The Reorganizational Meeting of the Town Board of the Town of
Wappinger was held on January 3, 1994, at the Town Hall, 20
Middlebush Road, Wappingers Falls, Dutchess County, New York.
Supervisor Smith opened the Meeting at 7:00 P.M.
Present:

The Supervisor asked all to join in the Pledge of Allegiance to
the Flag.
The Supervisor confirmed the appointment of June Visconti as
Deputy Supervisor and Deborah Hongach as Confidential Secretary.
The Town Clerk confirmed the appointment of Sandra Kosakowski as
First Deputy, and Second Deputy (which is still provisional)
Florence Hannon.

The Highway Superintendent confirmed the appointment of Glenn
Thomas Heady as Deputy Highway Superintendent.

The Following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption:
RESOLVED, that the following persons be and they hereby are
appointed to the following offices and positions of employment
with the Town of Wappinger to serve in such capacity at the
pleasure of the Town Board for the year 1994.

AND IT IS FURTHER RESOLVED, that the salaries otherwise
fired for the above designated offices and positions shall be
paid to the holders of such offices and positions every Friday
throughout the year 1994, with the first payday to be January 7,
1994, with the Exception that no compensation shall be paid to
the holder of the office of Deputy Town Superintendent of
Highways, and, the Town Historian is to be paid on a semi-annual
basis.
There was some discussion regarding the weekly salaries by Mr.
Incoronato, whether it would be more cost saving to go to
semi-monthly. Mrs. Smith explained that because the payroll is
done in-house it does not cost any more to do it weekly.

RESOLVED, that the salaries of all persons holding either
full time or part time positions as otherwise fixed for these
designated positions shall be paid to the holders of such
offices and positions payable every Friday throughout the year
1994, and
BE IT FURTHER
RESOLVED, that the Receiver of Taxes and Assessments be and
she hereby is authorized to employ such clerical employees as
may be necessary for the performance of her duties and to

appointed to the office of Receiver of Taxes and Assessments in
the Town of Wappinger, to serve in such capacity for a term
ending on the 31st day of December, 1995, and

RESOLVED, that the Receiver of Taxes and Assessments be
paid an annual salary of $24,308.00 payable every Friday
throughout the year 1994, with the first payday to be January 7,
1994, and

Recreation Committee of the Town of Wappinger be and the same
hereby is fixed and established at the annual rate of $7,200.00,

21. APPOINTING A BUILDING AND
GROUNDS CUSTODIAN FOR THE
TOWN OF WAPPINGER

The following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption:
RESOLVED, that Joel Petrus be and he hereby is appointed so
serve as the Custodian for the maintenance of the Building and
Grounds at the Town Hall of the Town of Wappinger, and
BE IT FURTHER
RESOLVED, that the salary for the Custodian of Buildings and
Grounds be and the same hereby is fixed and established at an
annual rate of $20,260.00, to be paid every Friday throughout
the year 1994, with the first payday to be January 7, 1994.

There was a discussion lead by Mr. Incoronato regarding the
duties of the Custodian. Mrs. Smith explained all the duties of
the Custodian, such as, coming in at 7:30 every morning to
help the Contractors get started with the Senior Citizens
Center, moving the furniture, washing & waxing the floors,
shoveling the sidewalks. Mr. Incoronato related that at one
time two years ago when he was on the Board there were just two
part time Custodians, and getting significantly less salary. He
questioned whether the duties for the Custodian increased. Mrs.

Smith stated that at that time many of the duties were
contracted out, because the part time Custodians did not have
the time to handle all the work.
Mr. Incoronato felt the salary of the Custodian for the level of
skills needed is highly overpaid. Mrs. Smith felt that after a
discussion and workshop on this matter that the decision to hire
a full time custodian was far less than contracting the work
out. She offered to give Mr. Incoronato all the figures.
Mr. Incoronato requested a Roll Call Vote on this matter.

RESOLVED, that the annual salary for the Senior Citizen
Center Director of the Town of Wappinger be and the same hereby
is fixed and established at the annual rate of $15,580.00 to be
paid every Friday throughout the year 1994 with the first payday

23• DESIGNATING COURT OFFICERS
FOR THE TOWN OF WAPPINGER
JUSTICE COURT
The following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption:
RESOLVED, that all individuals hereinafter designated by the
Town Board as Court Officers as such title is defined by the
Uniform Justice court Act have all those powers accorded to
Court Officers by Law during such time they are actually serving
in such capacity, and
BE IT FURTHER RESOLVED, that the town justices of the Town
shall designate and schedule the days and evenings such

individuals shall serve as Court Officers, and
BE IT FURTHER RESOLVED, that the Court Officers shall be
compensated at the hourly rate of $8.20 for time actually
served, and
BE IT FURTHER RESOLVED, that Armed Officers shall be
compensated at the hourly rate of $11.47 for time actually
served at sessions of Court where their services are required,

BE IT FURTHER RESOLVED, that the Town Justices shall submit
to the Town Comptroller on a weekly basis the names and hours
served, and that the Town Comptroller be empowered to issue
remuneration consistent with the foregoing from funds
appropriated for Justice Court, and

The following Resolution was offered by COUNCILWOMAN VISCONTI
who moved its adoption.
RESOLVED, that the pay scale for all presently employed
part-time clerical employees engaged to perform services for the
Town Board and/or its Officers, Officials and Agencies, be and
the same hereby is fixed and established at a minimum hourly
rate of $4.25 to a maximum hourly rate of $8.40 per hour, and
BE IT FURTHER RESOLVED, that the part-time hourly rate for
any subsequent Part -Time Clerical employee engaged by any
official or Agency Department Head shall be established at the
minimum hourly rate, or if otherwise fixed and established,
shall be subject to the approval of the Town Board, and
BE IT FURTHER RESOLVED, that Emergency Highway Employees be
paid at the rate of $7.00 per hour and
BE IT FURTHER RESOLVED, that the pay scale for all presently
employed part-time Laborers and Maintenance men, other than
Highway Personnel, engaged to perform services for the Town
Board and/or its Officers, Officials and Agencies, be and the
same hereby is fixed and established at a minimum hourly rate of
$4.25 to a maximum hourly rate of $8.93 per hour, and
BE IT FURTHER RESOLVED, that all such extra part-time
clerical employees and Laborers and Maintenance men, other than
Highway personnel, engaged on an hourly basis shall be paid
every Friday throughout the year 1994, with the first payday to
be on Friday, January 7, 1994.

services for the protection of Town Parks, various other Town

RESOLVED, that Emanuel Saris be and hereby is employed and
retained or the purpose of furnishing to the Town Board, its
officers and agencies, such legal advice and services as may be
required for representing and defending the Town of Wappinger
for all Article 78 Tax Certioraris as may be filed against the
Town in the year 1994, and, he shall receive compensation
therefore in accordance with a proposal to this Board.
Mr. Incoronato questioned the cost of the Mr. Saris services and
questioned as to whether the fee was a reasonable one. The
Boards reply were that the fee was reasonable.

retained for the purpose of furnishing to the Supervisor,
Comptroller and Bookkeeper to the Supervisor, such additional
accounting assistance as may be requested from time to time, in
accordance with a proposal submitted to this Town Board, not to
exceed the sum of $19,500.00 and

the Hornet newspapers published in the County of Dutchess and
having general circulation therein, be and they are designated
as additional newspapers for the publication of Town Notices,
subject to the limitations of Section 64, Subdivision 11 of the

The following Resolution was offered by SUPERVISOR SMITH who
moved its adoption:
RESOLVED, that the regular monthly meeting of the Town Board
of the Town of Wappinger shall be held at 7:30 P.M. at the Town
Hall, 20 Middlebush Road, in the Town of Wappinger, Dutchess
County, New York, in the evening of the 4th Monday of each
month, or at such other place or places within the Town of
Wappinger as the Town Board shall from time to time designate.
With exception to October and December, which will be held on
the 4th Tuesday.

There was some discussion by Councilman Incoronato regarding the
day of the Month that the meeting was held. He felt that the
4th Monday was not conducive to good coverage or good
attendance. Mrs. Smith felt that because of other conflicts,
that the 4th Monday is the best day for the Town Board Meetings.

future, funds and monies, except proceeds of loans and monies
the investment of which is otherwise provided by law, belonging
to the Town which are or which may be in excess of the amount
required for immediate expenditure to pay current expenses and
obligations, and
WHEREAS, it is or it may be to the advantage of the Town to

requires that the Supervisor of Each town prepare and file with

fiscal year an annual financial report accounting for all monies
received and disbursed by him, together with the certificates or
certificate of the bank or trust company where Town monies are
deposited, showing the amount of such monies on deposit with
said bank or trust company, and cause a certified copy of such
report to be published in the official newspaper, and

The following Resolution was introduced by Councilperson

WHEREAS, pursuant to Resolution duly adopted by the Town Board
of the. Town of Wappinger on the 2nd day of January, 1991, the Town
of Wappinger, on behalf of the Wappinger Ambulance District,
entered into a certain agreement with the Sloper-Will-en Community
Ambulance Service, Inc. to provide ambulance service for the
residents of the Town of Wappinger located within the
jurisdictional confines of the Wappinger Ambulance District; and
WHEREAS, pursuant to letter dated September 13, 1991, Sloper-
Willen Community Ambulance Service, Inc. offered to renew the
contract with no increase in fees for the calendar year 1992 and a
maximum increase of five percent in calendar year 1993, provided

the Town enters into a two-year agreement; and
1%W WHEREAS, the Town Board is desirous of entering into a two-
year contract with Sloper-Willen Community Ambulance Service, Inc.
to provide ambulance service to the Wappinger Ambulance District
upon the same terms and conditions as set forth in the contract
dated January 2, 1991, except for the monetary consideration above
set forth.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Town Board of the Town of Wappinger hereby determines
that it is in the best interests of the residents of the Wappinger
Ambulance District to enter into a contract for ambulance services
with the Sloper-Willen Community Ambulance Service, Inc. upon the
same terms and conditions as are set forth in a certain agreement
dated the 2nd day of January, 1991, by and between the Town of
4W Wappinger on behalf of the Wappinger Ambulance District and the
Sloper-Willen Community Ambulance Service, Inc.
2. The Town Board of the Town of Wappinger hereby elects to
enter into said agreement for a period of two years upon terms
hereinafter set forth.
3. The fee for ambulance service for calendar year 1992 shall
be the same fee as presently set forth in paragraph 2 of the
Agreement dated January 2, 1991, to wit the sum of $15,082.50
monthly, subject to fee adjustment as set forth in said paragraph.
4. The fee schedule for calendar year 1993 will be subject to
increase as determined by mutual agreement of the parties, which
increase shall not exceed five percent of the present fee

structure.
5. The Supervisor of the Town of Wappinger is hereby

authorized to enter into an agreement in substantially the same
form as the agreement dated the 2nd day of January, 1991, by and
between the Town of Wappinger, on behalf of the Wappinger Ambulance
District, and the Sloper-Willen Community Ambulance Service, Inc.,
subject to the fee increases as set forth herein.
6. The contract shall further provide that the agreement is
subject to budgetary appropriations made by the Town Board of the
Town of Wappinger for the calendar year 1993.
The question of the adoption of the foregoing Resolution was

after receipt thereof in a form approved by the State

**The Floating Holiday replacing Lincoln's' Birthday has been
approved for July 1st by the Town Board for 1994.
COUNCILWOMAN VISCONTI moved to establish reimbursement for
mileage at 28 cents per mile.

The Board Members were requested to present a person of their
choice as their appointment to the Board of Ethics.

report to the Town Board at each meeting.
COUNCILWOMAN VISCONTI moved to authorize a request that was
tabled at the last Board Meeting. The request made by R. Holt
for 3 people to attend a one day Seminar on Playground Safety
on February 3 at a cost of $69.00 per person.

One more item that the Supervisor brought to the attention of
the Board was the notification from Senator Saland of the
approval of $150,000.00 in SHIPS money for the widening,
drainage and realignment of Wheeler Hill Road to All State
Road.
Mr. Fosters commented that he received a letter saying
it was denied, but Mrs. Smith Corrected him by saying " SHIPS"
not " CHIPS".
Mr. Graham Foster, Highway Superintend reminded Mrs. Smith this
should be sent out for Bids as soon as possible and Mrs. Smith
agreed to take care of the matter at the January 27 meeting.
COUNCILWOMAN VISCONTI moved to adjourn the Reorganizational
Meeting.
