A Special Town Board Meeting was held on August 30, 1994 at the
Town Hall, 20 Middlebush Road, Wappingers Falls, New York.
Supervisor Smith Called the Meeting to order at 5:00 P.M.

The Supervisor scheduled the Meeting on August 22, 1994 for the
purpose of addressing three items; to vote on awarding the Bids
for the Emergency Services Building; to authorize the
Supervisor to sign the early connection agreement with the
Tri -Municipal Commission; and to consider appointing Donald
Keller Building Inspector, at an annual salary of $27,000.00.
The first Item for the Boards Consideration was for the purpose
of awarding the Bids for the Emergency Services Building.
There were (13) Bids for General Construction, the lowest from
Manfredi Construction at $1,034,200.00 (10) Bids for Prime
Electrical Construction, the lowest from Hudson Valley
Electrical at $141,234.00 (8) Bids for Prime HVAC Construction,
the lowest from P.M. Mechanical, Inc. at $198,872.00 and (9)
Bids for Prime Plumbing Construction, the lowest from P.M.
Mechanical, Inc. at $78,774.00.
Prior to awarding the Bids, Mr. Swartz gave a brief synopsis on
their recommendations, including discussions with client and
professional (architectural) references, banks, insurance
providers and bonding agents. With this criteria established
the following low bids were recommended:

COUNCILWOMAN VISCONTI moved to award the Bids for the Emergency
Services Building as recommended by Mr. Swartz, to Manfredi
Construction, Prime General Contractor; Hudson Electrical,
Electrical Contractor; P.M. Mechanical, Prime HVAC; and P.M.
Mechanical Prime Plumbing Contractor; they being the lowest
bidders.
Seconded by Mr. Ruggiero.
Motion Unanimously Carried
COUNCILMAN RUGGIERO moved to authorize the Supervisor to sign
the contracts with Manfredi Construction Corp., Hudson Valley
Electrical, and P.M. Mechanical Inc. ,
Seconded by Mrs. Visconti.
Motion Unanimously Carried
Mr. Valdati questioned Mr. Swartz on the time frame for
completion of the Outside Construction of the Emergency
Services Building and was told that there is a June 1995
completion date.
SUPERVISOR SMITH brought up a matter of concern that was
discussed at the August 22, Town Board meeting. Fund raisers
on Route 9 and Old Hopewell Road disrupting traffic. She has
since been informed that the State does not issue permits to
any organizations to collect money on State Roads, according to
the vehicle and traffic Law #1157, and the State Police should
be notified if it happens again.
The next item presented to the Board was an Amendment Agreement

submitted by Archetypes Architecture & Planning for the
Emergency Services Facility in the amount of $63,450.00.
The reason for and Description of Amendment are as follows:
(1) Include Section 2.5 Bidding or Negotiation Phase
(Paragraph 2.5).
(2) Include Section 2.6 Construction Phase - Administration of
the Construction Contract (Paragraphs 2.61 through 2.6.19
inclusive).
(3) Article 11 - Amend Section 11.2.1 to indicate an upset sum
of .
$ 8,600.00 Bid or Negotiation PHase (Paragraph 2.5.1).
54,850.00 Construction Phase - Administration of the
Construction Phase (Paragraph 2.61 through
2.6.19 inclusive).
$63,450.00 Total Bid and Construction Phase.
COUNCILWOMAN VISCONTI moved to authorize the Supervisor to sign
the Amendment Agreement with Archetypes not to exceed $63,450.00

At this time, Marge Gro
ten of Matt Rudikoff Associates went
over the Four page Memorandum that summarizes the proposed
agreement which describes changes in impact due to early entry
between the Town of Wappinger, and Tri -Municipal Sewer
Commission.
The following Resolution was offered by COUNCILWOMAN VISCONTI,
who moved its adoption.
RESOLUTION
TOWN OF WAPPINGER
EARLY ENTRY AMENDMENT
to the Agreement between the Town of Wappinger and Tri -Municipal
Sewer Commission to Treat 1 MGD of Sewage from Wappinger Sewer
Transmission/Sewer Improvement
SEQR NEGATIVE DECLARATION
WHEREAS, the Town of Wappinger, as Lead Agency completed an
environmental review for the Town of Wappinger Formation of

sewer Improvement for Tri -Municipal Service Expansion in
accordance with 6NYCRR Part 617 in March 1991; and
WHEREAS, the Town of Wappinger and the Tri -Municipal Sewer
Commission (TMSC) entered into an agreement on July 10, 1991 to
expand the Commission's waste water treatment facility pursuant
to Article 5G of the General Municipal Law to treat 1 million
gallons per day (MGD) of additional sewage generated from the
Town of Wappinger Sewer Transmission/Sewer Improvement Phases I
and II (WST/TT); and
WHEREAS, the Town and the TMSC are considering an amendment
of that agreement (herein after referred to as the Early Entry
Amendment) to have the effluent from the Town's Oakwood Knolls
Sewage Treatment Plant Treated by the Tri -Municipal Sewage
Treatment Plant Prior to the completion date of the expansion
called for in the agreement dated July 10, 1991; and
WHEREAS, the Town of Wappinger Town Board has directed it
consultants to perform an analysis of the environmental impacts
of the Early Entry Amendment; and
WHEREAS, the Town Board has reviewed and discussed the
analysis provided by its consultant;
NOW THEREFORE BE IT RESOLVED, that the Town of Wappinger
Town Board hereby declares that the Early Entry Amendment will
not have a significant effect on the environment; and
BE IT FURTHER RESOLVED, that the Town of Wappinger relies on
the following to support its determination:
1. The memo of Rudolph E. Lapar, P.E., dated June 1, 1994.
2. The SEQR Memorandum dated August 30, 1994.
BE IT FURTHER RESOLVED, that based on the foregoing the Town
determines the following:
1. The flows from the Oakwood Knolls Wastewater Treatment Plant I j,
(average daily flow of 258,000 gallons) not expected to cause
the Tri-MUnicipal Wastewater Treatment Plant to exceed the
effluent limitations of its SPDES Permit.

2. The installation of a disinfection system designed to treat
an additional 1 MGD will be more than adequate to treat the
additional flows permitted by this Early Entry Amendment.
3. The Sewage Sludge Compost Facility at the Tri -Municipal
Wastewater Treatment Plant is designed to process the sludge
generated by the permitted effluent in the Plant. Since the
additional flows from Oakwood Knolls are expected to remain
within the permitted effluent limitations o the Plant, the
compost facility will be sufficient to treat the additional
sludge generated by the Early Entry Amendment.
4. The impacts and mitigation measures identified in the
original FEIS and Findings Statement for the Town of Wappinger
Formation of Sewer Improvement for Tri -Municipal Service
Expansion Service Expansion are not altered by the change in
schedule for the transmission of these flows.
5. The Early Entry Agreement will result in the cessation of
further wastewater discharge from Oakwood Knolls Wastewater
Treatment Plant to a tributary of the Hunters Creek thereby
improving the water quality of the Creek.
BE IT FURTHER RESOLVED, the Town Board hereby authorizes the
Supervisor to execute, by and on behalf of the Town, the
proposed Amendment to Agreement dated July 10, 1991 dated August
22, 1994, in substantially the same form as presented to this
Board, subject to correction or amendment as determined by the
Attorney to the Town or Engineer to the Town.

Resolution Duly Adopted.
Due to the Early Entry with the Tri -Muni Commission, a
NEGATIVE DECLARATION notice of Determination of
Non -Significance was also issued.
JAY PAGGI, Engineer to the Town went over some changes on

wording that was made on the Early Entry Agreement on Pages 4
and 6. They changed the wording on the terms from "Maximum" to
"average daily flow".
COUNCILWOMAN VISCONTI moved to authorize the Supervisor to sign
the Early Entry Agreement.

The Civil Service position of Building Inspector, having been
vacated by reason of the resignation of Thomas Classey, was
offered to Donald Keller, since he was number one on the County
Civil Service List. Mr. Keller accepted.
COUNCILWOMAN VISCONTI offered the following resolution and moved
its adoption.
RESOLVED, that Donald J. Keller be and he hereby is
appointed to the Civil Service Position of Building Inspector
for the Town of Wappinger, and,
BE IT FURTHER RESOLVED, that the annual salary for this
classified Civil Service position in the Town be and the same
hereby is fixed and established at the following annual rate of
$27,000.00, pro -rated, to be paid every Friday throughout the
year.

There was no other business to come before the Board.
