and the same hereby is fixed and established at a minimum hourly rate of $4.25 to a maximum hourly rate of $9.29 per hour, and BE IT FURTHER RESOLVED, that clerical employees and Laborers Highway personnel, engaged on an every Friday throughout the year be on Friday, January 6, 1995. Seconded by Mr. Incoronato all such extra part-time and Maintenance men, other than hourly basis shall be paid 1995, with the first payday to Motion Unanimously Carried 28. DESIGNATING COURT OFFICERS FOR THE TOWN OF WAPPINGER JUSTICE COURT The following Resolution was offered by COUNCILMAN VALDATI who moved its adoption: RESOLVED, that all individuals hereinafter designated by the Town Board as Court Officers as such title is defined by the Uniform Justice court Act have all those powers accorded to Court Officers by Law during such time they are actually serving in such capacity, and BE IT FURTHER RESOLVED, that the town justices of the Town shall designate and schedule the days and evenings such individuals shall serve as Court Officers, and BE IT FURTHER RESOLVED, that the Court Officers shall be compensated at the hourly rate of $8.52 for time actually served, and BE IT FURTHER RESOLVED, that Armed Officers shall be compensated at the hourly rate of $11.92 for time actually served at sessions of Court where their services are required, and Page 12 Fk 95.REORG.MTG BE IT FURTHER RESOLVED, that the Town Justices shall submit to the Town Comptroller on a weekly basis the names and hours served, and that the Town Comptroller be empowered to issue remuneration consistent with the foregoing from funds appropriated for Justice Court, and BE IT FURTHER RESOLVED, that the following individuals be designated as Court Officers for the year 1995: Robert J. AUTHORIZING ISSUANCE AND PAYMENT FOR PAYDAYS OF 1995 ----------------------------------------- The following Resolution was offered by COUNCILMAN INCORONATO who moved its adoption: RESOLVED, that the salaries of all persons holding either full time or part time positions as otherwise fixed for these designated positions shall be paid to the holders of such offices and positions payable every Friday throughout the year 1995, with the first payday to be January 6. RESOLVED, that the Comptroller of the Town of Wappinger be authorized to issue and pay the holder of these designated positions on such designated paydays of the year 1995 Seconded by Mrs. Visconti Motion Unanimously Carried 30. ESTABLISHING PETTY CASH FUND FOR THE RECEIVER OF TAXES ------------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that a petty cash account not to exceed the sum of $200.00 and the same hereby is established for the Receiver of Taxes, and, BE IT FURTHER RESOLVED, that payments from said petty cash account be made and the Supervisor of this Town be reimbursed for advances made to such account in accordance with the provision of Section 64, Subdivision 1a of the Town Law of the State of New York. ESTABLISHING PETTY CASH FUND FOR THE TOWN CLERK ------------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: Page 13 95.REORG.MTG WHEREAS, the Town Clerk of th Town of Wappinger has numerous requests for the expenditures of small amounts of cash for postage supplies and miscellaneous items, for various departments of the Town of Wappinger. NOW THEREFORE BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to establish a petty cash fund in the sum of $200.00 for the use of said Town Clerk. DESIGNATING DEPOSITORIES FOR THE TOWN OF WAPPINGER MONIES The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: RESOLVED, that the Marine Midland National Bank of Southeastern New York, the Chase Manhattan Bank, the Fleet Bank, the Fishkill National Bank, and the Bank of New York, each being a banking institution maintaining banking rooms and offices in Dutchess County, New York, and all of the above banks have to be members and meet FDIC requirments, be and they each hereby are severally designated as depositories of the monies of this Town, and BE IT FURTHER RESOLVED, that the Town Clerk be and she hereby is directed to give notice of such designation to each of said banking institutions. RELATIVE TO TEMPORARY DEPOSITS AND INVESTMENTS OF TOWN FUNDS The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: WHEREAS, it has come to the attention of this Town Board off the Town of Wappinger that there are now or may be in the future, funds and monies, except proceeds of loans and monies the investment of which is otherwise provided by law, belonging to the Town which are or which may be in excess of the amount required for immediate expenditure to pay current expenses and obligations, and WHEREAS, it is or it may be to the advantage of the Town to deposit and/or invest all or part of such funds in special time deposit accounts, or in certificates of deposit issued by, banks or trust companies located and authorized to do business in this State, short term obligations of the United States of America and/or the State of New York, and WHEREAS, it appears that the Temporary Deposit and/or investment of such excess and surplus funds may be beneficial and profitable to the town of Wappinger, NOW, THEREFORE, IT IS HEREBY Page 14 91 95.REORG.MTG RESOLVED, that the duly elected, qualified and acting Supervisor of the Town of Wappinger by and she hereby is authorized, empowered and directed to deposit and/or invest such surplus and excess funds of this Town in the aforesaid manner pursuant to Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that such Temporary Deposits and/or investments shall be secured, registered or held, as the case may be in the manner prescribed by Section 11 of the General Municipal Law of the State of New York, and IT IS FURTHER RESOLVED, that the Supervisor of the Town of Wappinger be and she hereby is authorized and empowered to invest and participate in a Flexi-Cash program, sponsored by Merrill, Lynch, Pierce, Fenner and Smith, Inc., and administered by the Bank of New York, in the manner prescribed by Section 11 of the General Municipal Law, and IT IS FURTHER RESOLVED, that the aforesaid Supervisor of this Town be and she hereby is authorized, empowered and directed to take all steps necessary from time to time to carry out and implement this Resolution. AUTHORIZING THE SUBMISSION OF THE SUPERVISOR'S ANNUAL FINANCIAL REPORT TO THE STATE CONTROLLER ------------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: WHEREAS, subdivision 10 of Section 29 of the Town Law requires that the Supervisor of Each town prepare and file with the Town Clerk within 30 days after the expiration of each fiscal year an annual financial report accounting for all monies received and disbursed by him, together with the certificates or certificate of the bank or trust company where Town monies are deposited, showing the amount of such monies on deposit with said bank or trust company, and cause a certified copy of such report to be published in the official newspaper, and WHEREAS, in lieu of preparing the report required by Subdivision 10 of Section 29 of Town Law, the Town Board may determine, by resolution, that the supervisor shall submit to the Town Clerk within 60 days after the close of the fiscal year, a copy of the report to the State Comptroller required by Section 30 of the General Municipal Law and the Town Clerk shall cause a summary of such report to be published within 10 days after receipt thereof in a form approved by the State Comptroller in the official newspaper. RESOLUTION RELATIVE TO PURCHASING PROCEDURES ----------------------------------------- The following Resolution was offered by COUNCILWOMAN VISCONTI who moved its adoption: WHEREAS, pursuant to Town Law, a Budget is prepared each year by the Supervisor detailing expenditures and revenues for the ensuing year, and WHEREAS, the Town Board shall review said tentative budget and reject or modify any budgetary item as the deem appropriate, and WHEREAS, that after due process of Public Hearing and provision for additional amendments, the annual Budget shall be adopted NOW THEREFORE BE IT RESOLVED, that, within the confines of section 117 of the Town Law, where provision has been made in the annual budget for specific, large expenditures, further approval by the Town Board to consider the purchase of those expenditures need not be sought, provided that no other part of j the Town's Procurement Policy is circumvented. BE IT FURTHER RESOLVED, that the Town Board permission to seek bids on various large purchases may not be required if any item is available through either State or County Bids. Seconded by Mr. Ruggiero Mr. Incoronato felt that because conditions change, this resolution should be rephrased. This would allow any purchase by the supervisor predicated on the passage of the budget 1 year ahead of time. At the time it may have seemed appropriate, but months later may not. Once something is in the budget, no one can stop the purchase. A safety net is needed to rethink. Limits must be set. Mrs. Smith explained, that only items that are approved in the Budget can be purchased.
